Gonnason, Public Works Director ;7//' j lk? t - S,JBJECT: NE 4th Street -- Swanson, Stone, Mastro and Wehrman Land Use Development The above-referenced land development has come to our attention on an individual basis, but requires a comprehensive analysis of all four combined properties in regard to access. The portion of the property of Mike Mastro's which is proposed for apartments or condominiums with a possible restaurant has a projected traffic volume of 1 ,366 vehicles per day if fully developed. This would generate between two and three vehicles per minute during peak hour entering and exiting to NE 4th Street. Limited site distance due to a vertical curve and heavy peak hour traffic volumes on NE 4th Street will cause all left turning movement to the property' s proposed access unsafe. Possible corrective solutions to this unsafe condition are as listed : 1 . Restrict all left turning movements by installing 'C ' curbing on the centerline of NE 4th Street. 2. Property owners fronting on NE 4th Street could pay for the installation of a center lane, two-way left turn. It would be desirable if property owners would dedicate 5 feet of property to facilitate the most desirable design width. 3. Regardless of corrective actions on NE 4th Street, an additional east/west roadway access for the two southerly properties must be required and provide access to Union Ave. NE as proposed on the attached drawing. As you are aware, a portion of the properties shown in the proposed right-a-way (60 ft. ) would have to be dedicated as a public street by each property owner. In addition to the east/west roadway access, we also confirm the need for a north/south roadway access to NE 4th Street to release properties to the south of the above-referenced property from being landlocked and improve traffic circulation throughout the area as developments occur. O. STAFF ANALYSIS: • • 1. The proposed B-1 zone -is not consistent with the comprehensive plan map element which ;designates the site and area within the powerlines easement as greenbelt. However, there is existing B-1 zoning east of the site, within the powerline easement and south of the site. 2. The Greenwood Cemetery is located west of the site. There is a 30 foot existing right lof way adjacent to the cemetery together with a 30± foot strip between that right lof way and the subject site. It appears that this strip of land was intended for use as a'future access street. This right of way must be assured to provide suitable access to the site and area to the south. 3. The intent of the comprehensive plan greenbelt designation was to establish a buffer, between the cemetery and future uses to the east. At the time the cre- hensive plan was adopted the powezline easement may have been considered a right of way owned by the power company, It appears that the plan was inaccurate in its • assessment of the necessity, amount, and exact location of greenbelt buffer areas. It is 'a fact that B-1 zoning surrounds the site directly to the south and east. This has an effect of limiting the effectiveness of a greenbelt on the subject site. It would appear that' a more appropriate buffer or transitional land use would have been a medium or low density multiple family designation. Suitable setbacks and landscape buffers can also be established as part of.rezoning, to correspond to • the spirit of the plan. Comprehensive Land Use Report, Objectives 1 and 2 page 17. • 4. The area along the north side of N.E. 4th Street is presently zoned and developed as B-11. • • 5. The need for a left turn lane along N.E. 4th should be studied and required as • • part of any rezone. 6. Given the amount' of traffic and' the potential for future widening of N.E. 4th Street, additional setbacks and lan_dscape/buffer should be provided along N.E. 4th • Street. (Comprehensive Plan Land Use Report, Objective 2, 4, and 6, page )7-18.) • •7. The Utilities Division has indicated that snit-::hlc sewer and water line extensions per the Comprehensive Utility plan'will be required as part of site development. • 8. Rick Beeler, Hearing Examiner SUBJECT: Rezone, Applications: Stone (R-165-78) , Wehrman (R-166-78) , and Swanson (R-167-78) In response to your referral of July 24, 1978 and the July 26, 1978 memorandum from Councilman Stredicke (attached) , I have reviewed the record on these three applications. Access to these properties is only a problem for the Stone property. The Swanson property has rights of access to N.E. 4th Street, and the rezone required dedication of the westerly approximate six feet for part of the right-of-way for the road adjacent to the cemetery. With the dedication of the south 30 feet of the Wehrman property and the city's committed north 30 feet of the abutting,property, sufficient access exists for that property to the easterly border of the Stone property. Mr. Stone's property is the only one of the three applications without sufficient access. The comprehensive view of access for properties in the area was not entered into the record by the Public Works Department Traffic Division. However, the Planning Department provided a recommendation that the 60-foot roadway from the Wehrman property extend across the entire Stone property. This indicated that some comprehensive review had occurred by that department of the traffic circulation in the area. However, nothing formal with support or participation by the Traffic Division was provided the Examiner in the hearing on the Stone rezone application or in the subsequent responses requested by the Examiner. Therefore, the Examiner considered the recommendation for dedication of the north 30 feet of the Stone property as not completely researched, reviewed or coordinated with the Traffic Division (based upon the record) to make a specific requirement for that dedication. The condition the Examiner recommended in the Stone application was for acceptable access to be provided, thereby putting the burden upon the applicant to submit a means of access acceptable to staff. This access could take the form of dedication. of the north 30 feet of Mr. Stone's property or dedication of another alignment in cooperation with the northerly abutting property (the site of the proposed large apartment complex) . Either alternative could meet the east-west access recommendation of staff. It appeared at the time that, 1) the applicant would be more able to select one of the alternatives with the assistance of staff in coordination with the abutting northern property owner, and 2) the Traffic Division should have another opportunity for a comprehensive view of the access for the area. Whatever access staff reached a consensus on was acceptable to the Examiner; however, the Examiner did not wish to hinder this cooperative decision by dictating the location of the access without more complete information entered into the record. Members, Renton City Council Page Two • July 27, 1978 • • Per the memorandum of July 26, 1978, from Councilman Stredicke, another area of concern was the status of the right-of-way abutting the cemetery property and the Swanson property. The record in the public hearing was that a 30-foot public right-of-way exists abutting the easterly boundary of the cemetery property, although this is being contested in litigation. Staff supported making this a 60-foot dedicated public street for access serving the properties from N.E. 4th Street to the Leisure Estates Mobile . Home. Park. This appeared reasonable, logical and warranted. But upon examination of the 60 feet of property between the cemetery and' Mr. Swanson's property, it was discovered in the public hearing that Mr. Swanson did not own all of . what would be the easterly 30 feet of the needed 60-foot right-of-way.. Another .person owned approximately 24 feet of this easterly 30 feet of right-of-way.. Mr. Swanson could only dedicate six feet (westerly approximate six feet of his property) . Therefore, this was required of Mr. Swanson with full knowledge that the city would probably have to condemn the intervening 24 feet of property in order to develop a full 60-foot public street. • I hope this answers your questions regarding these three applications. Stredicke To: Rick Beeler, Hearing Examiner The Ways and Means Committee has reviewed your reports and proposed proposed ordinances rezoning properties in East Renton in accordance . . with 'recommendations from your office. • However, ' the committee has not reported the ordinances out for final reading because of discussion regarding the dedication of right-of-way. and establishment of roadways to properly serve the area between the cemetary and Union Avenue N.E . The committee has been concerned about granting a zoning on properties which' appear to,be '"land locked" to . higher, density multiple, even though there are no building permits . involved. • The proposed concentration of vehicles in that area would dictate establishment of roadways BEFORE anything is done in the .area and that either roadway right-of-way is dedicated by property owners or the city ' proceed to condemn that area which would be required. There was also some concern about. "dumping" a high volume of inter- for traffic onto either Union Avenue N.E. or N.E. Fourth St. • The interior property, in fact , lists the dedication of 30 ' of the • south property.-line, when 30 ' of the NORTH property would line up With that proposed in the eastern rezone request. Because of this concern, the committee had asked 'the Planning Depart- ment to' make : a report this past Monday. It appears that the depart- • ment 's recommendations did cover this problem, but the examiner's report failed to consider or include them. The proposed B-1 zone is not consistent with the camprehensive plan map element which ,designates the site and area within the powerlines easement as greenbelt. However, there is existing B-1 zoning east of the•site, within the powerline • easement and south of the site. 2. The Greenwood Cemetery is located west of the site. There is a 30 foot existing right of way adjacent to the cemetery together with a 30± foot strip between that right ,of way and the subject site. It appears that this strip of land was intended for use as a'future access street. This 'right of way must be assured to provide suitable access to the site and area to the south. 3. The intent of the caiprehensive plan greenbelt designation was to.establish a buffer between the cemetery and future uses to the east. At the tine the corrpre- hensive plan was adopted the powerline easement may have been considered a right of way owned by the power company, It appears that the plan was inaccurate in its - assessment of the necessity, amount, and exact location of greenbelt buffer areas. It is a fact that B-1 zoning surrounds the site directly to the south and east. This has an effect Of limiting the effectiveness of a greenbelt on the .subject site. It would appear that a more appropriate buffer or transitional land use would have been a medium or low density multiple family designation. ' Suitable setbacks and landscape buffers can also be established as part of:rezoning, to correspond to the spirit of the plan. Comprehensive Land Use Report, Objectives 1 and 2 page 17. 4. The area along the north side of N.E. 4th Street is presently zoned and developed as B-1. • 5. The need for a left turn lane along N.E. 4th should be studied and required as part of any rezone. 6. Given the amount of traffic and the potential for future widening of N.E. 4th Street,, additional setbacks and landscape/buffer should be provided along N.E. 4th Street. (Comprehensive Plan Land Use Report, Objective- 2, 4, and 6, page 17-18.) 7. The Utilities Division has indicated that ral t-nhle sewer and water line extensions per the Comprehensive Utility plan will be required as part of site development. 8, There are a number of existing evergreen trees on the site. These should be retained as much as possible as part of site develont and design. 9. Certain drainage problems in the area adjacent to the cemetery must be resolved as part of site development. Swanson This department concurs with the Public Works Department in the need for public access into the general area of the subject rezones . One parcel, the subject of R-165-78, is totally landlocked at the present time. Also from a land use intensity standpoint, the existing extensive amount of B-1 zoning together with the proposed rezones and 222 unit apartment complex establish a critical need for suitable public access and circulation into the area, if proper growth and development of the area is to proceed. We also point to the Streets and Arterials plan, purposes and objectives , pages 2 and 3, which clearly indicate a need for suitable public streets consistent with land use trends . Regarding the location of a Street extending south from NE 4th Street, we are not adverse to an alternate location being provided. However, it' appears that the existing platted 30 foot right of way along the cemetery boundary, together with an additional dedication of 30 feet adjacent to the east of it, is the most appropriate and significantly established alternative to date. Further dedications will take place through rezones , site development, and possible condemnations . We would not object to a street along the power transmission line easement provided it was dedicated and developed to suitable city standards . The matter of access to Union Ave. NE is also important, particularly with regard to the Wehrman and Stone properties . However, such access will also provide an important link to the overall circulation pattern of the area as it will eventually connect to the proposed north/south street. It appears , given the validity of the 10/30/68 letter from the 10 L. Rick Beeler June 12, 1978 Page Two city clerk to Mr. Wehrman, that a full 60 feet of right of way (south 30 feet of Wehrman property and north 30 feet of city property) is possible from Union Ave. to the Stone property, with the possibility of the north 30 feet of the Stone property and the south 30 feet of the property to the north being dedicated and developed as part of rezone and development of these properties . Page Two The Examiner asked Mr. Smith if the applicant possessed legal access over the 30-foot strip owned by the cemetery and the 24-foot strip owned by Mr. Ben Stark. Mr. Smith . deferred the inquiry to the applicant who advised that purchase of the 24-foot strip was not possible due to unreasonable purchase price and legal access could therefore not be gained. Mr. Smith clarified that the 30-foot strip is considered a public right-of-way by the City of Renton; however, litigation was pending involving the city and cemetery owners to establish status of legal ownership of the property. It was noted by the Examiner that alternatives such as shifting the proposed right-of-way to the east or - condemnation procedures may be necessary to gain access across the 24-foot piece of property. The Examiner asked for further testimony. Responding was: Marvin Wehrman 7459 S. 128th • Seattle, WA 98178 Mr. Wehrman indicated that although the existing Bonneville power line easement could not be utilized for construction of structures, it could be utilized for private access circulation purposes and parking for future developments. The Examiner asked Mr. Morgan for the division's opinion regarding the necessity of possible public access in conjunction with the 30-foot strip and condemnation of Mr. Stark's property to the property to the south. Mr. Morgan felt that the alternative would be logical for access to properties located to the south but that access from N.E. 4th Street would also be, a solution for the subject property. Responding to the Examiner's inquiries, Mr. Morgan indicated that consideration of plans to create a public right-of-way to the south from N.E. 4th Street had not occurred prior to the subject •application and that additional detailed study of proposed development would be required prior' to final determination of access provisions. Mr. Wehrman indicated that a demand for public access does not exist in the subject area due to joint ownership of 12 to 13 acres proposed to be developed by the same developer and because the Leisure Estates Mobile Home Park maintains a single primary access to Union Avenue N.E. and would not require public access to N.E. 4th Street. The Examiner advised that recent recommendations pertaining to expansion of the mobile home park required provision of a secondary access to align with the existing 30-foot strip currently involved in litigation. Mr. Smith advised plans for construction under building permit procedures of a proposed 222-unit apartment complex directly south of the subject site along with other high density development which would create a requirement for public access in the area. He noted that a possibility may exist to develop the entire area through a Planned Unit Development process in a single unified development with review of total access during final site approval. Regarding utilization of the Bonneville power line easement for access, Mr. Smith advised that power companies previously had been reluctant to improve public streets along transmission line easements although the access alternative still may be possible. He emphasized that it would be necessary to provide a north-south connector for controlled access onto .N.E. 4th Street as well as an east-west connector for access to Union Avenue N.E. Mr. Wehrman advised that a street will be developed south of Prairie Market from • Union Avenue N.E. to provide access to the proposed developments. . Responding to Mr. Smith's review of proposed development in the area, the Examiner asked Mr. Morgan for a recommendation from the Traffic Engineering Division regarding the need for public access to the subject properties from N.E. 4th. Street. Mr. Morgan reviewed potential vehicle trip generation computed from proposed densities in the R-3 zones for . proposed developments including the 222-unit apartment complex, Stanley Stone and Marvin Wehrman rezones for proposed multi-family development which would be projected .at 1760 • vehicle trips per day with development to maximum density according to standard published studies utilized by the division. Responding to the Examiner's inquiry regarding whether public or private access would accommodate projected traffic volumes, Mr. Morgan indicated that while public access was preferable for future traffic volumes, a comprehensive study of circulation and proposed development in the area would be necessary to establish total access requirements. • Mr. Wehrman noted that the intent of the Comprehensive Plan for greenbelt designation on • . the proposed site would be negated by development of a public street on the westerly • • boundary of the property and suggested that access be developed along the transmission • . line easement connecting to an east-west street to Union Avenue N.E. which could be • designated as either one or two-way circulation. Responding to the Examiner's question regarding the adequacy of the proposed street from Union Avenue N.E. , Mr. Wehrman reported that in 1968 the Renton City Council had dedicated the northern 30 feet of the city-owned reservoir property 'to him for the purpose of `street development, and he would 'submit the letter or authorization 'as. an. exhibit during the public hearing for his rezone, R-166-78, • scheduled subsequently on. the agenda. Mr. Smith advised that during his review of the proposed 222-unit apartment complex, it was not apparent that the `development was functionally related'.,to the'proposals 'scheduled for hearing this date and if. the entire area was to be „dye]opid through a 'single developer a more cohesive•effort should be made to review June 15, 1978 ' . SUMMARY OF REQUEST: Applicant requests approval of a rezone from G to B-1 to allow the construction of multiple family housing units and/or . condominiums along with compatible retail outlets. SUMMARY OF Planning Department: Approval to 'B-1 with restrictive covenants. RECOMMENDATION: . • Hearing Examiner: Approval to B-1 with restrictive covenants. PLANNING DEPARTMENT The Planning Department staff report was received'by the REPORT: 'Examiner on May 25, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field ,checking the property and surrounding area, the Examiner . conducted a public. hearing on the subject as follows: The hearing was opened on May 30, 1978 at 9:00 a.m. in the Council Chambers of the Renton • Municipal Building. ' Parties wishing to testify were affirmed by`' the Examiner. . It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, .Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: .. Exhibit #2: Comprehensive Plan Map Revision, dated 3-8-72 Exhibit #3: Vicinity Map - 1-200 scale . Exhibit #4: King County Assessor's.Map Exhibit 45: Plot Plan, 1-20 scale The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Arthur D. Swanson . • 4512 Talbot Road South . Renton, WA 98055 Mr. Swanson indicated his concurrence with the exception of Section P.6 which recommends ,provision of a 20-foot landscaped setback/buffer along the westerly edge of the.subject site. He felt that the existence of a 30-foot strip owned by Greenwood Cemetery along with a privately-owned 24-foot strip of land located along the westerly boundary of the property provided sufficient distance to preclude provision of an additional 20-foot landscaped setback/buffer. The Examiner asked for testimony in support or opposition to the application. • There was no response. Mr. Smith clarified the intent and spirit of the Comprehensive Plan in requiring the landscape buffer because of the greenbelt designation of the subject property' ' on the plan, and because of the possibility of utilizing the aforementioned strips for street access purposes. Traffic Engineering Division representative, Clint Morgan, requested. clarification from Mr. Smith ,regarding possible inclusion of setbacks for future roadway widening purposes. . - He advised that installation of a double left-turn lane at N.E. 4th Street would require a roadway width of ,66 feet which was not provided with the proposed width of 54 feet. . Mr. Smith responded that recommendations .contained in Section P.5 for provision of a • ' , ' minimum 30-foot landscaped setback/buffer 'along N.E. 4th Street would accommodate the possible necessity for future roadway widening and installation'.of left-turn lanes. R-167-78 Page Four 7. Testimony was not presented regarding previous area land use or zoning analysis (Section 4-3014. (A) ) or the impact of significant improvements since those analyses (Section 4-3014. (C) ) . 8. The Comprehensive Plan Land Use Map indicates the property to potentially be Greenbelt (Section 4-3014. (B) ) . 9. Abutting the westerly boundary of the site is a 24+-foot strip of property that is privately owned, and immediately west of this strip is an existing 30-foot public right-of-way. This right-of-way is adjacent to the Greenwood Cemetery. Currently, the 30-foot right-of-way is in litigation concerning whether or not it has become private property of the cemetery. 10. Access to the property is available. from N.E. 4th Street of the transmission line easement. Staff recommended that access be developed on the westerly 30-foot right- of-way and that this access be public (60-foot right-of-way per attached memoranda of June 6, 1978 and June 12, 1978) , which would require use of the private abutting 24+-foot strip. Staff also recommended that this access be coordinated with vehicular circulation of the properties south of the site. 11. The easterly portion of the property extends into the transmission line easement. 12. B-1 zoning surrounds the property on the north, east and south sides. Low density 'single family (G) zoning (cemetery) abuts the western portion of the site. Testimony indicated that the property immediately south of the site is scheduled to be developed as a 220 unit multi-family complex. 13. Some substantial trees exist on the site. 14. Additional right-of-way for improvements in N.E. 4th Street may be necessary for dedication from the northern portion of the site. Testimony indicated that as much as ten feet of additional right-of-way may be needed. 15. In 1979, the intersection of N.E. 4th Street and Union Avenue N.E. is scheduled for improvement to increase vehicular capability. CONCLUSIONS: • 1. Conformance with the Comprehensive Plan must be evaluated from the viewpoint of the Land Use Map and the Goals and Objectives. The Land Use Map indicates the property to be Greenbelt; however, a definition of this designation does not appear in adopted Comprehensive Plan documents. But it can be reasonably assumed that the intent of the Greenbelt is to provide an open space area in locations that are physically sensitive for development or that follow unique natural features. In , this instance the Greenbelt area on the Land Use Map appears to coincide with the transmission line easement, which would indicate an intent to retain the open space created by the easement and perhaps add open space areas of adjacent development. Testimony did not purport that the physical characteristics of the site posed developmental limitations. The condition of the easement is an open area cleared of almost all vegetation and used for access. Approximately the easterly 30% of the site lies within the easement. Dedication of additional area of the site for open space in conjunction with the easement would severely reduce the ability to reasonably develop the property. The Goals and Objectives of the Comprehensive Plan indicate that reclassification of the property to B-1 may be reasonable. B-1 zoning already abuts the westerly G zoning (cemetery) , and the reclassification would essentially constitute a "fill-in" of the existing B-1 zoning almost completely surrounding the site. This would be appropriate ". . .coordinated development of undeveloped areas. " (Summary, page 9, Comprehensive Plan, Renton Urban Area, July, 1965) . With some landscape buffer the rezone would not be ". . .unwarranted infiltration of incompatible uses which would contribute to premature decay and obsolescence, and prevent the development of orderly growth patterns." (Objective No. 1, Comprehensive Plan, Land Use Report, July, 1965) . Testimony did not claim that B-1 and the cemetery were incompatible uses. B-1 could be developed so as to protect ". . .property values. . .through the effective control of land use. . ." (Objective No. 4, Comprehensive Plan, Land Use Report, July, 1965) . This rezone would be the ". . .highest and best use in such a way as to promote the best interest of the community and contribute to the overall attractiveness and desirability as a place in which to work, shop, live and play." (Objective No. 6, Comprehensive Plan, Land Use Report, July, 1965) . R-167-78 Page Three various aspects of development. The Examiner suggested alternatives to the applicant including continuation of the public hearing to allow additional study of circulation requirements or closure of the hearing with subsequent receipt and review of the information to be included with the Examiner's report and recommendation on the matter. The applicant requested a brief recess to discuss the alternatives with associates. A recess was subsequently called at 10:05 a.m. and the hearing was reconvened at 10:20 a.m. Mr. Swanson reported that discussions with Mr. Smith during the recess had resulted in an acceptable proposal. Mr. Smith advised the applicants' concern with delay in development due to pending litigation regarding ownership of the 30-foot strip adjacent to Greenwood Cemetery and that review of utilization of the power line easement could be accomplished for possible public access. He indicated the applicants' willingness for. Examiner review of site development of the proposed 222-unit apartment complex concurrently with site developments proposed by Mr. Swanson, Mr. Stone and Mr. Wehrman which would be developed by one developer. He noted that the applicants' were in agreement that the public hearing be closed pending the study by the Traffic Engineering Division for review of access and circulation provisions. The Examiner advised his concern that his authority would not extend to encompass review of the proposed 222-unit apartment complex since development could occur through the building permit process and felt that Planning and Public Works Department review may be sufficient. Mr. Smith stated that because the proposed developments were closely associated, total review would be similar to Planned Unit Development procedures and would encompass aforementioned access problems and building placement during site development review. i Responding to the Examiner's inquiry regarding drainage provisions to prevent impact to or from the cemetery property, Mr. Smith reported Engineering Division concerns regarding drainage on the site and subsequent requirement for Public Works Department approval of final design. He indicated that a letter from Greenwood Cemetery relating to drainage problems would be submitted during review of a subsequent application on the public hearing agenda. The Examiner clarified that zoning designation of Commercial noted in Section B.9 of Exhibit #1 should be revised to Greenbelt designation. Mr. Smith confirmed the Examiner's statement. The Examiner reported that the public hearing would be closed and input from Planning and Public Works Departments would be received during the subsequent two-week period to be incorporated into the Examiner's report on the matter. He noted that the Planning Department had revised its recommendation for site approval of development included in rezones, R-165-78, R-166-78, and R-167-78 as well as on the 222-unit apartment complex proposed in the area owned by Mr. Wehrman. Mr. Smith advised that site approval had been previously recommended for the three rezoned developments and that the apartment complex review would be included due to its key relationship with the other properties to provide a comprehensive development for the entire area. The Examiner noted that he would retain flexibility in his final recommendation to determine the extent of his authority for including the apartment complex in his review. The Examiner asked for further comments. Since there were none, the hearing on File No. R-167-78 was closed by the Examiner at 10:30 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of reclassification of approximately 1.83 acres from G to B-1. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. ' 5. There was no opposition to the proposal expressed. • 6. All existing utilities are available and in close proximity.. R-167-78 Page Six Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed in writing on or before June 29, 1978. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or, the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record,, take further action as he deems proper. An appeal to the City Council is governed' by Title IV, Section 3016, which requires that such appeal be filed with theCity Clerk accompanying a filing fee of $25.00 and meeting other specified requirements Copies of this ordinance are available for inspection in the City Clerk's office, first floor of City Hall, or same may be purchased at cost in 'said.office. • R-167-78 Page Five 2. Conditions need to be attached to the rezone to achieve complete compliance with the Comprehensive Plan. A landscape buffer of 20 feet along the westerly property line would adequately buffer the development from the cemetery and possible road between the two properties. (Objective No. 1, Comprehensive Plan, Land Use Report, July, 1965) . Several substantial evergreen trees exist in this portion of the site which should be retained and used in the landscape buffer. This buffer would ". . . contribute to the overall attractiveness and desirability. . . " of the community and neighborhood (Objectives No. 2 and 6, Comprehensive Plan, Land Use Report, July, 1965) . . 3. Due to the potential expansion of the right-of-way of N.E. 4th Street for improvements, the northerly 30 feet of the site should be retained for landscaping. The existing substantial evergreen trees in this landscaping area should be retained as part of the landscaping of the site and any development. (Summary - Objectives, ' page 26, Comprehensive Plan, Arterials and Streets, June, 1965) . 4. Access to the site is readily available. In the best interest of the community and area surrounding the site a coordinated access is appropriate. The. study (attached) ' by the Planning and Public Works Departments indicated the 30-foot public right-of-way lying westerly of the property should be expanded to 60 feet to include a public street. ' This street would serve properties in the interior of the "block. " Condemnation may be necessary of the 24+-foot strip of property intervening between the cemetery and Mr. Swanson's property. , Approximately six feet of his property will' be required for the full 60-foot right-of-way. This right-of-way is appropriate in view of proposed development south of the site and resultant needed access. 5. The Public Works Department will review the storm drainage plans during the building permit process for conformance to Ordinance No. 3174. RECOMMENDATIONS: . ' Based upon the record, testimony, findings and conclusions, it is the Examiner's recommendation that the City Council approve the reclassification from G to B-1 subject to: 1. Dedication of the westerly approximate six feet for public right-of-way so as to constitute a total of 60 feet in conjunction with the property westerly of the site. Access for development on the property shall preferably be to and from this public street. . 2. Agreement to participate On a fair-share and equitable basis in an LID for improvement of this street. 3. The westerly 20 feet, exclusive of the aforesaid dedication of right-of-way, shall be a landscape buffer between the property and the cemetery per approval of the Planning DepartMent. Existing vegetation in this buffer area shall be retained. 4. The northerly 30 feet shall be reserved for landscaping. Existing substantial vegetation shall be retained in this landscaping area. '5. Retention of existing trees as much as possible on the remainder of the site. One parcel, the subject of R-165-78, is totally landlocked at the present time. Also from a land use intensity standpoint, the existing extensive amount of B-1 zoning together with the proposed rezones and 222 unit apartment complex establish a critical need for suitable public access and circulation into the area, if proper growth and development of the area is to proceed. We also point to the Streets and Arterials plan, purposes and objectives , pages 2 and 3, which clearly indicate a need for suitable public streets consistent with land use trends . Regarding the location of a Street extending south from NE 4th Street, we are not adverse to an alternate location being provided. However, it appears that the existing platted 30 foot right of way along the cemetery boundary, • together with an additional dedication of 30 feet adjacent to the east of it, is the most appropriate and significantly established alternative to date. Further dedications will take place through rezones , ' site development, , and possible condemnations . We would not object to a street along the power transmission line easement provided it was dedicated and developed to suitable city standards . The matter of access to Union Ave , NE is also important, ,particularly with regard to the Wehrman and Stone properties . However, such access will also provide an important link to the overall circulation pattern of the area as it will eventually connect to the proposed north/south street. It appears , given the validity of the 10/30/68 letter from the L. Rick Beeler June! 12, 1978 Page Two city, clerk to Mr. Wehrman, that a full 60 feet of right of way (south 30 feet of Wehrman property and north 30 feet of city' property) is possible from Union Ave . to the Stone property, with the possibility of the north 30 feet of the Stone property and the south 30 feet of the property to the north being dedicated and developed as part of rezone and development of these properties . Wildlife: The existing vegetation of the site provides suitable habitat for birds and small mammals . 5 . Water: There is no surface water evident on the site. 6 . Land Use: The site is basically undeveloped. The surrounding area is primarily single family residential in nature with commercial uses located to the northeast. F. NEIGHBORHOOD CHARACTERISTICS: The area is predominantly single family residential in nature . G. PUBLIC SERVICES: 1. Water and Sewer: An existing 12" water main is located along Northeast 4th Street and a 16" main extends south on Union Avenue Southeast for approximately 750 feet. An 8" sanitary sewer is situated on Northeast 4th Street and a similar pipe is located on Union Avenue Southeast extending south for approximately 450 feet. 2 . However, resulting development from such rezone may disturb existing soil and vegetaiton, increase storm water runoff and have an effect on traffic and noise levels in the area. However, these can be mitigated by proper development ocntrols and procedures. K. SOCIAL IMPACTS: Future development subsequent to a rezone will increase population levels and the related social impacts. L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW. 43.21C, a Declaration of non-significance has been issued for the subject proposal. The proposed B-1 zone is not consistent with the comprehensive plan map element which designates the site and area within the powerlines easement as greenbelt. However, there is existing B-1 zoning east of the site, within the powerline easement and south of the site. 2. The Greenwood Cemetery is located west of the site. There is a 30 foot existing right of way adjacent to the cemetery together with a 30± foot strip between that right of way and the subject site. It appears that this strip of land was intended for use as a future access street. This right of way must be assured to provide suitable access to the site and area to the south. 3. The intent of the comprehensive plan greenbelt designation was to establish a buffer between the cemetery and future•uses to the east. At the time the compre- I hensive plan was adopted the powerline easement may have been considered a right of way owned by the power company. It appears that the plan was inaccurate in its assessment of the necessity, amount, and exact location of greenbelt buffer areas. It is a fact that B-1 zoning surrounds the site directly to the south and east. This has an effect of limiting the effectiveness of a greenbelt on the subject site. 4 It would appear that a more appropriate buffer or transitional land use would have been a medium or low density multiple family designation. Suitable setbacks and landscape buffers can also be established as part of rezoning, to correspond to the spirit of the plan. Comprehensive Land Use Report, Objectives 1 and 2 page 17. L. 4. The area along the north side of N.E. 4th Street is presently zoned and developed as B-1. 5. The need for a left turn lane along N.E. 4th should be studied and required as ! part of any rezone. 6. Given the amount of traffic and the potential for future widening of N.E. 4th Street, additional setbacks and landscape/buffer should be provided along N.E. 4th Street L (Comprehensive Plan Land Use Report, Objective 2, 4, and 6, page 17-18.) • 7. The Utilities Division has indicated that suitable sewer and water line extensions per the Comprehensive Utility plan will be required as part of site development. 8. There are a number of existing evergreen trees on the site. These should be retained as much as possible as part of site development and design. 9.
