Projectl Description The applicant is requesting an administrative variance from the 20-foot
rear yard setback required in the Residential - 8 dwelling units,per acre
(R-8) zoning designation. Specifically, the applicant is proposing to
construct a 535 square foot attached garage with approximately 391
square feet of second story living space. The addition would project
approximately 8.5 feet into the required 20-foot rear yard setback. Prior to
the construction of the two-story addition, the applicant would be required
to demolish an existing 600 square foot attached carport and storage area
that is also partially located whin the required rear yard setback.

Project Description The applicant is requesting an administrative variance from the 20-foot
rear and setback required in the Residential - 8 dwelling units per acre
(R-8)yzoning designation. Specifically, the applicant is proposing to
construct a 535 square foot attached garage with approximately 391
square feet of second story living space. The addition would project

C. Project Description/Background:
The applicant, Rick Haight Construction, is requesting approval of an administrative variance
from the, required 20-foot rear yard setback in the Residential — 8 (R-8) zone (section 4-2-
110A). The subject site is located at 359 Thomas Avenue SW. The site is bounded by
Thomas Avenue SW on the east and other single-family residences to the north, south and
west.
Development standards in the R-8 zone require a minimum rear yard setback of 20 feet.
The setback is measured from the property line to the closest point of the structure. The
applicant,is proposing a reduction of this setback to eleven and one-half feet (11.5). The
reduced rear yard setback would allow the applicant to construct a new 535 square foot
attached ''two-story garage addition, enclose 68 square feet of existing porch space and
provide 391 square feet of second story living space. Initially, the applicant would be
required to demolish the existing 600 square foot carport and storage area, which is
currently located in close proximity to the planned addition.
The variance proposal would maintain the required 20-foot front yard (east) setback and 5-
foot side yard (north & south) setbacks along the respective property boundaries. However,
as the existing home is located approximately 11.5 feet from the rear.(western) property
boundary, the applicant is requesting a variance to align the proposed addition with the
existing rear building façade. As the proposed new addition would be partially located within
the required rear yard setback, an administrative setback variance is necessary.
The proposed addition is located on a lot that is 7,380 square feet in size and the proposed
residence's footprint (with the garage and second story addition) is 1,599 square feet, which
equals a total building lot coverage of approximately 22% (1,599 / 7,380 = 22%). The

proposal meets all other development standards (building height, etc.) prescribed in the R-8
zone.
The applicant contends that a hardship exists as the lot is only 60 feet deep, which would
only allow a 20-foot deep structure when you subtract out the required 20-foot front and rear
yard setbacks. However, the applicant argues that parking and maneuverability for two
vehicles could not be accommodated with a garage structure limited to 20 feet in depth. In
addition, the applicant is requesting that the new garage addition be allowed to line up with
the rear building line of the existing single family residence.
D. Consistency with Variance Criteria
Section 4-9-2508.5.a. lists 4 criteria that the Zoning Administrator is asked to
consider, along with all other relevant information, in making a decision on an
Administrative Variance application. These include the following:
The Zoning Administrator shall have authority to grant an administrative variance
upon making a determination, in writing, that the conditions specified below have
been found to exist:
a. That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, location or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in
the vicinity and under identical zone classification:
The applicant contends that special circumstances apply to the subject site that
impose limitations on the area on which an addition to the existing residence can
be built. Specifically, the applicant notes that the property in question is limited to
60 feet in lot depth, which limits the building depth to 20 feet (60-foot lot depth —
20-foot front yard and 20-foot rear yard setback= 20 feet).
Furthermore, the applicant contends that a 20-foot garage would not provide
enough area to park two large vehicles and provide adequate area to maneuver
around the two-parked vehicles. As other single-family residences in the area are
not constrained by a 60-foot lot depth and are allowed to construct deeper garages,
staff is in support of the proposed reduction of the rear yard setback to 11.5 feet.
Staff is also in support of the variance request as the reduced rear yard setback
Would allow the applicant to align the rear of the proposed addition up with the rear
of the existing single family residence.
b. That the granting of the variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone in which subject property is situated:
The granting of the variance would not be materially detrimental or injurious to the
property or public welfare. In fact, staff supports the proposed reduction in the rear
yard setback to 11.5 feet, which would allow the applicant to construct an attached
garage and second story living space. Staff anticipates the proposed addition
Would enhance the existing single family residence and the neighboring property by
adding a secure area to park vehicles and providing additional living space.
Furthermore, as a result of the proposed addition, the applicant would be required
to remove or demolish a dilapidated carport and storage area that may be
considered materially detrimental to the property owner and other neighboring
properties.

c. That approval shall not constitute a grant of special privilege inconsistent
with the limitation upon uses of other properties in the vicinity and zone in
which the subject property is situated:
Approval of the variance would not be considered a grant of special privilege as
other properties are allowed to construct attached two-car garages with living space
above. It should also be noted that all other pertinent R-8 development standards
would be met as a result of this proposal.
d. ' That the approval as determined by the Zoning Administrator is a minimum
variance that will accomplish the desired purpose:
Staff considers the approval of the proposal to be the minimum variance necessary
to accomplish the desired purpose of the addition. Moreover, the applicant is
requesting to construct a garage and second story addition that would line up with
the rear edge of the existing home, which is approximately 11.5 feet from the rear
(west) property line. All other setbacks and development standards would be
achieved as a result of this proposal. Furthermore, the applicant contends the
additional spaced gained by allowing the proposed addition to project into the rear
yard setback by approximately 8.5 feet would provide enough room to park to large
vehicles and still be allowed to maneuver around the parked cars.
FINDINGS, CONCLUSIONS & DECISION
Having, reviewed the written record in the matter, the City now makes and enters the
following:
E. Findings
1) !Request: The Applicant, Rick Haight Construction, has requested approval for an
administrative variance from the required 20-foot rear yard setback in the R-8 zone
'(section 4-2-110A) for the property located at 359 Thomas Avenue SW. Specifically,
the applicant is requesting a reduction of the 20-foot required rear yard setback to
'11.5-feet.
2) Administrative Variance: The applicant's administrative variance submittal
materials comply with the requirements necessary to process a variance. The
applicant's site plan and other project drawings are entered as Exhibits No. 1 through
6.
3) Existing Land Use: Land uses surrounding the subject site include: North: single
family residential; South: single family residential; East Thomas Avenue SW and
single family residential; and West: single family residential.
4) Zoning: The site is located in the Residential - 8 (R-8) dwelling units per acre zone.
The development standards for this zone require a 20-foot front and rear yard
setback, 5-foot interior side yard setback, and a 15-foot side yard along a street
setback. Maximum lot coverage is 35 percent or 2,500 square feet, whichever is
greater and building height is limited to 30 feet and two stories.
5) Lot width and depth:The subject site is approximately 123 feet in width and 60 feet
in depth, which limits the building depth to 20 feet (subtract 20-foot front and 20-foot
rear yard setback).
6) Lot and Building Size: The residence is located on a 7,380 square foot lot.
The applicant has designed a 535 square foot (first floor) addition to the existing

single family residence. The total proposed building footprint is 1,599 square feet,
which results in a building lot coverage of 22 percent.
F. Conclusions
1. The subject site is located at 359 Thomas Avenue SW, within the Residential - 8
Dwelling Units per Acre (R-8) zoning designation.
2. The R-8 zone requires a minimum 20-foot rear yard setback (section 4-2-110A). The
applicant is proposing a reduction of this requirement to 11.5 feet.
3. 'The analysis of the proposal according to variance criteria is found in the body of the
'Staff Report.

Land Use Action Appeals
The administrative land use decision will become final if the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.B, which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must
be made in writing on or before 5:00 PM on November 27, 2002. Any appeal must be accompanied by a
$75.00 fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications
may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals
to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing
through the'Hearing Examiner. All communications are public record and this permits all interested parties to
know the contents of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation of the appeal by the Court.

Re: Justification for the Variance Request
Julie Tharp's lot is 123 feet long by 60 feet deep. The setbacks for her lot are 20
feet in front and 20 feet to the rear lot. That leaves only a building structure of 20 feet.
The present building depth is 28 feet deep with 11 feet 6 inches to rear lot line. We
believe that because of the configuration of the lot that that in itself is a hardship. It
limits Julie Tharp's ability to improve the value of her property by adding an attached
garage.
Presently there is an attached carport and storage that needs to be replaced
because of dry-rot and decay. The attached garage will enhance the appearance of the
property on the front side or street side. Since the storage is less than 5 feet from
property line and is falling apart, by removing it and adjusting the garage to line up with
rear of house would only help to increase its value and thus would be a benefit to
surrounding properties.
By making these changes we would be making the house safer for Mrs. Tharp.
Two years ago, she and her late husband were victims of a home invasion. Our proposal
would allow Mrs. Tharp the ability to drive into her garage and enter directly into the
house.
It's important that we line up the rear of the garage to the existing house so that
we have enough depth in the garage for her to be able to exit her car and enter into the
home without going outside.

Project Narrative
The existing residence is a two story structure with an open carport. The
structure at the carport is in disrepair due to dry rot and is bad need of
replacement. The Owner, Julie Tharp, wants to enclose the open carport into a
more 'standard'enclosed structure while at the same time adding a second story
extension over the garage. The extension above the garage would open into an
existing bedroom area.
This proposal will not increase impervious surface, nor will it alter the streetscape
substantially. In fact, the addition will improve the street elevation due to the
continuance of the existing house'style'over the entire structure as viewed from
Thomas Avenue.
We seek an Administrative Variance, as discussed In the City of Kenton Nlannmg
Memorandum of 09.26,02, to allow a reduction of the rear yard setback to from
the 20' required in the R-8 zone to approximately 11'-6".
Most of the existing the residence is located approximately 11'-6"from the rear
property line.

General: We have completed a preliminary review of the pre-application for the above-referenced
development proposal. The following comments on development and permitting issues are based on •
the preiapplication submittals made to the City of Renton by the applicant. The applicant is cautioned
that information contained in this summary may be subject to modification and/or concurrence by
official decision-makers (e.g., Hearing Examiner,Zoning Administrator, Board of Adjustment, Board of
Public Works,and City Council). Review comments may also need to be revised based on site
planning and other design changes required by City staff or made by the applicant. The applicant is
encouraged to review all applicable sections of the Renton Municipal Code. The Development
Regulations are available for purchase for$50,plus tax, from the Finance Division on the first floor of
City Hall.
Project Proposal: The subject property is located at 359 Thomas Avenue SW. The proposal is to
remodel a portion of the existing single family residence along with constructing a new attached
garage. The existing single family residence is approximately 12 feet from the rear property line while
the existing carport is approximately 4 feet from the rear property line. The applicant is proposing to
remodel a portion of the existing single family residence that is within the required 20-foot rear yard
setback. In addition, the applicant has proposed to remove the existing carport and storage area and
construct a new garage and second story addition,which would also be located within the required rear
yard setback area.
Zoning: The subject site is zoned Residential at 8 dwelling units per acre (R-8). The R-8 zone is
primarily a single-family zone and only allows one residential dwelling unit per lot,
Development Standards: The R-6 zone permits one residential structure per lot. Detached
accessory structures are permitted at a maximum of two per lot at 720 square feet each, or one per lot
at 1,000 square feet. A handout listing the permitted uses and development standards tor this zone is
included with the attached materials.
Minimum Lot Size, Width and Depth: The R-8 zone requires a minimum lot size of 4,500 square feet,
a minimum width of 50 feet (interior lots) , and a minimum depth of 65 feet. The site plan submitted
indicates the existing lot conforms to the minimum lot width required per this zone; however, the
subject site has a substandard lot depth(60 feet).
Building Standards: The R-8 zone allows a maximum building coverage of 35% of the lot area for lots
over 5,000 square feet. Maximum building height is restricted to 30 feet and/or 2 stories for primary
structures and 15 feet and one story for nonresidential accessory structures. Driveways shall not be
closer than five (5) feet to any property Ilne. As indicated on the site plan, the existing residence and
proposed additions would result in a total building coverage of 28.5%. The proposal appears to meet
the building standards described above with the exception of the required rear yard setback area
discussed below.

Setback : The required setbacks in the R-8 zone are 20 feet in the front and rear and 5 feet on the
sides. All setbacks are measured from the property lines to the nearest point of the structure. It
should also be noted that decks that are 18-inches or less, measured from finished grade, are allowed
to be Iodated within setback areas.
The proposal appears to meet the.requirements of the R-8 development standards with the exception
of the rear yard setbacks, which would require an administrative variance approval to locate the
structures as proposed.
Administrative Variance: An Administrative variance would need to be applied for in order to reduce
the rear yard setback to five feet for the proposed two-story attached garage and to remodel any
portion of the existing single family residence that is located within the 20-loot rear yard setback area.
The burden would be on the applicant to demonstrate all of the following:
,
a. That the applicant suffers undue hardshp and the variance is necessary because of
special circumstances applicable to subject property, including size, shape,
topography, location or surrounding of the subject property,and the strict application of
the Zoning Code is found to deprive subject property owner of rights and privileged
enjoyed by other property owners in the vicinity and under identical zone classification.
b. That the granting of the variance will riot be materially detrimental to the public welfare
or injurious to the property or irrlp r^uarn-Z in rho vu unity and 7An9 in which subject
property is situated.

that will accomplish the desired purpose.
It is unlikely that staff would be able to support the requested variance(s) because it appears the
majority of variance decision criteria could not be justified in supporting such a request. Moreover,
basedlon the information provided,the applicant has sufficient lot area to construct an attached garage
uutslUi ul lira iuyuilui selbach areas. Nevertheless, Ctaff d000 have two options to consider, which
may be supported as part of an Administrative Variance process.
1) Staff would support a proposed variance request that reduced the rear yard setback to 12 feet. As
the existing residence is located approximately 12 feet from the rear property line,this proposal would
accommodate any remodel within the existing single family building footprint as well as allowing for a
new attached two-story garage,which would be located beyond the 12-foot rear yard setback. 2) Staff
may also support the proposed two-story attached garage to be built in the existing storage area and
carport footprint. However, if this option is chosen, Staff would not support any portion of the remodel
to the;existing single family building footprint that is located within the'20-foot rear yard setback area.
Application Requirements: See attached Variance Application submittal requirements for a
complete list of required submittal documents. Once a complete application is submitted, an
administrative variance will take approximately 6 to 8 weeks to process and would cost $100.00 plus
