RESOLUTION NO . lQ<1 Z • WHEREAS the City of Renton , a Municipal Corporation , operating as a non-charter Code City,Fus heretofore adopted and is enforcing the "Uniform Building Code , 1973. Edition" , together with the "Uniform Building Code Standards , 1973 Edition" , and WHEREAS Section . 6-' / - of said Code prohibits any person , firm or corporation from erecting, constructing, enlarging, altering, repairing, improving, moving or demolishing any building or structure without first obtaining a separate building permit for each building or structure from the Public Works Director, and WHEREAS the Public Works Department must examine all plans and specifications for the proposed construction when application is made for a building permit pursuant to the aforementioned Code , NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON, AS FOLLOWS : Section I: That the Public Works Department shall require the issuance of a permit for any excavation , grading, fill or constructil in the community as povided for by the existing Ordinance of the City of Renton, and as same may be amended from time to time . Section II: That the Public Works Department shall rapire review of each permit application to determine whether the proposed site and improvements will be reasonably safe from mudslides . Shellan, City Attorney -3- CITY OF RENTON, WASHINGTON RESOLUTION NO. 1983 WHEREAS the City of Renton, a Municipal Corporation, has heretofore adopted and is enforcing the "Uniform Building Code, 1973 I Edition" together with "Uniform Building Code Standards , 1973 Edition" a• and 1 WHEREAS the aforementioned Code, Section 301-A I prohibits any person, firm or corporation from erecting, constructing, enlarging, altering, repairing, improving, moving or demolishing any building or structure without first obtaining a separate building permit for each building or structure from the Public Works Director, and 1 WHEREAS the Public Works Department must examine all plans and specifications for the proposed construction when application is I made for a building permit pursuant to the provisions of said Uniform Code, NOW THEREFORE BE IT RESOLVED BY THE MAYQZAND THE CITY COUNCIL OF. THE CITY 1 OF RENTON, WASHINGTON, AS FOLLOWS: 1 Section I: That the PUblic Works Department shall review all building permit applications for new construction or substantial improvements to determine whether proposed building sites will be reasonably safe from flooding. If a proposed building site is in a loBtion that has a flood hazard, any pitposed new construction or sub- stantial improvement (including prefabricated and mobile homes) must (i) be designed (or modified) and anchored to prevent flotation, collapse, or lateral movement of the structure, (ii) use construction materials and utility equipment that are resistant to flood damage, and (iii) use construction methods and practices that will minimize flod damage; and Section II: That the Public Works Department shall review subdivision proposals and other proposed new developments to ass ure tha -1- (i) all such proposals are consistent with the need to minimize flood damage, (ii) all public utilities and facilities, such as sewer, gas , electrical and water systems are located, elevated, and constructed to minimize or eliminate flood damage, and (iii) adequate drainage is pnvided ! so as to reduce exposure to flood hazards ; and Section III: That the Public Works Department shall require new or replacement water supply systems and/or sanitary sewer systems to be designed to minimize or eliminate infiltration of flood waters into the systems and discharges from the systems into flood waters , and require on-site waste disposal systems to be located so as to avoid impairment of them or contamination from them during flooding. Shellan, City Attorney -2- City of Renton , Washington RESOLIIITION NO. 1984 WHEREAS, certain areas of the City of Renton , a Municipal Corporation, are subject to periodic flooding (and/or mudslides) from rivers causing serious damages to properties within said designated areas, and WHEREAS , relief is available in the form of Federally subsidize flood insurance as authorized by the National Flood Insurance Act of 1968 ; and WHEREAS, it is the intent of the City Council of the City of Renton, to require the recognition and evaluation of flood and/or mudslide hazards in all official actions relating to land use in the flood plain (and/or mudslide) areas having special flood (and/or mudslide) hazards; and WHEREAS this body has the legal authority to adopt land use and control measures to reduce future flood losses pursuant tathe. provisions of the State of Washington Optional Municipal Code being {I RCW 35A. 12 et _seq. WHEREAS the City of Renton is operating as a non-charter Code City under the provisions of the Optional Municipal Code , NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON , WASHINGTON, AS FOLLOWS : Section is The City of Renton hereby assures the Federal Insurance Administration that it will enact as necessary , and maintain i force for those areas having flood or mudslide hazards , adequate land use I control measures with effective enforcement provisions consistent with. . the Criteria set forth in Section 1910 of the National Flood Insurance Program Regulations . Section II : The Public Works Department is hereby vested with the responsibility, authority and means to : -1- a. Delineate or assist the Administrator, at his request , in delineating the limits of the areas having special flood (and/or mudslide)hazards on available local maps . r1` of sufficient scale to identify the location of • building sites . b . Provide such information as the Administrator may rt +fz request concerning present uses and occupancy of the floo plain (and/or mudslide area) . c. Cooperate with Federa], State and local agencies and private firms which undertake to study , survey, map and identify flood plain or mudslide areas , and cooperate with neighboring communities with respect to management of adjoining flood pkain and/or mudslide areas in order to prevent aggravation of existing hazards . d. Submit on the anniversary date of the community 's initia eligibility an annual report to the Administrator on the progress made during the past year within the I' community in the development and implementation of flood plain (and/or mudslide area) management measures . Section 3 . The .Public Works Department , acting by and through the Public Works Director, is hereby appointed to maintain for public inspection and to furnish upon request a record of elevations (in relation to mean sea level) of the lowest floor (including basement) of all new or substantially improved structures located in the special flood hazard areas . If the lowest floor is below grade on one or more sides , the elevation of the floor immediately above must also be recorded. Section 4 . The letter explained the 1973 Act requires formal application for participation in the insurance program prior to 7/1/75; otherwise, there will be no Federal financial assistance or mortgage loans from federally-insured or regulated banks or savings & loan associations available for buildings within the identified special hazard areas. Gonnason's letter recommended the City proceed with the application which will require adoption of three resolutions or ordinances relating to procedures for building permits and Zoning control as applied to flood-plain management. Councilman Perry suggested any legislation he coordinated with King County Flood Control Plan as presented by K.C. Councilman Mooney, being advised by Public Works Director Gonnason that the National Flood Insurance Program does not contain a financial commitment. Gonnason, Director gT6-1)SEP101O March 21, 1975 Honorable Avery Garrett, Mayor Members of the City Council Subject: National Flood Insurance Program Flood Disaster Protection Act of 1973 Gentlemen: The Federal Insurance Administration has identified three areas within the City which are considered as "Special Flood Hazard Areas." The attached vicinity maps show the specific locations involved, and the seven residences which are inside the hazard area boundaries. The 1973 Act constitutes an expansion and improvement of the National Flood Insurance Program, with increased limits of subsidized and total coverage and substantial reductions in subsidized flood insur- and premium rates. It does require, however, that communities where flood hazard areas j have been identified must complete a formal application for partici- pation in the Insurance Program. This participation must be arranged prior to July 1, 1975. Should a community decide not to join the Program, then after June 30, 1975, no Federal financial assistance, such as loans or grants, and no mortgage loans from federally-insured or regulated banks or savings and loan associations, will be available for buildings within the identified special hazard areas. Accordingly, we are recommending that the City should proceed with the application for participation, which will require the adoption of three Resolutions or Ordinances relating to the City's procedures for Building Permit and Zoning Control as applied to flood-plain management. What is the National Flood Insurance Program? A. It is a federally-subsidized program authorized by Congress in 1968 to protect property owners who up to that time were unable to get coverage through the private insurance industry. The program, for the first time, made flood insurance available to individuals at affordable rates . In return for the Federal subsidy, State and local governments are required to adopt certain minimum land use measures to reduce or avoid future flood damage within their flood-prone areas. Q. Has the program been changed since then? A. Yes. In December 1973 Congress passed the Flood Disaster Protection Act, greatly expanding the available limits of flood insurance coverage and imposing two new requirements on property owners and communities . Q. What are the new requirements? A. First, after March 1, 1974, property owners in communities where flood insurance is being sold must purchase flood insurance to be eligible for any new or additional Federal or federally-related financial assistance for any buildings located in areas identified by HUD as having special flood hazards. Second, all identified flood-prone communities must enter the program by Jul; 1, 1975. owner fails to buythe required Q. What happens if a property insurance, or a community fails to meet the deadline? A. Federal and federally-related financial assistance for buildings in the flood plain will be unavailable to any community or property owner that does not complywith the Act. - more - - 2 - Q. What is generally meant by Federal and federally-related financial assistance? A. All forms of loans and grants , including mortgage loans and disaster assistance loans , from either a Federal agency such as FHA, VA, or the Small Business Administration, or banks or savings and loan institutions . Q . Who is eligible to purchase flood insurance? A. Any property owner in a community that has had its application approved by HUD. Q. Where can a property owner obtain a policy? A. From any licensed property and casualty insurance agent or broker. Q. How does a community become eligible for the program? A. By submitting a complete application to the Federal Insurance Administration, HUD Building, Washington, D.C. 20410. Application forms may be obtained from the same address. Q, What types of structures are eligible for coverage? A. All types of buildings and their contents . Q. What types of losses are covered? A. Losses caused by (1) a general and temporary flooding condition of normally dry land areas or (2) erosion resulting from abnormally high water levels in conjunction with a severe storm, or (3) flood-related mudslides involving a mudflow. Q. How much coverage can I buy, and what will it cost? A. Under the expanded program the limits of subsidized coverage are doubled, tripled, or more, while rates have been substantially reduced. For example, the homeowner may purchase $20,000 of flood insurance coverage for as l+*Y47. as $50 a year. Property owners already protected under the original program can greatly increase their coverage at a very low cost. Gonnason, Public Works Director SUBJECT: National Flood Insurance Program Required Resolutions (or Ordinances) Dear Gerry: We have established that seven residences are located in the "Special Flood Hazard Areas" within the City, as defined on the map supplied by the Federal Insurance Administration (copy attached) . Accordingly, we are proceeding with the Application for Participation in the National Flood Insurance Program, which requires that the City adopt Resolutions (or Ordinances) similar to the Samples A, B-1 and B-11 attached. You will note that we have designated the Public Works Department as the responsible office where necessary. As an independent action, we intend to dispute one of the three designated special flood hazard areas, viz: the area adjacent to Monster Road SW as shown on sheet #06 of the HUD Flood Boundary Map. Elevations in that area range from 30' to 73' , and the delineation of the boundary line is not precise. This appeal will not affect the processing of our basic application. For your further information we have also included two Policy Letters from HUD which deal with the definition of "mudslide" insofar as Flood Insurance is concerned. Please arrange for the preparation of the required Resolutions or Ordinances in accordance with the samples supplied herewith. Included in the attachments is a copy of the latest Ordinance #2829 which adopts the 1973 Uniform Building Code, plus a copy of a letter which explains the Flood Insurance Program to the Mayor and City Council. The Commissioners of the Housing Authority of the City of Renton, Washington met in regular session Thursday, December 13, 1973, at 7:30 p.m. at its office in the City of Renton. l'' r. The meeting was called to order by the Chairman and upon roll call those present and absent were as follows: Present - Chairman Trimm, Commissioners Austin, Landon, Johnson, Gebenini ],; Absent - None { The Chairman declared a quorum was present. t The;minutes of the previous meeting were read and approved as written. Mr, Lsruier was present for his interview with the Commissioners. Upon ti,- completion of the interview, the Chairman thanked Mr. Ladner and execused him . from the meeting. Ms. Lemieux was then called in for her interview. After discussion Ms. Lemieux left the meeting and the Chairman thanked her for the interview. Mr. Shaff was asked to come in for his interview. When the interview was completed Mr. Shaff was excused and was thanked by the Chairman for his _ ^r time. t,: Discussion then followed with regard to the appointment of an Executive t,' Director. Commissioner Landon moved to offer the position of Executive Director to Mr. Ladner. The motion was seconded by Commissioner Austin !> and upon roll call the Ayes and Noes were as follows: I Ayes - Commissioner Landon, Austin, Johnson j . Noes - Gebenini It The Chairman thereupon declared said motion carried. ,: kit; Motion was made by Commissioner Johnson and seconded by Commissioner Landon 1 '; that a probationary period of nine months be set for Mr. Ladner and he be so notified. Upon being put to a vote the Ayes and Noes were as follows: Ayes - Commissioner Johnson, Landon, Austin ' Noes - Commissioner Gebenini 17 The Chairman declared said motion carried. The Chairman then telephone Mr. Ladner to offer him the position of Executive - Director as of January 2, 1973, at an annual salary of $12,500.
