That condition of approval indicated that the project as proposed does not comply with all tree retention regulations. The condition requires that the applicant submit a revised design that includes a tree retention tract and demonstrates compliance with the tree retention regulations for review at the time of Civil Construction Permit application. This design change would not increase the number of lots and is intended to ensure the preservation of trees within a dedicated tract. The appeal period ends on September 9, 2021. The appeal process provides the appellant the opportunity to specify the substantial error(s) in fact or law which exist in the record of the proceedings from which the appellant seeks relief. The appeal hearing is based on the decision and would not be postponed for redesign.
