CITYOFRENTON,WASHINGTONORDINANCENO.6024ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSECTION4-2-030OFTHERENTONMUNICIPALCODE,UPDATINGZONINGMAPPROCEDURESANDPRACTICES,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,thesubjectcodesection,RMC4-2-030,ZoningMapInterpretation,servestoclarifytheprevailinginterpretationintheeventofconflictsbetweenCitymapsandgroundconditions,code,orlegaldescriptionsinrezoneordinances,aswellasprovidingprocedureandtimelinesonzoningmapupdates;andWHEREAS,withthisOrdinance,theCityprimarilyseekstoupdateRMC4-2-030regardingzoningmapproceduresandpractices;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,thePlanningCommissionheldapublichearingonFebruary17,2021,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;andWHEREAS,pursuanttoRCW36.70A.106,onApril27,2021,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Section4-2-030oftheRentonMunicipalCodeareamendedasfollows.1 ORDINANCENO.60244-2-030ZONINGMAPINTERPRETATION:A.BOUNDARIES:Thedistrictboundariesare,unlessotherwiseindicated,thecenterlinesofstreets,centerlinesofalleysorlotlinesasshownonthemaps.B.DIFFERENCESINSTREETLAYOUT:WheretheStreetlayoutactuallyonthegroundvariesfromthatshownontheZoningDistrictMaps,thedesignationsshownonthemapsshallbeappliedtothestreetasactuallylaidoutsoastocarryouttheintentandpurposeofthezoningplanofthatdistrict.C.CONFLICTBETWEENZONINGMAPANDCHAPTERTEXT:IfanyconflictexistsbetweentheZoningDistrictMapandthetextofthisChapter,thetextoftheChapterwill-shall_prevail.D.CONFLICTBETWEENZONINGMAPANDLEGALDESCRIPTIONOFREZONEORDINANCE:IfanyconflictexistsbetweentheadoptingadoptedZoningMapoftheCitydepictedbythezoninglayershownontheCityofRenton’sCORMaps,andthetextofanyrezoneordinanceforanyparticularparcelofproperty,thetextoftherezoneordinancewillgovernshallprevail.Onceanyconflictisshowntoexist,theCityCouncilshallasktheAdministrationtodeterminethesourceoftheconflictandtomakearecommendationforanyfutureactionbytheCouncil.TheCouncilwillholdapublichearingtodetermineifitwishestotakeanyactiontoresolvetheconflict.Notificationofthepublichearingwillbegiventothepropertyowners2 ORDINANCENO.6024andpartiesofrecordtotherezoneZoningMapoftheCityshallbeupdatedtobeconsistentwiththetextoftherezoneordinance.E.DETERMINATIONAUTHORITYWHEREACONFLICTBETWEENTHEZONINGMAPANDREZONEORDINANCEISUNCLEAR:Ifanyconflictisshowntoexistthatcannotberesolvedbycomparingtheadoptedzoningmap,asdepictedbythezoninglayershownontheCityofRenton’sCORMaps,tothetextofanyrezoneordinance,theAdministratorshalldeterminethesourceoftheconflictandmakearecommendationforactionbytheCouncilafterthePlanningCommissionholdsapublicheatingregardingtheconflict.Notificationofthepublichearingwillbesentbyregularmailtothepropertyowner(s)ofthesubjectpropertyandallotherpropertyownerswithinthreehundredfeet(300’)ofthesubjectproperty.F.DESIGNATIONOFSPECIALZONINGCATEGORIESANDTIMELIMITATIONS:Propertieshavingazoningcategorysubjecttoatimelimitation,suchasaPlannedUrbanDevelopmentapprovalorreversionaryzoning,andthosepropertiesundercontractrezoneshallbespeciallydesignatedontheZoningMaptoindicatetheirspecialnatureandgivenoticetothepublicthatfurtherinquiryintotheirzoningstatusisnecessary.G.ANNUALZONINGMAPUPDATES:TheZoningMapoftheCityofRentonshallbeupdatedatthetimeofzoningchangesorofficialannexationsorasnecessarytoresolveconflicts.Whenazoningchangeorannexationordinanceisadopted,theZoningMapshallbeupdatedto3 ORDINANCENO.6024coincidewiththeeffectivedateoftheordinance,quarterlytoreflectchngesintheCityboundaryandanyzoningordinanccsadoptedsincethcpriorquarter.TheofficialZoningMapshalllisttheordinancenumberandindicateeffectivedateonthefaceofthemap.ThisshallbepresentedtotheCouncilforadoptionbytheCouncilastheformalandlegalzoningclassificationforthepropertieswithinthecornoratelimitsoftheCity.SECTIONIII.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONIV.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis13thdayofSeptember,2021.JasoA.Seth,yClerkAPPROVEDBYTHEMAYORthis13thdayofSeptember,2021.10Pavone,Mayor4 ORDINANCENO.6024Approvedastoform:ShaneMoloney,CityAttorneyDateofPublication:9/16/2021(Summary)ORD:2161:7/19/215
