RESOLUTIONNO.4434WHEREAS,asapartoftheProject,WSDOTneedstoacquirea102,240squarefeetdrainageeasementover,under,upon,andacrossacertainportionofpropertyownedbytheCity,forthepurposeofconstructing,operatingandmaintainingdrainagefacilities,suchportionofpropertybeinglegallydescribedinExhibitC,attachedheretoandincorporatedbyreferenceasiffullysetforth(the“DrainageEasement”);andWHEREAS,asapartoftheProject,WSDOTneedstoacquirea11,537squarefeetutilityeasementover,under,upon,andacrossacertainportionofpropertyownedbytheCity,forthepurposeofconstructing,operatingandmaintainingpetroleumpipelinefacilities,withtheintentthatsucheasementbeassignedtoOlympicPipeLineCompanyLLC,suchportionofpropertybeinglegallydescribedinExhibitD,attachedheretoandincorporatedbyreferenceasiffullysetforth(the“UtilityEasement”);andWHEREAS,WSDOTinformedtheCityofitsintenttoacquiretheRight-of-WayProperty,TemporaryEasement,theDrainageEasement,andtheUtilityEasementundertheimminentthreatofWSDOT’sexerciseofeminentdomain;andWHEREAS,theRight-of-WayPropertywasappraised,andWSDOTofferedtheCityapurchasepriceof$37,600commensuratewiththeappraisalvalue,whichWSDOTsubsequentlydecreasedby$100to$37,500toreflectthevalueoftheUtilityEasementReservation;andWHEREAS,theTemporaryEasementrightswereappraised,andWSDOTofferedtheCityapriceof$6,600commensuratewiththeappraisalvalue;andWHEREAS,theDrainageEasementrightswereappraised,andWSDOTofferedtheCityapriceof$12,800commensuratewiththeappraisalvalue;and2 RESOLUTIONNO.4434WHEREAS,theUtilityEasementrightswereappraised,andWSDOTofferedtheCityapriceof$1,500commensuratewiththeappraisalvalue;andWHEREAS,damageswerecalculatedaftermuchoftheProjecthadbeencompleted,andWSDOToffereddamagesintheamountof$13,900;andWHEREAS,theCityafteranewsreleaseandpublicationofapublicnoticeforpublichearing,didholdonthe3tddayofMay,2021,apublichearingtoconsiderauthorizingthesaleoftheRight-of-WayPropertyandthegrantoftheTemporaryEasement,theDrainageEasement,andtheUtilityEasement,andthosemembersofthepublicwhowishedtotestifyweredulyallowedtotestifyandthetestimonywasconsideredbytheCityCouncil;andWHEREAS,theCityCouncilhasdeterminedthatthesaleoftheRight-of-WayPropertyandgrantoftheTemporaryEasement,theDrainageEasement,andtheUtilityEasementareinthepublicinterest;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DORESOLVEASFOLLOWS:SECTIONI.TheCouncilauthorizesthefollowing:A.SaleoftheRight-of-WayProperty,lessthevalueoftheUtilityEasementReservation,toWSDOTintheamountof$37,500;B.GrantoftheTemporaryEasementintheamountof$6,600;C.GrantoftheDrainageEasementintheamountof$12,800;D.GrantoftheUtilityEasementintheamountof$1,500;andE.Acceptanceofdamagesintheamountof$13,900.3
