City Clerk DAM/st Encl . it x • • • 'Renton City Council u - 11/22/76 Page 2 Correspondence and Current Business - Continued Street Vacation Letter from City Clerk Mead explained the State Highway Department Portion of has withdrawn its petition for vacation of that portion of Camas Ave. Camas Ave. NE NE between NE Park Drive and Sunset Blvd. NE, and has declared the property surplus to sell at public auction next spring, deciding that the new owner should be the participant in the street vacation. The letter further explained that Mike Potoshnik, Jr. , original peti- tioner, requested that further vacation action be withheld until the ownership has been transferred. Upon inquiry by Councilman Stredicke, City Attorney Shellan advised as ordinance has not been adopted the petition can be withdrawn, that $100 filing fee can be held in abey- ance until the State Highway interest is adjudicated. i - Planning Letter from Planning Commissioner, Sandra Gist, thanked Council for Commission 11/15/76 authorization for attendance at 11/17 & 18/76 Planning Assoc. I Travel Budget of Washington conference in Wenatchee; however, datewise it was not expected that Council concurrence would be forthcoming and other commit- ment was made. The letter recommended that funds remaining in the Planning Commission's travel account from 1976 be carried forward to 1977 for Commission attendance at future educational meetings and conferences. Albert Heglund, Jr. Letter from Planning Director Ericksen reported Planning Commission Rezone R-1 to B-P recommendation for approval of the rezone for Albert Heglund, Jr. , 437 S.Whitworth from R-1 to B-P for 6,144 sq.ft. of property located at 437 S. Whitworth Ave. for the proposed use of business parking, presently vacant from demolished residence. The letter explained providing of additional parking for substation rehabilitation project and that . project is in agreement with the long term development of the area and Comprehensive Plan. Council President Stredicke called attention that applicant has agreed to extend the restrictive covenants applying to his adjacent property relating to landscaping, access and storage. F.Bartow Fite Letter from Planning Director Ericksen reported Planning Commission Rezone to recommendation for approval of rezone from G to M-P for F. Bartow Manufacturing Park Fite for property located on the West Valley Highway 450 ft. north West Valley Hwy. of SW 43rd St.. The letter explained the 6.43 acres is zoned G and undeveloped, that the proposed use is to rezone to M-P, being compatible with existing zoning and future use of the area. MOVED BY PERRY, SECONDED BY SHINPOCH, COUNCIL CONCUR IN RECOMMENDATION OF PLANNING COMMISSION AND REFER THE MATTER TO THE LEGISLATION COMMITTEE. Upon inquiry of Councilwoman Seymour-Thorpe, Planning Director Ericksen explained that site plan had been submitted and property should be under development by first of the year. Upon inquiry by Council President Stredicke, Ericksen further explained the need for additional fill has not been determined as yet. MOTION CARRIED. Duane A. Wells The letter from Planning Director Ericksen reported Planning Commission Rezone G to MP recommendation for approval of the rezone from G to M-P for Duane A. Lind Ave. SW Wells, 36,000 sq.ft. property located on. Lind Ave. SW at SW 10th St. in the Earlington Industrial Park area. The letter explained the rezone was in agreement with the Comprehensive Plan and consistent with existing uses and zoning in the surrounding area. MOVED BY PERRY, . SECOND BRUCE, COUNCIL CONCUR AND REFER TO LEGISLATION COMMITTEE. Upon inquiry by Councilwoman Thorpe, Planning Director Ericksen reported site plan had been submitted and was under review with the Planning Commis- sion. Councilwoman Seymour-Thorpe noted Planning Commission criteria for rezoning, that there should be a need for change in use and there should be intended use for property under new zoning, especially with ' Manufacturing Park zoning, noting desirability of submittal of site plan with rezone application. MOTION CARRIED APPROVING REZONE. iInterim Financing Letter from Finance Director Marshall reported 11/19 bid opening for LID 298 & LID 300 interim financing on LID 298, sanitary sewers E.Valley Hwy. area in amount of $220,000 and for LID 300, sanitary sewers Olympic View near Benson Hwy. in amount of $68,000. The letter reported three' bids received for the $288,000 financing from Seattle First National Bank 5. 10%; Rainier Bank 5.25%; Peoples National Bank 5.39%. The letter recommended Council accept low bid of Seattle First National Bank for the interim financing. Metro Meeting The Water Quality Committee of the Municipality of Metropolitan Seattle is sponsoring a workshop for local elected officials on 12/15/76 at the Doubletree Inn at Southcenter 8:30 a.m. to" 1 :30 p.m. The meeting • will focus on local governments' responsibilities and activities under the Federal Water Pollution Control Act Amendments of 1972 and has invited all Mayors and Council members of the Cedar/Green River basins. Family Unity Week . Proclamation of Mayor Delaurenti declared the week of 11/21 through 11/21 - 11/27/76 11/27/76 as Family Unity Week in Renton, noting the family is most important unit in the society. Voucher Approval The Finance Committee recommended Council approval for payment of Vouchers No. 11637 through 11791 in the amount of $284,310.10 having received departmental certification that merchandise and/or services have been received or rendered. CORRESPONDENCE AND CURRENT BUSINESS Springbrook Letter from City Clerk Mead reported receipt of Letter of Intent to Annexation annex properties to the City,which has been certified valid by the Plan- 10% Petition ning Department that petition signatures represented 17.2% of assessed valuation. The letter explained that state law requires signatures on the, letter represent not less than 10% of the assessed value of the property to be annexed. The letter recommended December 20, 1976 be set for meeting with initiating property owners at which time the Legis- lative body should determine whether to accept the letter of intent; require adoption of the Comprehensive Plan, zoning ordinance and pre- existing bonded indebtedness. ESPECIAL Metro Transit presented to Council those conclusions and recommendations ; PRESENTATION as to service changes and needs from public meetings held in Renton. Community Services Committee Chairwoman Seymour-Thorpe, having taken Metro Transit part in the Metro meetings, introduced Metro Transit Company personnel assisting with the presentation. Wally Brown, Transit Planner, explained the corridore- study and used wall maps to explain service changes, noting limited budget and short-range improvements recommended. Mr. Brown fur- ther explained the need for Park & Ride Lot in Renton establishing long range planning. Brown explained the revised routing, direct service to I Seattle, Renton Boeing and Duwamish area; also eliminating of loops and streamlining of routes to shorten time between Seattle and Renton by 20 minutes; adding of extra busses during peak hours. Councilman Perry made inquiries to ascertain special consideration for senior citizens in Highlands area, Councilwoman Shinpoch urging covered shelter. Metro officials distributed copies of the proposed changes in bus scheduling effective June 1977 for Routes #42 & 107. PUBLIC HEARING This being the date set and proper notices having been posted and pub- 4WD 1977 lished according to law, Mayor Delaurenti opened the second public hear- Block Grants ing to consider the Housing Urban Development 1977 Block Grants Program. Program The first hearing was held 11/8/76 at which time the projects were listed along with grant request: Housing & Community Development Planning & Implementation $40,296; Park for Handicapped $160,000; Senior Citizen Activity Center $150,000; Cedar River -Trail System $150,000; Preventive Health Care $15,000., Total project $515,296. Community Services Committee Chairwoman Seymour-Thorpe reported review of the permit and made recommendation for approval based on conditions which meet the concerns of surrounding neighbors, which are noted here briefly: Approval of permit on year-to- year basis for up to three years; review of permit at any time; maximum of eight residents; 24-hr. supervision; reasonable noise level ; no cars or motorcycles for residents at the site; home structure to be rehabili- tated and maintained, as well as grounds; screening from single family residences. The committee had determined that the Neighborhood Advisory Council would not be an enforceable requirement, that the Planning Commission and Hearing Examiner are existing advisory council in this case. Council President Stredicke suggested the following names for advisory council : Don Holm, Janet Harris, Louise Matlock, Joe Venera, Mrs. James Hamilton, Mrs. Dean Ringer and Mayor Delaurenti . Pursuant to our telephone'conversation of October 19th, you will recap that petition for street vacation was filed with this office, along with $100 filing. fee, by Mr. Mike Potoshnik, Jr. , 3403 Burnett Avenue South, Renton, Washington, as above-referenced. Your letter, dated October 5, 1976, accompanied the petition advising of no objec- tions by the Highway Commission to the proposed vacation. A vacation petition must be filed by owners Of more than. 2/3 of the abutting properties to be valid, and with the Highway, Department approlIval •, 100% ownersnip is represented. We attach, for your further information, copy of City ordinance which provides for payment of up • to 1/2 of the appraised value (of the city's vested right-of-way interest) which in this case has been established in total amount of. $320, 1/2, of Which, $160, is to be paid into the city by the abutting owners , each to assume his pro rata share of $80. Upon receipt of the total fee due the vacation ordinance is adopted , by the city, certified and filed with the .King County Auditor's office and the property is conveyed thereby to abutting owners , 1/2 to each. In the event a single owner wishes to acquire the parcel he may; as agreed upon between the parties, pay the fee to the city, in which case property owners would need to execute a quit claim deed convey- , ing their portion of the parcel to the other, the property otherwise divided equally to the abutting owners by the county upon receipt of the city ordinance. LID 295 and LID 295 for total amount of $63,314.27 and bonds to mature 10/1/88 Bond Offer bearing annually payable interest of 7%; and bond offer for LID 291 in amount of $373,839.08 with bonds to mature on or before 10/1/95 bearing interest payable annually at 7. 10%. The Finance Director' s letter requested referral to the Finance and Personnel Committee. Street Vacation Letter from City Clerk Mead reported receipt of petition from Mike Portion of Potoshnik Jr. , 3403 Burnett Ave. N. , for vacation of portion of Camas Camas' Ave.NE Ave. NE located between NE Park Dr. and Sunset Blvd. NE, also noting receipt of $100 filing fee. Finance Director Marshall requested approval of prior service Retirement retirement credit for Donald W. Custer which had not been reported to the Credit - Statewide Retirement System in 1969 when prior service credits of other D'.W. Custer officials were reported.; noting the Washington State Public Employee's Retirement System requires Council action in verifying length of service and re-establishing credits. The letter certified Mr. Custer as Council- , f man from June 1962 through April 5, 1964 and that he served as Mayor from April 6, 1964 until December 1 , 1969; total service of 90 months. The letter requested referral to the Finance and Personnel Committee and recommended approval of the requested certification. CARRIED. - CORRESPONDENCE AND CURRENT BUSINESS Request for Petition filed with the City Clerk, bearing 166 signatures, asked the Sligns & Flasher , city to grade that portion of Aberdeen Ave. NE which obstructs clear at Intersection vision of the intersection of Aberdeen Ave. NE and NE 24th St. and to of Aberdeen NE install a four-way stop with flasher, signs and appropriate crosswalks, and NE 24th St. noting the intersection is adjacent to the entrance of Kennydale Lions at Kennydale Park. The letter noted this is a year-round park crossing and also a Lions Memorial school crossing for Kennydale Elementary students, McKnight Middle School Park students and a bus stop area for the Hazen High School students. The letter noted that at the present time, there are no signs , no crosswalks, no flashers and no lights and therefore no protection for the children. Councilman McBeth noted this matter was referred to the Administration previously with letter from Public Works last week on the Consent Agenda with referral to the Public Works & Transportation Committee where it is presently under investigation; noting the letter from Public Works Dept. recommended no change be made. Jim Dalpay, 2425 Monterey NE, asked that Council take close look at intersection of Aberdeen and NE 24th for installation of signal light, noting heavy park use and many accidents not reported. Vicky Seegmiller, 2016 NE 24th St. , explained her son had• been hit at the crossing and asked that action be taken to prevent further accidents. MOVED' BY McBETH, SECONDED BY CLYMER, LETTER AND PETITION BE REFERRED TO THE TRANSPORTATION COMMITTEE. Travel Request Letter from Chief Darby requested Council authorization for Police Police Department Officer Earl McKenney of the city's Check/Fraud Unit, to attend the North- west Check Investigators Assoc. meeting in Richmond, B.C. 10/23/76. Renton City Council 10/11/76 Page 4 Public Hearing - Continued Hearing Council having completed correspondence as requested, the business of Examiner for the meeting returned to the Public, Hearing to consider ordinances adopt- Land Use ing. zoning examiner system of land use and revising duties of the Plan- ning Commission. (Time: 10:20 p.m. ) Persons present making inquiries: Art Scholes, 1708 Ferndale Ave.. NE, noted his sixyears on the Planning Commission having served as Chairman, noted this was a public service with no pay, that the work load of the commission had not increased over the past four years, that there have been 27 applications so far this year, 50 last year and 54 applications the previous year. : Mr. Scholes felt it would be difficult for a zoning examiner to act without bias as the city does not have countless planning decisions or documentation on ' which to base judgement, and felt the ordinance established too much power with one position, objecting that County interviewed 90 persons and the City has already chosen person for the position starting in November and the law not yet passed. Scholes also explained the difficulty in appeal to Council on decision of examiner as opposed to commission system, as appeal will be on grounds of procedural error, likening same to going from' Superior Court to Supreme Court in U.S. Scholes also expressed belief the application process would be lengthed with proposed change. Scholes suggested appointment of citizen ad hoc committees such as Shoreline Management Committee or Cable TV to aid in additional input. Scholes asked the Council to retain the Planning Commission as being representative and felt the proposed changes were premature. Eugene Richards, 7817 S. . Sunnycrest, Seattle, representing the Greater Renton Chamber of Commerce, urged concept of hearing examiner as modernizing step for the many permits required. George Nelson, 574 Windsor Pl . NE, favored land use hearing examiner as it would be based on professional examiner based on facts with consistent, rapid decisions; and urged adoption of ordinance. Nadine Palmer, 2901 NE 4th St. , felt city foolish to change systems when present services rendered without cost. George Pasco, 1900 NE 16th St. , reported to be a fence sitter, however, felt ordinance was premature and needed more study. Jim Dalpay, urged harder look at the proposed system, felt should have recourse to Council without $100 fee.' Gary Moritz, 2525 NE 24th, concurred in adoption of the ordinance as it would expedite applicants zoning requests with professional planner and remove some of burden from the Planning Commission. Joan Walker, 1433 Monterey , NE, noted need for more precise guidelines and neighborhood committees to do research and give input. Kathleen Stremick, 2532 Smithers So. , noted the Planning Commissioners sound like experts and didn't believe the city needed professional examiner. Mike Smith, 3402 NE 7th St. , . approved of hearing examiner concept, however felt some aspects of the ordinance needed further study, that city employee could not be impartial'. Smith suggested interim plan that the city reappoint the two members to the commission and it be divided into two groups to update comprehensive plan and make land use recommendations. Barbara Shinpoch, 361 Maple NW, favored adoption of ordinance, noting having served on four boards and commissions and felt there was a false concept that those that serve with- out pay are free from outside or political influence. Byland Wik, 2616 NE 18th St. , recommended reconsideration of some of the commission load, noting attempt to work out guidelines with some of less controversial material being referred to the Planning staff; asking Council consider full consequences of the ordinance. Bob Johnson, 535 Morris S. , inquired re salary for planning examiner. MOVED BY PERRY, -SECONDED BY GRANT, COUN- CIL CLOSE THE PUBLIC HEARING. CARRIED. Councilman Grant announced committee meeting time of 7:00 p.m. Monday and noted several amendments. Councilman McBeth addressed various aspects of the ordinances.
