The Grantor, as named above, for, and in consideration of mutual benefits, hereby grants, bargains, sells and
delivers to the Grantee, as named above, the personal property described in Exhibit B of this document. Such
personal property lies within the Grantee’s existing Right of Way located on the Grantor’s property
described in Exhibit A. This Sale is not intended to, nor shall it, expand the scope or dimension of Grantee’s
existing Right of Way, nor shall it expand or enlarge any obligations of Grantor to Grantee except as set
forth herein.
By this conveyance, Grantor will warrant and defend the sale hereby made unto the Grantee against all and
every person or persons, whomsoever, lawfully claiming or to claim the same however, this warranty does
not extend in any way to or create a duty to defend the Grantee against personal injury claims that occur
within the Grantee’s Right of Way that are not due to the negligence or intentional act or failure to act of
Grantor or Grantor’s agents, successors, heirs, or assigns. This conveyance shall bind the heirs, executors,
administrators and assigns forever.
