The proposed fence would extend along the rear property line to 5-feet east of the easterly side property line. Fence materials would include 1"x4" or 1"x6" cedar boards and pressure treated 4"x4" posts with cedar post caps (Exhibit 2). The fence posts would be placed at a minimum every 4 feet and a maximum of 8 feet. Renton Municipal Code (RMC 4-4-040D.2.d) allows fences with a maximum height of 72 inches (6 feet) along the rear property line except the fence shall be limited to 48 inches (4 feet) in height where it intersects the width of the required side yard setback of the side street. The side yard setback along a street in the R-8 zone is 15 feet; the applicant proposes to construct a 6-foot rear yard fence which encroaches 10 feet into the side yard setback along the street (Elma Place NE). The applicant states the purpose of the proposed fence is for privacy. The subject site is located in a developing neighborhood and is one of four lots in a unique "island" surrounded by streets (Exhibit 3). Because each of these four lots have driveways which access the garages from the front yards (along NE 3rd Place and NE 2nd Place), no sight distance issues would be encountered as a result of the proposed rear yard fence. An existing sidewalk abuts the property. The submitted site plan (Exhibit 4) indicates the location of the proposed fence. Staff recommends approval of the Lozier at Laurel Crest Special Fence Permit, LUA11-093, SF, as proposed.
