That said Grantor(s),for and in consideration of mutual benefits,do by these presents,grant,bargain,sell,
convey,and warrants unto the said Grantee,its successors and assigns,an easement for public utilities
(including water,wastewater, and surface water)with necessary appurtenances over,under,through,across
and upon the following described property(the right-of-way)in King County,Washington, more particularly
described on page 1. (or if full legal is not on page 1--Exhibit A.)
For the purpose of constructing,reconstructing,installing,repairing,replacing,enlarging,operating and
maintaining utilities and utility pipelines, including,but not limited to,water,sewer and storm drainage lines,
together with the right of ingress and egress thereto without prior institution of any suit or proceedings of law
and without incurring any legal obligation or liability therefor. Following the initial construction of its
facilities;Grantee may from time to time construct such additional facilities as it may require. This easement
is granted subject to the following terms and conditions:
1. The Grantee shall,upon completion of any work within the property covered by the easement,restore the surface of
the easement,and any private improvements disturbed or destroyed during execution of the work,as nearly as
practicable to the condition they were in immediately before commencement of the work or entry by the Grantee..
2. Grantor shall retain the right to use the surface of the easement as long as such use does not interfere with the
easement rights granted to the Grantee.
Grantor shall not,however,have the right to: '
a. I Erect or maintain any buildings or structures within the easement;or
b. Plant trees,shrubs or vegetation having deep root patterns which may cause damage to or interfere with the
utilities to be placed within the easement by the Grantee;or
c. I Develop,landscape,or beautify the easement area in any way which would unreasonably increase the costs to
the Grantee of restoring the easement area and any private improvements therein.
d. Dig,tunnel or perform other forms of construction activities on the property which would disturb the
`"� I compaction or unearth Grantee's facilities on the right-of-way,or endanger the lateral support facilities.

This easement shall run with the land described herein,and shall be binding upon the parties,their heirs,

The City was not able to approve your lot line adjustment. As shown on the plan,:the',
proposed 20 foot private access easement for the. benefit of lot 2 precludes the future,
subdivision of lot 2 at the density range prescribed by the R-10 zoning designation.

In order for the City to approve your proposal, the lot line adjustment plan will need to be
revised to show the location of NE 6th Street at the northeast corner of the site. This will
demonstrate that there is sufficient access to lot 2 which will support the future subdivision
of the property. _

Extension of N.E. 6t1i Street East of Union Avenue N.E.
In response to your memo of February 4, 1999, we have no objections to proceeding with the
proposed Williams Lot Line Adjustment(LUA 98-148-LLA).
Regarding the extension of N.E. 6th Street east of Union Avenue N.E., we would like to keep our
options open at this time. We continue to prefer an alignment straight through the north edge of
the Williams property (see Option 1 attached); but are willing to discuss this further with you
during site plan development of Williams Lot 2. If we agree at that time that wetland issues,
impact; on Lot 2 site development options and other concerns preclude this street alignment
option,: a roadway meandering through Lot 2 as previously proposed (see attached conceptual
plan) and noted.in your February 4th memo could be a second option.

SUBJECT: EXTENSION OF NE 6TH ST EAST OF UNION AVE NE
We are reviewing a proposed Lot Line Adjustment (see attached copy) which is located on the NE
6th St alignment east of Union Ave NE. The property owner wants to sell the new Lot 2 to a
developer who will then subdivide the property, with emergency access only to Union Ave NE.
Primary access would be from the east, via the platted and improved NE 6th St right-of-way.
I believe that Bob Mahn attended a meeting with Development Services staff where it was agreed
that the NE 6th St alignment east of this property could not be reasonably be extended straight
through to Union Ave NE due to significant wetlands at this location (most of the northwest
corner of the site).
I believe what was agreed to was to proceed with the LLA as proposed. Development of Lot 2
would include a meandering right-of-way from the end of NE 6th St on the east side of the
property (northeast corner) and extend to the middle of the west side of Lot 2. When Lot 1 is
redeveloped or platted in the future, the remaining right-of-way would be dedicated to Union Ave
NE.
Should werproceed on this basis? Do you have any objections to recording the proposed Lot Line
Adjustment?

The City of Renton has reviewed your revised lot line adjustment. The following corrections
will need to be made before the City can approve your.proposal:

1. Please correct the land use action number shown on the drawing sheets. The sheets
reference LUA-98-148-LLA. The correct number is LUA-98-146-LLA.
2. If the adjoining properties on the ,north and east of the subject properties are
unplatted, note the word "UNPLAT.TED":on'the drawing.
•- 3. The address given for proposed Lot 2 appears to be in error: The correct address is
• 560 Union Avenue•NE.
4. With the inclusion of the 'Declaration of Covenant" language on sheet 1 of 2, the
"Easement .Conditions" document becomes redundant and unnecessary. The
applicant can include the specific conditions of the "Easement Conditions" document
on the face of the lot line adjustment document, if the applicant so desires. An
additional comment the "Easement Conditions" document's described easement
