That said Grantor, for and in consideration of mutual benefits, does by these presents grant unto the
said Grantee a temporary easement for sidewalk and slope purposes with necessary appurtenances
thereto over, under, through, across and upon the property in King County, Washington that is
legally described in Exhibit A, attached, and graphically depicted on Exhibits B and C, attached.
This easement is for the purpose of constructing, improving,maintaining, and repairing sidewalk
and slope stabilization facilities over, under, and upon the temporary easement area described in
Exhibit A and graphically depicted on Exhibits B and C together with all necessary or convenient
appurtenances thereto without prior institution of any suit or proceedings of law and without
incurring any legal obligation or liability therefor. Following the initial construction of its
facilities, Grantee may from time to time construct such additional sidewalk and slope-related
facilities as it may require. This temparary easement is granted subject to the following terms and
conditions:
1. The Grantee shall, upon completion of any work within the property covered by the temporary
easement,restore the surface of the temparary easement, and any private improvements
disturbed or destroyed during execution of the work, as nearly as practicable to the condition
they were in immediately before commencement of the work or entry by the Grantee.
2. Grantor shall retain the right to use the surface and subsurface of the temporary easement as
long as such use does not interfere with the temporary easement rights granted to the Grantee.

This temporary easement shall run with the land described herein, and shall be binding upon the
parties, their heirs, successors in interest and assigns. Grantor covenants that it is the lawful owner
of the property legally-described on Exhibit A and graphically depicted on Exhibits B and C and
that it has a good and lawful right to execute this agreement.
This temporary easement shall remain in full force and effect until such time as Grantee obtains
permanent easement and fee simple right-of-way rights as a part of its Phase II Project for
Improvements on SR 169—Maple Valley Highway, at which time this easement shall
automatically terminate. Once that happens, within 60 days following written demand of the
Grantar(or Grantor's heirs, successors in interest or assigns), the Administrator of the City of
Renton Department of Planning/Building/Public Works or his/her designee shall execute and
deliver to Grantor in recordable form a written confirmation of such termination of this temporary
easement.
IN WITNESS WHEREOF, said Grantor has caused this instrument to be executed this 27th day of
October, 2004 and said Grantee has accepted this instrument on the terms set forth above.

TEMPORARY EASEMENT FOR SIDEWALK AND SLOPE
Legai Description
An easement over a portion of a parcel of land located in Government l.ot 7 and the
southwest quarter of the northeast quarter of Section 17, Township 23 North, Range 5 East,
W.M., said parcel more particularly described as follows:
A portion of a parcel of land described as Parcel A on Exhibit C to that certain Quit Claim
Deed recorded under Auditor's File No. 8803011522, records of King County, Washington.
Situate in the City of Renton, County of King, State of Washington.
Said easement more particularly described as follows:
COMMENCING at a stone monument in case which is the center of said
Section 17;
Thence South 89'46'22" East 872.40 feet along the quarter section line to a
point on the centerline of State Route 169, said point being Highway
Engineer's Station (HES) 1538+59.8 as per sheet 4 of 4, SR169 MP 23.69 to
MP 25.07 State Highway Right of Way Plan approved Feb. 18, 1971, and-a
point on a 10,000 foot radius curve, concave to the northeast, from which
point the radius bears North 48°25'44" East ;
Thence northwesterly along the arc of said centerline through a central angle
of 00'22'08" a distance of 64.41 feet to HES 1539+24.21;
Thence South 48°47'S2" West radial to said centerline 47.29 feet to the
POINT OF BEGINNING:
Thence South 46°07'00"West 18.38 feet;
Thence South 26°12'28"West 16.22 feet;
Thence South 86'10'30" East 50.02 feet to a point opposite centerline HES
1538+81.93 and 45.37 feet southwesterly therefrom, when measured radial
thereto;
Thence North 43°54'41" West 42.52 feet to the POINT OF BEGINNING.
Containing an area of 766 square feet, more or less.
