ORDINANCE NO. 4732
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
ESTABLISHING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES TO BE ANNEXED TO THE CITY OF RENTON TO
RESIDENTIAL 1 DU/AC (R-1) AND RESIDENTIAL 5 DU/AC (R-5) (MAY
VALLEY PREZONE-PHASE II; FILE NO. LUA 98-009, ECF).
WHEREAS, under Chapter 31 (Zoning Code), of Title IV (Building Regulations), of
Ordinance No. 4260 known as the "Code of General Ordinances of the City of Renton," as amended,
and the maps and reports adopted in conjunction therewith, the property hereinbelow described has
not been zoned in the City of Renton; and
WHEREAS, said property owners petitioned the City of Renton for assignment of zoning
classifications prior to annexation, and the City Council having held two public hearings to consider
this prezoning application, the first hearing being held on January 29, 1997, and the second hearing
being held on April 14, 1997, and said zoning request being in conformity with the City's
Comprehensive Plan, as amended, and the City Council having duly considered all matters relevant
thereto, and all parties having been heard appearing in support thereof or in opposition thereto;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION I. The following described property in the City of Renton shall bear the following
zoning designations once annexed to the City of Renton: Residential 1 DU/AC (R-1) and Residential 5
DU/AC (R-5), as hereinbelow specified, the Development Services Director is hereby authorized and
directed to change the maps of the Zoning Ordinance, as amended, to evidence said rezoning, to-wit:
See Exhibit "A" attached hereto and made a part hereof as if fully set forth herein.

Renton's Potential Annexation Area in accordance with RCW Sections 35A.14.330 and 35A.14.340. Proposed zoning is
Resident al- 1 dwelling unit/acre(R-1) and Residential-5 dwelling units/acre(R-5). King County R-4 and R-1-P Zones are
currently in effect. City zoning would supplant King County zoning at such time as annexation of the subject properties is
effective Location: The subject properties are generally bounded by S.E. May Valley Road, Coal Creek Parkway S.E. and

Comments rega ding the environmental determination must-be filed in writing on or before 5:00 PM March 9, 1998. Any
aggrieved person feeling that the environmental determination of the Environmental Review Committee is based on erroneous
procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the
time of the deterr rination may submit written comments. After review of the comments, if Environmental Review Committee finds
there is not suffic ent evidence to amend its original determination, then there will be no further extension of the appeal period. Any
person wishing tc take further action would need to file a formal appeal within the original 15-day timeframe. Written comments must

4 and R-1-P Zones are currently in effect. City zoning would supplant King County

proposed zoning. Such impacts are not anticipated to increase with the supplanting of existing King County zoning with
the proposed zoning designations.

Nexus:
2. Air
Impacts: Emissions to air resulting from construction and activities associated with residential land uses may occur as a
result of the proposed zoning action. Since the proposal would not increase the potential intensity of development over
existing zoning,the potential for such impacts is not anticipated to increase as a result of the proposal.
Mitigation Measures: No mitigation measures are proposed for this nonproject action.
Nexus:
3. Water
Impacts: The zoned development density of specific portions of the subject area would not increase as a result of the
proposed zoning action. However, the -P suffix of the King County R-1-P Zone, currently applying to the majority of
the subject area, requires that all parcels of 5 acres or more cluster development so that at least 50% of the original lot
area is left as an open space tract. Areas left in open space, particularly if forest cover is retained, may contribute to a

higher recharge of surface water into the ground. Since the proposed zoning has no comparable requirement for open
space and tl erefore resulting in potentially more impervious or semi-pervious surfaces, implementation of the proposed
zoning may -esult in a lower level of surface water infiltration.
Mitigation lvleasures: No mitigation measures are proposed. Surface water management requirements currently
required of development within the City of Renton should be sufficient, in general, to mitigate potential impacts to
surface and ground water.

3. Public Services
Impacts: Police noted a probable minor impact to public services but stated that the impact on police services would be
minimal.
Mitigation lvleasures: No mitigation measures are proposed.

PROJECT SUMMARY
MAY VALLEY PREZONE - PHASE II
The proposed action would assign City of Renton zoning designations to an area outside the existing
city limits. The subject area is bounded by Coal Creek Parkway on the west, S.E. May Valley Road on
the north and the Renton corporate boundary on the east and south. A combination of R-1 and R-5
zoning has been recommended by the Planning and Development Committee. (see attached Planning and
Development Committee Recommendations Map) The zoning recommendation has necessitated an
amendment to the Comprehensive Plan Land Use Map. Environmental review of the Land Use Map
changes has occurred separately.
The proposed zoning ordinance will not be implemented until annexation occurs. No annexations have
been initiated from this area.
May Creek flows through the subject area. Additionally, the area is mapped for a variety of critical
areas in the City's Critical Area Inventory, including landslide and erosion hazards, wetlands and
floodplain.
The area has been subject to flooding and erosion problems which appear to have increased over time.
As a result, the draft May Creek Basin Action Plan, developed with the participation of City staff,
includes a recommendation to maintain zoned densities at the existing level for areas that drain to May
Valley. This recommendation would apply to all of Phase II. The proposed zoning is consistent with
this recommendation.
The majority of the area is zoned R-1-P by King County. The -P suffix requires that parcels five acres
or more maintain half of the original lot area in open space. The maximum density of one unit per acre
would be maintained under the proposed zoning. Those portions of the affected area that are currently
zoned R-4 would be zoned R-1 and R-5 under the City's proposal. Since the County calculates density
on gross area and the City applies density to net area, R-4 and R-5 would allow a similar number of
units. Therefore, under the proposed zoning, the total number of new units would be marginally
reduced from that possible under existing zoning.

PURPOSE OF CHECKLIST:
The State Environmental Policy Act(SEPA), Chapter 43.21C RCW,requires all governmental agencies to consider the
environmental impacts of a proposal before making decisions. An Environmental Impact Statement(EIS)must be prepared
for all proposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is
to provide information to help you and the agency identify impacts from your proposal(and to reduce or avoid impacts from
the proposal, if it can be done)and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use
this checklist to determine whether the environmental impacts of your proposal are significant,requiring preparation of an
EIS. Answer the questions briefly,with the most precise information known,or give the best description you can.
You must answer each question accurately and carefully,to the best of your knowledge. In most cases,you should be able to
answer the questions from your own observations or project plans without the need to hire experts. If you really do not know
the answer,or if a question does not apply to your proposal,write"do not know"or"does not apply". Complete answers to
the questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline,and landmark designations. Answer these
questions if you can. If you have problems,the governmental agencies can assist you.
The checklist questions apply to all parts of your proposal,even if you plan to do them over a period of time or on different
parcels of land. Attach any additional information that will help describe your proposal or its environmental effects. The
agency to which you submit this checklist may ask you to explain your answers or provide additional information reasonably
related to determining if there may be significant adverse impact.

The proposal is to prezone an area of unincorporated King County within Renton's Potential
Annexation Area in accordance with RCW Sections 35A.14.330 and 35A.14.340. The
subject area is designated Residential Rural (RR) and Residential Single Family (RS) in the
Comprehensive Plan. Proposed zones are Residential- 1 du/ac (R-1)and Residential-5
du/ac, consistent with the Comprehensive Plan Land Use Map. (Figure 1)
King County zoning for the area includes Residential- 1 Unit per Acre(R-1-P) and
Residential-4 Units per Acre(R-4). (Figure 2)
Environmental impacts from the imposition of City zoning are taken to be those that result
from the difference in development potential between proposed zoning and the existing King
County Zoning.
12. Location of the proposal. Give sufficient information for a person to understand the precise location of
your proposed project, including a street address, if any, and section,township, and range if know. If a
proposal would occur over a range of area,provide the range or boundaries of the site(s). Provide a

The subject properties are generally bounded by S.E.May Valley Road, Coal Creek
Parkway S.E., and the Renton corporate boundary. (figure 1)

Since erosion impacts could occur as a result of site specific project proposals, such impacts
should be assessed and mitigations proposed through the application process. Additionally,

This is a nonproject action and therefore the method of collection and disposal and the
quantities of run-off associated with the implementation of the proposed zoning are unknown.
It is possible that the amount of run-off could increase for those areas proposed for R-1. For
the majority of the subject area,the R-1 Zone would supplant the County's existing R-1-P
Zone which requires that all parcels of 5 acres or more cluster development so that at least
50% of the original lot area is left as an open space tract. Although the overall density of R-1 .
is the same as R-1-P, areas left in open space,particularly if it remains forested,will allow
more surface water to recharge into the ground. However,the portion of the R-1 that is
proposed to supplant existing R-4 Zoning with annexation may lower the run-off from that
area.
2) Could waste material enter ground or surface waters? If so,generally describe.
Residential development of the subject area may create the potential for substances, including
but not limited to pesticides, herbicides and fertilizers to enter surface waters and sewage from
septic systems to enter ground waters. However, potential impacts are not anticipated to
increase under the proposed zoning.

Pacific Flyway. This flyway, as it overlies Renton,is used by a variety of migratory birds,
including, but not limited to,the Canada goose.

residential development. Residential uses may consume one or more types of energy,
including electric, natural gas, oil,wood stoves, or solar. The type and quantity of energy
consumed is not anticipated to increase if and when the proposed zoning supplants existing
zoning.

future development as a park.

the north, east and west are vacant and single family.

within the prezone boundaries are currently used for hobby farms.

Proposed zoning designations are consistent with Renton's Comprehensive Plan and are
comparable to existing King County zoning. The proposal is also consistent with the
recommendations of the draft May Creek Basin Action Plan which encourages maintenance
or reduction of the existing zoned densities for areas that drain to May Valley. The subject
area drains to May Valley.

This is a nonproject action. Housing units would not be created or eliminated by the
• proposal.
A portion of the area currently zoned R-4 is proposed for R-5 zoning. The remainder of the
area currently zoned R-4 and all subject areas zoned R-1-P are proposed for R-1 zoning.
Since the City's R-5 Zone, based on net area, and the County's R-4 Zone, based on gross
area, are roughly equivalent,total potential new housing units would not change significantly.

impacts over the existing regulations as the proposed zoning would allow uses similar to those
allowed under current King County zoning. Total potential new units are estimated to be
equivalent or lower under the proposed zoning than under existing zoning.
Proposed measures to avoid or reduce such increases are:
No specific measures are proposed. However, specific development proposals made to the City
following annexation of any portion of the affected area would be subject the City's other
regulations as well as the standards in the Zoning Code. These regulations govern, among
other things, surface water management, aquifer protection, noise level and septic systems.
2. How would the proposal be likely to affect plants, animals,fish, or marine life?
Any additional development of this area may result in a reduction of wildlife habitat and
potential degradation of existing habitat due to increased surface water run-off. Since the
existing County R-1-P requires that subdivision of parcels five acres or greater maintain at
least 50% of the original lot area in open space, current zoning may maintain more land in
natural habitat than would proposed zoning. Further, preserving natural open space may
provide greater opportunity for surface waters to infiltrate, reducing surface water entry to
May Creek. Reducing discharge to May Creek may lessen the potential for degradation of the
creek habitat.
However, since the development densities allowed under the proposed zoning are comparable
to or lower than existing zoning,total impacts are not anticipated to be significant.
Proposed measures to protect or conserve plants, animals,fish, or marine life are:
Measures that may reduce impacts to plants and animals include implementation of land
clearing and tree cutting regulations, wetland regulations and surface water management
regulations.

Any additional residential development may increase the depletion of energy and natural
resources. However, the proposed zoning would allow an equivalent or fewer number of
potential units than would existing zoning. Therefore, the potential for depletion of energy or
natural resources should not increase as a result of this nonproject action.
Proposed measures to protect or conserve energy and natural resources are:
No measures are proposed.
4. How would the proposal be likely to use or affect environmentally sensitive areas or areas
designated (or eligible or under study)for governmental protection; such as parks, wilderness,
wild and scenic rivers, threatened or endangered species habitat, historic or cultural sites,
wetlands,floodplains, or prime farmlands?
The subject area includes wetlands, floodplains and a fish-bearing stream. In general, the
nonproject proposal would not directly affect environmentally sensitive and other protected
areas. These areas will be more affected by the replacement, with annexation, of the County's
sensitive area regulations with the City's. However, supplanting the existing R-1-P zoning with
the City's R-1 would remove the requirement for maintaining over 50% of the area of parcels
over 5 acres in permanent open space. This may result in greater surface water run-off to
May Creek.
Proposed measures to protect such resources or to avoid or reduce impacts are:
The proposal is consistent with the recommendations of the draft May Creek Basin Action Plan
with are intended to minimize impacts to the hydrology and habitat of May Creek and
environs.
Development that may occur under the proposed zoning, should all or portions of the subject
area annex to the City of Renton, would be subject to the City's critical areas and surface
water management regulations.
5. How would the proposal be likely to affect land and shoreline use, including whether it would
allow or encourage land or shoreline uses incompatible with existing plans?
The type and intensity of land uses would not change significantly with implementation of the
proposed zoning. The proposed R-1 and R-5 Zones are consistent with the Renton
Comprehensive Plan land use designations and with existing King County zoning designations
in terms of the type and intensity of potential development.
Proposed measures to avoid or reduce shoreline and land use impacts are:
No measures are proposed.
6. How would the proposal be likely to increase demands on transportation or public services and
utilities?
Any additional development that may occur as a result of the proposed action may increase
demands on transportation and public services and utilities. However,the type and intensity of
development allowed under the proposal is comparable to that allowed under existing zoning.
