Project Description/Background The applicants, Mark Johnson and Marianne Nicol, propose to subdivide a 0.50-acre parcel into three lots. The property is currently developed with an existing single family residential structure, which is proposed to remain on new Lot 1. Lot sizes proposed are: Lot 1 at 10,072 square feet, Lot 2 at 4,500 square feet and Lot 3 at 7,177 square feet. The proposal for eventual development of two new single family residences on new Lots 2 and 3 and the existing single family home on new Lot 1 would arrive at a density of 6.00 dwelling units per net acre (du/ac). Lots 1, 2 and 3 would be access from a shared driveway via Renton Avenue South. A portion of the driveway easement would be 16 feet in width adjacent to the current residence and would widen to the required 20 feet width at the point where the existing home ends. A total width of 12 feet of pavement would be provided along the entire length of the shared driveway. The 'topography of the subject site is generally flat with a small section of slopes up to 25% located at the northeast portion of the site. A rock retaining wall exists along the southern property line of the site which continues from new Lot 1 to Lot 3. A railroad tie retaining wall exists at the southern property line of new Lot 1. The 'site is located in the Aquifer Protection Area Zone 2 and is located in a moderate landslide hazard area according to the City's Critical Areas' maps. 2. Environmental Review Except when located on lands covered by water or sensitive areas, short plats are exempt from SEPA Environmental Review pursuant to WAC 197-11-800(6)(a). 3. Compliance with ERC Conditions N/A 4. Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Appreval of a plat is based upon several factors. The following short plat criteria have been established to assist decision-makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation The site is designated Residential Single Family (RSF) on the Comprehensive Plan Land Use Map. The RSF designation is intended to promote and enhance single family neighborhoods. The proposal is consistent with the RSF designation in that it would allow for the future construction of new single family homes, thereby promoting goals of infill development. Net development densities should fall within a range of 5 to 8 dwelling units per acre in Residential Single Family neighborhoods. The proposed project for three lots would arrive at a net density of 6.00 dwelling units per net acre which is within the allowable range. Policy LU-35. A minimum lot size of 4,500 square feet should be allowed in single family residential neighborhoods except when flexible development standards are used for project review. The three lots meet or exceed the minimum lot size of which the smallest lot is 4,500 square feet. Policy H-4. Encourage in fill development as a means to increase capacity. The proposal would create two additional lots, thereby increasing density within a currently developed residential area. b) Compliance with the Underlying Zoning Designation The subject site is designated Residential — 8 Dwelling Units per Acre (R-8) on the City of Renton Zoning Map. The proposed development would allow for the future construction of two new single family dwelling units with the existing home to remain. The allowed density range in the R-8 zone is a minimum of 5.0 to a maximum of 9.7 dwelling units per acre for lots one-half an acre or less in net size. Net density is calculated after the deduction of sensitive areas, areas intended for public right-of-way, and private easements serving 3 lots or more from the gross acreage of the site. The property does not contain any sensitive areas nor areas required for right-of-way dedication. Based on three lots, net density would arrive at 6.00 dwelling units per acre, which is within the allowed range. The allowed building lot coverage in the R-8 zone is 35 percent or 2,500 square feet whichever is greater for lots over 5,000 square feet in size and, lots 5,000 square feet or less are allowed to have up to 50% lot coverage. New Lot 1, with the existing residential structure, would have a lot coverage of approximately 19.6% after the short plat, which is lower than the maximum allowed. Setbacks in the R-8 zone are as follows: front yard is 20 feet, side yard is 5 feet, side yard along a street is 15 feet and the rear yard is 20 feet. New Lot 1, where the existing residence is to remain has setbacks from the all property lines greater than the development standards require; thus the lot is in compliance. It appears that new Lots 2 and 3 would meet the setback requirements and provide adequate buildable area. Each lot would have adequate area to provide two off-street parking spaces as required by the parking regulations. The R-8 zone permits accessory structures only when associated with a primary structure located on the same parcel. The plat plan shows a shed on new Lot 1 that will be required to be removed prior to recording of the final short plat. Staff recommends that a demolition permit be obtained and this outbuilding be removed prior to recording of the final short plat as a condition of the short plat approval. c) Compliance with Subdivision Regulations Streets: No new public streets would be created as part of the proposed short plat. The proposed subdivision is anticipated to generate additional traffic on the City's street system. In order to mitigate transportation impacts, staff recommends a condition of approval be placed on the project requiring a Transportation Mitigation Fee based on $75.00 per net new average daily trip attributed to the project. The two additional lots are expected to generate approximately 9.57 new average weekday trips per lot with credit given for the existing single family residence. The fee for the proposed short plat is estimated at$1,435.50 ($75.00 x 9.57 trips x 2 lots = $1,435.50) and is payable prior to the recording of the short plat. Blocks: No new blocks will be created as part of the proposed short plat. Lots: The minimum lot size permitted in the R-8 zone is 4,500 square feet. The proposed plat would create three lots, which are proposed as: Lot 1 at 10,072 square feet, Lot 2 at 4,500 square ' feet and Lot 3 at 7,177 square feet. The proposed lot sizes are compatible with.other existing lots in this area under the same R-8 zoning classification. The minimum lot depth of 65 feet is achieved by all lots and thus complies with the development standard. The residence to remain on new Lot 1 meets the required setbacks and lot coverage permitted in the R-8 zone. New Lot 2 appears that it would have the front yard facing the shared driveway (to the north) as the lot is sized at 62 feet x 72 feet whereby the minimum lot depth of 65 is required. New Lot 3 would have its front yard facing to the west. New Lots 2 and 3 appear to have adequate building area for the construction of single-family residences when taking setbacks and lot coverage requirements into consideration. The size, orientation and arrangement of the proposed lots comply with the requirements of the Subdivision Regulations and the development standards of the R-8 zone. d) Reasonableness of Proposed Boundaries Access: Each lot will have direct access to a public right-of-way via a shared driveway. A shared driveway is required to be a minimum of 20 feet wide with 12 feet of pavement. However, due to the constraint of the existing home's location and the physical characteristics of the site the shared driveway easement is proposed to be 16 feet wide at the western portion of the site. At the point where the existing house ends, the easement will be widened to the required 20 feet. The entire length of the easement will be a minimum of 12 feet of pavement. The Fire Department has given its approval of these modifications subject to the condition that the homes on new Lots 2 and 3 must be fully sprinklered. The Fire Department has also required that the far corner of the new home on new Lot 3 shall be within 150 feet from the end of the Fire access roadway. In order to ensure that the all shared improvements are maintained, staff recommends as a condition of approval that a maintenance agreement is established and recorded concurrently with the short plat. Staff also recommends a condition of project approval requiring the applicant to provide a sign listing all addresses, to be located at the intersection of driveway and Renton Avenue South. This condition would insure emergency vehicles would be able to locate the homes in the event of an emergency. Topography: The topography of the site is generally flat at the western portion of the site with slopes up to approximately 25% at the northeastern corner of the property where new Lot 3 is proposed. The buildable area for new Lot 3 is outside of the sloped area. A geotechnical review of the site was conducted by Berquist Engineering Services. A geotechnical letter, dated November 6, 2002, was provided by the applicant to determine soil conditions. The letter indicates that the near-surface soils, as mapped by the USDA, as Gravelly Sandy Loam (Silty SAND (SM)) over glacial till. The SM soils are considered slightly to severely erodible depending upon the severity of the slope that they form. The underlying soils at this site are Vashon till which are dense to very dense. Though dense, the soils are moderately erodible due to their grain size distribution and ground surface slope. Construction is proposed to be away from the perimeter slopes. The geotechnical consultant further states that erosion control measures should be implemented to reduce erosion impacts. The measures include: minimizing the removal of vegetation outside the construction site; installing silt fences and hay bales; and covering soil stockpiles with plastic sheeting during rain. Staff recommends the following as conditions of approval. The applicant must install construction fence and silt fence along the down slope perimeter of the site. The silt fence is to be in place before clearing and grading is initiated. The project contractor is to perform daily review and maintenance of all erosion and sedimentation control measures at the site during the construction of both off-site and on-site improvements as well as building construction. Also, Temporary Erosion Control must be installed and maintained for the duration of the project. Relationship to Existing Uses: The properties surrounding the subject site are designated Residential — 8 Dwelling Units Per Acre (R-8) and Resource Conservation (RC) on the City's zoning map. The proposal is similar to existing development patterns in the area and is consistent with the Comprehensive Plan and Zoning Code, which encourage residential infill development. The Fire Department states that street addresses must be visible from the public right-of-way. The Fire Department has approved the modification to the driveway easement width provided several requirements are complied with as outlined in the aforementioned section of Access. A Fire Mitigation Fee, based on $488.00 per new single family lot with credit given for the existing single family residence, is recommended in order to mitigate the proposal's potential impacts to City emergency services. The fee is estimated at $976.00 ($488 x 2 new units = $976.00) and is payable prior to the recording of the short plat. Recreation: The proposal does not provide on-site recreation areas for future residents of the proposed short plat. However, there are existing recreational facilities in the area such as: Gene Coulon Memorial Park, Liberty Park and Cedar River Park that future residents would use. Therefore, in order to offset the additional use of these facilities, a Park Mitigation Fee would be required. A Parks Mitigation Fee of$530.76 per new single family lot is recommended prior to the recording of the short plat. Credit would be given for the existing single family residence. The fee is estimated at$1,061.52 ($530.76 x 2 new lots = $1,061.52) and is payable prior to the recording of the short plat. Schools: According to the Draft Environmental Impact Statement for the City of Renton Land Use Element (January 16, 1992), the City of Renton has a student generation factor of 0.44 students per single family residential dwelling. Based on the student generation factor, it is anticipated that the proposed short plat would result in one additional student (0.44 X 2 = 0.88) to the local schools (Talbot Hill Elementary, Dimmitt Middle School and Renton High School). However, the Renton School District has indicated they can accommodate any additional students generated by this proposal. Storm Water. Storm drainage facilities exist in Renton Avenue South. If 5,000 square feet or more of new impervious area dedicated to vehicular use, a Biofiltration Swale will be required. Detention may be required depending upon the post developed conditions. The System Development Charge will be at the current rate of $525.00 per new single family residence. Current charges would be for two lots x $525.00 per lot = $1,050.00 and is payable with the construction permit or prior to recording of the final short plat. Water and Sanitary Sewer Utilities: The site is within the Aquifer Protection Zone 2. A 6-inch water main is located in Renton Avenue South and provides 1,400 gpm. An eight (8) inch sewer main exists in Renton Avenue South. A new fire hydrant will be required to serve the short plat. For site activity during the months from October 1 to April 30, the applicant must follow the "Wet Season" guidelines in addition to standard erosion control requirements (see attached requirements). Additionally, code requires that a temporary erosion control plan be prepared and is to be installed and maintained for the duration of the project. All system development charges will be charged at the current rates as stipulated in the advisory notes. These fees are payable at the time of issuance of construction permits. H. Findings: Having reviewed the written record in the matter, the City now enters the following: 1. Afire mitigation fee of$488.00 is required for all new single-family structures. FIRE CODE REQUIREMENTS: 1. Afire hydrant with 1000 GPM fire flow is required within 300 feet of all new single-family structures. If the building square footage exceeds 3600 square feet in area, the minimum fire flow increases to 1500 GPM and requires two hydrants within 300 feet of the structures. 2. There is a 6-inch water main in Renton Ave S. The available fire flow from the existing 6-inch is 1,400 gpm. The static water pressure is 100 psi. Pressure Zone is 370 feet. SEWER 1 There is an 8-inch sewer main in Renton Ave S. STORM This project drains to the Lower.Cedar River basin (Arnold sub-basin). There are storm drainage facilities on Renton Ave S. STREETS There are curb/gutter fronting the property with Renton Ave S. CODE REQUIREMENTS WATER 1. The Water System Development Charge at a rate of $1,105.00 per new building lot will apply. 2. A new fire hydrant will be required. SANITARY SEWER 1. The Sewer System Development Charge at a rate of $760.00 per new lot will apply. 2. Plats shall provide separate side sewers stubs to each building lot. No dual side sewers are allowed. Side sewers shall be minimum 6" at 2% slope. SURFACE WATER 1. Surface Water System Development Charge at a rate of $525.00 per new building lot will apply. 2. The subject site is located on Renton Hill and is in an area designated as Residential Single Family (RS) on Renton's Comprehensive Plan Land Use Map and is currently zoned R-8,eight units per net acre. Relevanit Comprehensive Plan Land Use Policies: Policy LU-35. A minimum lot size of 4,500 square feet should be allowed in single family residential neighborhoods except when flexible development standards are used for project I. review. Policy LU-40. New plats developed at higher densities within existing neighborhoods should be designed to incorporate street locations, lot configurations, and building envelopes which address privacy and quality of life for existing residents. Policy LU-40.1. New plats proposed at higher densities than adjacent neighborhood de velopments may be modified within the allowed density range to reduce conflicts between old and new development patterns. However, strict adherence to older standards is not required. Policy LU-70. Streets, sidewalks,pedestrian or bike paths in a neighborhood development should be arranged as an interconnecting network. Analysis: The proposed short plat meets the minimum lot size with its smallest lot (Lot "2") being 4,500 square feet in area. The largest lot,Lot"1"is 10,360 square feet in area which raises questions about whether the applicant or the owner of that site will seek to subdivide this lot at sometime in the future. Even with an additional lot,however,the resulting density would be below the 9.7 units per net acre allowed in this one for lots less than th acre and platted before March 1, 1965. Pursuant to Policy LU-40.1 efforts should be made in the siting of new dwellings to reduce conflicts between old and new development while protecting the privacy and quality of life of existing residents. The rectangular-shaped ro the east side of the street property is situated on e. of 316 Renton Avenue South in Renton, Washington. The relatively level and flat site is about six feet above the elevation of Renton Avenue. The elevation chongeis facilitated by a rockery slope on the west side of the property in front of the existing house and o gently sloped, paved driveway along the north property line, north of the house. East of the existing single-family residence on the site, the property is relatively level and flat) and about five to seven feet above the property to the north. Eost of the east property line, the ground sur€ace remains flat for a distance of about 40 feet where the ground Surface slopes steeply down on estimated 30 to 40 feet. The near-surface soils at this site are mopped by the USDA as Gravelly Sandy Loam (Silty SAND (SM)) soils otiar glacial till. The presence of these surface soils was confirmed during my visit to the site. These soils are dense to very dense, Silty SAND (SM) with grovel to'SAND-SILT (SM) with grovel according to ASTM D 2488. Occasional cobbles and boulders may also be encountered within the glacial till. Though these soils are dense to very dense, they are considered moderotely erodible due their grain size distribution and ground surface slope_ The proposed plan is io construct two, residentiol structures on the level and floe portion of the site east of the existing house, Construction will be well away from the afoirementioned, perimeter slopes. Accordingly, if the typical and ordinary erosion control measures listed below are implemented during construction, there will be minimal risk to the site'and surmunding properties due to soil erosion. Minimize the removal of vegetation outside the construction site, • Install silt fences and hay bales at strategic locations,and • Cover so;'st::+-kpiles with plastic sheeting when rain is expected. The temporary erosion control systems used on this site should remain in-place and maintained until sufficient, permanent, landscape vegetation is established to prevent loss of surface soils. The proposed construction may begin as soon as the plat is approved,winter of 2002, and will continue for about 6 months once started. The hours of operation will be per the City of Renton ordinance covering construction work in residential neighborhoods. Hauling will primarily be done from the existing Renton Ave S.to S 3rd s'and to I-405. Very'little material will need to be hauled onto or off of the site. Excavation will be limited to the side sewer installation and the installation of the fire hydrant. Sweeping and or flushing depending on what is appropriate at the time will clean any dirt or mud coming from the site.Dust will be kept to a minimum by watering if needed. Review comments may also need to be revised based on site planning and other design changes required by the City or made by the applicant. I have reviewed the preliminary application for this 3-lots short plat, located at 326 Renton Ave S and have the following comments. WATER 1. There is an existing 6-inch water main in Renton Ave S. 2. All new construction must have a fire hydrant capable of delivering a minimum of 1,000 gpm and must be located within 300 feet of the structures. An additional fire hydrant will be required for this project. 3. The proposed project is located in the 370-water pressure zone and is within Aquifer Protection Zone 2. 4. The Water System Development Charge (SDC) would be triggered at the single-family rate of$1,105 per building lot. This fee is collected prior to issuance of a construction permit. SANITARY SEWER 1. There is an existing 8-inch sewer main in Renton Ave S. 2. Short plats shall provide separate side sewers stubs to each building lot.No dual side sewers are allowed. 3. The Sanitary Sewer System Development Charges (SDC) is $760 per new lot. These are payable at the time the utility construction permit is issued. SURFACE WATER 1. There are storm drainage facilities in Renton Ave S. 2. If there is 5,000 square feet or more of new impervious area subject to vehicular use, a Biofiltration swale is required. A storm drainage plan and drainage report design by 1990 King County Surface Water Manual is required with the formal application of the short plat. 4. The Surface Water System Development Charges (SDC) are $525 per building lot. These are payable at the time the utility construction permit is issued. STREET IMPROVEMENTS 1. All new electrical, phone and cable services must be underground. Construction of these franchise utilities must be inspected and approved by a City of Renton public works inspector prior to recording of the short plat. 2. A joint use driveway may be permitted for access to two (2) lots. The private access easement shall be a minimum of 20-feet wide with 12-feet paved. 3. Street improvements including, but not limited to paving, sidewalks, curb and gutter, storm drain and street signs are required to be constructed across the frontage of the parcel being developed along Renton Ave S. 4. The traffic mitigation fee of$75 per additional generated trip shall be assessed per single family home at a rate of 9.57 trips. GENERAL COMMENTS 1. All required utility, drainage and street improvements will require separate plan submittals prepared according to City of Renton standards by a registered Civil Engineer. The stated purpose of the Residential Single Family land use designation is set forth in Objective LU- J, below. Objective LU-J: Protect and enhance the Residential Single Family areas, encourage re-investment and rehabilitation resulting in quality neighborhoods, improve opportunities for better public transportation, and make more efficient use of urban services and infrastructure. Areas of Consistency with the Comprehensive Plan Policy LU-34. Net development densities should fall within a range of 5 to 8 dwelling units per acre in Residential Single Family neighborhoods. Policy LU-35. A minimum lot size of 4,500 square feet should be allowed in single- family residential neighborhoods except when flexible development standards are used for project review. Policy LU-36. Allow development at 9.7 dwelling units per acre on infill parcels of one acre or less as an incentive to encourage single family small lot development on 4,500 square ft. lots. Policy LU-40.1. New plats proposed at higher densities than adjacent neighborhood developments may be modified within the allowed density range to reduce conflicts between old and new development patterns. Two of the proposed three lots are 5,920 square feet each and the third, with the existing house,is 10,360 square feet in area. The total area is 22,200 sf. The.proposed density for this short plat is 5.89 units per net acre based upon a property size of 22,200 square feet with no deductions from gross area for streets or sensitive areas. The proposed short plat is within the allowable density range of minimum 5 du/a and maximum of 9.7 du/a. Mark Johnson Short Plat 2 07/09/02 Other relevant Comprehensive Plan Elements or other sections of the Land Use Element: Subdivision of Land Objective LU-O: Create a neighborhood development pattern consistent with Renton's older neighborhoods and an interconnected road network. The proposed short plat would not result in a neighborhood development pattern consistent with the existing residential neighborhood of Renton Hill. It would be consistent, however, with the potential future development pattern, as large lots of approximately 0.5 acre are subdivided for more dense urban development. Policy LU-80. Land should be arranged in blocks divided into lots with all lots required to front on a public street or a park. Although the two new houses would not front on a public street, they would share the existing drive with the house to remain. This means no additional curb cuts would be introduced onto Renton Ave S. According to Title IV code requirements, however, no more than two houses can be accessed from a single driveway (RMC 4-6-060K1). Reducing access drives on Renton Ave S is probably the preferable situation. The applicant is encouraged to review all applicable sections of the Renton Municipal Code. The Development Regulations are available for purchase'for$50.00 plus tax, from the Finance Division on the first floor of City Hall. Project Proposal: The subject property is addressed as 316 Renton Avenue South. The proposal is to subdivide a 21,750 square foot lot (0.50-acre) into three lots for eventual development of single family homes. Access would be via a 16 foot wide driveway. An existing single family residence is proposed to remain on new Lot 1. Zoning/Density Requirements: The subject property is located within the Residential - 8 dwelling units per acre (R-8) zoning designation. The density range required in the R-8 zone is a minimum of 5.0 to a maximum of 8.0 dwelling units per acre (du/ac). It appear that there are no areas to be deducted from the gross area of the site. The proposal for three dwelling units on the property would arrive at a net density of approximately 6.0 du/ac, which is in compliance with the density range of the R-8 zone. Development Standards: The R-8 zone permits one residential structure / unit per lot. Detached accessory' structures are permitted at a maximum number of two per lot at 720 square feet each, or one per lot at 1,000 square feet in size. Minimum Lot Size, Width and Depth = The minimum lot size permitted in the R-8 zone is 4,500 square feet. A minimum lot width of 50 feet for interior lots and 60 feet for corner lots, as well as a minimum lot depth of 65 feet, is also required. The proposal appears to comply with the minimum lot size, width and depth for all lots. .. Building Standards — The R-8 zone allows a maximum building coverage of 35% of the lot area or 2,500 square feet, whichever is greater for lots over 5,000 square feet in size. Lots under 5,000 square feet in size'are permitted a maximum building coverage of 50% of the lot area. Building height is restricted to 30 feet and two stories. Detached accessory structures must remain below a height of 115 feet and one-story with a gross floor area that is less than the primary structure. The required setbacks in the R-8 zone are 20 feet in the front, 20 feet in the rear, 5 feet on interior side yards, and 15 feet on side yards along streets. Access/Parking: Each lot is required to accommodate off street parking for a minimum of two vehicles per lot. In addition, appropriate shared maintenance and access agreement/easements will be required between lots with shared access. Private driveways may serve a maximum of two lots and must have a minimum easement width of 20 feet with 12 feet of paving. Addresses are to be visible from the public street by provision of a sign stating all house numbers and is to be located at the intersection of the driveway and the street. The existing single family home is located 16 feet from the northern property line. As three lots would be served, the proposed access easement is required to be 20 feet wide for emergency access. Sensitive Areas: Based on the City's Critical Areas maps, the site is located in. the Aquifer Protection Area (APA) —Zone 2. The APA zones prohibit certain types of facilities, restrict the use and storage of hazardous materials, and have additional requirements during construction and fill activities. If the project requires more than 100 cubic yards of fill, a source statement will be required. Medium Landslide Hazards may also be present on site based on the City's Critical Area maps which indicate the potential presence of landslide hazards. As required by the City's Critical Areas Regulations, a Geotechnical Report that addresses potential land slide issues would be necessary. Through the short plat review process, the City may condition the approval of the development in order to require mitigation of any potential hazards based on the results of the studies. In addition, pursuant to RMC section 4-3-050.J.3, the geotechnical report submitted with the application will be required to undergo independent secondary review by a qualified specialist selected by the City at the applicant's expense. Permit Requirements: The short plat would be processed administratively in approximately 6 to 8 weeks. The application fee for the short plat is $1,000, plus $0.37 per mailing label required for notification to surrounding property owners within 300 feet of the site. Fees: In addition to the applicable building and construction permit fees, the following mitigation fees would be required prior to the recording of the plat. • A Transportation Mitigation Fee based on $75.00 per each new average daily trip attributable to the project; • A Parks Mitigation Fee based on $530.76 per new single family lot; and, • A Fire Mitigation Fee based on $488.00 per new single family lot.
