1.0 PURPOSE:
To establish a policy governing job classifications which are eligible for overtime
compensation.

4.0 POLICY:
4.1 Overtime should be used only when necessary to maintain effective operations
and respond to emergencies. The City will pay overtime or provide compensatory
time off per FLSA or labor agreement provisions.
4.2 Employees in classifications defined as "non-exempt" under FLSA rules are
entitled to overtime compensation for time worked in excess of 40 hours in a
workweek unless otherwise authorized by a labor agreement.
4.3 Overtime compensation is paid at one and one half the employee's regular rate of
pay unless otherwise authorized by labor agreement.
4.4 Employees in classifications defined as "Exempt" under FLSA rules are not entitled
to overtime compensation unless authorized by labor agreement or by the Chief
of Police (see 300-04).

4.5 Review of exempt and non-exempt positions will periodically be performed by
the Human Resources Department in conjunction with policy updates,
classification changes, job duty adjustments, etc.
4.6 New positions created within the city will be reviewed by the Human Resources
Department by completing an FLSA Exemption Duties Test and will be deemed
either “exempt” or “nonexempt” based on the results of that test.
5.0 DEFINITIONS:
5.1 “Workweek” refers to any consecutive seven-day period. The most common
workweek for employees commences at 12:01 a.m. on Sunday and ends at 12:00
a.m. on Saturday. The workweek, however, need not coincide with the calendar
week and may be changed from time to time in accordance with the provisions of
the Fair Labor Standards Act.
6.0 PROCEDURES:
6.1 All overtime to be worked must have prior supervisory approval.
