Project Description/Background: The applicants, Mehrdad and Elaine Shirazi, are requesting approval of an administrative variance from the required front yard setback in the R-8 zone (section 4-2-110A). The subject site is located at 215 NW 2nd Place - at the SE corner of NW 2nd Place and vacated Maple Avenue NW. The development standards of the R-8 zone require a minimum front yard setback of 20 feet. The setback is measured from the property line to the closest point of the structure. The applicant is proposing a reduction of this setback to 10 feet due to an area of ground water seepage in the rear of the property. The applicants received approval fora building permit (#CP98241) to construct a 1,438 square foot single family home on the subject property. Upon preparation of the site for construction, the applicants became aware of an area of ground water seepage approximately 20 feet north of the rear property line at the proposed location of the SW corner of the foundation. The applicants then consulted with an engineer and received recommendations to avoid construction and excavation activities for at least 10 feet from the area of ground water seepage to reduce the risk of slope instability and to avoid construction difficulties and additional expenses associated with construction of a permanent dewatering system. The applicants contend that revising the location of the house 10 feet to the north (resulting in a 10 foot front yard setbacl) is necessary in order to reduce safety hazards to the subject site and to minimize the potential costs of creating a new drainage system. In addition, NW 2nd Place is improved for only 30 feet of its 60 foot dedicated riiht-of-way. Because the subject site fronts NW 2nd Place on its northern boundary, the property appears to rave a greater front yard setback which fulfills the intent of the front yard requirement of the zone. Findings 1) Request: The Applicants, Mehrdad and Elaine Shirazi, has requested approval for an adm nistrative variance from the required front yard setback of the R-8 zone (section 4-2-110A) for the prop erty located at 215 NW 2nd Place. 2) Administrative Variance: The applicant's administrative variance application complies with the regi,irements for information for a variance. The applicant's site plan and other project drawings are entered as Exhibits No. 1 thru 3. 3) Existing Land Use: Land uses surrounding the subject site include: North: single family residential; South: single family residential; East single family residential, church; and West: currently undeveloped (soon to be single family residential). 4) CONSISTENCY WITH VARIANCE CRITERIA Sec,ion 4-31-19F.3. lists 4 criteria that the Zoning Administrator is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. These inchrde the following: The Zoning Administrator shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a. Teat the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in thl vicinity and under identical zone classification: Tf a applicants have provided letters from a geotechnical engineer which state the site is constrained by an area of ground water seepage located in the southwest portion of the site. The er gineer recommends that construction and excavation activities should be avoided for at least 10 feut from the area of ground water seepage to reduce the risk of destabilizing the adjacent slope and tq utilize the most geologically favorable portion of the site. A: the engineer described, the persistent ground water seepage, which emanates from near the toe of a relatively steep slope that rises to the west, forms a 3 foot diameter earthen pool. Staffs visit to thy,: site found that the ground water seepage appears to emanate from two locations near the toe of the slope with one at approximately 8 feet and another at approximately 16 feet from the north property line. The water then flows almost directly south where it forms the subject pool of water. While the geotechnical engineer's concerns regarding the disturbance of the slope are legitimate, the proposed location of the house would not serve to mitigate these concerns as the structure would still be within a close proximity to the source of ground water seepage and the adjacent slope is relatively steep throughout the entire site. The applicant contends that the denial of the variance would be a hardship because of the monetary expenses related to the extensive drainage system that would be required to build on the pool of wLter. However, the additional expenses associated with the construction of a permanent dE watering system would only be slightly offset by the additional drainage requirements for construction directly adjacent to the source and flow of ground water seepage. Therefore, taking all of the above into consideration, the applicant does not suffer an undue hardship and does not have special circumstances that will be mitigated by the proposed variance. b. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: Tr e granting of the variance will not be materially detrimental to the public welfare. It may be ccnsidered injurious to property improvements in the vicinity and zone because it would allow for ccnstruction that differs from the standards that generally apply to all properties in the R-8 zone. Tr is would set a precedent and create uncertainty about maintaining zoning standards which have been adopted to protect and enhance single family neighborhoods. Tr e applicant contends that because the proposed front yard setback would actually be approximately 40 feet south of the improved street, the intent of the code provision would be fu filled. The front yard requirement of the R-8 development standards is intended to provide a ccntinuous setback fronting streets in residential neighborhoods. The setback functions as a landscape buffer between the public street and provides for an aesthetic streetscape. However, in th s specific application, NW 2nd Place is improved for only the north 30 feet of its dedicated 60 foot right-of-way. Although this may be true for the present time, street improvements to the full 60 right- of way are a possibility in the future and would result in an undesirable situation if the variance is aK;proved. c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The adjacent properties to the west of the subject site are currently undeveloped. When building pE:rmits are applied for they will be required to maintain the 20 foot front yard setback regardless of whether NW 2nd Place is improved for its full 60 foot right-of-way or not. Areas of ground water seepage are common throughout the area and it is probable that other properties will encounter the same circumstances as this site. Therefore, approval of the variance would be considered a grant of special privilege unless all of the lots in this area were given the same exception. d. That the approval as determined by the Zoning Administrator is a minimum variance that will accomplish the desired purpose: Tile approval of the proposal would not be the minimum variance that will accomplish the desired pt irpose of constructing a single family residence. The applicant contends the granting of the variance is the minimum measure that can be taken in order to prevent construction on an area of potential risk to safety as well as avoid excessive costs in constructing the drainage system. However, the proposed location of the structure 10 feet to the north will not significantly reduce the need or additional drainage mitigations. E. Corrclusions 1. The subject site is located at 215 NW 2nd Place, within the Residential - 8 Dwelling Units per Acre (R- 8) zoning designation. 2. The R-8 zone requires a minimum 20 foot front yard setback from the street (section 4-2-110A). The applicant is proposing a reduction of this requirement to 10 feet. 3. The analysis of the proposal according to variance criteria is found in the body of the Staff Report. F. Decision The Administrative Variance for the Shirazi Variance, File No. LUA-99-004, V-A, is denied. We described general site conditions and ground water seepage evident in the southwest portion of the site in our letter"Consultation, Proposed Single Family Residence, 215 Northwest 2nd Place, Renton, Washington"dated December 7, 1998. The area of ground water seepage located in the southwest portion of the site emanates from near the toe of a relatively steep slope (steepest portion of slope on the site) that rises to the west. The persistent ground water seepage forms an approximately 3-foot diameter earthen pool that has been a feature of the site for many years. In our opinion, construction and excavation activities in the area of the identified persistent ground water seepage and pool will increase the risk of slope instability in the relatively steep slope that is located adjacent to the pool. We therefore recommended in our December 1998 letter that all construction and excavation be kept at least 10 feet from this area of ground water seepage to reduce the risk of slope instability. In our opinion, it is prudent to avoid this area of evident risk and identify the most geologically favorable portion of the site for construction of the planned residence. To clarify the statement presented in the last paragraph of our December 1998 letter, it is our opinion that that ground water seepage will likely be encountered elsewhere on the property during excavation. However, slopes in the other portions of the site are not as steep as in the southwest portion and do not present the same degree of risk. This would require us to set the foundation in a location that could become unstable and requiring us to spend unknown funds to divert the water into a new drainage system. A drainage system has been in existence for the pool of water for many years and has been sufficient in controlling the amount of water that remains to a constant level. This information and possible destruction of the site is included in the report from the geologist. B) That granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The road that fronts the site is NW 2nd Place, it is currently dedicated for 60 feet the improvements on the road are 30 feet. When we originally applied for the building permit we assumed the improvements for the road were in the middle of the 60-foot right a way. It was not until after we received our permit and began staking the property that it was brought to our attention that the road was placed on the North side of the 60 feet. Our property began not 15 feet from the road edge as assumed but 25 feet and our calculations for the location of the building site were not the same and that is when we discovered we would be in the middle of the pool of water. On the North side of NW 2nd Place the homes are starting from 5 feet off of the road and have a set back of approximately 20 feet. If we are granted this variance we would still have a set back from the edge of the road greater then that of the others in the neighborhood. We would set back 35 feet from the road. This variance would maintain the visual set backs to approximately the same distances and would not be injurious to the vicinity. C) The approval shall not constitute a grant of special privilege inconsistent with • the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: Again using the same argument as in B) above this would not be inconsistent with the neighborhood. This request would not allow us special privilege it would however, allow us to maintain the integrity of the neighborhood. When we first considered this project we were not aware that the lot line began so far into the property. Because of the road right-a-way it begins approx. 25 feet past the street on our side (the street is currently 30 foot wide and I do not believe there are any plans to improve or widen the road). These services have been completed in general accordance with the scope of services presented in our confirming agreement dated December 7, 1998. Our services were requested by you to provide an opinion regarding the proper location of the proposed residential structure and the possible impacts of construction near the area of ground water seepage. We visited the site and met with you on December 3, 1998 to discuss the evident ground water seepage in the southwest portion of the site. The ground surface slopes up to the west in the west portion of the site. A relatively flat area is located in the east portion of the site above an existing retaining wall located on adjacent property. The area of ground water seepage is located in the southwest portion of the site near the toe of the slope and includes an approximately 3-foot diameter earthen pool. We understand that the seepage and standing water evident in the small pool have been features of the site for many years. We also understand that the seepage water is routed into a black corrugated pipe and to the east to the storm water system located near Taylor Street. In our opinion, construction and excavation activities should be avoided near the area of ground water seepage to reduce the risk of destabilizing the adjacent slope. We therefore recommend that all construction and excavation be kept at least 10 feet from this area of ground water seepage to reduce the risk of slope instability, and to avoid construction difficulties and the additional expense associated with construction of a permanent dewatering system. The following comments on development and permitting issues are based on the pre-application submittals made to the City of Renton by the applicant. The applicant is cautioned that information contained in this summary may be subject to modification and/or concurrence by official decision makers (e.g., Hearing Examiner, Zoning Administrator, Board of Adjustment, Board of Public Works, and City Council). The applicant is encouraged to review all applicable sections of the Renton Municipal Code. 1, General: The subject property is located at 215 NW 2nd Place. The proposal is to construct a single family residence. The site is currently vacant. An artesian well exists on the property and w Duld be located on the southwest corner of the proposed residence. The request is for a variance fr 3m the required 20 foot front yard setback to allow a 10 foot setback from the property line. 2 Zoning/Development Standards: The subject site is zoned Residential at 8 dwelling units per a;re (R-8). The R-8 zone is primarily a single-family zone and only allows one residential dwelling unit per lot. The R-8 zone requires a minimum lot size of 4,500 square feet, a minimum width of 50 feet, and a minimum depth of 65 feet. Building height is restricted to 30 feet or 2 stories for primary structures and lot coverage by buildings is limited to 35% on lots over 5,000 square feet. The required setbacks in the R-8 zone are 20 feet in the front and rear and 5 feet on the sides. The setbacks are measured from the property lines to the nearest point of the structure. A handout listing the permitted uses and development standards for this zone is included with the attached materials. The proposal appears to meet the requirements of the R-8 development standards with the exception of the subject variance request. 3 Administrative Setback Variance: An administrative setback variance would need to be applied for in order to reduce the front yard setback to 10 feet. The burden would be on the applicant to show tl at: a. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surrounding of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileged enjoyed by other property owners in the vicinity and under identical zone classification. It is likely that staff would be able to support the requested variance if the applicant is able to d,monstrate that building within a close proximity to the well would cause genuine safety issues (e.g., a geotechnical report or recommendation from an engineer). If there is nothing that demonstrates the infeasibility of building on the well, the variance would be denied. I-owever, there is a possibility that the a portion of NW 2nd Street may be vacated, providing the n.quired setback to the proposed structure. The right-of-way for NW 2nd Street is currently 60 feet in H idth. Only 50 feet is required for residential access streets and 42 feet may be approved through a modification. Vacating a part of NW 2nd Street would give the property from 5 to possibly 10 feet H hich would provide the required setback. 4.
