tendaysafterthedateofmailingtheexemptiondecisiontotheDepartmentofEcologyandAttorneyGeneral--providedtheStatedoesnotappealtheexemptiondecisionduringthetendayreviewperiodandprovidedallotherrelevantrequirementshavebeenmet.1Anyprojectwithacertificationfromthegovernor.AnyprojectwithacertificationfromthegovernorpursuanttoChapter80.50RCW;2Totalcostorfairmarketvalueofproject(whicheverishigher)islessthan$6,416.00.Anydevelopmentofwhichthetotalcostorfairmarketvalue,whicheverishigher,doesnotexceedfivethousanddollars,ifsuchdevelopmentdoesnotmateriallyinterferewiththenormalpublicuseofthewaterorshorelinesofthestate.Forpurposesofdeterminingwhetherornotapermitisrequired,thetotalcostorfairmarketvalueshallbebasedonthevalueofdevelopmentthatisoccurringonshorelinesofthestateasdefinedinRCW90.58.030(3)(e).Thetotalcostorfairmarketvalueofthedevelopmentshallincludethefairmarketvalueofanydonated,contributedorfoundlabor,equipmentormaterials;Normalmaintenanceorrepairofexistingstructuresordevelopments.Normalmaintenanceorrepairofexistingstructuresordevelopments,includingdamagebyaccident,fireorelements.“Normalmaintenance”includesthoseusualactstopreventadecline,lapse,orcessationfromalawfullyestablishedcondition.“Normalrepair”meanstorestoreadevelopmenttoastatecomparabletoitsoriginalcondition,includingbutnotlimitedtoitssize,shape,configuration,locationandexternalappearance,withinareasonableperiodafterdecayorpartialdestruction,exceptwhererepaircausessubstantialadverseeffectstoshorelineresourceorenvironment.Replacementofastructureordevelopmentmaybeauthorizedasrepairwheresuchreplacementisthecommonmethodofrepairforthetypeofstructureordevelopmentandthereplacementstructureordevelopmentiscomparabletotheoriginalstructureordevelopmentincludingbutnotlimitedtoitssize,shape,configuration,locationandexternalappearanceandthereplacementdoesnotcausesubstantialadverseeffectstoshorelineresourcesorenvironment;4Emergencyconstructionnecessarytoprotectpropertyfromdamagebytheelements.Emergencyconstructionnecessarytoprotectpropertyfromdamagebytheelements.An“emergency”isanunanticipatedandimminentthreattopublichealth,safety,ortheenvironmentwhichrequiresimmediateactionwithinatimetooshorttoallowfullcompliancewiththischapter.Emergencyconstructiondoesnotincludedevelopmentofnewpermanentprotectivestructureswherenonepreviouslyexisted.Wherenewprotectivestructuresaredeemedbytheadministratortobetheappropriatemeanstoaddresstheemergencysituation,uponabatementoftheemergencysituationthenewstructureshallberemovedoranypermitwhichwouldhavebeenrequired,absentanemergency,pursuanttoChapter90.58RCW,theseregulations,orthelocalmasterprogram,obtained.AllemergencyconstructionshallbeconsistentwiththepoliciesofChapter90.58RCWandthelocalmasterprogram.Asageneralmatter,floodingorotherseasonaleventsthatcanbeanticipatedandmayoccurbutthatarenotimminentarenotanemergency;Normalagriculturalconstructionandpractices.Constructionandpracticesnormalornecessaryforfarming,irrigation,andranchingactivities,includingagriculturalserviceroadsandutilitiesonshorelands,constructionofabarnorsimilaragriculturalstructure,andtheconstructionandmaintenanceofirrigationstructuresincludingbutnotlimitedtoheadgates,pumpingfacilities,andirrigationchannels:Provided,Thatafeedlotofanysize,allprocessingSH:\CED\Data\Forms-Templates\SeIf-HeIpHandouts\Planning\ShorelineExemptions.docRev:03/2018 plants,otheractivitiesofacommercialnature,alterationofthecontouroftheshorelandsbylevelingorfillingotherthanthatwhichresultsfromnormalcultivation,shallnotbeconsiderednormalornecessaryfarmingorranchingactivities.Afeedlotshallbeanenclosureorfacilityusedorcapableofbeingusedforfeedinglivestockhay,grain,silage,orotherlivestockfeed,butshallnotincludelandforgrowingcropsorvegetationforlivestockfeedingand/orgrazing,norshallitincludenormallivestockwinteringoperations;6Constructionofasingle-familyresidenceforusebyownerorowner’sfamily.Constructiononshorelandsbyanowner,lesseeorcontractpurchaserofasingle-familyresidencefortheirownuseorfortheuseoftheirfamily,whichresidencedoesnotexceedaheightofthirty-fivefeetaboveaveragegradelevelandwhichmeetsallrequirementsofthestateagencyorlocalgovernmenthavingjurisdictionthereof.“Single-familyresidence”meansadetacheddwellingdesignedforandoccupiedbyonefamilyincludingthosestructuresanddevelopmentswithinacontiguousownershipwhichareanormalappurtenance.An“appurtenance”isnecessarilyconnectedtotheuseandenjoymentofasingle-familyresidenceandislocatedlandwardoftheordinaryhighwatermarkandtheperimeterofawetland.Onastatewidebasis,normalappurtenancesincludeagarage;deck;driveway;utilities;fences;installationofaseptictankanddrainfieldandgradingwhichdoesnotexceedtwohundredfiftycubicyardsandwhichdoesnotinvolveplacementoffillinanywetlandorwaterwardoftheordinaryhighwatermark.Localcircumstancesmaydictateadditionalinterpretationsofnormalappurtenanceswhichshallbesetforthandregulatedwithintheapplicablemasterprogram.Constructionauthorizedunderthisexemptionshallbelocatedlandwardoftheordinaryhighwatermark;Constructionofaprivatedockfornon-commercialusebypropertyowner(s).Constructionofadock,includingacommunitydock,designedforpleasurecraftonly,fortheprivatenoncommercialuseoftheowners,lessee,orcontractpurchaserofasingle-familyandmultiple-familyresidences.Thisexceptionappliesifthefairmarketvalueofthedockdoesnotexceedtenthousanddollars($10,000);however,ifsubsequentconstructionhavingafairmarketvalueexceedingtwothousandfivehundreddollars($2,500)occurswithinfive(5)yearsofcompletionofthepriorconstruction,thesubsequentconstructionshallbeconsideredasubstantialdevelopmentpermit;andadockisalandingandmooragefacilityforwatercraftanddoesnotincluderecreationaldecks,storagefacilitiesorotherappurtenances;8ConstructionormodificationauthorizedbyCoastGuardordesignatedauthority.Constructionormodification,byorundertheauthorityoftheCoastGuardoradesignatedportmanagementauthority,ofnavigationalaidssuchaschannelmarkersandanchorbuoys;Operation,maintenance,orconstructionrelatedtoirrigation.Operation,maintenance,orconstructionofcanals,waterways,drains,reservoirs,orotherfacilitiesthatnowexistorarehereaftercreatedordevelopedasapartofanirrigationsystemfortheprimarypurposeofmakinguseofsystemwaters,includingreturnflowandartificiallystoredgroundwaterfromtheirrigationoflands;10Markingofpropertylinesorcornersonstate-ownedlands.Themarkingofpropertylinesorcornersonstate-ownedlands,whensuchmarkingdoesnotsignificantlyinterferewithnormalpublicuseofthesurfaceofthewater;6H:\CED\Data\Forms-Templates\SeIf-HeIpHandouts\Planning\shorelineExemptions.docRev:03/2018 11Operationandmaintenanceofagriculturaldrainageanddikingfacilities.Operationandmaintenanceofanysystemofdikes,ditches,drains,orotherfacilitiesexistingonJune4,1975,whichwerecreated,developedorutilizedprimarilyasapartofanagriculturaldrainageordikingsystem;12iactivitiesnecessaryforpreparationofapplicationfordevelopmentauthorization.Siteexplorationandinvestigationactivitiesthatareprerequisitetopreparationofanapplicationfordevelopmentauthorizationunderthischapter,if:(I)Theactivitydoesnotinterferewiththenormalpublicuseofthesurfacewaters;(ii)Theactivitywillhavenosignificantadverseimpactontheenvironmentincludingbutnotlimitedtofish,wildlife,fishorwildlifehabitat,waterquality,andaestheticvalues;(iii)Theactivitydoesnotinvolvetheinstallationofanystructure,anduponcompletionoftheactivitythevegetationandlandconfigurationofthesitearerestoredtoconditionsexistingbeforetheactivity;(iv)Aprivateentityseekingdevelopmentauthorizationunderthissectionfirstpostsaperformancebondorprovidesotherevidenceoffinancialresponsibilitytothelocaljurisdictiontoensurethatthesiteisrestoredtopreexistingconditions;andTheactivityisnotsubjecttothepermitrequirementsofChapter90.58.550RCW;13RemovingorcontrollingaquaticnoxiousweedsTheprocessofremovingorcontrollingaquaticnoxiousweeds,asdefinedinChapter17.26.020RCW,throughtheuseofanherbicideorothertreatmentmethodsapplicabletoweedcontrolthatarerecommendedbyafinalenvironmentalimpactstatementpublishedbythedepartmentofagricultureorthedepartmentofecologyjointlywithotherstateagenciesunderChapter43.21CRCW;14WatershedrestorationprojectsWatershedrestorationprojectsasdefinedherein.Localgovernmentshallreviewtheprojectsforconsistencywiththeshorelinemasterprograminanexpeditiousmannerandshallissueitsdecisionalongwithanyconditionswithinforty-fivedaysofreceivingallmaterialsnecessarytoreviewtherequestforexemptionfromtheapplicant.Nofeemaybechargedforacceptingandprocessingrequestsforexemptionforwatershedrestorationprojectsasusedinthissection.(i)“Watershedrestorationproject”meansapublicorprivateprojectauthorizedbythesponsorofawatershedrestorationplanthatimplementstheplanorapartoftheplanandconsistsofoneormoreofthefollowingactivities:(A)Aprojectthatinvolveslessthantenmilesofstreamreach,inwhichlessthantwenty-fivecubicyardsofsand,gravel,orsoilisremoved,imported,disturbedordischarged,andinwhichnoexistingvegetationisremovedexceptasminimallynecessarytofacilitateadditionalplantings;(B)Aprojectfortherestorationofanerodedorunstablestreambankthatemploystheprinciplesofbioengineering,includinglimiteduseofrockasastabilizationonlyatthetoeofthebank,andwithprimaryemphasisonusingnativevegetationtocontroltheerosiveforcesofflowingwater;or7H:\CED\Data\Forms-Templates\SeIf-HeIpHandouts\Planning\ShorelineExemptions.UocRev:03/2018 (C)Aprojectprimarilydesignedtoimprovefishandwildlifehabitat,removeorreduceimpedimentstomigrationoffish,orenhancethefisheryresourceavailableforusebyallofthecitizensofthestate,providedthatanystructure,otherthanabridgeorculvertorinstreamhabitatenhancementstructureassociatedwiththeproject,islessthantwohundredsquarefeetinfloorareaandislocatedabovetheordinaryhighwatermarkofthestream.(ii)“Watershedrestorationplan”meansaplan,developedorsponsoredbythedepartmentoffishandwildlife,thedepartmentofecology,thedepartmentofnaturalresources,thedepartmentoftransportation,afederallyrecognizedIndiantribeactingwithinandpursuanttoitsauthority,acity,acounty,oraconservationdistrictthatprovidesageneralprogramandimplementationmeasuresoractionsforthepreservation,restoration,re-creation,orenhancementofthenaturalresources,character,andecologyofastream,streamsegment,drainagearea,orwatershedforwhichagencyandpublicreviewhasbeenconductedpursuanttoRCWChapter43.21C,theStateEnvironmentalPolicyAct;15Projectsintendedtoimprovefishorwildlifehabitatorfishpassage.Apublicorprivateproject,theprimarypurposeofwhichistoimprovefishorwildlifehabitatorfishpassage,whenallofthefollowingapply:fi)Theprojecthasbeenapprovedinwritingbythedepartmentoffishandwildlifeasnecessaryfortheimprovementofthehabitatorpassageandappropriatelydesignedandsitedtoaccomplishtheintendedpurpose;(ii)TheprojecthasreceivedhydraulicprojectapprovalbythedepartmentoffishandwildlifepursuanttoRCWChapter75.20;and(iii)Thelocalgovernmenthasdeterminedthattheprojectisconsistentwiththelocalshorelinemasterprogram.Thelocalgovernmentshallmakesuchdeterminationinatimelymannerandprovideitbylettertotheprojectproponent.HazardoussubstanceremediationpursuanttoWAC173-27-040.17Projectsonlandsnotsubjecttoshorelinejurisdictionpriortorestoration.SH:\CED\Data\Forms-Templates\SeIf-HeIpHandouts\Planning\shorelineExemptions.docRev:03/2018
