LEGAL DESCRIPTION: A portion of the Southwest Quarter of Section 8,Township 23 North,Range 5 East,W.M.,in the City of Renton,King County,Washington. For the purpose of constructing,reconstructing,installing,repairing,replacing,enlarging,operating and maintaining signage,together with the right of ingress and egress thereto without prior institution of any suit or proceedings of law and without incurring any legal obligation or liability therefor except as provided herein. Following the initial construction,Grantee may from time to time construct such additional facilities as it may require. This easement is granted subject to the following terms and conditions: 1. The Grantee shall,upon completion of any work within the property covered by the easement,restore the surface of the easement,and any private improvements disturbed or destroyed during execution of the work,as nearly as practicable to the condition they were in immediately before commencement of the work or entry by the Grantee. 2. Grantor shall retain the right to use the surface of the easement as long as such use does not interfere with the easement rights granted to the Grantee. Grantor sha�l not,however,have the right to: a. Erect or maintain any buildings or structures within the easement unless approved by the Grantee;or b. Plant trees,shrubs or vegetation having deep root patterns which may cause damage to or interfere with the signage to be placed within the easement by the Grantee or which interfere with the visual lines to the sign;or c. Develop,landscape,or beautify the easement area in any way which would unreasonably increase the costs to the Grantee of restoring the easement area and any private improvements therein. 3. Grantor shall be authorized to relocate the signage,at Grantor's expense,upon redevelopment of the property 10 a location agreed upon by the Grantee. City of Renton,a Municipal Corporation Grantee shall indemnify,defend,and hold harmless the Grantor,its directors,officers,employees,agents, contractors,invitees,successors and assigns,from and against any and all claims,liabilities,and costs (including the cost of establishing the right to indemnification hereunder)for bodily injury or property damage arising out the use of the Easement Area or the presence on the Easement Area of Grantee or any of its ot�icials,officers,agents,employees,contractors,invitees,successors and assigns,except to the exztent that such claims,liabilities,and costs are the direct and proximate result of the negligence or willful misconduct of Grantor,its directors,officers,employees,agents,contractors,invitees,successors and assigns. Grantee will use the Easement Area in compliance with all applicable laws,including without limitation all laws regulating the use of hazardous materials or dangerous wastes,and will indemnify,defend,and hold harmless Grantor,its directors,of�icers,employess,contractors,invitees,successors and assigns against any and all claims,liabilities,and costs(including the cost of establishing the right to indemnification hereunder) arising out of any use,distribution,handling,transportation,release,or disposal by the Grantee or any of its officials,o�cers,agents,employees,contractors,invitees,successors and assigns of any hazardous materials, dangerous wastes,or any other substance regulated by any law relating to the protection of the environment or of human health. This easement shall run with the land described herein,and shall be binding upon the parties,their heirs, successors in interest and assigns. Grantors covenant that they are the lawful owners of the above properties and that they have a good and lawful right to execute this agreement. This grant of easement is made without representation or warranty by the Grantor as to Grantor's title to the real property described above. Grantee accepts said property in its"AS IS"condition. This conveyance shall bind the heirs,executors,administrators and assigns forever.
