Minutes of the Renton City Council Meeting (cont. ) 10-7-63
COMMUNICATIONS:
A letter from Planning Director Jensen submitted the Planning Commission recom-
mendation that the requirement for building setbacks from 4th Avenue be enforced in
the matter of denial of building permit for Mr. E. C. Sorensen, 350 Park Street.
A letter was read from Mr. Sorensen advising that in the event the permit is denied
he will have no alternative but to start suit to determine whether the City can restrict
the use of his property.
Discussion ensued and City Attorney Shellan advised that in accordance with legal posi-
tion a city may, if it wishes, under its police power require a property owner to provide
a set back to widen a street, however, if the City wishes to widen the street it must pay
the property owner since he can no longer use his property. If on the other hand as part
of your comprehensive plan you have set back requirements saying a building must be within
so many feet it is perfectly legitimate, for purposes of averting traffic congestion or
otherwise, but you must have a comprehensive plan.
After further discussion and suggestions, it was moved by Bruce, seconded by Custer
to refer the matter to the Council As A Whole. Carried.
Planning Commission recommendation on the Petition of Arne Goedecke for the vacation
of a portion of McAllister road as it affects Tiffany Park was to deny the request until a
proper legal description is furnished and adequate access provided to abutting properties
which use or depend upon McAllister road. Upon inquiry City Engineer Wilson advised such
vacation might create a landlock without adequate ingrees and egress to certain properties.
Mr. Greathouse of Puget Properties commented that inasmuch as much of this road runs' through
their property and ten tat i ve new school property they would like a clear title and will
petition for vacation of any rights as they exist, the road description having been written
from aerial survey and constituting a right that is under shadow. If vacated the City may
be acting on something that is a cloud and not a clear title.
Moved by Reid, seconded by Poli, to table the matter until a clear description of the
street can be furnished. Carried.
A Petition containing approximately 450 signatures was read requesting the City to
provide immediate relief from traffic hazard existing on Sunset Blvd. East, especially
between its intersections with 10th Avenue North and 12th Avenue North, by widening the
improved portion of the right of way, providing for left turn lanes at proper locations and
installation of adequate traffic control lights.
Moved by Garrett, seconded by Hulse, to refer the Petition to the Street and Alley
Committee to whom the matter has been previously referred. Carried.
A letter from M. C. Walls, Fire Chief, requested an Ordinance appropriating $55,000.00
unto Cumulative Reserve Fund #1698 from moneys received by the City in excess of estimated
revenues paid by Boeing in lieu of taxes on the former Air Force Plant No. 20.
Moved by Dahlquist, seconded by Custer, to refer the matter to the Ordinance Committee
for drafting of an Ordinance as requested. Carried.
Communication read from Fire Chief Walls requested authorization to call for bids on
motorized fire apparatus with October 28th recommended as the date for opening of the bids.
Moved by Custer, seconded by Dahlquist, to concur in the request to call for bids and
that October 28, 1963 be set for the opening of the bids. Carried.
A letter from City Clerk Nelson was read submitting and recommending for payment
Progress Payment No. 3 due and payable to the Public Administration Service for work
performed during the month of August, 1963 in connection with the position clasFification
and pay plan study, to be funded from Non-Departmental Acct. No. 7035/603 in the sum of
$319.11. Detailed report of personal services of Mr. Ralph DeSantis attached thereto.
Moved by Custer, seconded by Hulse, to refer the payment to the Accounting and Auditing
Committee with power to act. Carried.
City Clerk Nelson submitted and recommended for payment, Progress Payment No. 2, due
and payable to the Public Administration Service for finance and revenue study during the
Month of August by Mr. Ralph DeSantis and Mr. G. M. Morris in the amount of $2,592.67, to
be paid from Non-Departmental Acct. 7035/603.
Moved by Custer, seconded by Dahlquist, to refer the payment to the Accounting and
Auditing Committee with power to act. Carried.

Gentlemen:
Since there are no formal application forms for a street vacation, I hereby
respectfully request that a vacation be initiated for McAllister Road as it
affects the plat of Tiffany Park.
To my knowledge, there is no current or proper legal description for this
roadway and I would suggest that the legal description be described as:
"That portion of King County Road No. 63, also known as McAllister Road,
that is located Southerly of the Southerly right-of-way line of the Bonneville
Power Administration's Rocky Reach-Maple Valley Transmission Line, as
located in Section 21, Township 23 North, Range 5 East, W.M., King County,
Washington" .

Gentlemen:
The Bonneville Payer Administration has been requested by J. J. Sleavin
fe Associates to dedicate to the City of Renton a triangular plot of
land approximately 36.1' x 296.1' x 285.9' in the northeast corner of
its Maple Valley Substation property for public road and highway pur-
poses. This office has prepared an easement deed for this purpose, a
copy of which is enclosed.
Before proceeding further with this matter it is necessary that we be
advised whether or not the easement deed is acceptable to the City of
Renton.
An early reply would be appreciated.

COMM.f►NICATIONS:
A letter was read from J. J. . Sleavin & Associates, requesting, on behalf of
Mr. Arne Goedecke, that a Vacation be initiated for McAllister Road as it affects
the Plat of Tiffany Park. Upon inquiry, Planning Director Jensen advised that
this road is also known as the old King County Road and runs through the particular
section under development by Mr. Goedecke and that the Planning Commission feels
generally that they would approve this vacation. Discussion ensued relative to
the public use of the road and the fact that other roads would be developed in lieu
of this one subsequent to the Vacation.
Moved by Reid, seconded by Dullahant, to refer the matter to the Street and
Alley Committee. Councilman Garrett suggested in quest of expediting the matter that a
hearing date be set and recommendations from the various parties could be presented,
however, the City Attorney and City Clerk questioned the validity of the petition inas-
much as it did not bear the signature of the fee title holder nor did it indicate that
60% of abutting property ownership was represented. After discussion, the pending
motion carried.
Application from Mr. Mark Hokenson, Honey Dew Sharp Shop was read for a license
for Master Locksmith.
Moved by Custer, seconded by Gianini, to refer the application to the Police and
License Committee with power to act. Carried.
A petition received from Mr. Earl McLaughlin was read affirming desire to annex
5.77 acres of land in the Bryn Mawr area to the City of Renton. 100% ownership was
indicated on the petition along with willingness to assume appropriate share of the
pre-existing bonded indebtedness. The land petition to be annexed is described, to-
wit: That portion of the S.E.4 of the NW4 of Section 18, Twp. 23N, Range 5E., W.M.
as follows: Beginning at the intersection of northerly margin of Renton Avenue,
(E. S. Goodwin Road No. 1446), with the northerly production of the westerly margin
of 89th Avenue South; thence southwesterly along said westerly margin and said line
produced norhterly to the southerly margin of South 133rd Street; thence easterly along
the southerly margin of South 133rd Street and said line produced easterly to the east
margin of 91st Avenue South; thence northerly along the easterly margin of 91st Avenue
South to the easterly production of the norhterly margin of Renton Avenue, (E.S. Goodwin
Road No. 1446); thence westerly along said northerly margin of Renton Avenue to the
northerly production of the westerly margin of 89th Avenue South and the point of be-
ginning. The total assessed valuation is designated to be $9,050.00.
Moved by Custer, seconded by Poli, that the Petition, being in full compliance
with all requirements of the law, be accepted and the matter referred to the Mayor to
convene a Review Board. Carried.
A letter from C. S. Sargent, Mgr., Facilities Engineering, requested, on behalf of
The Boeing Company, that any Lease of the 150 x 1000 ft. parcel of land located between
the Cedar River and the defense plant recently purchased by Boeing, be limited to a one
year term inasmuch as Boeing may make an offer to purchase the property.
Moved by Custer, seconded by Hulse, to refer the request to the Property Committee.
Carried.
A letter read from the Soroptomist Club of Renton requested favorable consideration
of their application for a license to operate a fireworks stand during the coming Inde-
pendence Day holiday. Their organization, being one of business and professional women,
provides scholarship fees and sends a representative to Girls' State among other service
projects.
Moved by Poli, seconded by Bruce, to refer the request to the Police and License
Committee. Carried.
A bulletin from the Assn. of Washington Cities was read advising of its offices
being moved to 3935 University Way. N. E., Seattle 5, Washington and their phone is now
543-0182.
