Home My WebLink AboutContractCAG—01—140AGREEMENTONTRANSFEROFWATERSERVICEBETWEENTHECITYOFRENTONANDBRYNMAWR-LAKERIDGEWATERANDSEWERDISTRICTTHISAGREEMENTisenteredintothis/9dayoft?i4zt,byandbetweentheCITYOFRENTON,aWashingtonmunicipalcorporation,her(nafterreferredtoas“City”andBRYNMAWR-LAKERIDGEWATERANDSEWERDISTRICT,aWashingtonmunicipalcorporation,hereinafterreferredtoas“District”,1.0WHEREAS,DistrictandCityaretheownersandoperatorsofwatersystemsinKingCounty,Washington.TheDistrict’scorporateboundaryoverlapsandlorisadjacenttoCity’scorporateboundary;andiiWHEREAS,Districtcurrentlyprovideswaterservicebya2-inchgalvanizedsteelwatermaintothefollowingthreeproperties,hereinafterreferredtoasthe“ThreeProperties”withinitscorporateboundariesattheaddresseslistedbelowandasshownonExhibit“A”:12812-84thAvenueSouth(KingCountytaxparcel#1823059222),12816—84thAvenueSouth(KingCountytaxparcel#1823059223),12818—84thAvenueSouth(taxparcel#1823059187),and2.1‘WI-IEREAS,theDistrict’s2-inchgalvanizedsteelwatermainisattheendofitsusefullife,hasbeensubjecttoseveralrecentbreaksandislocatedatashallowdepththatexposesittotheriskofadditionalbreaksandreplacementofthewatermainwouldbecostlytoservetheThreeProperties;and2.2WHEREAS,theCitycurrentlyprovideswaterservicewithinitscorporateboundariesbyanew8-inchductilewatermaininNW3rdCourt,asshownonExhibit“A”andconnectiontotheCity’smainwouldprovidetheThreePropertieswithdomesticwaterflow;and2.3WHEREAS,theDistrictandtheCitybelieveitwouldbeinthebestinterestoftheDistrict,theCityandtheThreePropertiesidentifiedinparagraph1.1abovetotransferwaterservicetoCity.TheCityisagreeabletoprovidingwaterservicefromthewatermaininNW3’Courtatthesamewaterrateasitprovideswaterservicetoitsin-citycustomers;and2.4WHEREAS,DistrictandCityareauthorizedbyChapter39.34RCWtoenterintointer-localagreementsforjointaction.Inconsiderationofthetermsandconditionscontainedherein,thepartiesnowagreeasfollows:2.1TheDistrictagreestotransfertotheCity,waterservicetotheThreePropertiesidentifiedinparagraph1.1aboveandExhibitA.InconsiderationoftheDistrict’stransferoftheThreeProperties,theCityshallacceptandprovidewaterservicetosuchproperties.TheCityshallinstallanewmeterforeachpropertyandbearfiftypercent(50%)ofallcostofconnectiontoitssystem,exceptasnotedbelow.TheDistrictshall,atitsexpense,removetheexistingmetersandprovideacopper“jumper”toconnecttothenewmeter.TheDistrictshallbearfiftypercent(50%)ofthenewmeterinstallationcosts.TheDistrictshallprovidepersonnelforandinspectthedisconnectionfromtheDistrict’swatermain.HJWATERJAGIBRYN-MAWRJSERVICETRANSFERAGREEMENT 2.2TheCityagreestoprovidewaterservicetotheThreePropertiesonthesamebasisaswaterserviceisprovidedtocustomerslocatedwithinitscorporateboundariesinaccordancewiththeCity’sordinances,resolutions,regulationsandcodes.TheCityagreesnottochargetheThreePropertiesanyneworadditionalconnectionchargetoreceivewaterservicefromtheCityinrecognitionandacknowledgementthatconnectionchargeswerepreviouslypaidtotheDistrictbysuchcustomers.2.3TheDistrictandtheCityagreethattheDistrict’stransferoftheabovecustomerstotheCitydoesnotconstitutetheassumptionofanyDistrictassets,facilitiesorindebtednessforthepurposesofChapter36.93RCW.ThisAgreementcomplieswithservicearearequirementsandisconsistentwiththe“AgreementforEstablishingWaterUtilityServiceAreaBoundaries”intheAmendedSkywayCoordinatedWaterSystemPlanauthorizedbyChapter70.116,RCW2.4ThepartiesagreetoeffectsuchtransferofcustomersfromDistricttoCitynolaterthantheISthdayofAugust2001;provided,however,intheeventanypartyotherthanDistrictorCitychallengesthecustomertransferprovidedherein,suchtransfershallbecomeeffectiveuponanydateasprovidedbylaworcourtorder.ThistransferdoesnotresultinthechangeofcorporateboundariesforeithertheDistrictortheCity.2.5ThepartiesagreetocooperatetoeffectthepurposesofthisAgreementandtoexecuteanyfurtheragreementsordocumentsrequiredforsuchcustomertransfer.TheDistrictshallprovidetheowners/residentsoftheThreePropertieswithmailednoticeregardingtheproposedchangeofwaterpurveyorfromtheDistricttotheCityatleast45daysbeforethedateofsuchtransfer.ThenoticeshallalsoprovideinformationastothemeetingdatebeforetheBoardofCommissionerswhereowners/residentswillhaveanopportunitytocommentonthetransfer.ThisAgreementmaybeterminatedinwholeorinpartbythewrittenconsentofthepartiesortheirsuccessorsininterest.2.6EachpartyshallapprovethisAgreementbyappropriateresolutionorordinanceandprovidetheotherpartywithacertifiedcopyofthesame.ThisAgreementshalltakeeffectuponitsapprovalbytheCityCouncilofCityaridtheDistrictBoardofCommissioners.EachpartyrepresentstotheotherthatithasthefullpowerandauthoritytoenterintothisAgreement.CITYFRENTONBRYNMAWR-LAKERIDWATESEWER-DISTRICT8/17/01BJesseTaner,MyorDated.By.GenalManagerDated____________________________N/AAttest:arilnetersen,CityClerkAttest:ApprovedastoLegalForm:WilliamSnellDistrictLegalCounselHJWA115RJAG/BRYN-MAWRJSERVICETRANSFERAGREEMENT 0)0)0Ea000.0)0aH)—riDJD.Cr,1’ICaLULLC’)zHuJC-)>LUU)LUFLUC,)000LUHLU0LU—Jz>-cci0U-z0HzLUU0>-.<F-H‘-‘IL)XF-Lu
