PUBLIC HEARING: After reviewing the Development Services Report, examining available information on file with the application, field checking the property and surrounding area;the Examiner conducted a public hearing on the subject as follows: MINUTES The following minutes are a summary of the July 28, 1998 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,July 28, 1998, at 9:10 a.m. in the Council Chambers on the second floor of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Exhibit No.3: Site plan and elevations Exhibit No. 4: Aerial photograph of site The hearing opened with a presentation of the staff report by PETER ROSEN,Project Manager,Development Services,City of Renton, 1055 S Grady Way,Renton,Washington 98055. The applicant requests a conditional use permit to construct a canopy approximately 20 by 180 feet attached to the north side of the existing Bowker building. The building is located on the south portion of the King County Reclamation Plant property which is used as an instructional and equipment storage facility. The area under the canopy would be paved and used to store equipment such as pumps,motors and compressors. An additional 3,000 square feet to the north of the canopy would be paved for a driveway and delivery area. The expansion would not expand the King County Bowker Building Canopy File No.: LUA-98-105,CU-H August 13, 1998 Page 2 capacity or operations of the reclamation plant in any way,nor would it result in additional employment. There is no parking proposed as part of this application. The canopy would consist of steel columns with reinforced concrete footings to support it, and the roof would be constructed of corrugated fiberglass with painted steel. In terms of environmental review,King County Department of Natural Resources Waste Water Treatment Division,as lead agency, issued a Determination of Non-Significance for the project. This site is within the Employment Area-Valley Comprehensive Plan(CP)designation. There are no EAV policies which pertain to the reclamation plant. There are policies in the utilities element that recognize the treatment plant as a regional facility with regional significance and recognize continuation of the use on the site. The subject site is zoned Public Use(P-1)and public use utilities are permitted with a conditional use permit. This is a part of the third enlargement project which was approved by the City in 1991. This project meets the limited development standards of the P-1 zone such as size of use,height, setbacks, lot coverage and landscaping. This canopy is a relatively small expansion to a building and would not result in an over- concentration of the use in the area. Noise and glare are not anticipated to be impacts with this addition. The site is adequately served by utilities and services and the proposal would not impose undue burden on public improvements, faculties or services. Staff recommends approval of the canopy with no conditions of approval. Joe Fernandes,King County, 1200 Monster Road SW,Renton,Washington 98055,applicant representative herein,presented an aerial photograph of the overall site. He further stated that there would be no testing of any equipment on the site,thus no noise would be generated as a result. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:30 a.m. FINDINGS,CONCLUSIONS &DECISION Having reviewed the record in this matter,the Examiner now makes and enters the following: FINDINGS: 1. The applicant,King County,by Joe Fernandes,filed a request for approval of a Conditional Use Permit to add a canopy to an existing structure in the P-1 (Public/QuasiPublic)zone. 2. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 3. King County,as lead agency, issued a Declaration of Non-Significance(DNS)for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal. King County Bowker Building Canopy File No.: LUA-98-105,CU-H August 13, 1998 Page 3 6. The subject site is located at 1200 Monster Road SW. The site is actually just north of Grady Way and west of Oakesdale Avenue SW at the extreme south end of the King County Reclamation Plant (formerly known as the Metro Renton Sewage Treatment Plant). 7. The subject site is an approximately 2.38 acre parcel that is part of the much larger, approximately 95 acre plant site. The building is currently used for instructional purposes as well as storing older equipment. The applicant proposes adding a 20 foot by 180 foot canopy to the existing building's north facade. 8. In addition,an approximately 3,000 square foot area would be paved for use as a driveway and delivery area. 9. The subject site was annexed to the City with a series of separate actions over a course of approximately 18 years. See Ordinances 1745, 1764, 1928 and 4040. 10. The subject site is currently zoned P-1. While the City has been working to eliminate the P-1 zone and convert properties so classified to more appropriate zones matching other surrounding uses,this site has not been reviewed yet. The current P-1 zone requires any use or expansion to have a conditional use permit. 11. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of employment generating uses but does not mandate such development without consideration of other policies of the Plan. The Comprehensive Plan also recognizes the need to provide both local and regional utilities. 12. The existing building is 16,200 square feet in size. The canopy is 3,600 square feet. The total footprint after the addition will be 19,800 square feet. 13. The addition would be supported by steel columns supported by concrete footings. The canopy would be corrugated fiberglass surrounded by painted coping and trim. 14. The canopy would be approximately 15 feet tall. The P-1 zone permits structures up to 50 feet tall. 15. The expansion will not expand plant capacity and will not create any additional employment. Equipment will be stored out of the weather under the canopy. 16. The applicant has landscaped portions of the site. No additional landscaping is currently proposed. 17. The applicant will not be doing any outdoor testing on any of the equipment that it stores under the canopy. CONCLUSIONS: 1. The applicant for a Conditional Use Permit must demonstrate that the use is in the public interest,will not impair the health,safety or welfare of the general public and is in compliance with the criteria found in Section 4-31-36(C)which provides in part that: a. The proposal generally conforms with the Comprehensive Plan; King County Bowker Building Canopy File No.: LUA-98-105,CU-H August 13, 1998 Page 4 b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking, unless otherwise permitted,will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. Landscaping shall be sufficient to buffer the use from rights-of-way and neighboring property where appropriate; and i. Adequate public services are available to serve the proposal. The requested conditional use appears justified. 2. The addition of a relatively small canopy to an existing structure which serves adjunct purposes to an existing utility is generally compatible with the Comprehensive Plan. The Comprehensive Plan permits utilities. 3. There is a community need for utilities and associated buildings and structures. The canopy is a small addition to an existing building. 4. The canopy is also sandwiched between the building and the larger treatment plant and will generally be hidden from sight. It should not have any appreciable impact on the public or nearby properties. 5. The canopy will be attached to the building at about 15 feet. The low profile will be in scale with surrounding uses. There should be minimal impact on any uses and none on any residential uses. 6. The proposed use will not generate any long term traffic or parking impacts. The area will be used for on-site storage and not increase the employee population. 7. Except for short term construction noises,there should be no impacts from the use. 8. The proposed use should not create any impacts on public services. 9. In conclusion,this modest addition seems appropriate and will not create any adverse impacts on the community. DECISION: The conditional use permit to install a canopy and pave portions of the site is approved. STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials to identify and address site plan issues from the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. CONSISTENCY WITH CONDITIONAL USE CRITERIA Section 4-31-36 lists 11 criteria that the Hearing Examiner is asked to consider, along with all other relevant information, in making a decision on a Conditional Use application. These include the following: (5A) CONSISTENCY WITH THE COMP. PLAN,ZONING CODE& OTHER ORDINANCES: The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City of Renton. (1) COMPREHENSIVE PLAN LAND USE ELEMENT The subject site is located within the Employment Area-Valley (EAV) Comprehensive Plan designation. There are no EAV policies which pertain to the King County Reclamation Plant or the subject proposal. The subject proposal would not expand the capacity or operations of the Reclamation plant. The Utilities Element includes policies which generally support continuation of the Reclamation Plant: Policy U-33. Recognize and continue to allow utility facilities that may have regional significance to located within the City, consistent with the goals and policies of the City of Renton Comprehensive Plan. Policy U-61. Coordinate with the regional wastewater agency and adjacent jurisdictions in the planning and maintenance of regional wastewater systems in and near the City. (2) ZONING CODE The subject site is zoned Public Use (P-1). Public utility facilities are permitted with approval of a conditional use permit. The third enlargement of the Reclamation Plant was approved in 1991. The subject proposal requires a conditional use permit because the code does not have a threshold to allow for expansion of projects allowed under previously approved conditional use permits. (3) DEVELOPMENT STANDARDS: (a) SIZE OF USE: The P-1 zone has no standard or limitation related to the size of a use. (b) SETBACKS: The proposed canopy is on the north side of the Bowker Building and complies with required building setbacks from property lines. (c) HEIGHT: The P-1 zone allows a maximum building height of 50 feet. The canopy would be approximately 15 feet. (d) LOT COVERAGE: No standard listed in P-1 zone. There is a master landscape plan that was previously approved for the entire King County Reclamation Plant site. (5B) COMMUNITY NEED: There shall be a community need for the proposed use at the proposed location. In the determination of community need, the Hearing Examiner shall consider the following factors, among all other relevant information: (1) THE PROPOSED LOCATION SHALL NOT RESULT IN EITHER THE DETRIMENTAL OVER CONCENTRATION OF A PARTICULAR USE WITHIN THE CITY OR WITHIN THE IMMEDIATE AREA OF THE PROPOSED USE. The subject proposal to add a canopy to an existing building would be a relatively small expansion to a building which functions as an instructional and equipment storage facility. It would not expand the capacity or operations of the Reclamation plant and it would not result in a detrimental over concentration of the use. (2) THAT THE PROPOSED LOCATION IS SUITED FOR THE PROPOSED USE. The proposed canopy would expand an existing building. It would be added to the north side of the Bowker Building which faces toward the interior of the large Reclamation Plant property. Its location would not use existing parking area or interfere with circulation or operations of the plant. The proposed location is suited for the proposed use. (5C) EFFECT ON ADJACENT PROPERTIES: The proposed use at the proposed location shall not result in substantial or undue adverse effects on adjacent property. The following site requirements shall be required: (1) LOT COVERAGE: LOT COVERAGE SHALL CONFORM TO THE REQUIREMENTS OF ZONE IN WHICH THE PROPOSED USE IS TO BE LOCATED. There are no lot coverage standards in the P-1 zone. The proposed canopy would be an insignificant expansion relative to the area of existing buildings on the site. (2) YARDS: YARDS SHALL CONFORM TO THE REQUIREMENTS OF THE ZONE IN WHICH THE PROPOSED USE IS TO BE LOCATED. ADDITIONS TO THE STRUCTURE SHALL NOT BE ALLOWED IN ANY REQUIRED YARD. The proposed canopy complies with yards/setback requirements of the P-1 zone. (3) HEIGHT: BUILDING AND STRUCTURE HEIGHTS SHALL CONFORM TO THE REQUIREMENTS OF THE ZONE IN WHICH THE PROPOSED USE IS TO BE LOCATED. SPIRES, BELLTOWERS, PUBLIC UTILITY ANTENNAS OR SIMILAR STRUCTURE MAY EXCEED THE HEIGHT REQUIREMENT UPON APPROVAL OF A VARIANCE. BUILDING HEIGHTS SHOULD BE RELATED TO SURROUNDING USED IN ORDER TO ALLOW OPTIMAL SUNLIGHT AND VENTILATION, AND MINIMAL OBSTRUCTION OF VIEWS FROM ADJACENT STRUCTURES. The canopy would be approximately 15 feet in height, complying with the P-1 zone standard of a 50 foot maximum height. The canopy would face toward the interior of the King County property and would not obstruct views or sunlight to surrounding buildings. (Ord 3599, 1-11-82) The proposed canopy addition to the Bowker Building would not impact surrounding properties or the neighborhood. The Bowker Building is located on the south portion of the 95 acre Reclamation Plant property. The canopy is proposed on the north side of the building and it would not be visible from off-site locations. There are no residential uses in the vicinity of the site. (5E) PARKING: Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five percent (75%) of the lot coverage requirement of the zone, in which the proposed use is located, if all parking is provided underground or within the structure. (Ord.3903, 4-22-85) According to the applicant, the proposal does not expand operations of the facility nor generate additional employees. Therefore, no parking is proposed to be added or deleted as part of the subject application. (5F) TRAFFIC: Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in the surrounding area. The environmental checklist prepared by King County states there would be no increase in trip generation associated with the project. Plan Review staff has not recommended a traffic mitigation fee. The proposal would not impact internal pedestrian or vehicular circulation on the site. (5G) NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. Noise levels in the immediate vicinity of the Bowker Building would temporarily increase during construction. After completion, the area under the canopy would be used to store equipment associated with the treatment plant, i.e. pumps, motors, compressors, etc. which would not generate noise impacts. The area beneath the canopy would not be lit, avoiding any potential of glare impacts. (5H) LANDSCAPING: Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use. No landscaping is proposed as part of the project. The canopy would be a relatively small expansion of the existing building and does not trigger any landscape requirements. There is a master landscape plan for the entire Reclamation Plant property. The area under the proposed canopy would also be used for equipment storage, similar in nature to the existing use of the building. (6J) CONVERSION: No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the provisions of this Chapter. IAA/2/ .9 I J' ;r� 5 C75230C AND DETAILS EP No- OF 8 c D F d� F , H July 16, 1998 BACKGROUND INFORMATION EAST SECTION RECLAMATION PLANT IN RENTON King County's East Section Reclamation Plant(ESRP)in Renton is approximately 95 acres in area. The Waste Water Sewage Treatment Plant has been constructed in three(3) stages. The original plant, brought on-line in 1965, provided just liquid stream secondary treatment facilities with an average wet weather flow(AWWF)design capacity of 24 mgd. A biosolids force main conveyed solids to King County's West Point plant for treatment. Treated effluent was discharged to the Green River. The first enlargement of the liquid stream treatment facilities was completed in 1974, expanding the AWWF treatment capacity to.36 mgd. The second enlargement, completed in 1988, included expansion of liquid stream AWWF treatment capacity to 72 mgd in addition to providing on-site solids treatment capabilities and an ETS including effluent pumping station, a transfer pipeline and offshore ocean outfall. With completion of the ETS, the discharge of effluent to the fresh water of the Green River was discontinued and effluent was discharged to the marine waters of Puget Sound. The plant is bounded to the East by the P-1 drainage channel (Springbrook Creek) and Oakesdale Avenue, to the West by Monster Road, and to the South by Southwest Grady Way. Existing contiguous land uses include office parks, distribution centers, an aggregate recycling facility and open space which is zoned for office park and other commercial uses. Liquid stream treatment encompasses raw sewage screening, influent pumping, pre-aeration grit removal,primary sedimentation, air activated biosolids biological treatment, secondary sedimentation and chlorine based effluent disinfection. The residuals removed from the liquid stream as a result of treatment include screenings, grit, scum, primary biosolids and waste activated biosolids. Screenings and grit are washed and dewatered and disposed off-site at a sanitary landfill. Primary biosolids,waste activated biosolids and scum are co-thickened in dissolved air flotation tanks (DAFTs) and stabilized by mesophilic anaerobic digestion and belt press dewatered to produce a Class B digested biosolids product. The biosolids produced is trucked to various agricultural, silvicultural sites for use as a soil amendment and to a commercial sawdust based compost operation to produce a Class A compost product for distribution in the Seattle metropolitan area. Final plant effluent is transferred via the ETS, which encompasses an effluent pumping station and a 12-mile transfer line for effluent discharge at a depth of 600 feet to the marine waters of Puget Sound. The plant discharge is required to meet the secondary effluent limits as defined in its National Pollutant Discharge Elimination System(NPDES) permit. Project Narrative: The King County Fast Section Reclamation Plant is located at 1200 Monster Road,in Renton. The County owns approximately 95 acres to operate a waste water sewage treatment plant. This proposal is to construct a 3,860 square-feet canopy adjacent to the Bowker Building which is located at the South and East section of the plant site. The Bowker Building is an instructional and equipment storage facility associated with the treatment plant. The canopy will consist of steel columns, supported by reinforced concrete footings which in turn will support the 180 ft by 20 ft.canopy. The roof of the canopy will be constructed of corrugated fiberglass with painted steel coping and trim. The area under the canopy will be paved with asphalt concrete, and will be used to store treatment plant associated equipment (i.e.,pumps, motors, compressors, etc.). An additional 3,000 square feet of the site will be paved for use as a driveway and delivery area. No additional employment opportunity will be generated as a result of this construction and hence no additional parking will be provided. JUN 2 1 8.
