Page2property.NowetlandswereobservedonthepropertyoradjacenttothepropertyboundaryasfaraswasvisiblefromtheTranproperty.Theunnamedtributaryhasasmallwatershed(estimatedtobeabout40acresinsize)upstreamfromthesubjectparcel.Approximately80feetupstreamfromtheparcel,thestreamisimpoundedbya2-3foothighconcretedam.A24-inchdiameterCMPculvertcarrieswaterwestunderNE29thStreet.Thestreamconveyswaterapproximately700feetnorthandwesttoitsconfluencewithMayCreekwhichjoinsLakeWashingtonapproximatelyonemilefurthernorthandwest.MayCreekisknowntobeafishbearingstreamwithdocumentedpresencewithpossiblespawningforfallChinookandcohosalmonandwinterrunsteelhead.NofishpresencehasbeennotedintheunnamedtributaryontheTranproperty(SalmonScape2015).SiteHistoryTheTran’spurchasedthesubjectparcelin2011.Theexistingdilapidatedstructurewasdemolishedin2012,andsitegradingwascompletedtoallowforconstructionofanewresidenceunderthenewsinglefamilyresidencecombinationpermitnumberCP12039.Existingusesinthevicinityofthechannelpriorthenewconstruction(SeeFigure2)includedahomewithlandscapedyardincludingaswimmingpool,fence,androckterraceretainingwallwhichparalleledthechannel,approximately15feettothesouth.RegulatoryFrameworkTheregulatoryframeworkforworkalongthestreamandinitsbuffermustconsiderfederal,stateandlocalleveljurisdiction.FederalJurisdictionAsatributaryofMayCreekwhichflowstoLakeWashington,theunnamedtributarytoMayCreekontheTranpropertyisconsideredaWateroftheUnitedStates,andthuswillberegulatedunderSection404oftheCleanWaterAct.TheU.S.ArmyCorpsofEngineers(ACOE)regulatesworkbelowOrdinaryHighWater(OHW).FederalpermitsmayberequiredforanyworkthatoccursbelowOHW.TheACOENationwidepermit18allowsforminordischargesasfollows:1$.MinorDischarges.MinordischargesofdredgedorfillmaterialintoallwatersoftheUnitedStates,providedtheactivitymeetsallofthefollowingcriteria:(a)Thequantityofdischargedmaterialandthevolumeofareaexcavateddonotexceed25cubicyardsbelowtheplaneoftheordinaryhighwatermarkorthehightideline;(b)Thedischargewillnotcausethelossofmorethan1/10-acreofwatersoftheUnitedStates;and(c)Thedischargeisnotplacedforthepurposeofastreamdiversion.Notification:Thepermitteemustsubmitapre-constructionnotificationtothedistrictengineerpriortocommencingtheactivityif:(1)Thedischargeorthevolumeofareaexcavatedexceeds10cubicyardsbelowtheplaneoftheordinaryhighwatermarlforthehightideline,or(2)thedischargeisinaspecialaquaticsite,includingwetlands.(Seegeneralcondition31.)(Sections10and404). Page3Ifanyworkinthechannelisproposedandislimitedtostreambankstabilizationandhasdischargebelow10cubicyardsanddoesnotresultinstreamdiversion,noACCEpre-constructionnotificationshouldbeneeded.StateJurisdictionTheWashingtonStateDepartmentofEcologyregulateswaterqualityunderSection4OloftheCleanWaterAct.litheprojectimpactsarelessthan(temporaryorpermanentimpacts)‘/2acreofwetland,noindividual401reviewisrequired.AnHydraulicProjectApproval(HPA)wouldberequiredforanyworkbelowOHW.MostconstructionprojectsoractivitiesinornearstatewatersarerequiredtoobtainanHPAfromWashingtonDepartmentofFishandWildlife(WDFW)whichisdesignedtoensureprojectsmeetstateconservationstandardstoprotectfishlife.LarryFisheristheregionalwildlifebiologist.AnHPAapplicationcanbecompletedbyfillingouttheonlineapplicationformlocatedatthewebsiteaddressLocalJurisdiction:CityofRentonLocalcodeprovidesforprotectionofcriticalareasincludingstreamsandtheirbuffers.Basedoncurrent2015codeguidance,theunnamedtributarycrossingtheIranpropertyisaCityofRentonStreamClass4(SeeFigure3).Class4streamshavebufferuserestrictionsforastandardwidthof35feet.Perthecode,thesebufferwidthsassumedegradedbufferswithnoenhancement.Codeallowsthatnarrowerbuffersmaybepermittedunderrestoredorimprovedbuffersthatrestoreandprotectriparianfunctions.Thisparcelhadapreviouslegalalterationthatoccurredwithinthebufferdecadesagointheformofaretainingwallandfence.ExistingConditionsThestreamanditsbufferatthispropertyexhibitcharacteristicsofaheavilyurbanizeditsriparianenvironment(seePhotographs1-3).ThestreamliesatthenorthernedgeoftheTranproperty.TheTranpropertyboundaryextendsaminimumof5feetanduptoapproximately13feetnorthofthestream.Adjacentlanduseontheparceltothenorthofthechannelisaresidencewithfencedyard.Alineofwesternredcedartreesparallelsthepropertyline.Vegetationintheherbandshrublayeronthenorthsideofthestreamissparseduetothedensecanopycoverformedbythelineofcedartrees(seePhotographi).ManylowerbranchesofthecedarswereclearedbytheneighborinlateJulyorearlyAugust2015whichhasopeneduptheunderstorytosomeextentalongthewesternedgeoftheproperties.Vegetationonthesouthbankofthestreamiscurrentlymaintainedlawnuptoarockterracewhicheffectivelystabilizestheslopeleadinguptothehome.Thestreambedliesinswalethatisapproximately6-8feetlowerthansurroundingtopography.Atopographicmapshowing2footcontoursinthevicinityofthispropertyisprovidedinFigure4.Thestreamisapproximately2feetwideatOHWalongthelengthofthechannelontheTranproperty(approximately80linearfeet).Alongmuchofthestream,thebankswerestabilizedwithreusedconcreteriprapthatappearstohavebeenplacedatleastseveraldecadesago.Hollowconcreteblockswereplacedmorerecentlyalong27linearfeetofthenorthernbankofthechannel.Theblockisproposedtoberemovedandbankswillbestabilizedwithrushesand/orsedges.Thestreambedsubstrateiscomposedofamixofsandandgravelwithsomesilt.Someofthegravel-sizedmaterialis Page4chunksofangularbrokenconcrete.Flowsareregulatedbyadamonprivatepropertythatisabout100feetupstreamfromtheTranproperty.AculvertatthewestedgeofthepropertyconveyswaterunderNE29thStreetandofftheproperty.ExistingStreamBufferFunctionsIntactriparianbuffersprovideimportantecologicalfunctionsthatcanbedescribedassupportingHydrology,Biogeochemistry,PlantCommunityandHabitat/FaunalSupportsystems(followingBrinsoneta!.1993,Brinsoneta!.1995,andACKindig2003.).Riparianbuffersinanurbanenvironmentarecommonlydegradedfromdecadesofhumanencroachmentandprovideecologicalfunctionstovaryingdegrees.Hydrologyfunctionsprovidedbyriparianbuffersmayincludemaintenanceofwaterqualitytodownstreamwatersincludingstreamtemperatureregulation,andregulationofwaterquantityfromdelayingorretainingprecipitationandstormwaterrunoff.Biogeochemistryfunctionsprovidedbyurbanriparianbuffersmayincluderegulationofsedimentandnutrientinputstodownstreamwaterwaysthroughstreambankstabilizationandfiltrationofrunofffromupgradientsystems.Riparianbuffersmaysupportdiversenativeand/ornon-nativeplantcommunities.Theseplantcommunitiesmayprovidelimitedhabitatopportunitiesforaquaticspecies,smallbirdsormammals,andbeneficialinsectswithlifehistorystrategiesthatallowsurvivalinnarrowcorridorswithintheurbanenvironment.Inthisurbancorridor,theprimarygoalsforprotectingandenhancingriparianbuffersaretosupportcleanerwater,streamtemperatureregulation,streambankstabilization,andtoalimiteddegreeprovideimprovedhabitatforaquaticspeciesandwildlifethatcansurviveintheurbanenvironment.EcologicalfunctionsprovidedbytheriparianbufferalongtheunnamedtributarytoMayCreekaredescribedunderexistingconditionsinthesectionsbelow.Thenextsectiondescribestheproposedbufferrestorationandenhancementactivitiesandassessespotentialforimprovementinecologicalfunctionsthatmayresultfromthiswork.HydrologyFunctionsUnderexistingconditions,thestreamanditsbufferprovideminimaltonohydrologyfunctionswithenhancewaterqualityorregulatingstormwaterrunoff.Treecanopycoveroccursonlyonthenorthernbankofthechannel.Thechannelisrecessedwithintheshallowravineandispartiallyshadedbythesetreesduringmid-summer.Thesetreesalsointerceptsomeprecipitationtohelpreducestormrunoffenteringthestream.Thechannelbanksarenearlyverticalwithriprapliningmuchofthechannelonbothsides.Sedimenttransportmayoccurtothestreamfrombaresoilbelowthecedarcanopy.Intactlawngrassonthesouthernbankreducespotentialfortransportofsedimenttothestreamfromerosion.Theexistingretainingwallsupslopefromthestreamreduceprecipitationrunofffromtheupslopeurbanenvironment.BlogeochemistryFunctionsUnderexistingconditions,thestreamanditsbufferprovidelowtomoderatebiogeochemistryfunctioning.Thereisminimalvegetationincontactwiththestreamduringnormalflowsduetoriprapalongsteepchannelbanks.Theplantcommunityismaintainedlawntothesouthandbareherblayeronthenorthandthusthereisminimalpotentialfornutrientuptakeandtransformationsintheriparianbuffer. Page5PlantCommunityFunctionsThecedartreesparallelingthepropertylineareanativetreespecies.Therestoftheriparianbufferisdominatedbynon-native,predominantlyherbaceousspeciesincludingweeds,lawngrasses,andhorticulturalplants.Thenorthernbankhasonlysparsevegetationintheunderstory.Underexistingconditions,thestreamanditsbufferprovidelowtomoderateplantcommunityfunctions.Thecedartreecanopytothenorthofthestreamprovidesaslightpotentialforinsectandlitterfallinputtothecreekthatcouldsupportdownstreamaquaticfoodwebcycling.FaunalSupport/HabitatFunctionsMinimaltononativefaunalsupportorhabitatfunctionsareprovidedwithinthestreamoritsriparianbufferunderitsexistingconditions.Nofishareknowntooccurwithinthissmall,2-footwide,unnamedtributary.Thereislittlehabitatstructurewithinthechannelduetothestraight,ripraplinedbank.Thesparseunderstoryplantcommunityandadjacentdevelopedareaslimitpotentialspeciesthatcouldutilizethishabitat.However,ducksanddeerhavebeenseeninthisripariancorridor(A.Iran,Pers.Comm.2015).ProposedProjectPlantingPlanTheproposedplantingplanisprovidedinFigure5.Arowofnativeplantswillbeinstalledalongthenorthpropertyboundarytoprovidedualfunctionofdesignedvisualprivacyandlimitingtrespassandrestoringnativeplantcommunityfunctions.TherowoftallOregongrape(Mahoniaaquifolium)willbeplantedat3-footspacinginarowthatparallelsthepropertyboundaryandsouthoftherowofcedartreesperFigure5.Theproposedplantingareaoccupiesapproximately110squarefeetinthestreambuffer.RemovalofConcreteBlockApproximately27linearfeetofverticalconcreteblockwillberemovedfromthenorthbankofthechannel.Thisstreambankinthisareawillberestoredtosoftbanksandstabilizedwithnativerushes(Juncuseffusus,Juncusacuminatus)and/ornativesedges(Carexutriculata,Carexlenticularisvar.lipocarpa).ConstructionSedimentandErosionControlMeasuresConstructionbestmanagementpracticeswillbeusedduringplantinstallationtopreventdischargeofsedimenttothestream.Mulchwillbeappliedatthebaseeachshrubasneeded.Fertilizersshouldnotbeusedgivenproximitytothestream.In-streamworktoremovethebankarmoringblockwillbedoneusingworkareaisolationtominimizesedimentdisturbance.AtypicalforworkareaisolationisshowninFigure6. Page6AnalysisofProjectEffectsThescaleoftheproposedplantingprojectisverysmallandthuspotentialliftforecosystemfunctionsislimited.Theproposedprojectwillprovideminor,incrementalpositiveimpacttoecosystemfunctioningintheriparianbuffer.HydrologyFunctionsIncreasingshrubcanopycoverintheriparianbufferwillprovideincrementalbenefitstoregulationofstreamtemperaturesalongthis80footlongreachofthestream.However,astheproposedplantingisonthenorthsideofthechannel,minimaladditionalshadingwillbeprovided.Someoftheshrubsmayoverhangthechannelastheygrowlarger.Additionalvegetationanddevelopmentofshrubandherbcanopylayersbelowthetreelayerwillinterceptadditionalprecipitationduringstormevents.Removaloftheconcreteblockandrestorationofherbaceousvegetationonthestreambankmayprovideminorreductioninstreamvelocitytodelaystormwaterrelativetocurrentconditionwiththeconcreteblock.Theproposedprojectwillresultinminorandincrementalincreaseinhydrologyfunctionsinthestreamanditsbuffer.BiogeochemistryFunctionsIncreasingplantcoveranddiversifyingtheplantcommunitythroughouttheriparianbufferwillincrementallyimprovebiogeochemicalcyclingopportunitiesinthisshortreachalongthestream.Restoringthechannelbanktosoilwithnativeherbaceousvegetationforbankstabilizationwillprovideminoropportunityfornutrientretentionalongthechannel.Duetothesmallareaandsinglenativeshrubspeciesproposed,minimalchangestobiogeochemicalfunctioninginthebufferwillberealizedfromtheproposedproject.PlantCommunityFunctionsTheproposedprojectwillincrementallyincreasethenativeplantdiversitywithinaportionofthebufferbydevelopinganunderstoryshrubcanopycoverbelowthecedartrees.Thisshrubcanopycovermayprovidegreatershadecoveroverthestreamthatcouldhelptoregulatestreamtemperatures.Installingtherowofnativeplantsinthebufferisdesignedtolimithumanaccesstothestreamandareaimmediatelyadjacenttothestream.Theproposedprojectwillhaveaminorandincrementalincreaseinplantcommunityfunctionsinthestreambuffer.FaunalSupport/HabitatFunctionsAlthoughonlyaverysmallincrementalincreaseinnativeplantdiversityisproposed,increaseddiversityinnativeplantcommunitywillincrementallyincreasetheopportunitiesforforagingbirdsandbeneficialinsects.Therearelimitedopportunitiesforimprovingfaunalsupportfunctionsduetotheheavilyurbanenvironmentinthesurroundinglandscape.Duetothescaleofthisprojecttherewillbelittletonochangeinfaunalsupport/habitatfunctionsduetotheproposedplantingproject.RecommendedProjectConditions•Nopesticidesorfertilizersshallbeusednorthofthefenceorrockretainingwall.Grassnorthoftherockwallshouldbelefttogrowandshouldnotbemowed.
