PUBLIC HEARING: After reviewing the Development Services Report, examining available information on file with the application, field checking the property and surrounding area;the Examiner conducted a public hearing on the subject as follows: MINUTES The following minutes are a summary of the July 20, 1999 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,July 20, 1999,at 9:00 a.m. in the Council Chambers on the seventh floor of the Renton City Hall. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit No. 1: Yellow file containing the original Exhibit No.2: Vicinity map/site plan application, proof of posting, proof of publication and other documentation pertinent to this request. Exhibit No.3: Zoning map Exhibit No.4: Lower level floor plan Exhibit No.5: Upper level floor plan Exhibit No.6: West elevation drawing The hearing opened with a presentation of the staff report by JENNIFER HENNING, Project Manager, Development Services,City of Renton, 1055 S Grady Way,Renton,Washington 98055. The applicant requests conditional use approval to enclose an existing courtyard. The project site is located in the Highlands neighborhood of the City. This project site is about 8 acres in size, with about two-thirds of the site undeveloped at this time. The proposed addition is located within the R-8 zone. The applicant is Highlands Community Church Larry Maison,Administrator Highlands Church Addition File No.: LUA-99-070,CU-H August 3, 1999 Page 2 proposing to add onto their structure by enclosing a courtyard which is located between two wings of existing buildings. This would add 550 square feet on two levels or about 1100 square feet of new floor area. This would permit the lobby near the sanctuary to be enlarged, three work stations within the structure would be relocated, and it would free up space so that two new office areas could be developed. The church library would also be relocated. This addition would permit three new staff members who would work during normal weekday business hours. The existing courtyard would have to be demolished, and if approved the project would begin this summer and last approximately 12 weeks. The Environmental Review Committee issued a Determination of Non-Significance -Mitigated with two conditions. One is to pay the applicable fire mitigation fee for the addition, and the other is to pay the appropriate transportation mitigation fee commensurate with the addition of building area. The Comprehensive Plan(CP)plans and policies support location of church structures and facilities in such a manner as to provide convenient transportation access to minimize adverse impacts on adjacent land uses. They also address parking for these types of uses. Parking spaces for the additional three employees are already provided. Development standards in the R-8 zone including setback and height restrictions are met with this proposal as they are within the footprint of the existing building. Because this is a minor addition, it is not considered to be a detriment to the surrounding area. There is a need for a larger gathering space outside the sanctuary and a need for that space to be enclosed, so it seems appropriate to enclose this courtyard space, as well as providing additional space for staff. This project does not change the character of the site or the neighborhood. Staff recommends approval of the proposal, subject to compliance with the ERC mitigation measures. Larry Maison, Highlands Community Church, 3031 10th Street, Renton, Washington 98056, applicant representative herein, stated that in 1996 the church had a fundraising project to remodel the current sanctuary as well as to expand the lobby and construct new offices. The sanctuary was remodeled in 1997 and this application will complete the second phase . Jay Wallace, 1207 N 33rd, Renton, Washington 98056, applicant architect herein, clarified that the new roof will be lower than adjacent structures. A mechanical unit is to be installed and will probably need to be screened with some type of parapet wall. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:30 a.m. FINDINGS,CONCLUSIONS&DECISION Having reviewed the record in this matter, the Examiner now makes and enters the following: Highlands Community Church Larry Maison,Administrator Highlands Church Addition File No.: LUA-99-070,CU-H August 3, 1999 Page 3 FINDINGS: 1. The applicant,Larry Maison,Administrator,Highlands Community Church, filed a request for approval of a Conditional Use Permit for a minor addition of approximately 1,100 square feet over two floors to an existing church structure. 2. The yellow file containing the staff report, the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 3. The Environmental Review Committee(ERC),the City's responsible official, issued a Declaration of Non-Significance-Mitigated(DNS-M)for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located at 3031 NE 10th Street. In addition to the 10th Street frontage, the subject site has frontage along Kirkland, east of the site, and NE 9th Street, south of the subject site. Sunset Boulevard NE is located a half block west of the subject site. 6. The subject site was annexed to the City with the adoption of Ordinance 1246 enacted in April 1946. 7. The subject site is located in two zoning districts. The eastern third of the subject site is zoned R-8 (Single Family; Lot size-4,500 sq.ft). The western two-thirds of the subject site is zoned CS(Center Suburban). 8. Single family uses are located east of the site, east of Kirkland Avenue and south of 9th. A variety of uses including multiple family uses and commercial uses are located north and west of the subject site. There is also vacant property west of the site. 9. The majority of the existing church building complex is located on the eastern portion of the site with parking and vacant property located generally on the western portion of the site. 10. The proposed expansion is located in an open courtyard area that is sandwiched between two wings of the existing church. The location is such that the expansion will be almost entirely invisible to passersby. It will be located on the west side of the complex away from the single family uses. 11. The footprint on the ground floor of the addition will be approximately 550 square feet. It will be a two-story addition. It will have a slightly rising roofline but will be approximately 28 feet tall. A parapet wall may be required to screen rooftop equipment. The addition's height will be less than the height of the existing main complex. The facade will be blended with that of the surrounding church facade. 12. Internally the modifications will allow an expanded lobby, the relocation of some work stations and the library, and create two new offices. 13. The new offices are expected to generate 3 new employees and a complementary 3 additional vehicle trips per day. The existing parking has been determined by staff to be more than adequate to serve the existing use and these new employees. Highlands Community Church Larry Maison,Administrator Highlands Church Addition File No.: LUA-99-070,CU-H August 3, 1999 Page 4 13. The proposed use itself provides more than adequate parking, providing 321 stalls whereas the sanctuary requires 300 stalls. 14. There was some concern expressed regarding the spillover of light onto adjoining residential area. CONCLUSIONS: 1. The applicant for a Conditional Use Permit must demonstrate that the use is in the public interest, will not impair the health, safety or welfare of the general public and is in compliance with the criteria found in Section 4-31-36(C)which provides in part that: a. The proposal generally conforms with the Comprehensive Plan; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking, unless otherwise permitted, will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. Landscaping shall be sufficient to buffer the use from rights-of-way and neighboring property where appropriate; and i. Adequate public services are available to serve the proposal. The requested conditional use appears appropriate. 2. The proposed expansion is a very modest enlargement of an existing church. The church is permitted in this location by the various Comprehensive Plan's policies and goals. This church has already received a Conditional Use Permit. The proposed expansion is similarly acceptable under the Comprehensive Plan. 3. This office rarely attempts to determine whether a given church is needed in a community. There is not an over-concentration of churches in this area and each denomination is entitled to appropriate respect. The proposed expansion is certainly quite limited. Its footprint of approximately 550 square feet and overall 1,100 square feet is very small. There should be little if any perceptible impacts from the proposed change. In addition, other than concerns about lighting, there was not much community concern about the proposed change in size--this for a use which has seen its share of controversy. 4. The modest facade change and the limited height coupled with the expansion's relatively hidden location on the commercial side of the complex will substantially limit its impacts, if any, on adjacent property. Highlands Community Church Larry Maison,Administrator Highlands Church Addition File No.: LUA-99-070,CU-H August 3, 1999 Page 5 5. Again, the modest expansion appears compatible to the adjacent residential areas that share its Zoning District. The nearby residential uses are located on the other side of the main church complex in any event and there should not be any visible impacts associated with the use. 6. The proposed use itself provides more than adequate parking and the approximately 3 new employees and their additional vehicle trips should have no discernable impacts. 7. The proposed expansion will not affect existing traffic patterns, driveway use or on-street parking, nor will it change on-site circulation. 8. While there may be some existing lighting and glare issues, it appears the applicant will be trying to address those. The current proposal shall not create any additional long term light, glare or noise issues. There will be some of the usual noises associated with the construction of the expansion. This is anticipated to last approximately 12 weeks. 9. The expansion does not seem to call for any additional landscaping. 10. There are adequate public services to serve the existing church complex and the expansion should not create any untoward demand on services. 11. In conclusion, there should not be much impact from this very limited expansion. It should not generally affect the site or surrounding community in any substantial fashion. I contacted Puget Sound Energy this morning and left a message with Mr. Gary Moritz regarding your concerns about the light glare. The church is willing to due whatever is necessary to correct this problem. In response to your second comment regarding the sanctuary seating, the church applied to the City of Renton for a building permit to remodel the church sanctuary to a 603 seating capacity room. The permit was issued on May 28, 1997, Permit# B960786. The seating capacity was improved by removing the fixed pews and installing interlocking chairs. Attachment: Letter Lloyd Hoshide to Ms. Jennifer Toth Henning, Project Manager; dated: June 14, 1999; Subject: Two Citizen Comments on Land Use Application LUA-99-070,CU,ECF. Dear Mr. Hearing Examiner: The undersigned submits written comments for subject Public Hearing. They are submitted to assure that the comments of Attachment are available to the Hearing Examiner for his consideration when reviewing subject Conditional Use Permit Application. In my opinion, inaction by the City of Renton on the light glare identified by Attachment could lead to an erroneous conclusion that the lights have been environmentally reviewed in this application. While the comments were available for the ERC review, no action on the glare resulted from their review. Should City Staff choose to not make a recommendation regarding the glare, then the undersigned requests that the Hearing Examiner establish a condition in the CUP requesting applicant to correct the glare. A second item, sanctuary seating, is also identified by Attachment. Since the number is at odds with the sanctuary capacity of the previous CUP, it would seem reasonable that rationale be provided for use of the new capacity number. Moreover, should the previous number be correct and the drawing in error then a correction to the drawing would seem in order. The undersigned has no further comments on the project and hopes the Hearing Examiner will grant the CUP while working out a resolution to the comments submitted. Maison on April 28,1999 and received by the City of Renton May 6,1999. Dear Ms. Henning: Your notice of application for subject project stated that an DNS Environmental Threshold Determination was likely to be issued. In my opinion, a Mitigated Determination of Non-Significance would be more appropriate for the reason outlined below. Question 11.b of reference 1.) was answered with an"N/A". It is my opinion that the answer does not adequately respond to question 11.b) because applicant has added at least(3) flood lights about his parking lot which produce glare. One flood light mounted on the 1st pole along Kirkland Ave.NE south of NE10th produces glare for one driving easterly on NE10th approaching the 4-way stop at Kirkland. A second flood light mounted along the westerly border of Applicant's lot adjacent to NE10th produces glare for one driving north on Kirkland Ave. NE and glancing westerly as one approaches the 4-way stop at NE 10th and Kirkland. A third flood light mounted on a pole just west of Jefferson Ave. NE along NE9th produces glare for one walking southerly along Kirkland Ave. NE from NE 10th as well as to those in the southeast part of the Safeway parking lot. The identified flood lights were not part of the Environmental Review of parking lot lighting when the CUP for their Christian Education Building was granted. Each Of the (3) flood lights affect the view and the glare for ones driving easterly on NE10th is particularly blinding. In my opinion, the latter condition is dangerous. A Mitigated Determination of Non-Significance directing applicant to redirect the identified flood lights to eliminate their glare would allow applicant to continue his project while correcting a problem for the neighborhood. As a second comment, please note that Applicant's drawing sheet A-1 under CODE SUMMARY refers to CUP CU-048-090 and identifies sanctuary seating at 600. This number is at odds with the City of Renton staff study conducted to determine parking requirements for ECF;R;CU-048-90 where sanctuary seating of 420 was used. Applicant did not question the use of the 420 figure at that time. One wonders how the increase to 600 was accomplished? Was there a CUP hearing or other process that authorized the increase? The lot sizes range between 4,550 sq. ft. and 5,888 sq. ft. The recreation Tract'A' is 5,905 sq. ft. Lots#1 and#6 would be accessed directly off SE 6th Street. Lots#2 through#5 would be accessed from a private street off SE 6th Street. The subject property currently consists of 4 lots approved under a short plat recorded in 1982. The existing short plat would be vacated concurrently with approval of this short plat application. The site is currently zoned Residential 8 DU/AC (R-8), with a pending rezone application to R-10. The applicant intends to record several covenants with the final short plat approval that implement agreements made with the City during the rezone application review. These covenants include a possible conversion of the recreation Tract'A' to a seventh residential lot, only after the rezone of the property from R-8 to R- 10 is complete. Another covenant would restrict the houses on the new lots to a single-story height. There would be a sunset clause that allows this height restriction to expire once the initial building permit is issued. A covenant would also require that all lots consist only of single family, detached residences. Location: SE 6th Street and Maplewood PI. SE. APPLICABLE SECTIONS OF THE COMPREHENSIVE PLAN: 1. Land Use Element - Religious Facilities Objective LU-MM: Site religious and ancillary facilities in a manner, which provides convenie transportation access and minimizes their adverse impacts on adjacent land uses. Policy LU-261: Parking should be provided on site a buffered from adjacent uses. F. DEPARTMENT ANALYSIS: 1. PROJECT DESCRIPTION/BACKGROUND Highlands Community Church proposes to enclose an approximate 550 square foot courtya between two wings of the existing 56,920 square foot church building. A total of approximate 1,100 s.f. of floor area would be created. This equates to approximately 550 square feet on eac i of two levels -- the lobby/sanctuary level, and the ground floor. The expanded area wou I provide a larger lobby outside of the sanctuary, move three work stations, create two ne offices, and relocate the church library. The roof over the newly created space would be low than the church's existing 27-foot high roof. Highlands Christian Church occupies 7.87 acres in the Highlands neighborhood. The site is sp by two zoning designations. Approximately 5 acres on the western two-thirds of the property 1 ; zoned Center Suburban, while the remaining 2.8 acres on the east is zoned Residential — Dwelling Units per Acre (R-8). The majority of the existing church structure is located within tt R-8 Zone. And, all of the proposed building addition is located within the R-8 Zone. The applicant estimates that up to three new staff members could be accommodated in the ne i office/work stations created by the proposal. Up to three additional cars would be added to It parking lot during normal business hours on weekdays. The project includes demolition of an existing 550 s.f. paved courtyard. Construction woul i occur within the footprint of the existing church structure. Construction is anticipated to beg i during the summer of 1999 and last approximately 12 weeks. The proposal would expand i church approved subject to a Conditional Use Permit. Therefore, an additional conditional u:: permit and environmental review is required. City of Renton P/B/PW Department Preliminary Report to the Hearing Examin HIGHLANDS COMMUNITY CHURCH ADDITION LUA-99-070, CU-H, EC PUBLIC HEARING DATE: JULY 20, 1999 Page 4 o, 2. ENVIRONMENTAL REVIEW Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 z ; amended), on June 15, 1999 the Environmental Review Committee issued a Determination Non-Significance - Mitigated (DNS-M). The appeal period for the environmental determinatic ended on July 6, 1999. No appeals of the environmental determination were filed. 3. COMPLIANCE WITH ERC MITIGATION MEASURES The Environmental Review Committee issued a Determination of Non-Significance - Mitigated with two mitigation measures as shown below. The applicant's compliance with each of the measures is also indicated. 1. The applicant shall pay the appropriate Fire Mitigation Fee at the rate of$0.52 per square foot of new construction. The fee is due prior to the issuance of the building permit. The applicant intends to comply with this mitigation measure. 2. The applicant shall pay the appropriate Transportation Mitigation Fee at the rate of $75.00 per each new average weekday trip attributed to the proposal. The fee is due prior to the issuance of the building permit. The applicant intends to comply with this mitigation measure. 4. STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials t identify and address site plan issues from the proposed development. These comments ar contained in the official file, and the essence of the comments has been incorporated into th appropriate sections of this report and the Departmental Recommendation at the end of thu report. 5. CONSISTENCY WITH CONDITIONAL USE CRITERIA Section 4-9-030:G lists 11 criteria that the Hearing Examiner is asked to consider, along with other relevant information, in making a decision on a Conditional Use application. These inclua the following: (5A) CONSISTENCY WITH THE COMP. PLAN, ZONING CODE& OTHER ORDINANCES: The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City of Renton. (1) COMPREHENSIVE PLAN LAND USE ELEMENT Policies of the Land Use Element of the Comprehensive Plan address community facilities such as schools and churches. The siting of religious facilities is discussed in Objective LU-MM which states that such facilities should be sited in a manner which provides convenient transportation access and minimizes their adverse impacts on adjacent land uses. Policy LU-261 states that parking should be provided on site and buffered from adjacent uses. City of Renton P/B/PW Department Preliminary Report to the Hearing Examiner HIGHLANDS COMMUNITY CHURCH ADDITION LUA-99-070, CU-H, ECF PUBLIC HEARING DATE: JULY 20, 1999 Page 5 ot8 The proposal for the Highlands Community Church Addition appears to be consistent with policies addressing religious facilities. (2) ZONING CODE Approximately 2.8 acres of the subject site is zoned Residential - 8 Dwelling Units per Acre (R-8), and about 5 acres is zoned Center Suburban (CS). Churches are permitted in both the R-8 and CS zones subject to the approval of a Conditional Use Permit by the Hearing Examiner. The proposal would result in the expansion of the size of the existing church building in order to expand the lobby, add offices, relocate work stations and relocate the library. This expansion/intensification of a conditional use on the site triggers an additional Conditional Use Permit. The addition to the existing structure would occur on that portion of the site zoned R-8, therefore, the analysis of compliance with the Zoning Code with the R-8 Zon Development standards of the R-8 Zone require minimum front yard setbacks of 20 fe,. from the property line, minimum rear yard setbacks of 20 feet, and minimum side yard setbacks of 15 feet for corner lots. The minimum sideyard setback for interior lots is 5 feet. In the R-8 Zone, the height of the structure is limited to two stories or 30 fec Maximum lot coverage (building) is limited to 35% of the total lot area for parcels ovi 5,000 s.f. in size. The proposal would not change the existing building setbacks as the addition wou occur in an area that presently functions as an interior courtyard. Neither would tt existing building height increase. The proposed addition would increase the building I coverage by about 550 square feet, but would not expand the building footprint. As proposed, the Highlands Community Church would meet the development standar( of the R-8 Zone. (3) PARKING AND LOADING ORDINANCE The Parking and Loading Ordinance requires that churches provide one parking stall f,. each fixed seat in the main sanctuary. Parking is also required for educational ar I office uses that occur on site. Previous Conditional Use Permits have considered tt total amount of required parking for the Highlands Community Church. According to tt , codes and conditions of previous conditional use permits issued to the church, If amount of required parking is 295 parking stalls. The current proposal would increa the amount of required parking by a minimum of 4 parking stalls and a maximum of 5 parking spaces, or a total of 299 to 300 stalls. Since 321 parking stalls are current y provided on the property, no additional parking would be required to be developed s part of this application. (58) COMMUNITY NEED: There shall be a community need for the proposed use at the proposed location. In ti , determination of community need, the Hearing Examiner shall consider the following factor among all other relevant information: (a) The proposed location shall not result in either the detrimental over concentration of 1 particular use within the City or within the immediate area of the proposed use. The proposal would not result in detrimental impacts to the immediate surrounding area. Most of the proposed revisions would occur within the existing building and would not be evident from off-site areas. The expansion of facilities would add approximately 1,1C i square feet of floor area and would accommodate up to an additional three employees t the church. This incremental intensification of a conditional use and the addition of thr e employees are not expected to result in an overconcentration of a particular use with n the City or the immediate area. City of Renton P/B/PW Department Preliminary Report to the Hearing Examir HIGHLANDS COMMUNITY CHURCH ADDITION LUA-99-070, CU-H, E( PUBLIC HEARING DATE: JULY 20, 1999 Page 6 0 3 (2) That the proposed location is suited for the proposed use. The proposed church addition appears to be an appropriate expansion of the condition I use on the site. The addition would not be evident to the neighborhood, except when construction is underway. The footprint of the building would not increase, and tl-e addition would not be visible from the surrounding streets. The project would result n tenant improvements for the improved operation of the facility. The existing structure s setback from the street and surrounded by a parking areas and landscaping. (5C) EFFECT ON ADJACENT PROPERTIES: The proposed use at the proposed location shall not result in substantial or undue adverse effects on adjacent property. The following site requirements shall be required: (1) Lot Coverage: Lot coverage shall conform to the requirements of zone in which tf proposed use is to be located. The applicant estimates that the building footprint occupies approximately 9.2% of tt site. This is less than the 35% lot coverage permitted in the R-8 Zone. The addition approximately 550 square feet to the building footprint would only slightly increase I coverage, but would not exceed limits specified in the zone. (2) Yards: Yards shall conform to the requirements of the zone in which the proposed use s to be located. Additions to the structure shall not be allowed in any required yard. The proposal would not result in encroachments into any required setback areas since change in the building footprint is proposed. (3) Height: Building and structure heights shall conform to the requirements of the zone which the proposed use is to be located. Spires, belltowers, public utility antennas similar structure may exceed the height requirement upon approval of a varianc Building heights should be related to surrounding used in order to allow optimal sunlig and ventilation, and minimal obstruction of views from adjacent structures. The existing structures do not exceed the 30 feet or two-story limit of the R-8 Zone. Tt existing structure is approximately 27 feet in height. The addition would be lower thli the existing church building. (5D) COMPATIBILITY: The proposed use shall be compatible with the residential scale and character of ft neighborhood. (Ord. 3599, 1-11-82) The proposal would not change the character of the site or neighborhood. The request( I Conditional Use Permit would allow the church to construct an addition to relocate office ar I library facilities, and expand a lobby, consistent with the operation of the church. (5E) PARKING: Parking under the building structure should be encouraged. Lot coverage may be increased • as much as seventy-five percent(75%) of the lot coverage requirement of the zone, in which t proposed use is located, if all parking is provided underground or within the structure. (Ors.. 3903, 4-22-85) Parking would continue to be provided in surface parking areas located on the site. A total 32 parking stalls exist. Previous conditional use permits have required a total of 295 parking stall . The addition of 1,070 square feet of office would require a minimum of 4 and a maximum of • additional parking stalls, for a total requirement of 299 to 300 parking stalls. City of Renton P/B/PW Department Preliminary Report to the Hearing Examir HIGHLANDS COMMUNITY CHURCH ADDITION LUA-99-070, CU-H, E( PUBLIC HEARING DATE: JULY 20, 1999 Page 7 o I (5F) TRAFFIC: Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use ai I surrounding area shall be reviewed for potential effects on, and to ensure safe movement in tl surrounding area. The existing driveways from NE 10th Street, Kirkland Avenue NE, and NE 9th Street would continue to be used for access to the site. Internal site circulation is accomplished via a two-way circulation aisle within the parking lots. Parking and loading areas located adjacent to te existing buildings would continue to function as parking lots for the church use. (5G) NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. Operation of the proposed building addition would not increase noise, light or glare on the site. Noise would increase during the 12-week construction period. The noise impacts are considers i to be short-term in nature and would not be unlike the type of noise generated by typic I residential construction projects. (5H) LANDSCAPING: Landscaping shall be provided in all areas not occupied by building or paving. The Hearii I Examiner may require additional landscaping to buffer adjacent properties from potentia r adverse effects of the proposed use. The site is presently landscaped in developed areas. Undeveloped portions of the property ( 1 the west are planted in grass and scrub vegetation and would not be disturbed as a result of tl proposal. (51) ACCESSORY USES: Accessory uses to conditional uses such as day schools, auditoriums used for social and spc t activities, health centers, convents, preschool facilities, convalescent homes and others of 3 similar nature shall be considered to be separate uses and shall be subject to the provisions f the use district in which they are located. The proposal would enclose a courtyard, expand the lobby area, more three work stations, crate two new offices, and relocate the church library. The Highlands Community Church would continue to occupy and operate on the site. The tenant improvement triggers the need fo(a conditional use permit, separate from any previous special permit or conditional use permit that would have been required for the church. (5J) CONVERSION: No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the provisions of this Chapter. Not applicable. (5K) PUBLIC IMPROVEMENTS: The proposed use and location shall be adequately served by and not impose an undue burd n on any public improvements, facilities, utilities, and services. Approval of a conditional use per it City of Renton P/B/PW Department Preliminary Report to the Hearing Examin HIGHLANDS COMMUNITY CHURCH ADDITION LUA-99-070, CU-H, EC PUBLIC HEARING DATE: JULY 20, 1999 Page 8 o, may be conditional upon the provision and/or guarantee by the applicant of necessary pubs improvements, facilities, utilities, and/or services. BACKGROUND ERC MEETING DATE June 15, 1999 Project Name Highlands Community Church Addition Applicant Larry Maison, Administrator Highlands Community Church 14021 143rd Avenue SE Renton, WA 98059 File Number LUA-099-070,CU-H, ECF Project Manager Jennifer Henning Project Description Highlands Community Church proposes to enclose an approximate 550 square foot courtyard between two wings of the existing church building. A total of approximately 1,100 s.f. of floor area would be created on two levels, the lobby/sanctuary level, and the ground floor. The expanded area would provide a larger lobby outside of the sanctuary, to move three work stations, create two new offices, and relocate the church library. The roof over the newly created space would be lower than the church's existing roof. Applicant estimates that up to three new staff members would be accommodated in the new office/work stations. Up to three additional cars would be added to the parking lot during normal business hours on weekdays. The project includes demolition of the existing 550 s.f. paved courtyard. Constructior would occur within the footprint of the existing church structure. Construction is anticipated to begin during the summer of 1999 and last approximately 12 weeks. The proposal would expand a church approved subject to a conditional use permit, therefore, and an additional Hearing Examiner Conditional Use Permit and Environmental Review is required. ENVIRONMENTAL IMPACTS In compliance with RCW 43.21 C. 240, the following project environmental review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. 1. Earth Impacts: The church addition would be constructed in an outdoor courtyard that is paved. While no grading is proposed, any disturbance of the earth or stockpiling of earth in conjunction with the proposal could result in erosion or sedimentation. In order to contain disturbed or stockpiled material, staff recommends that temporary erosion control measures be installed and maintained to the satisfaction of the Development Services Division. This should be accomplished for the duration of the project. These measures are required by City Code; therefore, no further mitigation is required. Mitigation Measures: No further mitigation required. Nexus: Not applicable. 2. Emergency Services—Fire Prevention Impacts: The proposal would result in the construction of an additional 1,100 square feet of building area within the existing structure. Code requires that all fire sprinkler and alarm systems be extended to the addition. In addition, the City requires that a Fire Mitigation Fee be paid for all new non-residential construction. The applicable Fire Mitigation Fee is $0.52 per square foot of new construction, and is due prior to the issuance of the Building Permit. Mitigation Measures: The applicant shall pay the appropriate Fire Mitigation Fee at the rate of$0.52 per square foot of new construction. The fee is due prior to the issuance of the building permit. Nexus: Environmental (SEPA) Ordinance, Fire Mitigation Fee adopting resolution 3. Transportation and Streets Impacts: The proposal would increase the area of the existing church facility and add offices/work stations that could accommodate up to three additional employees. A Transportation Mitigation Fee is required by the City for new construction. The fee is equivalent to $75.00 per each new average weekday trip that is attributable to the proposal. Since a total of 1,100 square feet of new floor area is being added to the church, the Institute of Transportation Engineers (ITE) Manual indicates that the resulting trip ratio is 10.252 new average weekday trips. The applicable Transportation Mitigation Fee is estimated to be $768.90 (10.252 x$75.00/trip = $768.90). The fee is due prior to the issuance of building permits. Two hundred ninety five (295) parking stalls are required on the site based on current use and previous conditions o approval as required by the Hearing Examiner. The proposal would increase parking demand by approximately thre spaces. At this time, a total of 321 vehicle parking stalls are available on the site. No new parking stalls would need to be added for the proposal. Question 11.b of reference 1.)was answered with an"N/A". It is my opinion that the answer does not adequately respond to question 11.b)because applicant has added at least(3) flood lights about his parking lot which produce glare. One flood light mounted on the 1st pole along Kirkland Ave.NE south of NElOth produces glare for one driving easterly on NE 10th approaching the 4-way stop at Kirkland. A second flood light mounted along the westerly border of Applicant's lot adjacent to NE 10th produces glare for one driving north on Kirkland Ave.NE and glancing westerly as one approaches the 4-way stop at NElOth and Kirkland. A third flood light mounted on a pole just west of Jefferson Ave.NE along NE9th produces glare for one walking southerly along Kirkland Ave.NE from NE 10th as well as to those in the southeast part of the Safeway parking lot. The identified flood lights were not part of the Environmental Review of parking lot lighting when the CUP for their Christian Education Building was granted. Each of the(3)flood lights affect the view and the glare for ones driving easterly on NE10th is particularly blinding. This is being done to allow the church to expand its lobby to reduce congestion before and after the weekend services and to improve the ingress and egress from the sanctuary. To expand the lobby, two existing offices will be relocated to the proposed enclosed 550 square feet space located between the two existing wing of the church structure. Three additional workstations will be added between the two offices. The ground floor space will be used to relocate the church library. The City of Renton has established certain submittal requirements for conditional use permits. One of these requirements is a statement justifying the conditional use permit request. The basis for this requirement is the burden of proof as to the appropriateness of the application for a conditional use permit lies with the applicant. Among other thins, this justification is suppose to address the comprehensive plan, the community need for the proposed use as the proposed location, and the impacts of the proposed use on adjacent properties. The overall plan consist of the following: a. Expansion of the church lobby by relocating two existing offices to the west in the open space between two wings of the existing church structure. b. Three additional workstations in a workroom will be added between the two offices. c. The ground floor space will be used to relocate the church library. d. Our current library will be converted into two additional offices. e. Widening the stairs to the ground level. The facilities described above will be used for religious purpose and administrative support. 3031 NE Tenth Street, Renton, WA 98056-3131 phone 425.255-4751 fax 425.255-5460 As shown on the application, environmental checklist and plans, our campus consist of the following: R8 Zone 2.79 acres 121,532 sq. ft CS Zone 5.08 acres 212,495 sq. ft TOTAL 7.87 acres 334,027 sq. ft The existing campus consists of church buildings, landscaping, parking areas and vacant land. There are no wetlands, steep slopes or water bodies on the campus. There will be no view blockage by the lobby/office remodel. It will be hidden between the two wings of the church structure on the north and south, the sanctuary on the east and the sky bridge on the west. Height: R8 Zone 27 feet (approximate) New Addition Floor Area: 550 sq. ft sanctuary level 550 sq. ft ground level 1,100 sq. ft Lot Coverage: Allowed: 35% max building area Proposed: 17.4% building area Proposed: 9.2% building footprint area Parking: 54 spaces - North lot 267 spaces - South lot 321 spaces Access: NW - Index Avenue (private) N - N.E. 10`h Street NE - Kirkland Avenue E - Kirkland Avenue S - NE 9th Street Addressing the review criteria: a. Lot Coverage: The Lobby/Office remodel is an enclosed 550 sq. ft addition within the footprint of the existing church structure and conforms to the zone requirements. b. Yards: Conforms to the requirements of the zone. c. Height: The proposed Lobby/Office remodel will be approximately 27 ft high and will not exceed zone requirements. It will not cause any view blockage since it is within the footprint of the current church structure. d. Compatibility: The Lobby/Office remodel will be compatible with the current structure and will have an insignificant affect on adjacent properties. e. Parking: The Lobby/Office remodel will have no affect on parking during peak weekend service hours. It will have an insignificant effect on parking during the Monday through Friday work week as the church anticipates hiring 3 additional employees. Staff parking occurs on the North 54 space parking lot during the work week. The church currently employees 28 full-time or part-time permanent employees who work at different shifts throughout the day during the work week. f. Traffic: The Lobby/Office remodel will have no affect on traffic during peak weekend service hours. It will have an insignificant affect during the Monday through Friday work week. g. Noise, Glare: There will be no noise or glare impact with the proposed remodel project. h. Landscaping: There is an existing paved asphalt court where the enclosed remodel is proposed. An existing play station slightly west of the remodel will remain. i. Accessory Uses: The Lobby/Office remodel is for religious purpose administrative support. There are no additional uses with this remodel. j. Conversion: The proposed Lobby/Office remodel will be constructed compatible to the existing church structure complying with city building codes. k. Public Improvement: The proposed Lobby/Office remodel will be a significant public improvement since it will enhance egress in case of an emergency. It will have an insignificant impact on or impose any undue burden on adjacent properties since it will be built within the current footprint of the existing church structure. The analysis of this project demonstrates that it is entirely in compliance with applicable land use regulations, and in keeping with the policies of the comprehensive plan. The project has been designed to comply with all zoning regulations. These regulations implement the comprehensive plan policies and compliance with these regulations is, therefore, sufficient to demonstrate compliance with the comprehensive plan. The proposed facility is partially located on property that is zoned for residential purposes. Relatively intense commercial and multi-family development exist to the west and north of the Church campus. The use of this property for religious worship and education creates a buffer between the existing single-family residential uses to the east and south. The proposed project will have an insignificant affect on adjacent properties. The proposed Lobby/Office remodel will not generate more traffic nor demand a need for additional parking during the peak weekend service times, and will have only an insignificant affect on the Monday through Friday work week. There is no need to conclude that this will significantly affect the use of adjacent properties. The peak use of the facility will generally be limited to weekend services and religious holidays. Traffic levels on the nearby road network during times of expected peak use of the church facility are extremely low and will continue to be within established levels of service. Off-site impacts will be negligible except for times of peak use. "to cerely, OA( 04111,\4 11141. The enclosed area would allow an expansion on two floors—the ground floor and the lobby/sanctuary level—for a total of approximately 1,100 square feet of additional space. The roof of the new space would be lower than the church's existing roof The primary purpose of this project is to provide a larger lobby outside of the sanctuary by relocating two offices located adjacent to the church lobby to the new space. Three additional workstations will be added in a workroom between the two offices. The ground floor space would be used to relocate the church library. Our current library would be converted into two additional offices. Also included in this renovation would be widening the stairs in the lobby that lead to the ground level and widening the hallway between the lobby and the Fellowship Hall. Currently the church has two offices adjacent to its existing lobby outside the church sanctuary. These offices total approximately 320 square feet in size. The lobby area often becomes congested before and, in particular, after weekend services as members of the congregation meet and stop to chat with each other. The purpose of relocating these offices is to create a larger lobby in order to reduce congestion,to allow the informal contact between members of the congregation—an important aspect of creating and sustaining a community of faith—and to allow other members of the congregation to come and go from the sanctuary in an efficient and orderly manner. The enlarged lobby will also improve emergency egress from the sanctuary. The project will allow us to create additional workstations and offices for a growing staff. The two current offices are used by employees to perform various administrative functions. The additional space for church staff and an increase in staff size by up to three new staff members would add some additional cars to the church parking lot during 3031 NE Tenth Street, Renton, WA 98056-3131 phone 425.255-4751 fax 425.255-5460 1 City of Renton May 4, 1999 Page 2 normal business hours on weekdays. It is not expected to add any vehicles during peak use periods; that is, during worship services on the weekend. The church does not anticipate any significant impacts as a result of this construction. This addition will increase the size of the church's lobby and provide two additional offices and three additional workstations. This increase in the size of the lobby and the additional offices is not anticipated to have any significant impacts associated with it since attendance at services is limited by the size of the sanctuary, which will not be increased. Since the proposal would simply provide more space within which to perform existing functions, there will be no increase in traffic or demand for parking during periods of peak use associated with this proposal. Since the traffic and parking impacts of the church during normal business hours on weekdays are minimal, there is no significant impact associated with this minor action. The church currently provides significantly more parking on-site than is required by City code. The church will continue to meet City parking requirements after completion of this addition. The proposed 12-week construction project is schedule to begin in late July 1999. Hours of operation will be Monday through Saturday from 8 a.m. to 6 p.m. The amount of demolition for the 550 sq. ft paved court will be insignificant and will not impact traffic. The construction is enclosed within the footprint of the existing church structure so noise will have an insignificant affect on adjacent properties. S'io erely, Ana#11 , aison 411,in' ator CITY OF RENTON DEVELOPMENT SERVICES DIVISION ENVIRONMENTAL CHECKLIST PURPOSE OF CHECKLIST: The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental agencies to consider the environmental impacts of a proposal before making decisions. An Environmental Impact Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required. INSTRUCTIONS FOR APPLICANTS: This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should be able to answer the questions from your own observations or project plans without the need to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write "do not know" or"does not apply". Complete answers to the questions now may avoid unnecessary delays later. Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations. Answer these questions if you can. If you have problems, the governmental agencies can assist you. The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of time or on different parcels of land. Attach any additional information that will help describe your proposal or its environmental effects. The agency to which you submit this checklist may ask you to explain your answers or provide additional information reasonably related to determining if there may be significant adverse impact. USE OF CHECKLIST FOR NONPROJECT PROPOSALS: Complete this checklist for nonproject proposals, even though questions may be answered "does not apply." IN ADDITION, complete the SUPPLEMENTAL SHEET FOR NONPROJECT ACTIONS (part D). For nonproject actions (actions involving decisions on policies, plans and programs), the references in the checklist to the words "project," "applicant," and "property or site" should be read as "proposal," "proposer," and "affected geographic area," respectively. We have completed a preliminary review of the pre-application materials for the above- referenced development proposal. The following comments on development and permitting issues are based on the pre-application submittals made to the City of Renton by the applicant. The applicant is cautioned that information contained in this summary may be subject to modification and/or concurrence by official decision makers (e.g.,Hearing Examiner,Zoning Administrator, Board of Adjustment, Board of Public Works, and City Council). Review comments may also need to be revised based on site planning and other design changes required by City staff or made by the applicant. The applicant is encouraged to review all applicable sections of the Renton Municipal Code. As we understand the project proposal,Highlands Christian Church intends to enclose approximately 550 square feet of space located between two wings of the church. The additional space would be improved for offices, enlarged restrooms, church library. Tenant improvements would occur on two- levels with the library on the ground floor level and offices/restrooms on the upper level. Zoning. The portion of the site that is proposed for expansion is zoned R-8, a single family residential zone. Churches are permitted subject to a Conditional Use Permit. The church has previously been granted a Conditional Use Permit, however, the proposed expansion would trigger an additional CUP. It appears that the setbacks of the R-8 Zone would be met, as the expansion would occur within the footprint of the existing church structure. Environmental Review. Since the project would be an expansion of an existing use permitted under a Conditional Use Permit, the proposal is subject to environmental review(SEPA). An environmental checklist will need to be filled out and submitted with the application, and the appropriate fee paid. Expected mitigation measures that could apply to the proposal include Fire Mitigation Fee at the rate of$0.52 per each square foot of new construction(approx. 1,100 s.f.), and possibly additional traffic mitigation fees. Conditional Use Permit. A public hearing with the City's Hearing Examiner is required for the Conditional Use Permit. As part of the justification for the CUP, you should submit a parking analysis. \\TS SERVER\SYS2\COMMON\H:\DIVISION.S\DEVELOP.SER\DEV&PLAN.ING\PROJECTS\98-123.TTH\HGLNDS.DOC April 1, 1999 Page 2 Parking and Loading. Churches are required to have one parking stall for each fixed seat in the main sanctuary or auditorium. Offices require a minimum of 3 parking stalls for each 1,000 gross square feet(gsf)of floor area and a maximum of 4.5 parking spaces for each 1,000 gsf of floor area. For the purposes of calculating required parking, gross floor area is defined as the main areas o the building that are occupied. It does not include accessory areas ordinarily used by the occupant such as rest rooms, stairs, shafts, wall thickness, corridors, lobbies and mechanical rooms. Schedule. The combined land use approval process is expected to take approximately 12 weeks to complete. • qq - c AiroN MEMORANDUM T {' Cil,. • DATE: tvtA C-k 9 Cr 9 TO: Construction Services, Fire Prevention, Plan Review, Project Planner - FROM: Jim Hanson, Development Services` (Division Director f, 1 SUBJECT: New Preliminary Application: iG+ k\D5 t C-`vR ci LOCATION: Z0 6 A meeting with the applicant has been scheduled for Z^00 VM, Thursday, for one of the 6th floor conference rooms (new city hall).
