BOEING COMPANY FOR ACCESS TO CEDAR RIVER TRAIL PARK
FOR APRON ‘R’ CONSTRUCTION PROJECT
THIS AMENDMENT, dated for reference purposes only as November 23, 2021, is by and between
the City of Renton (the “City” or “Licensor”), a Washington municipal corporation, and The Boeing
Company (“Licensee”), a Delaware corporation. The City and the Licensee are referred to
collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this
Amendment is effective as of the last date signed by both parties.
Whereas, the City agreed to the terms under Agreement CAG‐19‐145, dated May 3, 2019, and
Amendment No 1 dated July 2, 2019 to provide periodic non‐exclusive use of Nishiwaki Lane in
Cedar River Trail Park for truck access and egress located on Licensee’s property, temporary
installation of a truck access gate and temporary installation of a drainage culvert and pavement
over the existing drainage ditch (referred to herein as the “Agreement”);
Whereas, the Parties wish to amend the Agreement to change the scope of work in order to allow
for the placement of a portable outbuilding at Cedar River Trail Park.
NOW THEREFORE, It is mutually agreed upon that CAG‐19‐145 is amended as follows:
1.Scope of Work: Section 2.(j), Use – “Licensee may erect signs or barricades …”, is
amended to add a portable outbuilding to the items the Licensee may erect on the
Licensed Property with the following conditions. Section 2 (j) is amended to read as
follows:
2.(j) Licensee may erect signs, barricades and/or a portable work shed on the
Licensed Property only with the prior written consent of Licensor, which Licensor
may withhold in its sole discretion. Any signs or barricades allowed by Licensor
shall be removed by Licensee at the termination of this License.
The Licensee may locate a portable outbuilding on the following conditions:
(1) The portable outbuilding shall be located at least five (5) feet away from an
existing sewer lid as specified in Exhibit A‐2 and must maintain access to the sewer
lid at all times, and
(2) remove the portable outbuilding immediately upon request by the City.
