NORMAN The Barbee Mill Company has requested a City Council resolution. recommending to the Washington State Harbor Line Commission reloca- tion of the inner harbor line adjacent to the mill property. The Attached map indicates the areas of concern. It should also be noted the Renton City Limits and the inner harbor line coincide. The jurisdiction for the area. to the water side of the inner harbor line rests with the State Department of Natural . Resources and the Seattle Post District . Relocation of the harbor line would be a necessary step to resolve the jurisdictional question as well as permit annexation to the City. (Note City Attorney' s memorandum. ) Mr. Norman has indicated, while his request was for a resolution , a motion by the Council and a letter of concurrence would be adequate to support the Barbee proposal. It was noted during Committee review that the proposed revision would be necessary prior to an annexation request by Barbee. The Committee, therefore, recommends that the Council support the request of the Barbee Mill Company, and the Mayor be requested to forward a letter so indicating to the State Harbor Line Commission. Warren, City Attorney RE : Barbee Mill Request for Relocation of Inner Harbor Pine Dear Gordon: We have researched the above matter , at the request of the Community Services Committee. The basic law in this area is that the State has retained ownership of all "Harbor areas". The State ownership goes up to a line referred to as the "Inner Harbor Line or the Line of Ordinary Navigation". Once that line is established the State retains juris- diction over all property lying on the water side of that line even if the land should become dry. Laws in this State provide for an application to the Harbor Commission to change the Inner Harbor line. Under Article XV, subsection 1 of the Constitution of the State of Washington is contained the following ways : "Any harbor lines so located or established may thereafter be changed, relocated or re-established by the commission pursuant to such provision as may be made therefor by the legislature." To the best of my knowledge it would not be necessary for the City to request the relocation of the Inner Harbor Line although it may do so if it wishes . I would presume the adjacent property owner could make a similar request. If I understand the request from Barbee Mill Company they wish the accreted land to be within the jurisdiction of the City of A.enton rather than the local ,Port District and the State of Washingto The City may if it wishes , assist Barbee Mill Company in making that change. However, my research does not indicate that the City must become. involved in that process and it would appear that the property owner could make the request for a change in the Inner Harbor Line without the City' s assistance. Tonda, Renton Historical Society for removal of Cedar Tree large cedar tree from the south side of the museum. The report at Historical noted Mr. Tonda changed his request to trimming of tree affecting Society Museum down spouts and asked that drain tile be repaired, that building work accomplished since the fire department vacated the building has been primarily financed by the Historical Society through state and county grants, some work done by the Renton Building Department. The report recommended that the original request to remove the tree be denied and that the matter of trimming, drain work and landscaping maintenance be referred to the Adminis- tration for proper assignment to avoid future confusion. MOVED BY STREDICKE, SECOND CLYMER, CONCUR IN COMMITTEE REPORT. CARRIED. Inner Harbor Line , Community Services Committee report explained the Barbee Mill Co. BarbeE Mill Co. has requested a City resolution recommending the the Washington State Harbor Line Commission relocate the inner harbor line which is adjacent to the mill property (City limits and the inner harbor line coincide) . The report explained that jurisdiction for area to water side of inner harbor line rests with the State Department of Natural Resources and the Seattle Port District; that relocation of the harbor line would resolve jurisdictional question and permit annexation to city. The report Cumulative recommended the ordinance establishing and amending Cumulative Reserve #115 Reserve Fund #115 be held in committee pending report from the Utilities Committee as referred 9/10/79. The report recommended that funds requested for 1979 budgetary appropriation by the Building Dvn. Public Works Building Division be taken from Unanticipated Revenue. Honeydew and Letter from Public Works Director Gonnason reported Moore, Wallace Kennydale Trunk and Kennedy, Inc. have prepared cost estimates for installation Sewer Lines of the Honeydew and Kennydale trunk sewer lines at total con- and struction cost of $1 ,650,000 including 10% inflation factor from Revenue Bonds present until proposed commencement of construction in one year. Proposed The letter proposed the city install sewer lines connecting with Metro installed trunk lines explaining that the city will realize savings through elimination of Sunset and Honeydew pump stations into the Highlands trunk line . The letter proposed that the city's initial installation financing will be recollected by means of a latecomer agreement as properties in the drainage basin that develop and connect to the system at estimated $0.030 per sq. ft. Also, properties now developing in Kennydale and Honeydew basins can be assessed, at present six developments would amount to assessment of $49,000. The letter requested authorization to establish a project fund for the two trunk lines to be financed by revenue bonds and to proceed with the design and construction of the Kennydale and Honeydew trunk lines to connect to May Creek trunk line. The purpose of the relocation is to effect an exchange of equal land areas which will resolve significant ques- tions of title and jurisdiction now existing and which relate to the vacation of reserved areas following a council action last year. There is approximately one acre of accreted uplands now lying waterward of the inner harbor line which is in question. The Department of Natural Resources claims direct land use jurisdiction because this land lies within the harbor area. The legislature did not intend harbor areas to include dry land and has provided authority to the Harbor Line Commission to relocate the lines when this occurs. By relocation of the inner harbor line, the sole direct land use authority would be clearly vested in the City of Renton and the ambiguity now present will be eliminated. It is the intention that all of the remaining questions of jurisdiction and title of the areas vacated be resolved as soon as possible. Relocation of the inner harbor line by the Harbor Line Commission would accomplish that. Norman DON/jaj Ct cc: Alex Cugini Jim Hanken Z / 1`-(&J Ay QUENDALL TERMINALS Post Office Box 477• Renton, Washington 98055• (206) 271-1540 BACKGROUND INFORMATION On March 13 , 1978, the Renton City Council passed resolution #2173 recommending to the Commissioner of Public Lands of the State of Washington and the Department of Natural Resources "institute proper action to vacate the areas designated ' slip ' and 'wharf ' on the Lake Washington Shorelines Plat . " On November 7 , 1978 , the Board of Natural Resources sitting as the Harbor Line Commission vacated all slip and wharf sites located within harbor area in front of the City of Renton. The vaca- tion concluded a series of steps to eliminate obsolete reserve areas which never had been used for the purposes intended , and which were also inconsistent with the City of Renton' s Shore- line Master Program. Since last November , representatives of : the Barbee Mill Company , owners of the property abutting three of the former reserved areas and leasees of harbor area lease #102 ; Department of Natural Resources , owner in fee of the harbor areas in the State ; and the Port of Seattle , administrator for the Department of Natural Resources of harbor areas on Lake Washington, and owner in fee of the vacated reserve areas , have been meeting to resolve questions of the jurisdiction and land titles raised by November 7 , 1978 vacation. It now appears that a change in the inner harbor line will be necessary to resolve ambiguities in the title and land use jurisdiction for those portions of the vacated reserved areas now having the character of dry land. The title questions are the subject of ongoing negotiations between the owners in fee of the effected areas in question. On the issue of land use jurisdiction, it is Barbee Mill Company ' s position that it is inappropriate for the Port of Seattle and the State of Washington to have direct land use jurisdiction over a strip of dry land which is surrounded on three sides by land area under the juris- diction of the City of Renton. The legislature of the State of Washington has said it is not the State ' s intent to establish or maintain harbor areas which have the character of uplands . Further , the legislature has provided for changes in the location of harbor lines in such occurrences . Barbee Mill Company has proposed an exchange of privately owned submerged shorelands for an equal area of dry land lying waterward of the inner harbor line which would be accomplished by an inner harbor line change . Intersection The Transportation Committee report regarding traffic at the Bronson Way N. intersection of Bronson Way N. , Factory Ave. N. and Houser Way N, Factory N. stated this is a signalized intersection which is state-controlled Houser Way N. and operated in conjunction with the Maply Valley Y operation. The report recommended that the Administration investigate and report back to Council the matter of prohibiting the left-turn from Factory Ave. N. southbound during peak hours. Sidewalks The committee recommended that the Council initiate a Local Senior Housing Improvement District by resolution for the construction of side- walks on the easterly side of Burnett Ave. S. from S. 2nd St. to the Senior Citizens Housing area. Community Services Committee Report Community Services Committee Chairman Stredicke presented report Neighborhood re Neighborhood Strategy Area Program, advising progress to date Strategy Area for information only. Two multi-family complexes are ready for Program approval for participation - Whitworth Lane Apartments under Section 8 program and Bennett Apartments under Section 312. Together 48 units would be upgraded and assured for low-income elderly families. In a joint King County/Renton/Auburn program, 75 multiple units would be upgraded in Renton in the next three years; all costs covered by H&CD Block Grant funds. Bicycle Trail The committee report noted review of alternate route for the bicycle trail which was proposed in May and the Council 's concern about use of Airport Perimeter Road. The report submitted alternate route along Rainier to Airport Way and South Tobin St. to Logan to Cedar River Trail for eastbound traffic and Airport Way sharing sidewalk to Rainier for westbound traffic. The report noted the trail system is a part of a multi- jurisdictional program extending a trail for bicyclists from Seattle through King County to Renton and eventually to both Maple Valley and Tukwila. The report recommended the Administra- tion be authorized to proceed on the alternate bike system route as proposed; funding covered totally through H & CD Grants. Low Income Councilman Shane inquired regarding effect on neighborhoods and Housing need for hearings on federally funded low-income housing through- And out the City.
