amends and restates in its entirety that certain Terriporary:Easeinent�f'or Surface Water Drainage

Easement for Surface Water Drainage Overflow and Agreement da�ed �eptember�2f, 2007 and
recorded under Recording No. 20070928000176, (the "Second Amendrrient"), (co�lectiv�ly,�;the : ::` �
"Agreement"}, pursuant to which Grantor granted to Grantee certain rights,for�#he cor�vey�nce.� >:

qf Renton;�Kirig�ounty, Washington arid legally cfescribed on Exhibit A attached hereto.

C. Section 3 :of tfie Agree�r►er�i' states that the term of the easement shall be
coterminous with Speci�l...Use Permit �10.;SP-92-1.74��and be exterided to be coterminous with
any subsequent issued Special I:1se Perrriit. ;:Per�Section.:3, the: term of the Agreement was
automatically extended to be cot�rminous with:�SpeGial=�:Use�:Permif�No. LUA00-064, SP, which
terminated July 31,2010. � �
D. ,�'��.rantee has constructed all n�essary�iEr►prvvements,,within�f�e Easement Area
and wishes`to conti�ue using the Temporary Ov�rflow�ys�em_.:�
E. :`1'he parties wish to reinstate and amend�.:tl�e Agreeriient ta��allow.:Grantee to
contin�te usi}ag the Temporary 4verflow System according to the agreertient set.forth'below.
- AGREEMENTS
I. Reinstater,�ent. Grantor and Grantee hereby agree that the Agreement shall be
reinstated in,,,its �ntirety with.; ful�:��arce and effect, with each party having the rights and
obligations set forth tlierei.r�.
2. Terri�.of Easeinent._,`The�Ag�eemerit is hereby amended by deleting in its entirety
Section 3, which was 'tast a�nen,ded in tlie.:First Atiiendment, and substituting the following
therefor: � �
3. TERM O�`��ASEMENT. The Easeme�t�s�i�ll be reinstated as of the date
hereof and shall automatically t�rminate��and� expir�...on Febr,uary 1, 24i1, or on such
sooner date as improvements ha�.e b�en rz�ade to,.:the:Grantee's�;existing storm sewer
system such that the need for the Temporary Overflow �ystem and this Easement is
obviated. Under no circumstances shall tfiis :easetiler�t� becorrie ,.perr'rianent. Upon
Grantor's requesi, Grantee shall execute aitd� deliver��to;`Gra�n�or an. instjrument in
recordable form quit claiming and releasing to Grantor all ri,g}�'ts and,...r�eaff�i�triing:.the
survival of Grantee's obligations hereunder. „
ln the event Grantor receives, prior to the termination dat€ of the��Ease:men� as:set �. "
