Action: The Board approved the variance from the Underground Ordinance based on the following condition: 1. Minimum vertical clearance over right-of-way is 18 feet(per National Electrical Code). The Board also agreed that the Provosts would not be required to sign a letter requiring participation in any future project that would place the overhead utility lines underground in this area of the City. OLD BUSINESS: • ONE YEAR EXTENSION OF OFF-SITE DEFERRAL,HEIFA SHORT PLAT,LUA 98-032-SHPL,N.E. 7`h Street —The applicant is requesting a one-year extension of the off-site deferral of sidewalks. Applicant was previously granted a one-year extension for these improvements May 26,2004 which expired May 26,2005. Action: The Board approved the extension of the off-site deferral of sidewalks. It was noted that due to the maximum five-year limitation,this would be the last approval for an extension of the deferral. It was moved by Christensen, seconded by McClincy. MOTION CARRIED. 5. OTHER BUSINESS: • REQUEST FROM WSDOT FOR NOISE VARIANCE MEETING RE: HOV LANE WORK HWY 167,S. 180TH TO HWY 167/I-405 INTERCHANGE—Chairman Watts surveyed the Board members as to whether they thought this meeting should be held in the evening to allow concerned Talbot Hill residents an opportunity to participate in the public hearing. The Board agreed this meeting could be conducted during regular business hours and, at this time, it did not appear this meeting needed to be in the evening. 6. Action: Following discussion, it was Moved by Christensen, Seconded by Gray to grant the deferral as requested, subject to the following conditions: 1. No occupancy will be granted to any building until the streetlights are in place. 2. A security device acceptable to the Board be in place to cover the deferred items(three streetlight poles and a service cabinet) at 150% of the costs of the deferred improvements, which would be $14,925.00. MOTION CARRIED. • RIGHT-OF-WAY USE PERMIT,THIRION RESIDENCE,2518 NE 5th Place—The applicant is requesting a Right-of-Way Use permit for storage of a boat and a tow vehicle on 16 feet of the back property line. Action: A discussion was held at length, in which Boardmembers, applicant and neighboring residents of the property were each given a chance to speak. The Board Chairman expressed that setting precedence for this kind of ROW and alley use for the future, as well as Code compliance become major concerns in this case. It was Moved by Christensen, Seconded by Burnell to deny this request for the following reasons: 1. The area is used as a playfield by children. 2. There is no established roadway/vehicular access to the ROW area requested(alley). 3. It will create an attractive nuisance. 4. There is a concern for allowing parking in the alley. Typically, parking is not allowed in alleys and would only be considered if the alley was not usable by other property owners. MOTION CARRIED. 4. Project Description/Background The applicant owns two lots that form an "L" shaped lot. One lot fronts on NE 7th Street and the second lot fronts on Monroe Ave NE. The applicant proposes creating four lots from the total area of the two existing lots. 2. Environmental Review Short plats are exempt from SEPA unless they include sensitive areas that require further review. In accordance with RCW Part Nine 197-11-800(6)(a) this short plat is exempt from SEPA. 3. Compliance with ERC Conditions No mitigation measures required. 4. Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The subject property is designated as Residential Single Family on the Land Use Element Map of the Comprehensive Plan. The proposed subdivision is consistent with the Comprehensive Plan. Policy LU-35: A minimum lot size of 4,500 square feet should be allowed in single family residential neighborhoods. The proposed lots range in size from 5,996 sf to 10,981 sf in area. The size of the proposed lots is consistent with the requirements for this area. Policy H-4: Encourage infill development as a means to increase capacity. The proposed short plat is an infill development. The proposed subdivision will take two large lots created in the past and create four new lots. The number of units per acre within a subdivision is based upon the net acreage. Net acreage is achieved by taking the gross acreage and subtracting out the sensitive areas and public roadways. This short plat includes 0.745 gross acres. There are no public roads that need to be subtracted from the gross acreage nor are there any sensitive areas that need to be deducted. The net density of this short plat is approximately 5.4 units per acre. This is within the acceptable range of 5 to 8 dwelling units per acre. c) Compliance with Subdivision Regulations Streets: No new streets will be created by this short plat. The applicant will be required to install all appropriate Code required improvements along the existing streets. The applicant will need to provide a Transportation Mitigation Fee of$75 per average daily trip ($2,148.75) to mitigate the impacts of this development on the existing City street system. The fee is estimated by taking the number of new homes allowed by the short plat, which is three (4 lots proposed minus the one existing home) multiplying that times 9.55 (average daily trips generated by single family homes) and multiplying that figure times $75 (4 lots- one existing home = 3)(3 x 9.55 = 28.65)(28.65 x $75 = $2,148.75). The applicant requested a deferral from the Board of Public Works for the installation of curbs, gutters, and sidewalks (Code required improvements) along NE 7th Street and a deferral for the installation of sidewalks along Monroe Ave. NE. The Board approved the Deferral of the required improvements along NE 7th Street and the installation of sidewalks along Monroe Ave. NE. The Board required the applicant to record covenants on each of the lots. The covenant for the two lots fronting on NE 7th Street would require future homeowners to participate in a LID for the construction of the Code required improvements when they are installed along the entire street. The applicant is required to post a bond equal to 150% of the cost of sidewalk along Monroe Ave. Blocks: No new blocks will be created by this short plat. Lots: Four lots will be created through this short plat from the two existing parcels. The four proposed lots will meet or exceed the minimum dimension requirements established for this zone. Lot 1 is (65.02'x 99.93') 6,495 sf, Lot 2 is (60.02'x 99.93') 5,995 sf, Lot 3 is (109.92'x 99.93') 10,981 sf and Lot 4 is (109.92'x 99.93') 5,994 sf. The lots are consistent with the standards for residential lots in the R-8 zone. d) Reasonableness of Proposed Boundaries Access: Two of the proposed lots will have direct access onto NE 7th Street and two of the proposed lots will access Monroe Ave, NE. The applicant will need to record an easement across Lot 4 to allow utility and vehicular access to Lot 3. The applicant has stated that he has the easement ready for recording. Topography: The project site is fairly level. No significant grading will be required to prepare the site for the future home construction. Relationship to Existing Uses: The adjacent neighborhood has developed primarily for single family homes. The Renton Technical College has operated across the street from the proposed short plat for a number of years. The Fire Department has also requested that the Fire Mitigation Fee be imposed on this short plat. The applicant will need to submit a Fire Mitigation Fee of$488.00 per new single family home. The Renton Municipal Code requires the applicant to install new fire hydrants so that there is a fire hydrant within 300 feet of the building pad on each of the proposed residential lots. If there are existing fire hydrants within 300 feet of the proposed lots, that meet current City standards, the applicant may not need to install new hydrant(s). Recreation:The applicant will not be providing on-site recreation facilities. The closest park to this location is the Highlands Neighborhood Center. It is anticipated that the new residents allowed by this subdivision will use the existing City parks and recreational facilities. The Community Services Department has established a Parks Mitigation Fee of$530.76 per new single family lot. As three new lot are being created, the mitigation fee for this short plat will be 3 x$530.76 = $1,592.28. Schools: It is anticipated that the proposed short plat will only generate one new school age child. The Renton School District has the capacity to accept new students. Storm Water:This short plat may not create a large enough impervious surface area that is subject to vehicular travel to trigger the need for an on-site storm water system. Existing storm water sheet flows across the site. This action will continue after the new house is constructed on the site. If in the final analysis it is determined that the short plat will create over 5,000 sf of impervious area subject to vehicular travel, the applicant will need to construct a biofiltration system to the satisfaction of the Development Services Division. Water and Sanitary Sewer Utilities: Adequate water and sanitary sewer service exists in the adjacent streets. The applicant will need to provide service to the new lots and a sewer extension as shown on the short plat application. H. DECISION: The Short Plat, File No. LUA-98-032,SHPL, is approved subject to the following conditions: 1. The applicant shall submit a Transportation Mitigation Fee of$75.00 per average daily trip generated by the short plat (Estimated at$2,148.75) prior to the recording of the short plat., 2. Any new construction must have a fire hydrant capable of delivering a minimum of 1,000 GPM fire and shall be located within 300 feet of the structure. This distance is measured along a travel route. An additional fire hydrant may be required as a part of this project to meet this criteria. 10. Water System Development Charges of$850 per each new lot will be required for this project. The Development Charges are collected either as part of the construction permit (if there is one) or prior to the recording of the short plat. DRAINAGE: 1. The storm drainage narrative appears to be in order. 2. There is a storm drainage system in Monroe Ave NE. 3. The Surface Water System Development Charges of$385 per each new lot applies to the proposed project. The Development Charges are collected either as part of the construction permit (if there is one) or prior to the recording of the short plat. STREET IMPROVEMENTS: 1. A shared private driveway may be permitted for access up to two lots. The private access easement shall be a minimum of 20 feet in width, with a minimum of a twelve foot paved driveway. 2. Curbs, gutters, sidewalks and paving are required along NE 7th St. and along Monroe Ave NE adjacent to the project site. 3. Street lighting is not required for a 4 lot short plat. 4. The Traffic Mitigation Fee $2,148.75 shall be paid prior to recording of plat. GENERAL PLAN REVIEW COMMENTS: 1. The conceptual utility plan appears to be in order. 2. All required utility, drainage and street improvements will require separate plan submittals prepared according to City of Renton drafting standards by a licensed Civil Engineer. 3. Permit application must include an itemized cost estimate for these improvements. The fee for review and inspection of these improvement is 5% of the first $100,000 of the estimated construction costs; 4% of anything over$100,000 but less than $200,000, and 3% of anything over$200,000. Half of the fee must be paid upon application for building and construction permits, and the remainder when the permits are issued. There may be additional fees for water service related expenses. See Drafting Standards. FIRE PREVENTION 1. A fire hydrant with 1000 GPM fire flow is required within 300 feet of all new single family structures. The applicant should ask the city for an application for release of easement, if that process has not already been started. The release process can take two to three months to complete. The applicant also has the option of not releasing this easement at all. The existing easement can be amended to cover the larger area. Note all recorded easements,agreements, and restrictions on the drawing. Information needed for final short plat document approval includes the following: Note the City of Renton land use action number (LUA-98-032-SHPL) and the city's land record number(LND-20-0226)on the drawing. The type size for the land record number should be smaller than that used for the land use action number. Remove the topog lines,curbs and gutters, light standards, power poles,etc.from the final short plat drawing. Retain the references to all easements. Addressing for the lots will be available from the city as soon as possible. The addresses need to be noted on the drawing. This distance is measured along a travel route. An additional fire hydrant may be required as a part of this project to meet this criteria. • Water System Development Charges of $850 per each new lot will be required for this project. Pywell, AICP SUBJECT: Heifa Short Plat Pre-App 98-13 We have completed a preliminary review of the pre-application for the proposed development. The following comments on development and permitting issues are based on the pre-application submittals made to the City of Renton by the applicant. The applicant is cautioned that information contained in this summary may be subject to modification and/or concurrence by official decision makers (e.g., Hearing Examiner, Zoning Administrator, Board of Adjustment, Board of Public Works, and City Council). Review comments may also need to be revised based on site planning and other design changes required by City staff or made by the applicant. The applicant is encouraged to review all applicable sections of the Renton Municipal Code. 1. The applicant has two parcels of land that join at right angles at the rear of the existing parcels. The southern most property is approximately 100' in width by 200' feet in length and fronts on Monroe Ave. The northern parcel is slightly smaller in that it is 100' in width and 125' feet in length. There is an existing house on the southern parcel. Access to the existing house is obtained from Monroe Ave. The property is zoned R-8. 2. The R-8, single family residential zoning allows for the construction of single family homes on lots that have a minimum area of 4,500 square feet. Lots must have a minimum width of 50 feet and a minimum depth of 65 feet. All of the proposed lots meet or exceed the minimum requirements. 3. From the dimension provided it appears that the two parcels combined include an area of approximately 0.75 acres. The four lots proposed will provide a density of 5.3 units to the acre. Actual density is probably slightly higher. Four lot short plats need to provide a minimum density of five (5) units per acre.
