THIS INSTRUMENT, made this�'J�' day of�d1� vt+-f 2007, by and between Kenneth
Lee, as his separate estate, thereinafter called the "Grantor", and t e CITY OF RENTON, a municipal
corporation of the State of Washington,hereinafter called the"Grantee",
WITNESSETH:
The Grantor, for and in consideration of the public good and other valuable consideration, does
by these presents, conveys and warrants unt� t}:A C:zntee an easement for public and private utility
purposes (including but not limited to water, sewer, electric power, natural gas, telephone,
telecommunications, fiber optics, and cable television together with the right of Grantee to grant
easements and franchises to public and private utilities), street lighting and other roadway improvements
with necessary appurtenances over, under, through, across and upon the following described real estate
("Property"herein)situated in the County of King, State of Washington:
The land referred to in this commitment is situated in the State of
Washington, and described as follows:
That portion of Tract 2, Joseph P. Marshall Tracts, according to the plat thereof recorded in
Yolume 38 of Plats,page 30, in King County, Washington, described as follows:
Beginning at the northwest corner of said Tract 2;
Thence south 4°59'22"west along the west line of said tract, a distance of 147.99 feet;
Thence south 87°35'17"east parallel with the north line of said tract, a distance of 126.70 feet;

Thence north 2°24'41"east, a distance of 147.84 feet to a point on said north line;
Thence north 87°35'19"west along said north line, a distance of 120.00 feet to the point of
beginning.
Situate in the Southwest Quarter of Section 3, Township 23 North, Range 5 East, W. M. in the
City of Renton, King County, Washington.
Except as may be otherwise set forth herein, Grantee's rights shall be exercised upon that
portion of the Property("Easement Area"herein)described as follows:
Beginning at a point 42.00 feet right and perpendicular to the centerline of Duvall Ave Northeast
at A station 188+85.19, per DUVALL AVENUE NE/COAL CREEK PARKWAY SE
RECONSTRUCTION PROJECT RIGHT-OF-WAY PLANS-CITY OF RENTON dated October Sth
2005, and revised on December 23rd 2006, records of the City o�R�nton under file number TED
40-2952, said point being the northwest corner of the property and the TRUE POINT OF
BEGINNING.
Thence south 04°SS'30"west 14.00 feet along the west property line.
Thence south 85°04'30"east 5.00 feet.
Thence north 04°SS'30"east 14.22 feet to the north property line.
Thence north 87°38'43" west 5.01 feet along the north property line to the TRUE POINT OF
BEGINNING.
Containing 71 square feet more or less.
Following the initial construction of all or a portion of its systems, Grantee may, from
time to time, construct, maintain, repair, or alter such additional facilities as it may require for
such systems. Grantee shall have the right of access to the Easement Area over and across the
Property to enable Grantee to exercise its rights hereunder. Grantee shall compensate Grantar
for any damage to the Property caused by the exercise of such right of access by Grantee.
Grantee shall have the right to cut, remove and dispose of any and all brush, trees, or
other vegetation in the Easement Area. Grantee shall also have the right to control, on a
continuing basis and by any prudent and reasonable means, the establishment and growth of
brush,trees or other vegetation in the Easement Area.
Grantor reserves the right to use the Easement Area for any purpose not inconsistent with
the rights herein granted, provided, however, Grantor shall not construct or maintain any
buildings, structures, or other objects on the Easement Area and Grantor shall do no blasting
within 300 feet of Grantee's facilities without Grantee's prior written consent.
This easement shall be a covenant running with the land and shall be binding on the
Grantor and Grantor's successors, heirs and assigns. Grantor covenants that Grantor is the
lawful owner of the above described property and has a good and lawful right to execute this
easement.
