PUBLIC HEARING: After reviewing the Development Services Report, examining available information on file with the application, field checking the property and surrounding area;the Examiner conducted a public hearing on the subject as follows: MINUTES The following minutes are a summary of the January 5, 1999 hearing. The legal record is recorded on tape. The hearing opened on Tuesday,January 5, 1999, at 9:00 a.m. in the Council Chambers on the seventh floor of the Renton City Hall. Parties wishing to testify were affirmed by the Examiner. Exhibit No.3: Zoning map Exhibit No.4: Site plan Exhibit No.5: Building elevation/floor plan The hearing opened with a presentation of the staff report by JENNIFER HENNING,Project Manager, Development Services, City of Renton, 1055 S Grady Way,Renton,Washington 98055. The project site is located in the Highlands portion of the City. It is just east of Union Avenue NE and north of NE 8th Street if it were extended. The site is located north of Honeydew School,part of the Renton School District. This site is Darlene Kreh1 iel Highlands Christian Elementary School Highlands Christian School Daycare File No.: LUA-98-165,CU-H January 12, 1999 Page 2 about 6.5 acres in size and is currently owned and occupied by uses of the Renton Church of the Nazarene. Applicant seeks a conditional use permit to operate a daycare facility on this site. The daycare is currently operating,but because there is not an onsite resident in the home, it triggers the need for a conditional use permit. The City has issued a letter to the applicant stating they may continue to operate until such time as the outcome of this conditional use permit is determined. The site is designated R-8 as is much of the surrounding neighborhood,primarily a single family residential area. Conditional use permits are required for daycare facilities in the R-8 zone. The Environmental Review Committee(ERC) issued a Determination of Non-Significance with no mitigation measures attached. The Comprehensi',e Plan(CP)requires adequate amounts of land in appropriate locations for facilities such as schools, and that the schools be allowed in residential neighborhoods. On the site there is an existing asphalt and gravel driveway which comes off Union Avenue NE at two locations. There are currently 45 paved parking stalls as well as 70 spaces for overflow parking. There is no designated path between the school and the daycare office and either the parking facility or main church building. Staff is recommending some kind of striped walkway. The daycare would be in an existing house which has been converted to the daycare and school office. There are other portable structures on site which are used for school facilities,with quite a bit of open space on the east portion of the site. The daycare structure is a one-story 1,728 square foot building. The State is requiring remodeling of the structure to make it handicap-accessible. It requires tenant improvement to meet barrier-free access to the building and its restroom. The center offers accommodations for up to 16 children. The daycare accepts children from the surrounding neighborhood as well as those associated with the school. i There is presently a 14 foot sideyard setback from the north property line. With the addition of the required ramp,that setback would be reduced to 9 feet,but it would comply with setback requirements. There are existing trees, shrubs and a fence which separate the residential properties to the north and no additional landscaping is proposed. Staff is recommending approval of this conditional use permit, subject to the condition that applicant provide a striped crosswalk between the parking areas and the main entrance of the daycare, and also between the church and daycare building. Mark Bergqust,28415 181st Avenue SE,Kent,Washington 98042,applicant representative herein, stated that the play area is completely fenced so the children are protected from vehicular traffic. He also stated that applicant would indicate the striping for the pedestrian walkway when they submitted the plans for a building permit. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:30 a.m. FINDINGS,CONCLUSIONS &DECISION Having reviewed the record in this matter,the Examiner now makes and enters the following: Darlene Krehbiel Highlands Christian Elementary School Highlands Christian School Daycare File No.: LUA-98-165,CU-H January 12, 1 i 99 Page 3 FINDINGS: 1. The applicant,Darlene Krehbiel for Highlands Christian Elementary School,filed a request for approval of a Conditional Use Permit to establish a children's daycare center in a residential zone. 2. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 3. The Environmental Review Committee(ERC),the City's responsible official, issued a Declaration of Non-Significance(DNS)for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There,was no opposition from the public regarding the subject proposal. 6. The subject site is located at 850 Union Avenue Northeast. The subject site is located on the east side of Union north of NE 8th if that street were extended. 7. The site is just north of the Honeydew Elementary School and across Union from Kiwanis Park. 8. The subject site is a rectangular,approximately 6.42 acre parcel. 9. Singh family homes are located immediately north and east of the subject site. 10. The subject site was annexed to the City with the adoption of Ordinance 2000. 11. The subject site received its current R-8 (Single family residential/8 units per acre)Zoning with the adoption of Ordinance 4405 enacted in June 1993. 12. The scibject site is the location for the Renton Church of the Nazarene. The church has received a number of permits for the church, school and portable classrooms erected on the subject site. 13. A single family home located near the north boundary of the subject site has been converted to office and daycare use. A Conditional Use Permit is required for any daycare center in the R-8 zone which houses more than 12 children and requires a State license. The daycare center was mistakenly allowed to open without the permit after some initial confusion by City staff. The daycare use does require a Conditional Use Permit. 14. The only physical change to the bulk of the existing building will be the addition of a wheelchair ramp and concrete connecting sidewalk along the north side of the daycare building. 15. A church and school operations occur in the main building and portables located on the adjoining portions of the subject site. 16. No adverse comments were received from the residents of the single family homes located immediately north of the daycare use and this would be the group most likely affected by such use. 17. Parking occurs in areas in front,to the rear and along the side of the church building. The parking areas to the rear of the daycare center are generally blocked during school and daycare hours to avoid conflicts between the children and students and vehicles. 19. Staff has recommended that striped pavement markings delineate a crossing between the center and the church and parking areas. CONCLUSIONS: 1. The applicant for a Conditional Use Permit must demonstrate that the use is in the public interest,will not impair the health, safety or welfare of the general public and is in compliance with the criteria found in Section 4-31-36(C)which provides in part that: a. The proposal generally conforms with the Comprehensive Plan; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking, unless otherwise permitted,will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. Landscaping shall be sufficient to buffer the use from rights-of-way and neighboring property where appropriate; and i. Adequate public services are available to serve the proposal. The requested conditional use appears justified. 2. The Comprehensive Plan does not specifically address daycare centers as a special use. The Comprehensive Plan, a more generalized document of policies and goals, does not necessarily address every type of use unlike the Zoning Code which is much more exhaustive in its enumeration of types of uses.i The Comprehensive Plan does provide guidance on churches and schools which are the primary uses on the subject site. Such uses are permitted in single family zones when they are compatible in scale and appropriately located. This small daycare center is located on an arterial street and is generally contained within a small single family dwelling converted to house offices and the proposed daycare unit. 3. There appears to be demand by the general public for daycare centers. This one serves both church members,the school's students'younger siblings and the general public. Since the use was inadvertently provided a permit, it has demonstrated a demand by housing approximately 16 children. 4. It would be nicer if there could have been more separation between the daycare building and the adjacent single family home. While it meets the setbacks required by Code,those are the minimum Darlene Krehbiel Highlands Christian Elementary School Highlands Christian School Daycare File No.: LUA-98-165,CU-H January 12, 1999 Page 5 setbacks and to have anywhere from 10 to approximately 20 exuberant children a mere 10 feet from a single family residence could strain relations. It appears that there have been no complaints. The closest aspect of the proposal to the adjacent property is a wheelchair ramp which should not create any untoward impacts. The single family character of the existing building should also minimize any undue impacts from either bulk or scale. 5. The parking is generally located in front of the main church building and will not occur in required yard areas. 6. Staff has recommended a method of delineating a pedestrian walking area through the parking lot or driveway aisles to assure safe access for children and caretakers. The applicant has provided appropriate fencing to make sure children do not stray into vehicular areas. In addition,the applicant provides temporary diversions to keep vehicles out of the daycare and school building areas of the site. 7. Again,there have been no complaints from neighbors regarding the existing operation although large numbers of children could generate noise. There should be no adverse light or glare impacts from the proposal. 8. The site is landscaped and no additional materials are proposed for the site. There is landscaping along the north boundary of the site to screen adjacent uses from the subject proposal. 9. The site is served by appropriate City services. DECISION: The proposed use is approved subject to the following condition: 1. The applicant shall provide a striped crosswalk between the parking areas and the main entrance of the daycare, and also between the church and daycare building. The location of the crosswalk shall be approved by the Development Services Project Manager prior to the issuance of the building permit for the tenant improvements. PROJECT DESCRIPTION/BACKGROUND The Highlands Christian School, at the Renton Church of the Nazarene, has applied to remodel an existing structure for use as a daycare center. The one-story structure is 1,728 s.f. in size. Remodeling of the structure will add a ramp and landing to the north side of the building, providing barrier-free access to the rooms dedicated to daycare. An existing restroom will be remodeled to provide barrier-free access. The center will offer daycare for up to 16 children including those children of families enrolled at, or employed by, Highlands Christian School -- as well as children in the surrounding neighborhood. The subject site is 6.42 acres in size and has been developed on the western portion of the site with the existing Renton Church of the Nazarene, a former residence that currently serves as the daycare and school office, four portable buildings used for school classrooms, circulation and surface parking areas. There are 45 paved parking stalls, and 70 spaces for overflow parking on the gravel and lawn areas on the west portion of the site. A Conditional Use Permit is required for day care centers in the R-8 Zone. Day care centers are defined as: "A day care operation licensed by the State of Washington (WAC 388-73-014), for 13 or more children in any twenty four(24) hour period." 2. ENVIRONMENTAL REVIEW Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 as amended), on December 8, 1998 the Environmental Review Committee issued a Determination of Non-Significance (DNS). COMPLIANCE WITH ERC MITIGATION MEASURES No mitigation measures were required for the proposal. The appeal period for the DNS ended will end on December 28, 1998. As of the date of preparation of the Preliminary Report to the Hearing Examiner, no appeals of the environmental threshold determination had been filed. 4. STAFF REVIEW COMMENTS Representatives from various city departments have reviewed the application materials to identify and address site plan issues from the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. CONSISTENCY WITH CONDITIONAL USE CRITERIA Section 4-31-36 lists 11 criteria that the Hearing Examiner is asked to consider, along with all other relevant information, in making a decision on a Conditional Use application. These include the following: (6A) CONSISTENCY WITH THE COMP. PLAN, ZONING CODE& OTHER ORDINANCES: The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan, the Zoning Ordinance and any other plan, program, map or ordinance of the City of Renton. (1) COMPREHENSIVE PLAN LAND USE ELEMENT Policies of the Comprehensive Plan do not specifically address day care centers. However, policies address community facilities such as the existing school and church located on the site. Policies for those uses cite the need to locate such uses appropriately, and to provide adequate parking and pedestrian circulation. The day care primarily serves the children of employees at the school/church, or siblings of students attending the school. The use also serves the community and provides a service. It appears the daycare meets the intent of policies for similar uses. (2) ZONING CODE The subject site is zoned R-8. A Conditional Use Permit is required for day care centers in the R-8 Zone. Day care centers are defined as: "A day care operation licensed by the State of Washington (WAC 388-73-014), for 13 or more children in any twenty four (24) hour period." The daycare would provide care to a maximum of 16 children, and is licensed by the State of Washington. The day care is required to meet accessibility standards of the State and Uniform Building Code. The proposal would result in tenant improvements to an existing structure in order to comply with State Law. (3) DEVELOPMENT STANDARDS: The R-8 Zone requires a 5-foot side yard setback for interior lots in the R-8 Zone. The two side yards for the subject parcel are along the north and south property boundaries. There would be a 10-foot separation between the proposed ramp and the north property line,thus complying with the sideyard setback standards of the R-8 Zone. Building height is limited to two stories or 30 feet in the R-8 Zone. The existing structure is one-story in height, approximately 14 feet high. There are existing trees, shrubs, and fencing that separate the residential properties to the north from the church property and buildings, including the subject structure. No additional landscaping is proposed. (6B) COMMUNITY NEED: There shall be a community need for the proposed use at the proposed location. In the determination of community need, the Hearing Examiner shall consider the following factors, among all other relevant information: (a) The proposed location shall not result in either the detrimental over concentration of a particular use within the City or within the immediate area of the proposed use. The proposed use appears to be appropriate for the day care use. There are no other day care facilities in the immediate area, and the use serves children of church and school employees that work on-site in addition to other community members. Community need has been demonstrated by the enrollment at the daycare. Presently, the day care serves 14 children. The State of Washington permits up to 16 children to attend the subject day care facility. (b) That the proposed location is suited for the proposed use. A substantial area of the subject site that is currently not developed. The proposal for a day care center appears to be appropriate on the site for the following reasons: 1) adequate space exists to accommodate the proposal; and 2) development standards of the Zoning Code have been met. There is adequate area for drop-off, parking, and circulation on site. Many of the trips are linked with employment or other existing trips, since children enrolled in the daycare have siblings attending the on-site school, or have parents employed on-site by the church or school. (6C) EFFECT ON ADJACENT PROPERTIES: The proposed use at the proposed location shall not result in substantial or undue adverse effects on adjacent property. The following site requirements shall be required: The proposal does not increase lot coverage or building height. Presently lot coverage is approximately 7.5% considering all of the site development. An existing structure is used for the daycare, and minor modifications to the restroom and the addition of a ramp and landing are proposed to bring the structure into compliance with accessibility standards. No off-site land uses are presently impacted adversely by traffic, noise, light/glare, or other objectionable or adverse impacts as a result of the day care use. (6D) COMPATIBILITY: The proposed use shall be compatible with the residential scale and character of the neighborhood. (Ord 3599, 1-11-82) The daycare structure is a single family residence that is not longer occupied for residential purposes. It has been converted to a daycare and school office. (6E) PARKING: Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five percent(75%) of the lot coverage requirement of the zone, in which the proposed use is located, if all parking is provided underground or within the structure. (Ord. 3903, 4-22-85) Parking is currently provided on-site for the church and school. Section 4-14 requires that day care centers provide 1 parking spaces for each employee and 2 loading spaces within 100 feet of the main entry for every 25 clients in the program. Loading spaces are provided within approximately 40 feet of the main entrance. Designated accessible parking stalls are located within 20 feet of the main entry. Additional parking is provided in the existing church and school parking lot. There is no overlap in the schedule for church services and the day care use, and adequate parking exists to serve both the school and day care. Currently, 45 paved parking spaces, and 70 overflow spaces on gravel and lawn areas exist on the site. No additional parking is required to serve the day care. (6F) TRAFFIC: Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in the surrounding area. Existing access driveways from Union Avenue NE would continue to be used to access the site. Parking and loading areas located adjacent to the school office, day care and church would continue to be used by vehicles. However, a pedestrian path does not presently exist between within the parking area and the daycare entrance. Staff will recommend as a condition of the permit, that the applicant provide a striped crosswalk between the parking areas and main entrance, and across the paved circulation area to the church. (6G) NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. Noise would result when the children are outside playing. This level of noise would be an incremental increase to the surrounding area over the existing noise experienced when school- age children are playing out-of-doors. This is not expected to result in an adverse impact. (6H) LANDSCAPING: Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use. The proposal does not required additional landscaping. Existing mature trees and shrubs, in addition to a fence separates the day care from the residences to the north. (6K) PUBLIC IMPROVEMENTS: The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements, facilities, utilities, and services. Following are both the Project Narrative and the Construction Mitigation Description : Project Narrative The Highlands Christian School is located at the Renton Church of the Nazarene at 850 Union Avenue N.E., Renton, WA. Currently, there are fourteen pre-school age children enrolled in the school's daycare facility. Given the existing facilities available for this use,a total of sixteen children is allowed by the State Health Department. But State regulations also limit the enrollment based on staffing. If any child enrolled is as young as twelve months, then the ratio of adult staff members to children enrolled is a maximum 1:7. The HCS daycare does care for children as young as twelve months old, and there are two staff members caring for the children;thus, the current enrollment totals fourteen. There are no plans to add more staff and no plans to increase enrollment. The school also offers before- and after-school care for fifteen of the pupils enrolled in grades K-6. This care takes place at the existing school library and gym. The State Health Department would allow a total of fifty pupils,based on existing facilities available for this use, but again, State regulations also limit the enrollment based on staffing.The staff to child ratio for children five years or older is a maximum 1:15. Currently,there are fifteen pupils enrolled with one staff member supervising them. The school's plan to accept more pupils in the before- and after-school care program calls for a maximum of thirty children and two staff members. The site is 6.42 acres, approximately 280,000 square feet. Existing facilities on site include the church building with a 300 seat sanctuary, a house which serves as the school office and daycare facility, three classroom buildings serving grades K-6,a garage/workshop building,and another, older portable building. The areas of these several facilities are as follows: 12,000 SF at the church; 1,728 SF at the house; 1,792 SF at each of two classroom buildings; 1,725 SF at the third classroom building; 1,196 SF at the garage/workshop;and 768 SF at the old portable. The total area at these existing facilities is 21,000 SF.!Lot coverage, given these existing facilities,is 7.5%. The existing paved parking areas provide 451 stalls, including 2 barrier-free stalls for cars and 1 such stall for a van. There are an additional 70 overflow parking spaces available at the gravel and lawn areas in front of the church building. • 4. page 2-Project Narrative, Construction Mitigation Description &Justification for Request to drainage The existing site is flat; grading has been provided only as needed to slope to the storm system. The storm drainage system is in place, and no changes are required. The existing house which serves as the daycare facility is 1,728 SF. It is a one-story structure, approximately 14 feet in height. Access at the main door is by means of stairs. One part of the remodeling will be to add a ramp at the north side of the house,providing barrier-free access to the rooms dedicated to daycare.The other part of the remodeling will be to alter the existing restroom so as to provide barrier-free access to it as well. The addition of the ramp at the north side of the house will not affect the neighbors at all;there are already mature trees, shrubs and fencing separating the residential properties to the north from the church's property and buildings. Lot coverage will not be affected by this minor remodel;it will remain 7.5 %. Paved parking,which is currently more than adequate, will also remain as is. No staff will be added as a result of this proposed minor work Construction Mitigation Description Proposed construction dates are as follows: the last two weeks of March, 1999. Hours of operation during this two-week period will be week-days from 7:00 AM to 4:00 PM. At this point in time no"specialty hours"are foreseen. Dust, traffic and transportation impacts, as well as erosion, mud, noise and other noxious characteristics, will be minimal. No special measures will be implemented with respect to minimizing these impacts. Justification for the Conditional Use Permit Request The use of this daycare facility at the Highlands Christian School is compatible with the general purpose and goals of the City of Renton's comprehensive plan. It is an accessory use to both the school and the surrounding residences;to the school, in so far as it provides care for younger siblings of pupils enrolled at Highlands Christian School and to the surrounding residences, in so far as it provides them convenient access to affordable childcare. There is a community need for daycare at this location. The daycare serves both families of pupils enrolled at Highlands Christian School and families living in the immediate vicinity. Allowing daycare at this location does not result in detrimental over-concentration of this particular use within thelimmediate area. The existing house is well-suited and safe for daycare,and following the proposed remodeling, it will conform to requirements that it be accessible to the disabled. The use of this daycare facility at the Highlands Christian School does not result in any substantial or undue adverse effects on the adjacent residential, school or park properties.
