CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrativeVarianceReport&DecisionFORTUNEPOKERPOLESIGNSVARIANCELUA5-000810,V-AReportof:December21,2015Page2of7B.PROJECTDESCRIPTION/BACKGROUND:TheCity’ssignregulations(RMC4-4-100G.S)prohibittheuseofpolesignswithintheUrbanDesignAreasandrequiretheremovalofsignagewithin90daysoftheclosureofabusinessfRMC4-4-100D.6).Therearetwoexistingpolesignsonthesite.TheSignRegulationsRMC4-3-100E.5.aalsoonlyallowsonesignforeachstreetfrontage.Therefore,theexistingnon-conformingsignsshouldhavebeenremovedupontheclosureofthepreviousbusinessRoyceCoffeeandLounge,whichclosedpriortoJuly2015.Andonlyonesignshouldbeallowedratherthantwo.Theapplicantproposestousethetwoexistingpolesignsandchangingthesignagewithinthecabinets.Theapplicantdoesnotproposeothersiteimprovements.ThewestpolesignislocatednearEastValleyRdentranceandtheeastpolesignislocatedattherearofthebuildingnearStateRoute167(Exhibit4).Bothpolesignsaretwo-sided.Thesigncabinetsfacenorthandsouthandaredirectedtowardson-comingtraffic.Theproposedsignswouldhavesimilarcolorpalletsbutdifferenttextandlayouts(Exhibit5).Thepolessupportingthesigncabinetswouldberepaintedfrompinktogreen.LightingfixtureswouldbechangedtoLEDstylebulbs.ThewestpolesignislocatednearthepropertydrivewayentrancealongEastValleyRoad(Exhibit3).Theexistingsigncabinetsitsontopofapoleandthepoleextendsapproximately17feet7inchestothebottomofthecabinet(Exhibit5).Theexistingsigncabinetdimensionsareapproximately9feet23inchesinheightby11feet1-inchinwidth.Theheightofthewestpolesigntothetopofthecabinetisapproximately26feet814inches.ThecabinetfacesonthepoleonthewestsideofthesitefacingEastValleyRdwouldberenovatedinordertoaddtheirlogo,theirname“FortunePoker,”and“Restaurant&Bar”(Exhibit5).Thesignwouldhaveanareaofapproximately100squarefeet.TheeastpolesignislocatednearthesharedpropertylinewiththeStateRoute167right-of-wayattheeastofthesite(Exhibit3).Theexistingsigncabinetsitsontopofapoleandthepoleextendsapproximately26feet4inchestothebottomofthecabinet(Exhibit5).Theexisitingsigncabinetdimensionsareapproximately13feet914inchesinheightby16feet714inchesinwidth.Theheightofthepolesigntothetopofthecabinetisapproximately40feet.Thecabinetfaceswouldberenovatedinordertoaddtheirlogoandthewords“Poker,”“Restaurant,”and“Bar”tothesign(Exhibit5).Thepolesignwouldhaveanareaofapproximately230squarefeet.C.EXHIBITS:Thefollowingexhibitswereenteredintotherecord:Exhibit1:StaffReport,datedDecember21,2015Exhibit2:TitleReportExhibit3:SitePlanExhibit4:PhotosofExistingPoleSignsattheSiteExhibit5:PhotoSimulationofProposedSignsExhibit6:NeighborhoodMapidentifyingpolesignsinthevicinityExhibit7:PhotosofExistingPoleSignswithinthegeneralvicinityandneighborhoodVarianceReport15-000810 CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrativeVarianceReport&DecisionFORTUNEPOKERPOLESIGNSVARIANCELUA5-000810,V-AReportof:December21,2015Page4of7Route167wouldrequireatallenoughcranetoreachoverthebuildingfromthewesttoteachthesignforremoval.Inaddition,EastValleyRoadisautilitytight-of-waycorridorwithundergroundsewerlines,gaslines,andelectricallines.AsidentifiedinasimilarpolesignvariancerequestbythenearbyAFKElixirsandEatery(LUA14-000368),inordertoensurethesecorridorutilitylinesarenotdisturbedduringtheinstallationofaconformingground-relatedmonumentsign,theapplicantwouldberequiredtoverifyandtesttheexistingsoilconditions,possiblyutilizinghydro-vacexcavationmethods,haulawaysoil,dealwithpossiblegroundwater,reinforceorsleeveexistingutilitylines,andinstallanewfoundation(Exhibit9).Staffhasreviewedtheproposedvariancerequestandconcursthattherequirementtoremovetheexistingpolesignandreplaceitwithaground-relatedmonumentsignmaycausetheapplicantunnecessaryhardship.Staffhasreviewedtheproposedvariancerequestandconcursthattherearespecialcircumstancesforremovingandaddingnewsignstotheproperty.Staffalsoconcursthatotherpropertyownersinthevicinityhaveexistingpolesignsandthatthestrictinterpretationofthesignregulationswoulddeprivetheapplicantofprivilegesenjoyedbynearbyproperties.b.Thatthegrantingofthevariancewillnotbemateriallydetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzoneinwhichsubjectpropertyissituated:Theapplicantcontendsthatthereuseofthesignswouldallowforadvertisementassimilarlyallowedtonearbybusinesseswithpolesigns.Theapplicantsubmittedasiteplan(Exhibit3)andtitlereport(Exhibit2)identifyingthefollowingeasementsonthesubjectproperty:1103039isdedicatedtoPugetSoundTraction,Light&PowerCompanyforElectricTransmissionand/orDistributionSystem,7605170692isdedicatedtotheCityofRentonforWaterLineMaintenanceandRepair,20030602001850isdedicatedtotheCityofRentonforWaterline,$012290361isdedicatedtotheCityofRentonforWaterMains,FireHydrants,andWaterMeters,20030602001850isdedicatedtotheCityofRentonforWaterline,and641475$isdedicatedtotheMunicipalityofMetropolitanSeattle.Staffhasreviewedtheapplicant’sjustificationsandconcurswiththeiranalysisandfindsthatthesignswouldnotbeenlargedbeyondtheircurrentsizes.Inaddition,thereuseoftheexistingsignswouldlimittheamountofgrounddisturbancethatwouldoccuriftheapplicantwererequiredtoremovethepolesignsandinstallamonumentsign.Thegrantingofthevariancewouldnotbedetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzoneinwhichthesubjectpropertyissituated.c.Thatapprovalshallnotconstituteagrantofspecialprivilegeinconsistentwiththelimitationuponusesofotherpropertiesinthevicinityandzoneinwhichthesubjectpropertyissituated:Theapplicantcontendsthattheapprovalofthevariancewouldallowthetenantthesameprivilegealreadygrantedtootherbusinessesinthevicinity.NearbyrestaurantsoperatinginthesamezoneincludingBurgerKingandAFKElixirandEateryhavebeenpermittedtoutilizepolesignstoidentifytheirbusinesses(Exhibit6).AFKElixirandEaterywasrecentlygrantedapprovaltoreuseanexistingpolesignjusttwolotstothesouthoftheprojectsitein2014(Exhibit9).Staffhasreviewedtheapplicant’sjustificationsandconcursthattheapprovalofthevariancewouldgranttheapplicantthesameprivilegetoutilizeexistingpolesignsthathavebeengrantedtoVarianceReport15-000810 CityofRentonDepartmentofCommunity&EconomicDevelopmentAdministrativeVarianceReport&DecisionFORTUNEPOKERPOLESIGNSVARIANCELUA5-000810,V-AReportof:December21,2015Page5of7otherpropertiesinthevicinityandsamezoningdesignation.Inaddition,thegrantingofthisvariancewouldnotconstituteagrantofspecialprivilege,asavailablespaceonsiteforapossiblemonumentsignalongEastValleyisencumberedbyutilityeasements.d.ThattheapprovalasdeterminedbythePlanningDirectorisaminimumvariancethatwillaccomplishthedesiredpurpose:Theapplicantcontendsthattheapprovalofthevarianceistheminimumnecessaryastheyarenotrequestingtallerpoles,onlythereuseofexistingpoleswiththeinstallationofasimilarsizesignaswerepreviouslyinstalledontheprojectsite.Giventhelimitedvisibilitytothebuildingatthefareastofthesite,itisclearthatapolesignisthebareminimumthatwillmakethisbusinessvisibletodriversonEastValleyRoad.Staffhasreviewedtheapplicant’sjustificationsandconcurswiththeiranalysis.TheapprovalofthereuseoftheexistingpoleswouldallowtheapplicanttoinstallasignofsimilarsizeaswhatwaspreviouslyusedontheprojectsitefortheRoyceCoffeeandLoungeandgrantstheapplicantthesameprivilegegrantedtootherpropertiesintheprojectvicinity.Howevertheapprovalofthisvarianceshouldnotbeintendedtograntfuturetenantstheabilitytoreusethepolesigns.Staffrecommendsasaconditionofapprovalthatthesubjectvarianceapprovaltoreusethepolesignsbevalidforaperiodof10yearsoruntilachangeintenantwhichevercomeslast.The10-yeartimeframeallowsthenewbusinesstheopportunitytooperateandgaincapitaltoprovidesufficientfundstocompletethelargeramountofworkthatwouldbenecessarytoconstructamonumentsignalongEastValleyandremovethetwopolesigns.Withthisconditionofapproval,thecurrenttenantwillbeabletoutilizethetwopolesignsforthetimethattheyoccupythesite,andifthetenantchanges,anewtenantcouldusethepolesignsuntilDecember21,2025.Withthisconditionofapprovaltherequestistheminimumvariancethatwouldaccomplishthedesiredpurpose.F.CONCLUSIONS:1.ThesubjectsiteislocatedontheeastsideofEastValleyRoad,at3650EValleyRoad,withintheCommercialArterial(CA)zoneandUrbanDesignDistrictD.2.ThesignregulationsprohibitpolesignswithinUrbanDesignAreasandonlyallowonefreestandingsignperstreetfrontage.Theapplicantisrequestingapprovaltoreusetwoexistingpolesignsandtoalsoallowtwosigns.3.TherequestedvariancesmeetthefourcriteriatobeconsideredinmakingadecisiononavariancerequestasspecifiedinRMC4-9-250B.5.TheanalysisoftheproposalaccordingtovariancecriteriaisfoundinthebodyoftheStaffReport.[G.DECISION:ThetwoAdministrativeVariancesfortheFortunePokerPoleSignsVariance,FileNo.LUA15-000810,isapprovedsubjecttothefollowingcondition:1.Thevarianceapprovaltoreusetheexistingtwopolesignsshallbevalidforaperiodof10yearsoruntilachangeintenantwhichevercomeslast.VarianceReport15-000810
