Klinger 626 "S" Street Gas Installations COMMUNICATIONS: 1 A letter read from Jack Wilson, City Engineer, reported that the Petition for the Vacation of a portion of Lake Street between 2nd and 3rd Avenues contained signatures of 69.20% of abutting property owners. A letter read from City Attorney Shellan pertaining to this area reported that the legend on the "Second Supplemental Maps of Renton Shorelands" certificated 4-10-63, indicates that a dedication was made to the public of the streets in said maps for all purposes not inconsistent with the use thereof for public highway purposes, which includes the area now proposed for vacation. The dedication would mean that the area would undoubtedly revert to the State if the City ceased to use the area as a public street or determined that it was not suitable for such purpose. Mr. Shellan questions the State's attitude in the event only a portion of the dedicated street were so vacated and the effect such vacation would have on the balance of the right-of-way. It was pointed out that two parcels of property were not abutting the right-of-way as required by law and those signatures were not included in the 69.20% by the City Engineer. Moved by Morris, seconded by Perry to refer the matter to the Law and Ordinance Committee for proper Resolution and December 2nd was suggested as date for hearing. After inquiry on intent of the Conncil not to vacate, Mayor Custer's report that Mr. Torkelson was no longer interested therein and law on procedure, the motion carried,; RENTON CITY COUNCIL REGULAR MEETING 8:00 P.M. If Second Avenue is ever widened and returned to two way traffic, it would be very desirable to construct a connection to Third Avenue in this vicinity. At this time it would be im- possible to state that this right-of-way would never have any public value; therefore, it is the recommendation of the Engineering Department that this right-of-way not be vacated. The legend on these maps indicates that a dedication was made to the public of the streets shown on said maps fo,r all purposes not inconsistent with the use thereof for public highway purposes. This, includes the portion of the Old Black River Channel between Second and Third Avenues, the proposed vacation of which is now before you for consideration. The dedi- cation would indicate that if the City ceased to use the area as a public street or determined that it was not suitable- for such purpose' or surplus, then undoubtedly such right-of-way area would revert to the State and the City would thereupon cease to have- any interest therein. There would also be a question in the writer's mind as to the State' s attitude in the event that only a portion of the dedicated street were so vacated and what effect such vacation would have on the balance of the dedicated right-of-way. The development of this area together with the Sears Shopping Center will make this a key area for shoppers in the entire southeast trading area, which will bring more customers from e wide area to the City of Renton. 2. The construction of a major shopping center on the property will add approximately $2,000,000 to the tax rolls of the City of Renton. 3. It- is our understanding that the need for this street as ,a right-of way is based upon''future plans for the widening of'Second Avenue. Our information from the State indicates they do not feel it necessary or desirable to widen Second Avenue and that the cost .of-widening the street and properly integrating it into the present traffic system would`'be'prohibitive. Also, it appears that the completion of' the freeway system will eliminate the necessity of adding to the present number of traffic lanes. Since our options on the adjoining property expire on Oct. 30, 1964, and if you take the necessary action to vacate Lake Street we will still have to negotiate for the purchase of the property with the State of Washington, we would appreciate hearing from you within the next two weeks.
