WHEREAS, The Salvation Arm � � A�led the Grantor,is the owner in fee of
that certain parcel of land situated in the City of Renton, County of King, State of Washington,
more particularly described as follows:
BEGINNING AT A POINT 335 FEET NORTH AND 110 FEET WEST OF THE SOUTHEAST
CORNER OF A 2-ACRE TRACT SOLD TO ENOCH HYDE BY CHARLES BRUHN ON
MAY 28, 1900,ACCORDING TO THE DEED THEREOF RECORDED IN VOLUME 255 OF
DEEDS,PAGE 285, RECORDING NUMBER 192483,THE SAID SOUTHEAST CORNER OF
THE HYDE TRACT IS 1367.52 FEET WEST AND 1136.52 FEET NORTH OF THE
SOUTHWEST CORNER OF BLOCK 25
OF THE TOWN OF RENTON;
THENCE NORTH 200 FEET;
THENCE WEST 156.5 FEET;
THENCE SOUTH 200 FEET;
THENCE EAST 156.5 FEET TO THE PLACE OF BEGINNING,BEING A PORTION OF THE
H.H. TOBIN DONATION CLAIM 1N TOWNSHIl'23 NORTH RANGE 5 EAST OF THE
WII..LAMETTE MERIDIAN CONVEYED TO MARY F. TOBIN,ACCORDING TO THE
DEED THEREOF RECORDED IN VOLUME 38 OF DEEDS,PAGE 211, IN KING COLTNTY,
WASHINGTON;
EXCEPT THE EAST 60 FEET 7 INCHES OF THE SOUTH 100 FEET THEREOF; AND
EXCEPT THE EAST 55 FEET 5 INCHES OF THE NORTH 100 FEET THEREOF.
Hereinafter called"Crrantor's property", and outlined on the attached map(Exhibit A);
NOW,THEREFORE,in consideration of the sum of Four Thousand Seven Hundred
Fifty Dollars ($4,750.00), the receipt and sufficiency of which is hereby acknowledged,the
Grantor, for themselves, their heirs, administrators, executors, suecessors and assigns, do hereby
grant,bargain, sell and convey unto the City of Renton,Washington, hereinafter called the
Grantee, its successors and assigns, for the use and benefit of the public, an easement and right-
of-way, appurtenant to the Renton Municipal Airport, for the unobstructed passage of all aircraft,
("aircraft"being defined for the purpose of this instrument as any contrivance now lrnown or
hereafter invented, used or designed for navigation of or flight in the air)by whomsoever owned
or operated in the airspace above Grantor's property above an imaginary plane rising and
extending in a generally southerly direction over Grantor's property, sa?d imaginary plane
running from approximately forty seven(47) feet above mean sea level above the northern
property line of the Grantor's property, at the rate of one(1)foot vertical for each twenty(20)feet
harizontally, to approximately 57 feet above mean sea level at the southern property line of the
Grantor's property, to an infinite height above said imaginary plane,together with the right to
cause in all airspace above the surface of Grantor's property such noise,vibrations, fumes, dust,
fuel particles, and all other effects that may be caused by the operation of aircraft landing at, or
taking off from, or operating at or on said Renton Municipal Airport; and Grantors do hereby
fully waive,remise, and release any right or cause of action which they may now have or which
they may have in the future against Grantee, its successors and assigns, due to such noise,
vibrations, fumes, dust, fuel particles, and all other effects thai may be caused or may have been
caused by the operation of aircraft landing at, or taking off from,or operating at or on said Renton
Municipal Airport. "��

The easement and right-of-way hereby granted includes the continuing right of the
Grantee to prevent the erection or growth upon Grantor's property of any building, structure,tree �Ir -�.

or other object, extending into the airspace above the mean sea level of from approximately forty
seven(47) feet above mean sea level to fifty seven (57) feet above mean sea level feet, and to
remove from said airspace, or at the sole option of the Grantee, as an alternative to mark and light
as obstructions to air navigation, any such building, structure, tree or other objects now upon, or
which in the future may be upon Grantor's property, together with the right of ingress to, egress
. from and passage over Grantor's property for the above purpose. .
TO HAVE AND TO HOLD said easement and right-of-way, and all rights appertaining
thereto unto the Grantee, its successors, and assigns, until said Renton Municipal Airport shall be
abandoned and shall cease to be used for public airport purposes.
AND for the consideration set forth herein, the Grantor, for themselves,their heirs,
administrators, executors, successors and assigns do hereby agree that for and during the life of
said easement and right-of-way, they will not hereafter erect,permit the erection or growth of,or
permit or suffer to remain upon Grantor's property any building, structure,tree or other object
extending into the aforesaid prohibited airspace, and that they shall not hereafter use or permit or
suffer the use of Grantor's property in such a manner as to create electxical interference with radio
communication between any installation upon said airport and aircraft, or as to make it difficult
for flyers to distinguish between airport lights and others,or as to impair visibility in the vicinity
of the airport or as otherwise to endanger landing, taking off or maneuvering of aircraft,it being
understood and agreed that the aforesaid covenants and agreements shall run with the land.
