BLOCK 10, RENTON ,' HIGHLANDS ADDITION, RENTON, KING COUNTY, WASH INGTON. WHEREAS, a proper petition for vacating that certain 16-foot alley in Block 10, Renton Highlands Addition, in the City of Renton, King County, Washing- ton, was duly filed with the City Clerk of the City of Renton on or about Hay 13, 1957, which petition was later supplemented and signed by all of tne. owners of the property abutting upon said alley sought to be vacated, which petition was on that day received and read at the regular meeting of the City Council,, and EREAS the City Council, after due investigation, resolved to fix the 25th day'of June, 1957, as the date of public hearing on said petition and directed the Clerk to • give notice of said hearing in the manner provided by law; and WHEREAS the City Clerk has duly caused notice of, such hearing :to be published and to be posted for the time and in the manner provided by law; and WHEREAS a public hearing las . duly held upon said petition on the day so-fixed at a regular meeting of the ' City Council and no protest or objection' to the granting of said petition or the vacating of said certain alley having been,made, filed or received, and the.City, Council did at that time vote to grant said petition for vacating, subject to ,certain reservation; and WHEREAS the City Council finds that.the vacating of the hereinafter described alley;ts proper and advantageous to all concerned and is deemed to be in the,public interest ,and will not cause injury or damage to any properties or persons, but the granting of said petition is in the public . interest; NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE' CiTY COUNCIL OF THE CITY 'OF'RENTON AS FOLLOWS: SECTION I: The following 'described alley, to-wit: , That certain alley-way, 16 feet in width, as platted in Block 10, Renton lighlands'Addition to the City of ' Benton, King County, Washington, BE AND THE SAME IS HEREBY VACATED, RESERVING, HOWEVER, unto the City of Renton a perpetual easement for all public purposes and uses, said easement being 10 feet in width within said alley and being described as follows: The center 10 feet of the 16 foot, alley in'said ' Block 10, Renton. Highlands Addition. ' SECTION II: This ordinance shall'be effective from and -after its passage, approval and legal publication as provided by law. Baxter, Mayor Members of the City Council Gentlemen: Submitted herewith are signed supplements to the petition for the vacation of the 16 foot alley, Block 10, Ren- ton Highlands Addition. The original petition was signed by all the owners and contract purchasers abutting the alley. The contract purchasers are eight in number and we have the legal opinion that the owners of record must jointly sign the peti- tion. The supplements have been signed by the eight owners of record and the petition now complies with legal requirements. Baxter, Mayor Members of the City Council Re:• Petition for Closing Alley, Block 10, Renton Highlands Gentlemen: A more recent investigation of the petition has re- vealed an expression from the property owners that were instru- mental in circulating the petition. I have been given to un- derstand by- these owners that the intent of the petition was to vacate the alley and the use of the terminology "close the alley" was inadvertent as a choice of words to convey the mean- ing of "vacancy." The petition has been signed by all 27 abutting owners, 19 of which are owners of record, with the remaining 8 under purchase contracts. If permissable legally and with the intent established, I recommend proceding to the public hearing on the petition. James L. Hig_ City Engineer • May 13, 1957 Honorable Joe R. Baxter, Mayor Members of the City Council Gentlemen: Submitted herewith is a report on the petition for the closing of the 16 foot alley in Block 10, Renton Highlands Addition. The petition as presented requests private use of the alley by the abutting property owners, however the use as indicated would virtually vacate the alley as a practical mat- ter. It would appear that the petition represents a compromise between an open alley and a vacated alley and I base this as- sumption on a previous petition that was drafted for the im- provement of a portion of the alley. The signatures on the petition are purported to be those of the legal owners, however the King County Auditor's records show title to 8 of the 27 lots to be invested in other parties. Signatures for all 27 lots abutting on the alley are on the petition and I presume the 8 lots listed hereinbefore are under purchase contracts. Recommendation is withheld pend- ing legal opinion on procedure with regard to the 8 lots. am es L.
