HomeMy WebLinkAboutHanson Baker Response April 2015DenisLawityr,-_LApril18,2015Community&EconomicDevelopmentDepartmentC.E.”Chip”Vincent,AdministratorJohnI.LudlowHansonBarkerLudlowDrumheller,P.S.2229112thAveNW,Suite200Bellevue,WA98004-2936viaemail:jludlow@hansonbaker.comSUBJECT:ResponsetoAlizaPropertiesConcernsRegardingKiddieAcademy(LUA15-000021)DearMr.Ludlow:IhavereviewedyourletterofMarch12,2015regardingtheCity’sissuanceoftheKiddieAcademyStateEnvironmentalPolicyActfSEPA)ThresholdDeterminationofNon-Significance,Mitigated(DNS-M)andtheAdministrativeSitePlanReview(FileNo.LUA15-000021).TheSEPAthresholddeterminationandadministratesiteplanreviewdecisionwereprocessedconcurrentlybytheCityofRentonandissuedonFebruary13,2015.The14-dayappealperiodfortheSEPAdeterminationandlandusedecisionendedat5:00pmonFebruary27,2015.Noappealswerefiled.YourletterstatesthatDannyKornfeldofAliza,Inc.didnotreceivenoticeoftheKiddieAcademyapplicationfortheenvironmentalandlandusereviewprocesses.Basedonanearliertelephoneconversationwithyou,IunderstandthatAliza,Inc.acquiredtheproperty,whichislocatedat4431NE4thStreet(APN518210041),inthelateOctoberoflastyear.Becauseofyourinquiry,wereviewedthelandusefileandverifiedournotificationproceduresforthisapplication.ANoticeofApplicationwasmailedtopropertyownersandoccupantswithin300feetoftheboundariesoftheprojectsiteonJanuary20,2015.Also,three11”x17”brightpink“NoticeofApplicationandProposedDeterminationofNon-Significance—Mitigated(DNS-M)”signswereinstalledonornearthesubjectsiteonJanuary20thSincethisprojectrequiredSEPAreview,anoticeofthethresholddeterminationfortheDNS-MwaspublishedintheLegalNoticessectionoftheRentonReporteronFebruary27,2015.TheRentonReporteristheCity’snewspaperofrecord.AlsoonFebruary27th,theDNSMwasmailedtoagenciesandthosepartieswhorequestedfurthernotification.AnoticeoftheDNS-Missuance(brightpinkposter)wasinstalledinthreelocationsonornearthesubjectsite.And,noticeoftheprojectwaspostedtotheCity’swebsite,undertheCurrentLandUseApplicationspage.RentonCityHall.1055SouthGradyWay.Renton,Washington98057.rentonwa.gov Mr.JohnLudlowPage2of2April18,2015Forsurroundingpropertyownersinformation,werelyonpropertyownershiprecordsprovidedandmaintainedbyKingCounty.Changeofownershipinformationisnotimmediate;however,wedoourbesttoprovidealternativeformsofnotice.Aliza,Inc.wasnotindividuallynotifiedoftheapplicationduetoasKingCountypropertyownershiprecordsshowedthatAmberPropertieswastheowner.NoticewasmailedtoAmberPropertiesattheprovidedPostOfficeBoxaddress.NoticewasalsomailedtoAmberPropertiesat4431NE4thStreet,theaddressofKeyBank.WhileitisregrettablethatAlizaInc.didnotreceivenotice,theCityofRentonmetitslegalobligationsfornotification.Anotherconcerninyourletteriswithregardtotheaccessandparkingrestrictionsthatwererecordedatthetimeoftheshortplatwhichcreatedtwolots,thenowoccupiedbyKeyBank,andasecondlotthatisnowproposedforKiddieAcademy.Theshortplatwasrequiredtoprovidecrossaccessandcrossparkingeasements.ThiswasaccomplishedtotheCity’ssatisfaction.DuringreviewoftheKiddieAcademyproposal,parkingwasconsidered.Parkingfordaycarecentersisbasedonthenumberofemployees.Therequirementistoprovideoneparkingspaceforeachemployee,and2drop-off/pick-upspaceswithin100feetofthemainentranceforevery25clientsintheprogram.TheCity’sstaffreportanddecisionanalyzedtheparkingrequirementsandfoundthattheproposalhadadequateprovisionsforthenumberofparkingstallsneededfortheproposal.YouaskedthattheCityconsideryourcommentsandsuspendconsiderationofthedaycarecenter’sapplicationforbuildingpermitspendingresolutionofdifferencesviamodificationofthelanduseapplicationoranagreementbetweentheparties.TheCitywillnotsuspenditsreviewofpermitsforthisapplication,asthelanduseprocesshasbeencompleted,andtheCity’scodeshavebeenmet.Thisappearstobeaconcernbetweenprivateparties,andweencourageyoutocontinuetoworkwiththeotherpartyfies)toresolveyourdifferences.Sincerely,JenniferT.Henning,AICPPlanningDirectorcc:chipVincent,CEDAdministratorLarryWarren,cityAttorneyVanessaDolbee,currentPlanningManagerSteveLee,DevelopmentEngineeringManagerKrisSorenson,AssociatePlanner
