__LUA17-000087,V-AMatch20,2017Page4of89.Noticeoftherequestedvariancewasmailedtosurroundingpropertyownersandpostedinthevicinityoftheproperty.Nopubliccommentswerereceived.10.Representativesfromvariouscitydepartmentshavereviewedtheapplicationmaterialstoidentifyandaddressissuesraisedbytheproposeddevelopment.Thesecommentsarecontainedintheofficialfile,andtheessenceofthecommentshasbeenincorporatedintotheappropriatesectionsofthisreportandtheDepartmentalRecommendationattheendofthisreport.11.ComprehensivePlanCompliance:ThesiteisdesignatedLowDensity(LD)ontheCity’sComprehensivePlanMap.ThepurposeoftheMDdesignationistoallowavarietyofsingle-familyandmulti-familydevelopmenttypes,withcontinuitycreatedthroughtheapplicationofdesignguidelines,theorganizationofroadways,sidewalks,publicspaces,andtheplacementofcommunitygatheringplacesandcivicamenities.TheproposaliscompliantwiththefollowingComprehensivePlanGoalsandPoliciesifallconditionsofapprovalaremet:ComplianceComprehensivePlanAnalysis,PolicyHHS-8:UtilizetheCity’sauthoritytorehabilitatehousingtopreventneighborhoodblightoreliminateunsoundstructures.,GoalHHS-C:Increasethestabilityofneighborhoodsbyfosteringlong-termhomeownership,propertymaintenance,andinvestmentsinexistinghousing.12.VarianceAnalysis:(Describerequestedvariance).Theproposaliscompliantwiththefollowingvariancecriteria,pursuanttoRMC4-9-250.Therefore,staffrecommendsapprovaloftherequestedVariance.ComplianceVarianceCriteriaandAnalysisThattheapplicantsufferspracticaldifficultiesandunnecessaryhardshipandthevarianceisnecessarybecauseofspecialcircumstancesapplicabletosubjectproperty,includingsize,shape,topography,locationorsurroundingsofthesubjectproperty,andthestrictapplicationoftheZoningCodeisfoundtodeprivesubjectpropertyownerofrightsandprivilegesenjoyedbyotherpropertyownersinthevicinityandunderidenticalzoneclassification.StaffComment:TheapplicantcontendsthatpracticaldifficultiesandspecialcircumstancesexistonthesubjectpropertyandavariancefromRMC4-2-1OAisneededforthefrontandsideyardsetbacksinordertorepairtheexisting,fire-damagedhometobecompatiblewithotherhomesinthearea,andtoeliminateablightfromtheneighborhood(Exhibit4).Therequitedfrontyardsetbackis30feet,andtherequiredsideyardsetbackisacombined20feetwithnolessthan7.5feetoneitherside.Theexistingfrontyardsetbackis28feet,andtheexistingsideyardsetbackforboththeeastandwestsideyardsis5feet.Compliancewiththecurrentfrontandsideyardsetbackrequirementswouldrequirethattheapplicantremovelargeportionsoftheexistinghomeinordertorepairthestructure.TheapplicantcontendsthatthehomesufferedfiredamageinAugustof2014,andhasremainedindisrepairforovertwo(2)years.Staffhasreviewedthevariancerequestandconcursthat,whilethesize,shape,topography,locationandsurroundingsofthesubjectpropertydonotprevent_ CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrotiveReport&DecisionKARSINGLEFAMILYSETBACKVARIANCELUA7-000087,V-AMarch20,2017Page5of2whichpreventtheapplicantfromreasonablycomplyingwiththerequiredfrontyardandsideyardsetbacks.Forexample,iftheapplicantweretoremove5feetonbothsidesofthebuildinginordertocomplywiththecombined20-footsideyardsetbackrequirement,itwouldsignificantlyimpactthefootprintoftheupstairsmasterbedroomandbathroom,aswellasdownstairsdiningandlivingroom(Exhibit7).Theupstairsbathroomwouldbereducedtoanapproximatewidthof3feet2inches;theupstairsmasterbedroomwouldbereducedtoanapproximatewidthof8feet3inches;thedownstairsdiningroomwouldbereducedtoanapproximatewidthof5feet6inches;andthedownstairslivingroomwouldbereducedtoanapproximatelywidthof8feet7inches.Compliancewiththeapplicablesetbackswouldrequireeithertheremovalofseveralroomsoracompletereconfigurationofthehomeinteriorinordertoprovideadequatelivablespace.Inaddition,removalof5feetofthesideand2feetofthefrontoftheattachedgaragewouldreducetheusabledepthofthegaragetoapproximately17feet,whichwouldimpactthepotentialspaceforinteriorparkingformostvehicles.Inthiscase,thespecialcircumstancesthatareapplicabletothesubjectproperty,includetheconfigurationandlocationoftheexistingsinglefamilyhomeonthelot.Thehomewaslegallyconstructedin1990,withinKingCountyJurisdiction.Theownerisattemptingtorepairthestructuretothesameconfigurationasoriginallyapprovedandconstructed.ThestrictapplicationoftheCodewouldpreventthepropertyownerfromenjoyingtherightsthatwerepreviously_ _ _ _ _ ______enjoyedpriortothefire.Thatthegrantingofthevariancewillnotbemateriallydetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzoneinwhichsubjectpropertyissituated.StaffComment:Theapplicantcontendsthattheproposedvariancetothefrontyardandsideyardsetbacksrequirementswouldnotbemateriallydetrimentaltothepublicwelfareorinjurioustopropertyorimprovementsinthevicinity.Asstatedabove,thehomesufferedfiredamageinAugustof2014,andhasbeenaneighborhoodblightforovertwo(2)years.Therefore,repairoftheexistingstructurewouldimprovethepublicwelfare,property,andcommunity,byeliminatedanunsightly,damagedbuilding.Staffconcurswiththeapplicantthattheproposalwouldnotbemateriallydetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzone.Repairofthefiredamagedhomewouldimprovethevalueofthestructureandproperty,andeliminateadamagedstructureandimprovetheneighborhoodcharacter.Thecurrentsetbacksoftheexistingstructureareconsistentwiththoseofhomesinthesurroundingneighborhood.Thatapprovalshallnotconstituteagrantofspecialprivilegeinconsistentwiththelimitationuponusesofotherpropertiesinthevicinityandzoneinwhichthesubjectpropertyissituated.StaffComment:Aspreviouslydiscussedabove,theapplicantcontendsthattheproposedvariancefromRMC4-2-11OAtothefrontandsideyardsetbackrequirementswouldnotbeaspecialprivilegeinconsistentwithotherpropertiesintheLUAI7-000087StaffReportv.3 CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrativeReport&DecisionKARSINGLEFAMILYSETBACKVARIANCELUA7-000087,V-AMarch20,2017Page6of8vicinity,asotherpropertiesinthevicinityoftheprojectsitehavesimilarsetbacks.Thishomeandthesurroundinghomesintheneighborhoodwerelegallyconstructedin1990withinKingCountyJurisdictionbeforetheareawasannexedintoCityofRentonviaOrdinance#5327onMarch1,2008.MostotherexistinghousesintheareawereconstructedpertheapplicableKingCountyZoningandarealsoconsideredtobenonconforminginregardstosetbacks.Staffconcursthattherequestedvariancewouldnotbeaspecialprivilegeinconsistentwithotherpropertiesinthevicinity,asthecurrentsetbacksoftheexistingstructureareconsistentwiththesurroundingneighborhood.Basedontheanalysisprovidedaboveundera.andb.,staffbelievesthatapprovalofareducedfrontandsideyardsetbackwouldnotconstituteagrantofspecial_______________privilegeandthatotheridenticalrequestswouldbegranted.Thatapprovalisaminimumvariancethatwillaccomplishthedesiredpurpose.StaffComment:Theapplicantcontendsthattherequested28-footfrontyardsetbackand5-footsideyardsetbackvariancearetheminimumneededtoaccomplishthedesiredpurpose.Approvalofthisvariancewouldallowtheownerstorepairtheexistinghomeinitscurrentlocation.Staffhavereviewedtherequestandagreethatthe28-footfrontyardsetbackand5-footsideyardsetbackvariancefromRMC4-2-OAistheminimumvariancenecessarytoallowfortherepairoftheexistingsinglefamilyhome.WhileremovingportionsofthehomewouldsatisfytherequiredfrontandsideVyardsetbacks,therequested28-footfrontyardsetbackand5-footsideyardsetbacksistheminimumvariancethatwouldaccomplishtheapplicant’sdesiredpurposeofrepairingthedamagedstructuretobeconsistentwiththesurroundingneighborhooddevelopmentpatternandcharacter.Staffconcurswiththeapplicantthattherequested28-footfrontyardsetbackand5-footsideyardsetbackvariancewouldbetheminimumvariancenecessarytoaccomplishtheapplicant’sdesiredpurpose.Therefore,staffsupportsthevariancefromRMC4-2-IOAfora28-footfrontyardand5-footsideyardsetbackforthesubjectsiteintheR-4zone.Staffrecommendsasaconditionofapprovalthatthisvarianceonlyapplytotheexistingstructureinitscurrentlocation,andanyfutureadditionsorexpansionstothestructureshallcomplywithcurrentcode.I.CONCLUSIONS:1.Thesubjectsiteislocatedat10321SEl9O”P1.ThesiteiswithintheResidential—4(R-4)zoningclassification.2.Theapplicant’sproposalistorepairanexisting,fire-damagedsinglefamilyresidencewithexistingsetbacks(28-footfrontyardsetbackanda5-footsideyardsetbacksforboththeeastandwestsideyards).3.A30-footfrontyardsetbackandcombined20-footsideyardsetback(withnolessthan7.5feetoneitherside)isrequitedintheR-4Zone(RMC4-2-11OA).4.TheanalysisoftheproposalwasevaluatedaccordingtovariancecriteriaandisfoundinthebodyoftheStaffReport.Theprojectwouldcomplywithallfourvariancecriteriaifallconditionsaremet.LUA17-000087StaffReportv.3
