CITY OF RENTON 1055 South Grady Way DEC 0 Renton, WA 98055 RECEIVED Dear Mr. Jainga and Mr. Jordan: Re: City of Renton Shoreline Substantial Development Permit—LUA-02-124;SM Burlington Northern & Santa Fe Railway Company-Owner Via Puget Sound Energy (Joe Jainga)—Applicant Department of Ecology Shoreline SDP#2002-NW-50082 The subject Shoreline Management Substantial Development Permit was received in this office on November 19, 2002. The project described is to construct 5130 feet of four-inch medium density polyethylene pipe natural gas distribution line starting within the improved right-of-way of Ripley Lane North, continuing along the roadway easement in unincorporated King County and the private roadway on Burlington Northern & Santa Fe Railroad property, and terminating at 6603 Ripley Lane . This distribution line will be installed by utilizing directional drilling with the right-of-way. Small dugout holes will be required approximately every 50 lineal feet for the directional drilling/boring equipment and all installation will be done landward of, but within 200 ft. of the ordinary high water mark(OHWM) of Lake Washington. Once the natural gas distribution line is installed and operational, the applicant anticipates serving the majority of residents located along Ripley Lane North. The applicant will apply for an SDP from King County for extension of the gas line to serve residents north of the Renton city limits. No vegetation, trees, or existing landscaping will be disturbed. The development authorized by the subject permit may NOT begin until the end of the 21 day appeal period, December 10, 2002. The Shorelines Hearings Board will notify you by letter if this permit is appealed. Other federal, state, and local permits may be required in addition to the subject permit. spa %of If this permit is not appealed, this letter constitutes the Department of Ecology's final notification of action on this permit. This action was taken on the following application: APPLICANT: Puget Sound Energy PROJECT: Ripley Lane Natural Gas Line Installation DEVELOPMENT DESCRIPTION: The applicant has requested a Shoreline Substantial Development Permit (SM) to locate approximately 5,130 linear feet of 4-inch medium density polyethylene natural gas distribution line within Ripley Lane North. The natural gas distribution line would be installed by utilizing directional drilling within the right-of-way. Small dugout holes will be required approximately every 50 lineal feet for the directional drilling/boring equipment. Otherwise, the project does not require any other open-trench work. All natural gas line installation would be conducted outside of the ordinary high watermark (OHWM) but within 200 feet of Lake Washington. Once the natural gas distribution line is installed and operational, the applicant anticipates serving the majority of residents located along Ripley Lane North. It should also be noted that the applicant is also requesting a Shoreline Substantial Development permit from King County, which would allow the applicant to continue the natural gas service north to residents outside the City of Renton Limits. Soils on the site consist of primarily medium dense to dense, partially saturated sand and sandy gravel. The material is classified as alluvial soil and has been determined to be suitable for this type of development. As the applicant has elected to utilize directional drilling/boring, very little on-site excavation is expected. All excavated materials not needed for backfill would be immediately trucked to an approved dumpsite. Project construction is anticipated to commence upon project approval and should be completed by the beginning of 2003. Due to the subject site's location within 200 feet of the Lake Washington ordinary high water mark (OHWM), the proposal is subject to the City's Shoreline Master Program. The area of proposed work is designated as an "urban" shoreline environment, which allows residential development and encourages locating such uses where existing residential development exists. The proposed natural gas distribution line would serve existing residential areas, which were previously developed along the shore of Lake Washington. Finally, environmental (SEPA) Review is not required for this project as the Washington Administrative Code (WAC) 1 97-1 1-80024d exempts, "all natural gas distribution lines and necessary appurtenant facilities and hookups." Project fair market value is estimated at$112,469.00 Project narrative: The project is located within an existing City of Renton road right-of-way and an improved King County easement road within Burlington Northern&Santa Fe Railroad right-of-way in unincorporated King County adjacent to Lake Washington. The project lies within NW section 29,TWP 24N,Rng 5E. The zoning designation of the site is R-8 and the shoreline area is designated as"Urban Environment". Puget Sound Energy proposes to construct 5130 feet of four-inch medium density polyethylene Pipe starting within the improved right-of-way of Ripley Lane N.located in the City of Renton and extends northward within the roadway to the end of the Renton City limits. At this point,Ripley Lane becomes a roadway easement within unincorporated King County. The pipe will continue North along the private roadway on Burlington Northern&Santa Fe Railroad property terminating at 6603 Ripley Lane. Each individual customer receiving the Natural gas service will have a Natural gas service line installed to their property by boring the line in,terminating at a new gas meter location at the residence. Puget Sound Energy plans to install Natural gas to four residences within the Renton City limits and twelve residences within the unincorporated portion of the project. The plan calls for installing the proposed four- inch Natural gas main by directional drilling within the prism of the private roadway to minimize disruption of the existing road. This work will take place outside the ordinary high water mark and 200 feet of Lake Washington,no vegetation, trees or existing landscaping will be disturbed. bEtitOp ofArrp '%'&?ONNiNG • NATURAL GAS MAIN INSTALLATION IN RIPLEY LANE N—RENTON,WA Natural gas main extension to Ripley Lane N(Renton,WA)and Ripley Lane S(King County)to serve requesting customer,Mr.Steve Heurion at 6831 Ripley Lane N. The following comments on development and permitting issues are based on the pre-application submittals made to the City of Renton by the applicant and the codes in effect on the date of review. The applicant is cautioned that information contained in this summary may be subject to modification and/or concurrence by official decision-makers(e.g., Hearing Examiner, Zoning Administrator, Board of Adjustment, Board of Public Works, and City Council). Review comments may also need to be revised based on site planning and other design changes required by City staff or made by the applicant. The applicant is encouraged to review all applicable sections of the Renton Municipal Code. The Development Regulations are available for purchase for$55.00, plus tax, from the Finance Division on the first floor of City Hall. Project Proposal: The subject site is located near Ripley Lane North (inside the Renton City limits) and continues northward into Unincorporated King County. Puget Sound Energy is proposing to construct a four-inch polyethylene(PE) natural gas pipeline and associated residential services to provide natural gas to residences located near the subject area. The project is planned to extend northward out of the Renton City limits and into unincorporated King County. Zoning/Shoreline Designation: The subject property is located within the Residential-8 dwelling units per acre(R-8)zoning designation. The site is also located within the 200-foot boundary of the Lake Washington shoreline, which is regulated by the City's Shoreline Master Program. This shoreline area is designated as an "Urban Environment." In addition, because this project is located within 200 feet of Lake Washington, a City of Renton Shoreline Substantial Development Permit will be required. Development Standards: In general, utilities are allowed to be located within the 200-foot shoreline setback, when located within the Urban Environment. However, the applicant shall be required to demonstrate that the disturbed project area can be restored to its original condition. The City's shoreline regulations contain the following specific design criteria for utilities(pursuant to RMC section 4-3-090.L.18.a,b,c): Native Vegetation—The native vegetation shall be maintained whenever possible. When utility projects are completed in the water or shoreland, the disturbed area shall be restored and landscaped as nearly as possible to the original condition, unless new landscaping is determined to be more. desirable. Landscaping—All vegetation and screening shall be hardy enough to withstand the travel of service trucks and similar traffic areas when such activity occurs. Screening of Public Utilities—When a public utility building, telephone exchange, sewage pumping operation or a public utility is build in the shoreline area, the requirements of this Master Program shall be met. Environmental(SEPA) Review: The Washington State Environmental Protection Act(SEPA) indicates,"natural gas distribution lines and necessary appurtenant facilities and hookups" are exempt from SEPA review when not located on"lands covered by water"(WAC197-11-80024d). Therefore, you will not be required to go through any SEPA review as part of this City of Renton shoreline permit process. Pre00-007PSE gas Iine.doc\ However, the applicant should also note, that when considering the listing of Chinook Salmon as threatened under the Endangered Species Act,the State of Washington, Department of Ecology, may require additional information prior to initiating the 21-day appeal period for the shoreline permit. For example, the Department of Ecology may require additional studies or a Biological Evaluation, which • • • *demonstrates the proposal would not result iri any adverse impact to salmon That cannot be mitigated • or minimized. Land Clearing and Tree Cutting Regulations: Currently, the Renton Municipal Code establishes a 25-foot setback from regulated streams. However, because your proposal is for the installation of a SEPA Exempt Public or Private Utility, the proposal is also exempt form the Tree Cutting and Land Clearing regulations(RMC 4-4-130C4). Shoreline Substantial Development Permit:The proposal would exceed$10,000.00 in value for construction costs and, therefore, does not qualify for an exemption from the Shoreline Substantial Development Permit, thus a City of Renton Shoreline Substantial Development Permit will be required. Permit Requirements/Timeframes: The proposal would require a Shoreline Substantial Development Permit. The project would be processed within an estimated time frame of 6 to 8 weeks, including the necessary comment and appeal periods. Subsequent to the completion of the two-week appeal period, the Shoreline Permit may be issued. This decision would then be forwarded to the State Department of Ecology and would be followed by a 21-day appeal period. Therefore, it is likely that a decision from the City of Renton for the proposal would be final within approximately 12 weeks of the acceptance of a complete application package. The land use application fee is$1,000.00, plus$0.34 per mailing label for the first set of required mailing labels for notification to surrounding property owners within 300 feet of the site. Detailed information regarding the land use application submittal requirements is provided in the attached handouts. • Before construction of the proposed natural gas line could, the applicant would also be required to obtain the necessary approvals from State and Federal agencies(e.g., State Department'of Fish and Wildlife's Hydraulic Project Approval Permit,Army Corp of Engineers Section 10 Permit). Information regarding the JARPA permit, which may be used to apply for the required State and Federal permits, is also attached. In addition, the applicant will be required to apply for a City of Renton Franchise Permit for any work performed in City right-of-way. cc: Jennifer Henning • • Pre00-007PSE gas line.doc\ • Y.: . .L - . • . .,c, ., . a...:. {. :1.. . . . . .:,:,.:• . Their proposal states that the line will be installed underneath the roadway by drilling and boring rather than the open trench method. The applicants also state that project lies within the 200-foot shoreline jurisdiction of Lake Washington and that a Shoreline Substantial Development Permit is required. Relevant Comprehensive Plan Land Use Policies: Objective U-A: Provide an adequate level of public utilities in response to and consistent with land use, protection of the environment and annexation goals and policies. Policy U-3. Process permits and approvals for utilities and facilities in a fair and timely manner and in accord with development regulations that encourage predictability. Policy U-34. Ensure that development regulations are consistent with and do not otherwise impair the fulfillment of the serving utilities'public service obligations. Policy U-98. Allow for the extension of natural gas distribution lines to and within the city limits and Urban Growth Area, provided they are consistent with development envisioned in the Land Use Element of the Comprehensive Plan. Policy EN-76. Design, locate, and construct utility systems in a manner which will preserve the integrity of the existing land forms, drainage ways and natural systems. Analysis: The proposed installation appears to be consistent with the intent of these policies. By borrowing under portions of the roadway rather than digging ditches the project appears to preserve the integrity of the existing land forms, drainage ways and natural systems. Staff identified no adverse impacts from this project. Recommendation: Support this proposed development. cc: Don Erickson H:\EDNSP\Interdepartmental\Development Review\Green File\Comments\Riplley Lane Gas Main.doc\d City of Ro:' --) Department of Planning/Building/Public Works ENVIRONMENTAL & DEVELOPMENT APPLICATION REVIEW SHEET REVIEWING DEPARTMENT: 5t (-lAce / W fnL)Ck/COMMENTS DUE: NOVEMBER 15, 2002 APPLICATION NO: LUA-02-124, SM DATE CIRCULATED: NOVEMBER 1,2002 CITY OF RENTON APPLICANT: Puget Sound Energy PROJECT MANAGER: Jason E.Jordan R F C E 8 V E D PROJECT TITLE: Ripley Lane Natural Gas Main Installation WORK ORDER NO: 77054 eti a 2002 LOCATION: Ripley Lane North SITE AREA: 15,390 Sq.Ft.
