CITYOFRENTON,WASHINGTONRESOLUTIONNO.4465ARESOLUTIONOFTHECITYOFRENTON,WASHINGTON,REPLACINGRESOLUTIONNO.4410,PROVIDINGFORMEETINGSANDPUBLICHEARINGSOFTHECITYCOUNCIL,COUNCILCOMMITTEES,ALLCITYBOARDSANDCOMMISSIONS,ANDHEARINGEXAMINERHEARINGSTOBEHELDELECTRONICALLYDUETOTHECOVID-19PUBLICHEALTHEMERGENCY,ANDACCOMMODATINGSOMELIMITEDANDSAFEPHYSICALGATHERINGOFATTENDEESOFVIRTUALLYHELDMEETINGS.WHEREAS,onMarch24,2020,GovernorJayInsleeissuedProclamation20-28,thatamongotherthings,issuedaprohibitiononconductingmeetingssubjecttotheOpenPublicMeetingsAct(OPMA),chapter42.30RCW,in-personandinsteaddirectingthatanymeetingsbeheldentirelyelectronicallyandbelimitedtoconsiderationofnecessaryandroutinemattersorthoserelatedtotheCOVID-19emergency;andWHEREAS,theCityCouncilpassedResolutionNo.4410onJune15,2020,authorizingremotemeetingsandhearingsduetotheCOVID-19publichealthemergency;andWHEREAS,GovernorInslee’sProclamation20-28wassubsequentlyamendedbyProclamation20-28.14,datedDecember8,2020andlaterextendedbyProclamation20-28.15,requiringmeetingssubjecttotheOPMAbeheldremotely,withanin-personcomponentoptional;andWHEREAS,ResolutionNo.4410wasamendedbyResolutionNo.4427onMarch15,2021inordertoupdatethestaffaccountinformationforthetelephonic/virtualmeetingplatformusedbytheCity;andWHEREAS,EngrossedSubstituteHouseBill1329(HB1329)wassignedintolawonMarch24,2022,whichupdatesandclarifiestheOPMA;and1 RESOLUTIONNO.4465WHEREAS,HB1329providesthatifalocal,state,orfederalagencyhasdeclaredanemergencyandthepublicagencydeterminesthatameetingcan’tbesafelymadeopentothepublicinperson,themeetingmaybefullyremotewithacost-freeoptiontoattendthemeetinginrealtime,eitherbytelephoneoranotherreadilyavailablealternative;andWHEREAS,theCOVID-19pandemiccontinuestoposeriskstopublichealthandsafety,andtheGovernorhasnotliftedProclamation20-28;andWHEREAS,CityHallhasnotyetfullyreopenedtothepublic,andtheCity’scouncilchambersareundergoingrenovationsthat,whencomplete,willbetterenabletheCitytoconductCouncilmeetingsinpersonandopentothepublicwhilecontinuingtoprovidethepublicwithenhancedremoteviewingopportunities;andWHEREAS,duetoongoingrenovationsoftheCity’scouncilchambers,Councilandotherpublicmeetingscannotyetbesafelyorpracticallyfullyopenedtothepublicinpersonandtheregularmeetinglocationforwhichthepublicmayattendmeetingsshouldremainvirtualatleastuntilrenovationsarecompleteandmeetingscanbereliablyandsafelyopenedtoallwhowishtoattend;andWHEREAS,priortorenovationsbeingcomplete,theCityhaslimitedspaceandresourcestoaccommodateCouncilmembersandsomeCitystaffwhowishtoattendthevirtuallybroadcastmeetingsphysicallyatCityHall;andWHEREAS,astheCitycompletesrenovationsandcontinuesitstransitionofopeningmoreofCityHalltothepublic,theCitymaybeabletosafelyaccommodatesomemembersofthepublictoattendvirtuallyheldmeetingsatCityfacilitiesbeforeitissafetofullyreturntheregularlocationofsuchmeetingsfromvirtualbacktoaphysicallocation;and2 RESOLUTIONNO.4465WHEREAS,pursuanttotheongoingthreatCOVID-19poses,accesstoCityHallremainslimitedtothepublicnecessitatinghybridelectronicandin-personCityCouncilmeetings,publichearings,CouncilCommitteemeetings,boardsandcommissionsmeetings,andhearingexaminerhearings;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DORESOLVEASFOLLOWS:SECTIONI.TheCityCouncilAuthorizesRemoteMeetingsandHearings.A.PursuanttoSection4.1ofCouncilPolicy800-02,theCouncilestablishesthe“otherlocation”forregularbusinessmeetingsoftheCityCouncilwherethepubliccanattendmeetingsasthefollowingphonenumberandmeetingidentificationnumber:1-253-215-8782andenter84938072917andthenenterthepasscode156708.Inadditiontosuchlocation,theCitywillpublishadditionalmeansofviewingandlisteningtothemeetingsinthemeetingagendas,whichmeansmayincludevideoteleconferencesand/orinternetstreaming.TotheextentCitystaffdeterminesphysicalattendancebythepublicatmeetingscanbesafelyandpracticallyaccommodatedincompliancewithapplicableregulations,theCitymayalsopublishtheavailabilityofphysicallocationsatwhichthepublicmayattendvirtuallyheldmeetings.Theprovisionofsuchalternativemeansofattendingvirtualmeetingsshallnotservetochangetheofficialmeetinglocationfromthevirtuallocationidentifiedherein.Staffmaylimitthenumberofattendeesatanyalternativephysicallocationasdeemedprudentornecessary.Suchlimitsshouldbeclearlycommunicatedinanynoticeannouncingtheavailabilityofthephysicallocationtoattendvirtualmeetings.3 RESOLUTIONNO.4465B.TheCityCouncilfurtherdirectsthePlanningCommissionandallotherboardsandCommissionsandtheHearingExaminertosuspendanyrulesorpracticesthatrequirespublicmeetingsorpublichearingstooccurinpersonatCityHallorotherphysicallocationsandtoholdalloftheirmeetingsvirtually.Optionalphysicalattendancemaybeallowedwhensafe,practical,andincompliancewithapplicableregulations.C.TheCityCouncil,PlanningCommission,allotherboardsandcommissions,andtheHearingExaminer,shallholdallpublicmeetingsorpublichearingsvirtually,byphoneIelectronicmeans,andshallprovideforattendancebymembersofthepublic,inrealtime,thatwillallowthepublictolistentoorwatchthemeetingandhearallspeakers,and,ifapplicable,provideforpubliccommentortestimonyinaccordancewithanyapplicablestatelaworapplicableadoptedrules,asmodifiedherein.D.Totheextentapplicableregulationsaremet,Citystaffandgoverningbodymembersmaygatherforvirtuallyheldpublicmeetingsatthesamephysicallocation,buttheofficiallocationofmeetingsshallremainvirtualforallmeetingsuntiltheCouncilandCityadministrationdeterminethatpublicattendanceinpersoncanbeconsistently,regularly,safelyaccommodatedonanongoingbasis.Publicattendanceatsuchplaceofgatheringmaybeprohibitedorlimiteduntilsuchtimetheregularlocationofmeetingsischangedtoaphysicallocation.SECTIONII.RemoteMeetingsandHearingsProcedures.A.TheProceduressetforthinExhibitAareherebyadoptedasabaselinefortelephonicIvirtualmeetings.TheCityClerkmaymodifyandprovideadditionalproceduresinaccordancewiththegeneralguidanceofthisResolution.4
