In reviewing the City's motion for dismissal, it appears that the email I had sent to you on April 12, 2021 didn't include the attached attachments. For some reason, my email system
no longer automatically appends attachments when I forward emails with attachments. Consequently, if there is something you would like to add to your response on the City's motion to
dismiss given the attachments, please feel free to do so by 5:00 pm, May 5, 2021. Please note that the photographs presented by Ms. Locher on the current condition of your property
are irrelevant to the motion to dismiss. I've only included them because I have a duty to disclose to you any information I receive from the City on your case. I am only considering
the issue of whether your appeal was timely filed. I am also asking Ms. Locher below to let us know when she mailed the Finding of Violation. You can respond to that information as
well by the May 5, 2021 date if you wish.
Ms. Locher,
Please identify when the Finding of Violation was mailed to Mr. Snyder. Your email only identifies the date on the notice. As outlined in prior dismissal orders, the date of issuance
for purposes of RMC 1-3-2E2a is three days after mailing. If you have any documentation on the date it was mailed, that would be helpful as well. Please provide that information by
5 pm April 30, 2021.

Attached is the Warning of Violation that is being appealed. The Warning is dated March 15, 2021, making the appeal date deadline March 30, 2021.
The appeal is dated April 2, 2021, making it three days past the appeal deadline and received by the city on April 4, 2021, making it five days past the appeal deadline.
Attached are photos of the property taken today.
