CITYOFRENTON,WASHINGTONORDINANCENO.6034ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,REPEALINGSECTION1-3-2OFTHERENTONMUNICIPALCODE,REVISINGANDMOVINGCODEENFORCEMENTREGULATIONSTOANEWCHAPTER1-10,UPDATINGREFERENCESFROMSECTION1-3-2TOCHAPTER1-10THROUGHOUTTHERENTONMUNICIPALCODE,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsection1-3-1.BoftheRentonMunicipalCodeisamendedasfollows:B.AdditionalRemedies:Thissectiondoesnotpreclude,andisinadditionto,administrativeandcivilremediessetforthinthiscode.Thechargingauthorityshall,undertheprovisionsofthiscode,havetheauthoritytopursueremedialremedies,punitiveremedies,orboth.If,intheopinionofthechargingauthority,aviolationofthiscodemaybeamelioratedthroughthecodeenforcementprocess,thentheCityanditspersonnelareauthorizedtoadministerthatprocessinaccordancewithChapter1-10RMC132.If,however,intheopinionofthechargingauthority,acodeviolationpresentsarisktothehealth,safety,orwelfareofamember(s)ofthegeneralpublic,ortheremedialmeasuresareunnecessary,ineffective,orunsuccessful,thenacriminalremedymaybesoughtbythechargingauthority.1 ORDINANCENO.6034SECTIONIII.Section1-3-2oftheRentonMunicipalCodeisrepealedinitsentiretyandreplacedtoreadasfollows:1-3-2CODEENFORCEMENT:AllreferencesintheRentonMunicipalCodetoSection1-3-2shallbegovernedbyChapter1-10RMC.SECTIONIV.TitleIoftheRentonMunicipalCodeisamendedtoaddanewchapter10,entitledCodeEnforcement,toreadasfollows:CHAPTER10CODEENFORCEMENTSECTION:1-10-1:SystemofNon-JudicialCodeEnforcement1-10-2:Definitions1-10-3:EnforcementofViolations1-10-4:VoluntaryCorrectionAgreement1-10-5:HearingProcedures1-10-6:Abatement1-10-7:FailuretoComply1-10-8:AdditionalProvisions1-10-1SYSTEMOFNON-JUDICIALCODEENFORCEMENT:A.Purpose:Toprotectandpromotethehealth,safety,sanitation,andaestheticsintheCityofRentonbyproviding,innormalcircumstances,anexpeditedandcost-effectiveprocesstoaddresscivilcodeviolations,provideforprompthearingsanddecisions,andforthecollectionofappropriatefines,costs,andfees.2 ORDINANCENO.6034B.Authority:PursuanttoRCW7.80.010(5),theCityelectstoestablishanon-judicialhearinganddeterminationsystemtoenforceRentonMunicipalCode(“RMC”)civilcodeviolations.C.NotaBasisforLiability:ThiscodedoesnotcreateorimplyanydutyupontheCityoranyofitsofficers,employees,orvolunteersthatmaybeconstruedtobethebasisofcivilorcriminalliabilityonthepartoftheCity,itsofficers,employees,agents,orvolunteers,foranyinjury,loss,ordamageresultingfromanyactionorinactionontheirpart.1-10-2DEFINITIONS:A.AbateorAbatement:meanstocuretheViolation.AbatementshallnotbedeemedtobecompleteuntiltheViolatororPersoninControlhasnotifiedtheCCIoftheabatementandtheCCIhasbeenaffordedareasonableopportunitytoinspecttheViolationanddeemtheAbatementcomplete.B.Administrator:shallmeanaCityofRentondepartmentadministratororhisorherdesignee.C.CodeComplianceInspector:thereafterCCI)meansanyemployeeordesigneeoftheCityofRentonwhoisdirected,authorized,orresponsibleforfinding,respondingto,evaluating,orconsideringViolationsand/orallegedViolationsoftheRentonMunicipalCodeherein.D.CivilEnforcementAction:AnyappealableactiontakenbytheCityoritsdesigneetocommenceanenforcementproceedingforanyViolationoftheRentonMunicipalCode,including,butnotlimitedto:anoticeofviolation,anotice3 ORDINANCENO.6034andorder,anordertocorrect,astopworkorder,anordernottooccupypremises,oranyothercivilenforcementmechanismororderauthorizedbythisCode.E.Cost:includesandisnotlimitedtoreasonablelegalfeesandcosts(includingbutnotlimitedtoanylegalpersonnelcosts,filingfees,travelcosts,etc.),administrativepersonnelcosts,abatementcosts(includingbutnotlimitedtofilingfees,truckrentalfees,hiringorcontractingfees,overtimecosts,etc.),actualexpensesandcosts,andreimbursementforanyandallexpensesrelatedtothecodeenforcementprocess.F.Fines:areanymonetaryassessment,recovery,orreimbursementrelatedtotheCity’scivilcodeenforcement.FinesshallaccrueforeachdayorportionthereofthateachViolationoccurs.AViolatormayberesponsibleformultiplefinesforeachViolation.Finesareintendedtoberemedialinnatureandshouldbedistinguishedfromanypenaltiesthatmaybeseparatelyimposedthroughajudicialprocess.G.HearingExaminer:shallmeantheneutraladjudicatordesignatedbytheAdministratortooverseeandestablishrulesforanyhearingsrequestedpursuanttothisChapter.H.NoticeofViolation:isadeterminationmadebytheCCIthataViolatorhascommittedorpermittedaViolationoftheRentonMunicipalCode.ANoticeofViolationisacivilcodeviolation,punishableinaccordancewiththetermsofthischapter.4 ORDINANCENO.6034I.OngoingViolation:isaViolationthatisincontinuousviolationoftheRentonMunicipalCodeuntiltheconditionhasbeenabated.i.OrdertoCorrect:isanorderissuedtoaViolator(s)whichorderstheViolator(s)toabatetheViolation/condition.TheOrdertoCorrectshallsetthetimeandmannerinwhichtheconditionmustbeabated.AnOrdertoCorrectshallremainineffectuntiltheViolation/conditionisabatedandtheCityisnotifiedoftheabatementandhasbeenaffordedareasonableopportunitytoinspecttheViolation/condition.K.PersoninControl:meansanypersonwholivesinorstaysatapremises,oranypersonwholiterallypossessesorhashisorhernameonatitle,deed,mortgage,oranagreementrelatedtothepremises,oranypersonwhohascontroloverthepremises,orwhoisresponsibleforcreating,maintainingorpermittingacivilcodeviolation,whetherasowner,tenant,occupant,orotherwise.TheremaybemorethanonePersoninControlforpurposesofthischapter.IfthePersoninControlisnotthelegalowner,thePersoninControlandownerarebothjointlyliableandsubjecttotheprovisionsandremediesofthischapter.ApplicationofthischapteragainstonepartydoesnotprecludeapplicationtoanotherpartywhoisanownerorPersoninControl.ThereisapresumptionthataPersoninControlisawareoforhasknowledgeoftheconditionatapremises.1.ServeorService:meansdeliveryofanyWarningofViolation,NoticeofViolation,and/ororderuponpersonshavinganyknowninterestintheproperty5 ORDINANCENO.6034whereaViolationexists.Serviceisdeemedtobecompletedpursuanttoanyofthefollowingmeans:1.Personalservice;or2.Certifiedmailwithreturnreceiptrequested;or3.Electronictransmission;or4.IfthewhereaboutsofanypersonhavinganyknowninterestinthepropertywheretheViolationexistsareunknownandthesamecannotbeascertainedintheexerciseofreasonablediligence,andtheCCImakesanaffidavittotheeffect,thenservicemaybedeemedtobecompletedbypostingtheWarningofViolation,NoticeofViolation,and/ororderonthepropertyinaconspicuousplace;andmailingacopyviafirst-classmailtothelastknownaddressforpersonshavinganyknowninterestinthepropertywheretheViolationexists;andmailingacopyviafirst-classmailtothetaxpayerofrecordatthetaxpayer’slistedaddressintherecordsoftheKingCountyAssessor’sOffice.M.Violation:isanact,error,omission,location,property,structure,orconditionthatiscontrarytoanyprovisionoftheRentonMunicipalCodeand/orendangersthehealth,sanitation,orsafetyoftheresidents,neighborhood,orcommunity.EachdaythataViolationexistsshallconstituteaseparateandactionableViolation.MultiplesimultaneousViolationsatonelocationshallbeadministeredjointlyforadministrativeandfiscaleconomy.N.Violator:isanyperson(s),entity,ororganization(s),includingthepossessor,and/orownerofaproperty,anyperson(s)havinganyinterestinthe6 ORDINANCENO.6034property,and/orthePersoninControlorowner’sagentforapropertywhereacivilcodeviolationexistsorisallegedtoexist,and/oranyperson(s)whohasreceivednoticeofaViolationorOrdertoCorrect.0.WarningofViolation:isaninformaloralorwrittenwarningthatprovidesnoticetoaViolatorthattheCCIhasfound,seen,ordiscoveredapotentialRMCcivilcodeviolationthataViolatorhascreated,permittedtoexist,maintained,orfailedtoeliminate.AWarningofViolationisnon-appealableandusedtoinformthePerson(s)inControlregardingthepotentialofaViolationwhichdoesnotimposeathreattopublichealth,safety,orwelfare.1-10-3ENFORCEMENTOFVIOLATIONS:A.CodeComplianceAuthority:ACCIisauthorizedtoinitiateaCivilEnforcementActionwheneverallfactsandcircumstancesknowntotheCCIleadtheCCItoformareasonablebeliefthat,intheCCI’sprofessionaljudgmentandexperience,theRentonMunicipalCode(RMC)isbeingviolatedbyanyperson,property,act,omission,error,orcondition.B.InitiatingEnforcementProceedings:WhenaCCIinitiatesaCivilEnforcementAction,theCCIisauthorizedtotakeanyofthefollowingactions:1.OrdertheViolator(s)toAbatetheCondition:TheCCImayorderthepropertyAbatedbypersonsworkingundertheCity’sauthoritywithcostsassessedtotheViolator(s).2.AssessFines:TheCCImayassessanyapplicablecostsand/orFinesforeachViolationbasedonthefollowingcriteria:thenatureoftheoffense;the7 ORDINANCENO.6034historyoftheconditionoftheproperty;thehistoryoftheViolator;theimpactontheneighbors,neighborhood,orcommunity;andtheneedtodiscouragesuchconduct,inactivity,orneglect.Alternatively,theCCImaystaytheaccrualofcostsand/orcivilfines,uponanactualshowingthattheViolator,actingingoodfaith,isunabletobringtheconditionintocompliancewithintherequiredtime.3.IssueaStopWorkOrder:TheCCImayorderthatworkstopimmediatelyifthatworkisinconsistentwithapermitorlicense,hasnotbeenapproved,isbeingdonewithoutapermit,orhasnotbeeninspected,oraViolatorhasrefusedarequesttoinspect.4.Deny,Revoke,Suspend,orModifyaPermitorLicense,orApplicationTherefor:TheCitymaydeny,revoke,suspend,ormodifyapermitorlicensewhenaViolatorhasfailedtocomplywiththetermsofthepermitorlicenseoreffortstobringtheconditionorpropertyintocompliance,aViolatorhasexceededthescopeofworksetforthinthepermitorlicense,orifaViolatorhasfailedtoundertaketheprojectinthemannersetforthintheapprovedapplication.C.NoticeofViolation:WheninitiatingaCivilEnforcementAction,theCCIshallinformtheViolatorof:1.TherelevantdetailsthatformthebasisoftheViolation;2.ThesectionorsectionsoftheRMCthathavebeenviolated;3.ThetimeinwhichtheViolationmustbecorrected;4.ThefineamountfortheViolation,ifany;andalsothat,8 ORDINANCENO.60345.AnyViolatorwhowantsahearingtochallengetheNoticeofViolationmayhaveahearingbeforetheHearingExaminer,pursuanttotheprovisionsofthischapter.Therequestforahearingmustbetimelyandmustsatisfyalloftheotherrequirementsofthischapter.D.OngoingViolations:EveryViolationofthiscodeofacontinuousorongoingnatureshallbesubjecttodailyFinestobeginwhentheCivilEnforcementActionisinitiatedandshallnotenduntiltheViolationisAbatedtothesatisfactionoftheCCI.E.CriminalViolation:WhenaCCIdiscoversorismadeawareofaRMCViolation,andwheretheViolationcarriesacriminalpenalty,theCCIisauthorizedtoreferthemattertotheCityAttorneyforconsiderationofcriminalcharges.PursuingcriminalchargesdoesnotprecludetheCityfrompursuingadditionalremediesaswarrantedbylaw.SeeRMC1-3-1.1-10-4VOLUNTARYCORRECTIONAGREEMENT:A.VoluntaryCorrectionAgreement:litheCCIdeterminesthatacodeViolationhasoccurred,theCitymayenterintoavoluntarycorrectionagreementwithanyViolator,iftheCCIdeterminesitwouldbeappropriate.TheAdministrator,orhisorherdesignee,shalladministeraproceduretomanageanexpeditedvoluntarycomplianceprocess.B.Contents:Thevoluntarycorrectionagreementformordocumentmustcontain,ataminimum:1.AlloftherelevantinformationidentifyingtheViolator(s);9 ORDINANCENO.60342.TheViolationlocation(s);3.DetailsabouttheViolation(s);4.WhatmustbedonetoeliminatetheViolation(s);5.HowlongtheViolator(s)hastoeliminatetheViolation(s);6.WhethertherehavebeenanyknownpriorViolationsinvolvingtheViolator(s)intheCityinthelastten(10)years;7.AsignedrightofentrytoinspectuntiltheViolationhasbeeneliminated,and/orcorrectorabatethepropertyifthevoluntarycorrectionagreementisnotsatisfied;8.Theminimumamountofcivilfinesowedatthepointtheagreementisentered;and9.Inboldprint,thatifthevoluntarycorrectionagreementisnotsatisfiedtheCitymay,withoutanyadditionalnoticeorhearing,imposeanyremedyauthorizedbythischapter;ordertheabatementoftheViolationbytheViolator(s)ortheCity’semployeesoragents;andassessanyabatement,investigation,orenforcementcoststotheViolator(s)andagainsttheproperty.C.Hearing:1.Asaconditiontoenteringintoavoluntarycorrectionagreement,aViolatorexpresslywaivestherighttoahearing,oranyotherreviewtochallengethedeterminationofaViolation,ortheallegationscontainedinanyNoticeofViolation,astheViolatorconcedesthattheViolatorisresponsiblefortheViolationoftheRentonMunicipalCode,andthattheCityhastherighttouseanylawful10 ORDINANCENO.6034meansprovidedbythiscodeorapplicablestateormunicipallawtoinvestigate,enforce,andeliminatetheViolation.2.TheViolator(s)mayrequestahearingtochallengethecomputationofthecostsand/orFines,and/ortheViolator(s)mayaskforahearingtoaskformitigationofthecostsand/orFines.a.Iftherearemultiplerequestsforahearing,thosehearingsmaybeconsolidatediftheHearingExaminerfindsitreasonabletodoso.b.Therulesandproceduresofthehearingshallbegovernedbytherelevantprovisionsofthischapter.D.AdditionalCriteriaandRequirements:1.NoViolatormayenterintoasecondvoluntarycorrectionagreementifthatViolatorhasalreadyfailedtocomplywithavoluntarycorrectionagreementforapriorViolationofthesamecodeprovision.2.Thevoluntarycorrectionagreementactsasastayoftheaccrualofcostsand/orfines,butifaViolatorfailstoeliminatetheViolationinaccordancewiththevoluntarycorrectionagreement,thecostsand/orfinesshallbecomedueandpayable,andtheViolatorwaivesanyrighttoaheatingtochallengethedeterminationofaViolation.3.IfaViolatorisunableorunwillingtoeliminatetheViolationwithinthetimeprescribedbytheNoticeofViolationorOrdertoCorrect,thenavoluntarycorrectionagreementisnotappropriate.4.Avoluntarycorrectionagreementisnotasettlementagreement.11 ORDINANCENO.60345.TheAdministratormayusewhatevertypeofvoluntarycorrectionagreementformasisappropriateinhisorherjudgmenttomitigateandultimatelyeliminatetheViolation.TheAdministratormaymodifythevoluntarycorrectionagreementformonanindividualcasebasisasneededtobestrespondtothefacts,circumstances,andconditionsofaViolation.TheAdministratormaygrantanextensiontoaViolatoronlyif,intheAdministrator’sjudgment,theViolatorhastakenpromptandsubstantialstepstoeliminatetheViolation.6.Thevoluntarycorrectionagreementmustbeinwritingandsignedbyatleastone(1)Violator.AnydisagreementbetweenViolatorsshallbeaddressedbetweentheViolatorsand,ifnecessary,injudicialhearingswithoutrequiringtheparticipationorpresenceoftheCityofRenton.7.IftheViolatorfailstosatisfyone(1)ormoreterm(s)ofthevoluntarycorrectionagreement,afteraNoticeofViolation,theCitymay,withoutnoticeorfurtherhearings,ordertheabatementoftheViolationbytheViolator(s)orbyCityemployeesoragentsandassessanyothercostsrelatedtotheinvestigation,enforcement,andresolutionofthisprocesstotheViolator(s)and/oragainsttheproperty.1-10-5HEARINGPROCEDURES:A.OpportunityforaHearing:1.Inordertoprovidedueprocessandtoachievethepurposeofthischapter,aViolatorortheCCImayrequestahearingbeforetheHearingExaminer12 ORDINANCENO.6034toraiseanychallengetotheCivilEnforcementAction,theCity’sapplicationofthiscode,and/ortochallengeormitigatethecostsand/orFines.2.TheopportunityforahearingisavailableforeachCivilEnforcementActionandtheFinesimposedformultipleViolationsatone(1)siteoratmultiplesitesbyone(1)ormoreViolators.3.Thefailuretorequest,submitawrittenargument,and/orappearatahearingmakestheCivilEnforcementActionafinaldeterminationunlessaViolatortimelyrequestsahearingundertheprocessdescribedinthischapter.Ifahearingisrequested,thefinaldeterminationoftheNoticeofViolationshallbemadebytheHearingExaminerfollowingtheconclusionofthehearing.B.HearingRequirements:1.Timeliness:AnyViolatorand/orpersonshavinganyclaimagainstthetitleorcontractualinterestinthepropertywheretheViolationexistsortheCCImayrequestahearingtochallengethenotice,order,orapplicationofthecode,orchallengeormitigatethecostsand/orFines.AnysuchrequestforahearingmustbefiledandfiledwiththeCityClerkwithinfifteen(15)daysoftheissuanceoftheNoticeofViolationand/orOrdertoCorrect.AnyrequestforahearingthatisnottimelyfiledwiththeCityinaccordancewiththissectionshallbedenied.2.TimingofaHearing:IfaViolatorand/orpersonshavinganyclaimagainstthetitleorcontractualinterestinthepropertywheretheViolationexistsortheCCIsubmitsatimelyrequestforahearingpursuanttothissection,theCityClerkshallsetthedateofthehearingtobeheldnomorethanninety(90)days13 ORDINANCENO.6034aftertherequestforahearingisfiled.Thereshallbenofeetorequestahearingpursuanttothissection.3.Costs:AViolatorormultipleViolatorswhorequestahearingbutwhofailtoappearorparticipateinthehearingareresponsibleforanycostsincurredbytheCitytoholdthehearing.TheHearingExaminermayassessthecoststotheViolatorinwritingwithinfifteen(15)daysoftheViolator’sfailuretoappearorparticipateinthehearing.4.WithdrawalofRequestforHearing:AViolatormaywithdrawtheirrequestforahearingnolaterthanfive(5)dayspriortothescheduledhearing.TheViolatorwillnotbechargedthecostsofthehearingiftheViolator’srequesttowithdrawtherequestistimely.5.FinalDetermination:Ifnohearingistimelyrequested,theCCI’sdeterminationoftheViolationisdeemedfinal,andanycostsand/orFinesbecomedue.C.HearingProcedures:1.HearingProcedure:TheHearingExaminermaychoosetohearthematterorally,inperson,electronically,orbasedsolelyontheparties’writtensubmissions.TheNoticeofViolationand/orOrdertoCorrectmaysatisfytheCity’sburdenofproduction,buttheCitymaysubmitadditionalwrittentestimony.IftheHearingExaminerdeterminesthatthematterrequiresanin-personhearing,suchaheatingmaybescheduled,andappropriateandreasonablenoticeshallbeprovidedtotheparties.14 ORDINANCENO.60342.WhoMayAppear:IftheownerandthepossessororPersoninControlofthepropertyarenotthesame,andiftheownerfailstorespondinwritingorfailstoappearatanoralhearingafterserviceoftheNoticeofViolation,thereisapresumptionthattheownerhasgiventheViolator(s)theauthoritytoactashis/heragentforpurposesofthehearingorthattheownerhaschosennottoparticipate.AnyViolatorwhohasbeenissuedaNoticeofViolation,OrdertoCorrect,oranyFinesand/orcostsmayappearasapartyordesignatearepresentativefortheheating.TheCCIorhisorherdesigneeshallappearonbehalfoftheCity.AnypartywhodoesnotappearatahearingforfeitsthetighttochallengetheViolation,andtheViolationshallbedeemedfinalasagainstthatparty.3.ScopeofHearing:ThescopeofthehearingislimitedtotheconditionsofthepropertyonthedatelistedontheNoticeofViolation.Re-litigationofpreviouslyimposedcostsand/orFinesisprohibited.4.PreponderanceofEvidenceStandard:TheHearingExaminershalldeterminebyapreponderanceoftheevidencewhetherthefactsaresufficienttoproveaViolationofthecode,ifallofthecostsand/orfinesshouldbeimposed,orthataViolationexiststhatmustbecorrected,andwhichViolator(s)isresponsiblefortheViolation.MultipleViolatorsmaybeheldresponsible.TheNoticeofViolation,ifsignedanddatedbytheCCI,shallbedeemedadmissibleevidencetoprovetheViolation.IftheHearingExaminerdeterminesthattheevidencesupportsthataViolationwascommittedafterreviewingtheNoticeofViolation,15 ORDINANCENO.6034thentheburdenofproofshallshifttotheViolator(s)toshowbyapreponderanceoftheevidencethataViolationhasnotoccurred.TheCityisnotrequiredtocallwitnessestotestifyatthehearing.5.FinalDetermination:TheHearingExaminer,afterreviewingthewrittensubmissions,exhibits,testimony,andotheradmittedevidence,mayconfirm,dismiss,ormodifytheCivilEnforcementAction,and/ormitigateanycostsand/orFinesissued.TheHearingExaminer’sdecisionisdeemedtobeafinaldeterminationandmayonlybeappealedinaccordancewithrelevantprovisionsoflaw.Thefinaldeterminationshouldbeissuedwithinthirty(30)daysofthehearing,unlessreasonablecauserequiresadditionaltime.6.ImpositionofFines:TheViolator(s)foundtoberesponsibleforanRMCcivilcodeviolationshallbeliableforthepaymentofanycostsand/orFinesassessed.Paymentisduewithinfifteen(15)daysofthedateontheNoticeofViolation.Ifahearingisrequested,theduedateforpaymentshallbetolleduntilaftertheHearingExaminerissuesafinaldeterminationoftheNoticeofViolation.Thepaymentofanycostand/orFineshallbemadetotheCityofRentonFinanceDepartment.ItistheresponsibilityoftheViolator(s)toprovidetheAdministratororCCIwithproofofthepaymentofanycostsand/orfines,asisappropriate.TheHearingExaminerisauthorizedtoimposeFinesuptoandincludingthemaximumfines,ortomitigatetheFines,astheHearingExaminerseesfitbasedonthefollowingcriteria:thenatureoftheoffense;thehistoryoftheconditionoftheproperty;thehistoryoftheViolator;theabilityoftheViolatorto16 ORDINANCENO.6034directlyassessedbytheDirector.TheDirector,inareasonablemanner,mayvarytheamountofthepenaltyassessedtoconsidertheappropriatenessofthepenaltytothesizeofthebusinessoftheviolator,thegravityoftheviolation,thenumberofpastandpresentviolationscommitted,andthegoodfaithoftheviolatorinattemptingtoachievecomplianceafternotificationoftheviolation.AllcivilpenaltiesassessedwillbeenforcedandcollectedinaccordancewiththeproceduresspecifiedinChapter1-10RMCScction132.SECTIONXVI.Subsections6-27-7.Cand6-27-7.DoftheRentonMunicipalCodeareamendedasshownbelow.Allotherprovisionsin6-27-70remainineffectandunchanged.C.Anyownerofmulti-familyhousingwhichallowsanaccumulationofthree(3)ormoreshoppingcartsuponthemulti-familypremiseshascommittedacodeviolationpunishableaccordingtothetermsofChapter1-10RMC132.Thereshallbeanexceptionfortheownerofanymulti-familyhousingwhohassentalettertoalltenants,onaquarterlybasis,advisingthetenantstonotleaveshoppingcartsonthepremisesofthemulti-familypropertyandwhohaskeptarecordofsuchletters.Theownerofthemulti-familyhousing,toclaimthisexception,mustalsocontacttheownerofthecartsweeklyuntilthecartsareremoved,andaskthatthecartsberetrieved,keepingarecordofthedateandtimeofsuchcontact.D.Anyownerofcommercialorindustrialpropertywhichallowstheaccumulationofoneormoreshoppingcarts,notmaintainedaspartofthebusiness,hascommittedacodeviolationpunishableaccordingtothetermsofChapter1-10RMC132.Theownerofthecommercialorindustrialpropertymay33 ORDINANCENO.6034claimanexceptionfromthiscodeviolation.Toclaimthisexception,theownermustcontacttheownerofthecartsweeklyuntilthecartsareremovedandaskthatthecartsberetrieved,keepingarecordofthedateandtimeofsuchcontact.SECTIONXVII.Section8-7-5oftheRentonMunicipalCodeisamendedasfollows:8-7-5PENALTIESFORVIOLATION:Exceptasotherwiseprovided,anyviolationofthisChaptershallbeacivilviolationsubjecttoChapter1-10RMC132.Thepenaltiessetforthhereinshallnotbedeemedexclusive;theCitymayobtainaninjunctionagainstsuchviolationfromtheSuperiorCourtofKingCounty.AnyordinanceoftheCityinconsistentwithanyportionsofthisChapterisrepealedexceptthatanyordinancedefiningnoiseasanuisanceshallremaininfullforceandeffect.SECTIONXVIII.Section9-10-1oftheRentonMunicipalCodeisamendedasfollows:9-10-1PERMISSIONREQUIRED:Itshallbeunlawfulforanyperson,firm,corporationorassociationtoconstruct,cutup,digup,undermine,break,excavate,tunnelorinanywaydisturborobstructanystreet,alleyoranystreetpavement,streetcurb,sidewalk,drivewayorimprovementintheCitywithoutfirsthavingobtainedwrittenpermissionashereinprovided;provided,however,thatincaseofanemergencyoccurringoutsidetheregularofficehourswheneveranimmediateexcavationmaybenecessaryfortheprotectionoflifeorprivateproperty,suchmattershallbereportedimmediatelytotheDepartmentofCommunityandEconomicDevelopmentoftheCity,whomaythereupongrantpermissiontomakethe34 ORDINANCENO.6034necessaryexcavationupontheexpressconditionthatanapplicationforapermitbemadeinthemannerhereinprovided,onorbeforenoonofthenextfollowingbusinessday.AnyviolationofthisSectionshallbegovernedbyChapter1-10RMC132.SECTIONXIX.Subsection10-12-28.1oftheRentonMunicipalCodeisamendedasfollows:I.Violation—Penalty:AnypersonviolatingtheprovisionsofthisSectionshallbeguiltyofatrafficinfractionandshallbepunishedpursuanttoChapter1-10RMC1-32,exclusiveofanystatutoryassessments,provided,conductthatconstitutesacriminaltrafficoffenseshallbechargedassuchandissubjecttothemaximumpenaltiesallowedforsuchoffenses.SECTIONXX.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONXXI.Thisordinanceshallbeinfullforceandeffectthirty(30)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis15thdayofNovember,2021.Jason
