Riverside Dr. N. has provided business access, blockade would depreciate value of property. Problem noted if fire department were to go though barrier. During ensuing discussion it was suggested that the city wait to that point of construction of the trail system to determine if closure is necessary, because more problems would be created than solved. The appeal was filed at that time to meet your time deadline and was made before I had had a sufficient opportunity to review this matter and formulate a written statement in support of that appeal. I have now had an opportunity to review the matter more thoroughly and sub- . mit that the Hearing Examiner' s recommendation should be rejected for the reasons set forth in this letter. TheIproperty involved in this rezone request is situated at the corner of Union Avenue Northeast and Northeast 12thi Street, Renton, Washington. It is our understanding and position that this area has been designated as a "retail-commercial" use according to the Comprehensive Plan. The City Planning Department apparently disputes that contention, and the Hearing Examiner has accepted the Planning Department's position in that regard. (Findings 6 and 7) . Unfortunately, the record relating to the adoption of the Comprehensive Plan, and amendments thereto,, is not terribly clear, but we believe these findings to be incorrect and to constitute grounds for rejection on the IHearing Examiner' s recommendation. I am attaching herewith a copy of City Ordinance Nos. 2142 and 2439. As we understand the record of prior Council action in this regard, the original Comprehensive Plan was adopted by approval of a Comprehensive Land Use Map, rather than adoption of an ordinance setting forth speci- fic legal descriptions of the property effected. '1978 - 'Page 2. after, the City Council has adopted several amendments to the Comprehensive Plan, each time setting forth the legal descrip- tions of the properties involved. The two cited Ordinances enclosed herein modify the .Comprehensive Plan as it effects this property. Under Ordinance No. 2142, this area was designated "retail-commercial" (Finding >Nb. • 7) . The Hearing Examiner then states that this designation was revised to "medium-density multi-family'!. under City Ordinance No. 2439 (Finding No. '7) . As I read Ordinance No. 2439, that. Finding is in error. Ordinance No. 2439 does not effect this property at all. It effects only property lying easterly of and southerly of our' site® This Ordinance did not change the Comprehensive Plan designation for our property, and it should therefore remain "retail-commercial" . •We believe that this is a proper land use ! designation for this property and that the rezone requested should be approved as: being in conformance with the Comprehen- sive Plan. Additionally, we feel that our proposal -is . consis.tent with the development which has occurred in the surrounding area and 'creates little conflict with the residential areas ' . lying to the south and west of the subject site. The property lying to the north and east of the subject site has been::.. developed into a rather intense- retail-commercial use. Our proposal for a low-profile business use is compatible with adjacent uses, blends in well with the adjacent residential uses, and should be approved. Lastly, we do not agree that our proposal is in any way in- consistent with or incompatible with the goals and policies of the Comprehensive Plan. We dispute.. the inference that approval of our request would in any way contribute to a reduction in property values or contribute to a decay or obsolescence in adjacent residential areas. Dalpay, applicant in the above referenced matter, and have been asked to assist him in seeking review of the decision rendered by the City of Renton Hearing Examiner in the above referenced matter. The Hearing Examiner submitted his formal report and recommendation to the City Council, dated April 14, 1978, recommending that the City Council approve the requested reclassification of the property to an L71 zone subject to certain conditions relating to set- backs and landscaping requirement's. On April 28 , 1978 , we filed our "Request for Reconsideration" with the Office of the Hearing Examiner requesting that the restrictive covenants relating to setback and landscaping be modified to allow greater use of the property. Our Request for Reconsideration was denied by letter from the Hearing Examiner on May 5, 1978. Having no other recourse, we hereby file this appeal from the recommendation and decision now rendered by the Hearing Examiner in this matter and submit herewith our check in the sum of $25.00 in payment of the filing fee required pursuant to Title IV, Chapter 30, City ,Code, as amended. Specifically, we ask that the City Council reconsider and alter that portion of the Hearing Examiner's recom- mendation that effects setback and landscaping requirements. As we, understand the Hearing Examiner's decision, he is requiring a minimum setback/landscaping area of 20 feet The Honorable Charles J. By themselves, these requirements would pose very little problem for us and would,, in general, be acceptable. The City of Renton presently requires 'a minimum area of 18 feet in width to accommodate the necessary offstreet parking necessary for this building. That results in a total land area of approximately 5,000 square feet being committed to offstreet parking. The City's requirement for landscape/setback areas results in 7,920 square feet committed for this purpose. The total of these two, requirements, results in a substantial portion of the available land area being committed to offstreet parking, landscape/setback requirements. We do not feel that this leaves a sufficient area remaining to make the proposed build- ing development economically feasible. We sincerely ask that these requirementsbe altered as the present decision would require 67% of the available land area being committed to landscaping/offstreet parking. We feel that this is excessive. As we understand the conditions that have been imposed upon us by the Hearing Examiner, it appears to us that the Hearing Examiner is attempting to i?nco:rp:orat.e requirements of a' Manufacturing Park, zone .into the L-1 zone we have requested. ' It seems to me that 'we are entitled to an L-1 zone without the additional requirements for landscaping/setback being imposed upon us. We have previously. proposed that the Hearing Examiner' s recommendation be modified to permit a combination 20 foot setback/landscaping/parking area along Southwest 12th Street, and a combination 10 foot setback/landscaping/parking area ',along both the, east and north ;property lines. In effect, we are asking that the' applicant be allowed to intermingle landscaping areas with parking areas within the allotted 20 foot setback area. ' Obviously, .. if such a. proposal were accepted, al detailed landscape :plan would have to be' .submitted to and be:-..approved by the Renton Planning Department as part of the building permit, application. We feel that this proposal complies with the requirements of an L-l. zone and is fully compatible with the development which has occurred on adjacent properties. No new information was presented nor was substantiation received for the consideration request apparently based upon Section 4-3015 (Hearing Examiner Ordinance) . My recommendation to the City Council was essentially a continuation of the precedent established in the O'Brien (R-885-76) and Divelbiss (R-016-77) rezones. The specified landscape strips were required in order to accomplish as much of the Manufacturing Park character, in the midst of several single family residences, as possible per the Comprehensive Plan for the area. Another look at Exhibit #3 (Conceptual Plot Plan) revealed that apparently sufficient property exists to accommodate parking requirements while complying with the conditions of the rezone. It is a normal requirement that landscape areas be devoted exclusively to landscaping. These landscaping areas were deemed necessary to accomplish the general objectives of the Comprehensive Plan (M-P) and transitional buffering of existing single family residences. In the 'public hearing the existing alley was discussed in terms of access but I would suggest exploring parking alternatives as well for near the alley with the Planning Department. Perhaps a solution could be found there. The circumstances surrounding the property (e.g. Comprehensive Plan and existing single family residences) seem to require the conditions specified . in my recommendation to the City Council. Mr. Dalpay questioned the accuracy of the • setback measurement on the eastern corner of the site and advised that he had recently surveyed and measured the property. He also felt that conformance to a 30-foot average setback would not allow best use of his property because of the unusual configuration of the lot. The Examiner asked for testimony in support or opposition to the application. There was no response. He then asked Mr. Smith for additional comments. Mr. Smith revised the Planning Department recommendation for average setback requirements on the southerly property line adjacent to S.W. 12th Street from 30 to 25 feet to allow parking space at the rear of the structure and provide compatibility with the parallelogram-shape of the site. He noted that because improvement of the existing alley on the northern boundary of the property would not occur until a future date, access to the site would probably be provided from S.W. 12th Street: The Examiner asked the applicant for additional comments. Mr. Dalpay stated his opinion that setback requirements would interfere with provisions for parking space on the north and landscaping on the south side of the property, and advised that construction of additional structures on the eastern portion of the site is anticipated. For this reason, he felt that the setback requirements would decrease aesthetic value of the proposed development. In response to the Examiner's inquiry regarding 'the possibility of orienting the building parallel to S.W. 12th Street, Mr. Dalpay indicated that extension to the east would be necessary and would result in interference with future plans for that location on the site. The Examiner asked Mr. Smith for additional comments, modifications or revisions to Exhibit #1. Mr. Smith indicated that the report would remain as submitted with the exception of the revision of setback requirement on the southerly property line from - 30 to 25 feet with a minimum setback at the southwest corner of no less than five feet. He recommended that parking areas be located at the rear of the structure concurrent with development of the alley and that landscaping be located at the front of the building. He suggested that the alley be eventually utilized for access to the subject site, and noted that details of the plan will be reviewed during the building permit process. Mr. Smith emphasized that consideration of the unusual configuration of the property be given in review to maintain a balance to allow reasonable development of the site and also retain compatibility with the Comprehensive Plan designation of Manufacturing Park zoning. In response to the Examiner's inquiry regarding conformance of the Divelbiss property development to established restrictive covenants, Mr. Smith reported that although measurements taken from the approved Building Division plans indicated conformance, final inspection of the property had not yet occurred. The Examiner asked the applicant if the revised Planning Department recommendation for a 25-foot setback on the southerly property line was acceptable. Mr. Dalpay expressed a preference for a 15-foot setback and advised that a 10-foot setback currently exists on the site. In response to the Examiner's statement regarding the flexibility of the proposed building configuration in width and length, Mr. Dalpay advised that a limit of 50 feet had been established as maximum width to provide necessary parking space on the northern portion of the site. The Examiner asked for further comments. Deviation from this requirement can occur through only the variance process and lies outside the purview of the Examiner. RECOMMENDATION: Based upon the record, testimony, findings and conclusions, it is the recommendation of the Examiner that the City Council approve reclassification of the property to L-1 subject to the following conditions being attested to in the form of restrictive covenants: 1. Plans for the proposal have been reviewed by all city departments affected byithe impact of 'this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. • • 7. The proposed conceptual plot plan (Exhibit #3) is not compatible with the required front and sideyard setbacks of Section 4-730 (M-P) ,but is compatible with the setback requirements of Section 4-712 (L-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. Within the vicinity, two rezone applications have been approved for L-1 subject to conditions very similar to those recommended by the Planning Department (O'Brien, R-885-76, and Divelbiss, R-016-77) . The latter application immediately abuts the westerly boundary of Mr. Dalpay's property. The conditions imposed upon the Divelbiss property were: a. A minimum 20-foot setback along S.W. 12th Street; a minimum 10-foot setback along the east property line; and a minimum 10-foot setback along the north property line. • b. A minimum 20-foot landscape strip adjacent to S.W. 12th Street; a minimum 10-foot landscape strip adjacent to the east property line; and a minimum 10-foot landscape strip adjacent to the north property line. A detailed landscape plan shall be submitted to and approved by the Renton Planning Department as part of the building permit application. c. Outside storage of materials, equipment, and containers may be permitted•, within the buildable area'of the property, when ,said storage is properly screened by a sight-obscuring fence not less than six feet in height nor more than 10 feet in height, together with a minimum five-foot .landscape strip subject to review and approval of the Planning Department. 9. The area encompassed by FAI-405, S.W. Grady Way, and State Highway 167 was originally platted into small single family lots under G-6000 zoning. Some single family development occurred over the years; however, for the past several years commercial and industrial uses have,been located in this area (Section 4-3014. (C) ) . The Comprehensive Plan Land Use Map indicates this transitional trend in the designation of Manufacturing Park for the area (Section 4-3014. (B) ) . Due to the configuration of the platted lots (100-foot depth) , it is difficult to meet the setback requirements of the M-P zone. The setback requirements of the L-1 zone can be met. 10. The last area land use analysis was apparently completed for this area in 1970 during review of the Green River Valley element of the Comprehensive Plan. • Testimony was not provided regarding whether specific rezone classification . was considered at that time relative to the subject site (Section 4-3014. (A) ) . ✓CONCLUSIONS: 1. The proposal conforms to the goals and objectives of the Comprehensive Plan (Section 4-3014. (B) ) . 2. Development in the area and adjacent to the subject site have impacted the property significantly since the previous land use and zoning analysis of the . area (Section 4-3014. (C) ) . 3. The City Council has established clear precedent for this request in the O'Brien and Divelbiss rezones. It seems appropriate to require the same conditions of Mr. Dalpay as was required of the Divelbiss application and continue the type of development that responds to the unusual conditions surrounding properties in this area. Essentially, the required setbacks would represent in Mr. Dalpay's property the minimum requirements of the L-1 zone except for an additional five feet of side • yard setback.
