a. Approval of Council meeting minutes of November 24, 2003. Council concur.
b. City Clerk submits 2003 General Election canvas results from King County Records & Elections,
as follows: Mayor, Kathy Keolker-Wheeler (5,076 votes - elected) and King Parker (4,153);
Council Position No. 3, Marcie Palmer 14,777 - elected) and Rosemary Quesenberry (3,991);
Council Position No. 4, Denis Law (4,885 - elected) and Robin H. Jones (3,143); Council
Position No. 5, Eric Cameron (3,382) and Toni Nelson (4,663 - elected); Position No. 7, Don
Persson (6,395 - elected). Information.
c. City Clerk reports bid opening on 11/21/2003 for CAG-03-173, Kiwanis Park Improvements; 18
bids; engineer's estimate $110,000 to $120,000; and submits staff recommendation to award the
contract to low bidder, Advanced Construction, Inc., in the amount of $112,596. Council concur.
d. City Clerk reports bid opening on 11/24/2003 for CAG-03-158, Lind Ave. SW & SW 7th St.
Signalization; seven bids; engineer's estimate $190,000; and submits staff recommendation to
award the contract to low bidder, Totem Electric, in the amount of $172,103.70. Council concur.
e. Economic Development, Neighborhoods and Strategic Planning Department recommends
approval to utilize Washington State's multi -family property tax exemption to help foster new
multi -family development in targeted areas. Refer to Planning & Development Committee; set
public hearing on 12/15/2003 to consider the residential targeted areas.
f. Economic Development, Neighborhoods and Strategic Planning Department submits 10% Notice
of Intent to annex petition for the proposed Anderson Annexation, 19.75 acres located east of
148th Ave. SE and south of SE 120th St, and recommends that a public meeting be set on
12/15/2003 to consider the petition. Council concur.
g. Finance and Information Services Department recommends City endorsement of the adoption
and implementation of the State of Washington's streamlined sales taxes concept concurrent only
upon Federal adoption of internet and catalog sales taxes; where the State adopts a point of
delivery sales tax collection system for interstate sales, but orders the Department of Revenue to
distribute sales tax to Washington cities base on point of sale. Council concur. (See 9. for
resolution.)

h. Surface Water Utility Division submits CAG-03-103, SW 7th St. Drainage Improvement Project
Phase I; and requests approval of the project, authorization for final pay estimate in the amount
of $9,838.13, commencement of 60-day lien period, and release of retained amount of
$15,360.35 to D.D.J. Construction Co., Inc., contractor, if all required releases are obtained.
Council concur.
i. Utility Systems Division recommends approval of an agreement with Skyway Water and Sewer
District that establishes the water and sanitary sewer service boundaries. Refer to Utilities
Committee.

Mayor Jesse Tanner led the Pledge of Allegiance to the flag and called the
meeting of the Renton City Council to order.

SPECIAL PRESENTATION
Norma McQuiller, Neighborhood Coordinator, reported on the progress of the
EDNSP: 2003 Neighborhood
Neighborhood Program, stating that the program is now comprised of 28
Grant Program
officially recognized neighborhoods. She explained that 20 City employees
serve as neighborhood liaisons, volunteering their time to provide a link
between the neighborhoods and City Hall. Commenting on the success of the
neighborhood picnics, Ms. McQuiller indicated that this year, 12 picnics were
held for 18 neighborhood groups.
Ms. McQuiller stated that over $15,000 in neighborhood grants were awarded
in 2003 for various projects such as entrance signs, traffic circles, and
newsletters (the budgeted amount for 2003 was $50,000). She noted that one
such project involves the development of an urban park on Seattle Public
Utilities -owned property. In regard to the future, Ms. McQuiller reported that
plans for the Neighborhood Program include encouraging more innovative
projects, and organizing more neighborhood workshops. Furthermore, she
announced that a new video about the Neighborhood Program is now airing on
Renton's government access cable television channel 21.
Additionally, Ms. McQuiller presented the Neighborhood Grant Awards for the
second half of 2003 to representatives of the Ginger Creek Community
Association, Highlands Community Association, Talbot Hill Neighborhood
Association, and Windwood Homeowners Association.
ADMINISTRATIVE Chief Administrative Officer Jay Covington reviewed a written administrative
REPORT"' report summarizing the City's recent progress towards goals and work
programs adopted as part of its business plan for 2003 and beyond. Items noted
included:
The Clam Lights display at Gene Coulon Memorial Beach Park will light
up on December 5, and the Holiday Tree Lighting at the Piazza occurs on
December 6. The lights at each park will be displayed nightly through
January 1, 2004.
Puget Sound Energy estimates that the downtown Grady 15 electrical cable
replacement project will be completed by the end of December. The power
line conversion at the Sams Club site has been completed.

Council: Farewell and
Council President Keolker-Wheeler announced that on December 22, 2003, a

farewell event is planned for outgoing Councilmembers and Mayor Tanner at
6:30 p.m.; and on January 5, 2004, a Special Meeting will be held at 6:30 for
the swearing -in of the new Mayor, and the new and returning Councilmembers.
Council: Electronic Mail &
Council discussion occurred regarding City staffs role in the handling of
Correspondence Policies
Council correspondence and e-mail, and the use of e-mail by Councilmembers.
It was noted that the Council e-mail and correspondence policies are currently
being reviewed by the Ad Hoc Council Communications Committee.
Police: Peddler's Hours of
Reporting a resident's concern regarding a visit by a solicitor at her home at

COUNCIL REFER HOURS OF OPERATION FOR SOLICITORS TO THE
PUBLIC SAFETY COMMITTEE. CARRIED.
In response to Councilman Clawson's inquiry, Mayor Tanner confirmed that a
Peddler's License ordinance was adopted in 1998, which requires solicitors
conducting business in Renton to be licensed. Councilwoman Nelson noted
that solicitors are required to exhibit their permits, which display a photograph
of the solicitor, on their person while conducting any peddling activities.
Community Services: Senior
Councilman Persson expressed his appreciation to those who supplied food and
Center Thanksgiving Dinner
volunteered to serve Thanksgiving Dinner at the Senior Activity Center on
November 27. He noted that 270 people were served dinner, and there was
enough food left over to provide 200 take out dinners.

In addition to our day-to-day activities, the following items are worthy of note for this week:
ADMINISTRATIVE, JUDICIAL, AND LEGAL SERVICES DEPARTMENT
• A free copy of the 2004 Renton Community Calendar will be distributed to Renton residents as an insert in the
December 3`a edition of the Renton Reporter. The 16-page full -color calendar includes information about

• The December 2003 edition of CitySource, the City's newsletter to citizens and businesses, will be featured in
the December 3`a issue of the Renton Reporter. This edition features articles about holiday events, land use
changes to the 280-acre Boeing plant property, the 2004 Renton Community Calendar, free gardening
workshops, potential weather impacts to garbage collection, upcoming capital improvement project dedication
events, and Renton City Council highlights. CitySource can be found on the City's website,
www.ci.renton.wa.us, through the Spotlight section under the press release option.
COMMUNITY SERVICES DEPARTMENT
• Clam Lights at Coulon Beach Park will kick off the winter season on Friday, December 5`h, beginning at 6:30
p.m. The event will feature lights, entertainment, and Rainier Yacht Club's Lighted Boat Show. On Saturday,
December 6`h, join fellow Renton citizens for the Holiday Tree Lighting at the Piazza. The event begins at
5:00 p.m. and features several different entertainers, a visit from both Santa and Frosty the Snowman, and light
refreshments. The lights at each park will be displayed nightly through January I". For additional details
about either event, visit the City's website or call 425-430-6700.
• The new 2004 Winter/Spring Recreation Brochure was mailed to residents last week. It lists the diverse
programs and activities offered to meet the needs of all Renton citizens. From leisure and athletic programs
for youth, teens, and adults, to fun fitness and wellness programs - there is something to suit almost everyone.
Class registration opens to Renton residents on Tuesday, December 90'. Registration for non-residents begins
on Thursday, December 1 Ph. Individuals with a PIN number can register for classes via Cyber Sign -Up on the
City's website, www.ci.renton.wa.us, or through Fast Fone-In, 425430-6729. Individuals may also register in
person at the Renton Community Center, located at 1715 Maple Valley Highway.

PLANNINGBUILDING/PUBLIC WORKS DEPARTMENT
We received an update from Susan Hempstead of Puget Sound Energy regarding the progress of the downtown
Grady 15 electrical cable replacement project. PSE estimates that the work will be done by the end of
December, and advises that the power line conversion at the Sam's Club site has been completed.
On Wednesday, December P, from 8:30 a.m. to 3:00 p.m., there will be a vehicle license fee workshop in the
Renton Council Chambers. This workshop is intended for local and state government employees and will
explore the impacts of the loss of vehicle license fees on the transportation infrastructure and what the State
Supreme Court ruling on Initiative I-776 means to local transportation project funding.

SUBJECT: Acceptance of Bid for Kiwanis Park Improvement Project
A bid opening was held on Friday, November 21, 2003 for the Kiwanis Park Improvement
Project. The scope of work for this project includes demolition of an existing parking lot,
irrigation modifications and installation, asphalt/concrete construction of a new pathway,
landscaping, planting and sod installation, construction of a new wooden rail system, and
installation of new bollards. The engineer's estimate was $110,000 to $120,000.
The project budget amount is $145,600.00. Funding for this project comes from the 316
fund for capital improvements. Edlund Associates, Inc. was contracted to provide
professional design services for the project in the amount of $13,056.00. No other costs,
besides the contract with the approved contractor, are anticipated.
A total of eighteen (18) bids were received, with Advanced Construction, Inc., of Mill Creek,
WA, as the apparent low bidder, submitting a base bid of $100,096.00, plus alternate #1
($4,500.00, satellite irrigation controller) and alternate #2 ($8,000.00, concrete curbing for
walkway), for a total of $112,596.00. None of the bids contained irregularities. Advanced
Construction's bid plus alternates is within the budgeted amount.
We ask that Council concur with our recommendation that the base bid, including alternates
#1 and #2, be awarded to Advanced Construction, Inc. in the amount of $112,596.00.

SUBJECT: Lind Avenue SW & SW 7th Street Signalization
The work on the Lind Avenue SW & SW 7th Street Signalization Project shall include
construction of a fully actuated traffic Signal at the intersection of Lind Avenue SW and .
SW 71h Street in Renton, including poles, signal and detection loops, emergency pre-
emption, a new signal controller, interconnect to master computer, associated
channelization, and driveway removal / reconstruction.
The Lind Avenue SW & SW 71h Street Signalization Project (Project #12153) is ranked
number 43 in the 2003-2008 TIP and currently has $269,700 allocated. The lowest bid
submitted by Totem Electric fell well within the projects budget at $172,103.70 and
under the engineer's estimate of $190,000.
The Transportation Design Section would like to recommend that the contract be
awarded to Totem Electric. Additionally, we also recommend that the agenda bill
outlining this project go Council Concur since the low bid is within budget, there were
seven bids submitted, and there were no irregularities in the low bid.

EDNSP is proposing the adoption of a Multi -Family Property Tax Exemption for Residential
Targeted Areas for new construction multi -family housing projects in the CD, RM-U, RM-T and
UCN-1 zones and the CS, RM-C and R-10 zones in the Center Village Comprehensive Plan
designation. Under the proposed new program, the value of the qualified new housing construction
would be exempt from ad valorem property taxation for ten successive years after completion of
the project. Qualified projects would need to meet the eligibility criteria and other requirements
adopted by the Council to participate in the program.
The state's multi -family property tax exemption provided for in 84.14 RCW has been utilized by a
number of local jurisdictions to help spur development in urban neighborhoods with insufficient
housing opportunities. Although the tax exemption by itself is not enough to create developments,
it is an added financial incentive for developers to create multi -family housing in targeted areas in
our community.
STAFF RECOMMENDATION:
Staff recommends that Council: (1) set a public hearing on 12/15/03 for the proposed
residential targeted areas for the multi -family property tax exemption; (2) approve the
designated residential targeted areas; and (3) adopt an ordinance to establish the multi -family
property tax exemption for projects that meet desired local eligibility criteria.

SUBJECT: Proposed Multi -Family Property Tax Exemption for
Residential Targeted Areas
ISSUE:
Should the City utilize Washington state's multi -family property tax exemption provided for
in Chapter 84.14 RCW to help foster multi -family development in targeted areas?
RECOMMENDATION:
Set a public hearing for December 15, 2003 for the proposed residential targeted areas for
the multi -family property tax exemption as required by RCW 84.14.040.
Approve the designated residential targeted areas and adopt an ordinance to establish the
multi -family property tax exemption for projects that meet desired local eligibility
criteria.
BACKGROUND SUMMARY:
Overview
The Washington State Legislature adopted Chapter 84.14 RCW to encourage increased
residential opportunities in cities required to plan under the Growth Management Act by
providing a partial property tax exemption for up to 10 years for eligible multi -family
housing (e.g., apartments or condominiums) located in targeted urban, residential areas. The

purpose of the state's multi -family property tax exemption is to stimulate construction of new
multi -family housing and/or the rehabilitation of existing vacant and underutilized buildings
for multi -family housing in urban centers with insufficient housing opportunities.
The value of the qualified new housing construction, conversion and rehabilitation
improvements is exempt from ad valorem property taxation for ten successive years after
completion of the project. However, the exemption does not include the value of the land,
existing improvements or non -housing -related improvements (e.g., commercial space). The
multi -family property tax exemption is in addition to any other tax credits, grants or
incentives provided by law for the multi -family housing.
Example of Potential Property Tax Savings
The multi -family property tax exemption applies to all levels of the ad valorem property tax,
including the local jurisdiction, county, state and all local taxing districts. For projects in
Renton, this amounts to a total of $11.10347 per $1,000 of assessed value for 2003. (Please
see Attachment 1, Examples of Potential Property Tax Savings, for a breakdown of the local
ad valorem property tax rate and an example of how the tax rates apply to the various taxing
entities.)
The value of the property tax exemption will of course be determined by the nature, quality
and cost of the multi -family housing (e.g., size, type, parking and amenities). However, for
an eligible 1,000 sq. ft. apartment unit in Renton with development costs of $100 per sq. ft.
(excluding the land), the annual savings would be $1,110 (1000 sq. ft x $100/sq. ft., divided
by $1000, times $11.10347). For an apartment building in Renton with thirty similar 1,000
sq. ft. units, the savings from the multi -family property tax exemption would equal $33,300
per year, or $333,000 over ten years (based on the current ad valorem property tax rate).
Residential Targeted Areas
The state law, as amended, now allows for a city with a population of at least 30,000 to
utilize 84.14 RCW to provide a property tax exemption to eligible multi -family housing
located in a residential target area(s) designated by the local governing authority. The
designated area(s) must be an "urban center", a compact identifiable district as defined in
RCW 84.14.010 where urban residents may obtain a variety of products and services.
In light of the City's business plan, economic development and Comprehensive Plan goals,
EDNSP recommends that the following three areas be established as residential targeted areas
for the City's multi -family property tax exemption:
The Center Downtown (CD), Residential Multi -Family Urban Center (RM-U) and
Residential Multi -Family Traditional (RM-T) zones in the Center Downtown
Comprehensive Plan designation;
The Center Suburban (CS), Residential Multi -Family Suburban Center (RM-C) and
Residential 10 du/ac (R-10) zones in the Center Village Comprehensive Plan
designation; and

• The Urban Center North District 1 (UCN-1) zone in the Urban Center North
Comprehensive Plan designation.
Please see Attachment 2 for a map of the Proposed Residential Targeted Areas for the Multi -
Family Property Tax Exemption.
As required by RCW 84.14.040, EDNSP is requesting that the Council set a public hearing
for December 15, 2003 for the above proposed residential targeted areas for the multi -family
property tax exemption.
Eligible Properties
RCW 84.14 identifies the types of projects eligible to receive a multi -family property tax
exemption. However, as described in more detail in the Local Standards, Guidelines &
Requirements section below, the local jurisdiction has the authority to establish the specific
eligibility requirements for local projects within the parameters allowed by the statute.
Under RCW 84.14, the multi -family property tax exemption may apply to buildings with four
or more dwelling units that are used for "permanent residential occupancy" for either rental
or owner occupancy on a non -transient basis. This includes owner -occupied or rental
accommodation that is leased for a period of at least one month, but excludes hotels and
motels that predominantly offer rental accommodation on a daily or weekly basis.
The multi -family units may result from new construction, rehabilitation or conversion of
vacant, underutilized or substandard buildings to multi -family housing. However, property
proposed for rehabilitation must fail to comply with one or more state or local building or
housing codes AND be vacant for at least twelve months before submitting an application for
the multi -family property tax exemption. In mixed -use developments, at least fifty percent of
the total space must be provided for permanent residential occupancy. Notwithstanding the
above displacement prohibition, the property tax exemption may be used in the case of an
existing occupied multi -family development so long as a minimum of four additional multi-
family units are provided. Existing multi -family vacant housing that has been vacant for at
least twelve months does not have to provide additional multi -family units.
The new construction, rehabilitation or conversion of the multi -family housing must be
completed within three years from the date of approval of the application by the local
government. However, the deadline for completing the project may, in some instances, be
extended by the local jurisdiction for up to 24 consecutive months.
Local Standards, Guidelines & Requirements
State law allows the local government to establish standards and guidelines for utilizing the
multi -family property tax exemption within the parameters of the statute, including the
process and procedures for considering applications and making the determinations required
under RCW 84.14. The local government may, for example, (per RCW 84.14.030 and
RCW 84.14.040) establish building requirements addressing parking, height, density, public

benefit features, number and size of proposed development, low-income or moderate -income
occupancy requirements, environmental impact, compatibility with the existing surrounding
property, the provision of amenities that will attract and keep permanent residents and that
will properly enhance the livability of the residential targeted areas, and other adopted
requirements deemed necessary by the city.
EDNSP recommends the following general criteria for the City's Multi -Family Property Tax
Exemption for Residential Targeted Areas:
(1) The property must be located in a designated residential targeted area (see above);
(2) The project must be new construction;
(3) The project must have a minimum of 10 attached dwelling units if located in the RM-U
or RM-T zones or the RM-C or R-10 zones in the Center Village Comprehensive Plan
designation OR a minimum of 30 attached dwelling units if located in the CD or UCN-1
zones or the CS zone in the Center Village Comprehensive Plan designation; and
(4) The multi -family housing must be used for "permanent residential occupancy" which
includes either owner occupancy or rental accommodation that is leased for a period of
at least one month, but excludes hotels and motels.
(5) In mixed -use developments, at least fifty percent of the total space must be provided for
permanent residential occupancy.
Additional eligibility criteria and requirements for the City's Multi -Family Property Tax
Exemption for Residential Targeted Areas (such as mixed use and/or design requirements)
will be provided to the Planning and Development Committee for their consideration.
Process & Fees
Prior to the start of construction or rehabilitation, the project owner must submit an
application to the local jurisdiction, receive a conditional acceptance of tax exemption by the
local jurisdiction and enter into a contract (that specifies the terms and conditions for the
development project) with the local jurisdiction. At the completion of the project, the owner
must submit a report with a number of statements, including a breakdown of the amount of
construction or rehabilitation expenditures for each housing unit and the entire project. After
reviewing the material and ensuring that the completed project is consistent with RCW 84.14
and the local jurisdiction's requirements, the City issues a certificate(s) of tax exemption for
the project to the owner(s) and notifies the county assessor's office. The property owner(s)
also must submit an annual certification to the City during the ten-year tax exemption period.
State law allows the local jurisdiction to establish an application fee for the multi -family
property tax exemption to cover the costs incurred by both the local jurisdiction and the
county assessor in administering the multi -family property tax exemption for the project.
Typical application fees for other local jurisdictions range from $50 to $1, 000. Some
jurisdictions have additional fees, for example, for an application amendment or an extension
of the conditional certificate deadline.

A proposed fee schedule for the City's Multi -Family Property Tax Exemption for Residential
Targeted Areas will be provided to the Planning and Development Committee for their
consideration.
Experiences of Other Jurisdictions with the Multi -Family Property Tax Exemption
Please refer to Attachment 3, Experiences of Other Jurisdictions with the Multi -Family
Property Tax Exemption, for information about the utilization and success of 84.14 RCW in
other jurisdictions.
CONCLUSION:
The multi -family property tax exemption provided for in 84.14 RCW has been utilized by a
number of local jurisdictions to help spur development in urban neighborhoods with
insufficient housing opportunities. Although the tax exemption by itself is not enough to
create developments, it is an added financial incentive for developers to create multi -family
housing in targeted areas in our community.
In order to proceed, the City needs to hold a public hearing to consider the residential
targeted areas for eligible projects, approve the designated residential targeted areas and
adopt an ordinance that establishes a multi -family property tax exemption for projects that
meet desired local eligibility criteria.

Experiences of Other Jurisdictions with the Multi -Family Property Tax Exemption
Washington state's multi -family property tax exemption statute has been utilized by a number
of local jurisdictions to help spur development in urban neighborhoods with insufficient
housing opportunities, including Tacoma, Seattle, Spokane, Bellingham, Olympia,
Vancouver, Wenatchee, Federal Way, Puyallup and, most recently, Auburn.
Although there is no central administration of the multi -property tax exemption program by
the state, it appears as though many jurisdictions utilize 84.14 RCW to establish a multi-
family property tax exemption for one or more designated residential target areas with limited
additional local requirements or eligibility criteria. However, at least two jurisdictions -
Seattle and Auburn - established significantly more restrictive eligibility criteria to target the
use of the multi -family property tax exemption to better meet local needs.
In Seattle, the multi -family property tax exemption was implemented with an affordability
component wherein at least 40 % of the units were affordable at 60 % of median income in the
"Pike -Pine neighborhood" and 25 % of the units were affordable at 80 % of median income in
all of the other residential targeted areas of the city.
In Auburn, the multi -family property tax exemption was adopted with local requirements that
eligible projects: (a) be new construction only; (b) have 30 or more units; and (c) have a
"minimum investment of $150,000 per unit annually adjusted for inflation by the Consumer
Price Index".
Although both Federal Way and Auburn established multi -family property tax exemption
programs this year, neither had a project application as of earlier this fall. However, a
number of other jurisdictions have successfully utilized the multi -family property tax
exemption to help develop new rental and ownership multi -family properties in urban
neighborhoods.
For example, Tacoma has had 45 multi -family property tax exemption projects with 3,076
units approved since 1998 (including 764 condo units). Seattle has had 14 multi -family
property tax exemption projects since 1999, including 12 rental projects (with 878 units) and
2 projects for homeowners (with 86 units). Six of the 14 projects involve a nonprofit agency
and for -profit developers are developing eight of the projects.

SUMMARY OF ACTION:
The City is in receipt of a 10% Notice of Intent petition to initiate a direct petition method of
annexation for approximately 19.75-acres located in the area east of 148th Avenue SE and south
of SE 120th Street abutting the Urban Growth Area boundary on its north side. The annexation
area abuts the City of Renton boundary on its southern and eastern edges. Pasco Avenue NE in
the Woodwind Subdivision to the south terminates near the middle of the proposed annexation's
southern boundary (see attached map).
State law requires that the Council hold a public meeting within 60 days of the filing of the 10%
Notice of Intent to Commence Annexation petition to consider the proposed annexation and
decide whether it will accept, modify, or reject it. If Council accepts the annexation, it shall
authorize the circulation of the new 50% direct petition to annex.
STAFF RECOMMENDATION:
Council set a Public Meeting date for December 15, 2003 to consider this annexation.

SUBJECT: Proposed Anderson Annexation 10% Notice of Intent Petition
ISSUE:
The City is in receipt of a Notice of Intent to annex approximately 19.75 acres to the City of
Renton by direct petition (Figure 1, Vicinity Map). State law requires that the Council hold a
Public Meeting with the annexation proponents to decide whether to accept, reject or
geographically modify the proposal, whether to require the assumption of bonded indebtedness,
and, whether to require the simultaneous adoption of zoning.
RECOMMENDATION:
On the basis of the following analysis, the Administration recommends that Council accept the
Notice of Intent. If Council concurs with this recommendation, the Administration recommends
that Council take the following actions (pursuant to RCW 35A.14.120):
• Authorize the circulation of the 50% Petition to Annex for the proposed expanded
annexation;
• Require City zoning consistent with the Comprehensive Plan; and,
• Require that property owners with the proposed annexation area assume a proportional
share of the City's outstanding indebtedness.
BACKGROUND SUMMARY:
The applicant is proposing to annex the area east of 148 h Avenue SE and south of SE 1200' Street
next to the Urban Growth Area boundary into the City. The site is immediately west of recently
approved Maureen Highlands Subdivision. This area was the recent focus of a six-month
planning study that recommended amending the City's Comprehensive Plan land use designation
for this area, changing it from primarily Residential Single Family (RS) to Residential Low

Density (RSL) overlay designation with a new R4 zoning classification. The area of this
proposed annexation would receive the proposed new R-4 zoning if approved by Council.
1. Location: The proposed 19.75 acre rectangular shaped is located immediately south of
the King County Urban Growth Area boundary and east of 148 h Avenue SE in the East
Renton Plateau PAA.
2. Assessed Value: The assessed valuation at current development is $2,951,00.
3. Natural Features: The site is basically flat with a slight increase in height between 101,
Avenue SE on the west and its eastern boundary. A portion of a wetland spills over onto
the site from the south in its southwestern quadrant.
4. Existing Land Uses: Existing development includes 14 single-family detached dwellings,
mostly on the northern half of the site.
5. Existing Zoning: The site is currently zoned R-4, four units per gross acre, in King
County.
6. Comprehensive Plan: Renton's Comprehensive Plan designates the subject annexation
area Residential Low Density (RLD). This designation will allow R-4 zoning. The latter
is currently being developed and is anticipated to be ready by the time the annexation
process is completed.
7. Public Services: All responding departments and divisions noted that the annexation
represents a logical extension of their respective services and systems.
• Water Utility: Staff note that the annexation area is within King County Water
District 90's service area and stress the need for future developers to check on water
availability from this district.
• Surface Water: Staff notes that there is a deficiency in the existing storm drainage
system in the annexation area. They note that in the past there have been complaints
along the drainage course downstream. Any future development of the site could
result in increased surface water runoff and may necessitate the use of higher surface
water management design standards to address this potential.
• Wastewater: The subject annexation site is located with Renton's Sewer Service Area
and is considered a logical extension of this City service.
• Parks: Staff notes a current deficiency in usable recreation space in the vicinity of the
annexation.
• Fire: The site is within Fire District No. 10 but would be served by the Renton Fire
Department upon annexation.
• Police: Police note an accumulative impact from all annexations that will eventually
lead to the need for additional policing staff. Police costs are included in the fiscal
analysis.
• Public Works Maintenance: Staff notes that there are approximately 640 linear feet of
roadway along 148'h Avenue SE and that at full development there could be as many
as 2,800 linear feet of roadway associated with future development. The estimated
cost of maintaining this amount of roadway is estimated to be approximately $3,700
per year.

• Transportation: Transportation staff not the curb, gutters, sidewalks and street
lighting will be required along 148 h Avenue SE as well as any internal streets to
future development. They do not see this leading to any additional staffing.
ANALYSIS OF THE PROPOSED ANNEXATION:
Consistency with the Comprehensive Plan:
The annexation policies generally support this proposed annexation. The subject
properties are within Renton's Potential Annexation Area and are subject to development
pressure (Policies LU-378 and LU-380). The area is available for urbanization under the
King County Comprehensive Plan, zoning and subdivision regulations. Renton is the
logical provider of urban infrastructure and services to the area (Policy LU-385). Policy
LU-388 states that, in general, the greater the contiguity with the city limits, the more
favorable the annexation. The proposed area for annexation abuts the city boundary on
about 50 % of its perimeter.
2. Consistency with the Boundary Review Board Objectives:
a. Preservation of natural neighborhoods and communities;
The proposed annexation does not split or change existing neighborhoods. The
boundaries were drawn specifically to include all the homes along 148"' Avenue NE
and SE 120"' Street abutting the UGA boundary.
b. Use of Physical boundaries, including but not limited to bodies of water, highways,
and land contours;
The proposed annexation abuts the City of Renton along its southern and eastern
boundaries. The Urban Growth Area boundary to the north is a physical boundary as
is 148' Avenue SE.
c. Creation and preservation of logical service areas;
The proposed annexation area is within Renton's wastewater service area but within
Water District 90's service area. It is within the Issaquah School District and Fire
District 10. It would continue to receive water from District 90 and remain in the
Issaquah School District. Renton would provide fire service upon annexation.
d. Prevention of abnormally irregular boundaries;
The proposed boundaries for this annexation are regular.
e. Discouragement of multiple incorporations of small cities and encouragement of
incorporations of cities in excess of ten thousand population in heavily populated
urban areas;
Not applicable.
f. Dissolution of inactive special purpose districts;
There are no known inactive special purpose districts in this area.
g. Adjustment of impractical boundaries;
This annexation is not being proposed to adjust what are considered to be impractical
boundaries.

h. Incorporation as cities or towns or annexation to cities or towns of unincorporated
areas which are urban in character; and,
King County has designated this area for urban development because of its location
within the Urban Growth Area boundary. The county has also indicated that it wants
to divest itself from providing urban services to these unincorporated urban areas.
i. Protection of agricultural and rural lands which are designated for long term
productive agricultural and resource use by a comprehensive plan adopted by the
county legislative authority.
Not applicable. No portions of this proposed annexation are designated for long term
productive agricultural use in either the King County or Renton Comprehensive
Plans.
CONCLUSION:
The proposal is essentially consistent with City policies related to annexation as well as Boundary
Review board objectives for annexation. No impediments to the provision of City services to the
area have been identified.
An initial fiscal analysis was conducted by staff for this annexation area. It indicated an annual
surplus of $1,706 to the City under current projected revenues and costs. A more detailed
analysis may be conducted following receipt of the certified 50% Petition to annex.

SUMMARY OF ACTION:
Staff requests the Resolution be placed on Council Concur agenda of December 1, 2003. This
Resolution will be discussed at the informal Council Committee of the Whole meeting on the
same date. The Resolution supports the State of Washington's efforts in Streamlining Sales tax
project with national counterparts, with the exception that they not change the distribution of sales
taxes from point -of -sale to point -of -delivery. The Resolution supports the efforts the City of Kent
has been leading to ensure that land use policies and revenue policies remain aligned.
STAFF RECOMMENDATION:
Staff recommends the Council place the Resolution for Council concur and to have the
Resolution read on December 1, 2003.

Subject: Streamlining Sales Tax Effort
ISSUE:
As mentioned last month at the informal Committee of the Whole, the Department of Revenue (DOR) is
proceeding with the concept of Streamlining Sales Tax (SST). This concept has many elements. The
major change is "sourcing" of sales taxes. Under the SST, the State would change from a current
statutory model that is a mix of point -of -origin and point -of -sale to a pure point -of -delivery model. This
change in sourcing is expected to result in significant revenue dislocation from a number of local
jurisdictions, particularly those with a concentration of warehouses and manufacturing sites that ship
large goods or ship goods directly to businesses.
After the City of Kent pointed out to the DOR that Kent — and only a few cities — would be significant
"losers" in this new distribution model, the DOR promised to conduct a survey to discover the real
impacts. Further, they promised to meet with an intergovernmental group to discuss mitigation and other
issues. They are meeting now, but as follows, there has been little action to date.
RECOMMENDATION:
The recommendation is that the Council adopt the attached Resolution, which asks the State to be active
in the national Streamlining Sales Tax effort; however, to do so without impacting the way intrastate
sales taxes are distributed — i.e. based on location of the sales.
BACKGROUND SUMMARY:
On November 4, the State Department of Revenue convened the first of what will be, at best, five
meetings with a local government advisory and mitigation committee on the subject of the SST and how
best to resolve the issue of local sales tax "sourcing."
The one thing our representatives at the meeting noted was that the DOR expects to advance a bill that
anticipates enacting legislation that makes Washington SST compliant by April 1, 2005. Both the

City of Kent and our legislative lobbyist want to make certain we understand that if we cannot come to
resolution on mitigation issues, the DOR will not let that stop them from enacting legislation.
At the first meeting, the DOR did not have the results of the survey. They provided cities results as of
last week, however they did not provide any understanding of their methodology. The DOR now has
Renton as a "winner" city. This is a bit of a concern as we interviewed many businesses in the City, and
our results are different. The DOR's results are attached. The numbers the State provided is taxable
sales, not sales tax receipts, and on a biennial basis.
Our representatives stated the DOR is open to discussing mitigation options. The City of Kent identified,
and we are recommending, one mitigation option. The State can permit sales to be reported on a delivery
basis, but the sales taxes are actually allocated to cities on a point -of -sale basis — as currently the
practice. The State has the technological tools to support this. This is not a major change to the way
they currently do business.
The DOR did listen to the issues. There was no real discussion of the mitigation options, including this
one. The good news, if there is any, is that Seattle is now identified as a "loser" city. The DOR has now
taken a more active interest in this issue. They want to delay any action until we have a better
understanding of, at least, the methodology, and also the real impacts.
There are additional meetings of the intergovernmental group each Tuesday through November.
However, again, the DOR expects to have their recommendations for the State Legislature by
December 1. The cities are meeting again on November 20, and thus will be able to bring information
that is more current to you on December 1. We have written the Resolution assuming that we want to go
on record as stating that we support Kent's mitigation concepts, and the fact we want to be able to
identify sales in our cities. We should be "winners" in any interstate sales tax generation. However, we
also want to make certain sales generated within our City limits are distributed to us.
Finally, the City of Kent discovered that the State could indeed implement Kent's sales tax distribution
method and remain a member of the national Streamlining Sales Tax group. Thus, the motivation for
DOR is not quite the same as they suggested it was a year ago. At that time the State argued that if we
did not make these changes, the State of Washington would not be a member of the governing board of
the national committee. This simply is not correct. Again, this terminates any reasons for the sourcing
change to the intra-state sales.
CONCLUSION:
The City of Woodinville has passed a Resolution. There is another meeting of the impacted cities on
November 20, and we will then know the number of cities that have passed a Resolution or are ready to
pass this action. We know that Puyallup, Kent, and Olympia are all agreeing with this course of action.
We ask that you pass this legislation.

AND CATALOG SALES TAXES; WHERE THE STATE OF
WASHINGTON ADOPTS A POINT OF DELIVERY SALES TAX
COLLECTION SYSTEM FOR INTERSTATE SALES, BUT ORDERS THE
DEPARTMENT OF REVENUE TO DISTRIBUTE SALES TAX TO
WASHINGTON CITIES BASED ON POINT OF SALE.
WHEREAS, the City of Renton understands and supports the concept of streamlining
definitions and sales tax rates for interstate sales; and
WHEREAS, the City Renton believes it is important to make the State sales tax system
effective and efficient for private businesses both within the state of Washington and for
businesses outside its geographic boundaries; and
WHEREAS, the state of Washington's tax structure is highly dependent upon sales tax
receipts; and
WHEREAS, the City of Renton has made a commitment to economic development with
an emphasis on warehousing and retail sales as its economic base; and
WHEREAS, the City of Renton has made a commitment to its citizens and businesses,
which includes capital programs that are based upon present and future sales tax dollars for the
delivery of services to the citizens of Renton, construction and reconstruction of infrastructure
and facilities, and the possible investment in infrastructure as the City's share of economic
development; and

WHEREAS, the City of Renton and many other cities, pursuant to the expectations of the
Growth Management Act, have worked hard to develop economic, transportation, and land use
policies that meet regional needs for employment in warehousing and retail activities; and
WHEREAS, industrial, commercial and retail zones place disproportionate traffic, utility
and public safety demands on the City of Renton; and
WHEREAS, the City's industrial, commercial and retail zones have provided a sales tax
base that has allowed the City to develop and improve infrastructure to facilitate commerce; and
WHEREAS, if the State changes the distribution of sales tax receipts from point of sale
to point of distribution, there will be a tax shift between cities which have developed the economic
and land use policies to support regional growth to cities that have chosen not to have this activity
in their geographic boundaries; and that
WHEREAS, if the State changes the distribution of sales tax receipts from point of sale
to point of distribution, a small number of cities will bear the largest share of the burden; and
WHEREAS, the issues of equity are of great importance to the City of Renton; and
WHEREAS, the proposed changes to streamlining sales tax would provide a positive
impact for the state of Washington, but would produce disparate impacts for cities, counties and
lesser taxing districts;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO RESOLVE AS FOLLOWS:
SECTION I. The above findings are true and correct in all respects.
SECTION II. The City of Renton supports the concept of streamlining sales tax
rates and definitions to make it easier for interstate and intrastate commerce.

SUMMARY OF ACTION:

The City of Renton and Skyway Water and Sewer District (Skyway) have been discussing
updating our water and sewer service boundary agreements. We have come to an agreement
on the proposed interlocal agreement.
RECOMMENDATION:
The Planning/Building/Public Works Department recommends that Council approve the
agreement and adopt the resolution authorizing the Mayor and City Clerk to execute the
agreement.
BACKGROUND SUMMARY:
Our existing agreements predate the merger of Skyway and Bryn Mawr - Lakeridge Water
and Sewer Districts.
Renton had sewer and water boundary agreements with Skyway but not Bryn Mawr -
Lakeridge.
Renton and Bryn Mawr - Lakeridge utilized the water boundary as established in the 1999
update of the Skyway Coordinated System Plan.
The City and Skyway have agreed on the boundaries. The existing water agreement shows
the Skyway and Renton service areas with area(s) between that belong to neither. Typically
the area between is Seattle service area that is to be transferred in the future as agreed in the
Skyway Coordinated Water System Plan. The boundary shown in the new agreement

identifies what would be the boundary separating the two districts following the transfer.
There are some minor changes in the water boundary that both districts agreed would be
beneficial in providing logical service to the customers of both districts. For example, not
splitting a property with the boundary or trying to eliminate the need for both districts to have
a main in the same street to serve their side.
Similarly, there are some minor changes in the sewer boundary that both districts agreed that
would be beneficial in providing logical service to the customers of both districts.
Both the water and sewer boundaries have been extended to identify the service areas where
Renton is adjacent to the new portion of Skyway (the portion that was formerly Bryn Mawr -
Lakeridge Water and Sewer District).
There is language in the agreement that discusses each district continuing to provide water
service to properties they currently serve within the other district. This language is brought
forward from the existing water agreement.
The agreement introduces language that will lead to an eventual franchise agreement for the
areas that Skyway provides water or sanitary sewer service within Renton city limits.
Nothing in the agreement calls for the transfer of either water or sewer customers from one
provider to the other.
CONCLUSION:
We are asking the Council for approval and adoption of a resolution authorizing the Mayor
and City Clerk to execute the agreement.

THIS AGREEMENT is entered into this day of ,

municipal corporation, hereinafter referred to as "SWSD", and the CITY OF RENTON, a
Washington municipal corporation, hereinafter referred to as "RENTON".
WITNESS TH:

IT IS HEREBY AGREED by and between the parties hereto as follows:
1. Water Service Area Boundary Between RENTON and SWSD. The attached
legal description, Exhibit A, describes the line separating the RENTON water
service area from SWSD water service area. The attached map, Exhibit B,
depicts the line separating the RENTON water service area from SWSD water
service area. RENTON shall provide water service for the area generally South
and East of the line illustrated. SWSD shall provide water service for the area
generally North and West of the line illustrated.
Any new construction, upgrading, or replacements within the RENTON City
Limits by SWSD for water service shall be in compliance with RENTON design
and construction standards then in effect or SWSD design and construction
standards, whichever are the higher design and construction standards
including: materials, techniques, and fire flow.
2. City of Seattle Water Service Area: The City of Seattle (SEATTLE) currently
provides direct water service to portions of the service area being discussed in

this agreement. These areas are not contiguous to the remainder of SEATTLE's
service area, but have been served by SEATTLE for some time. These areas,
herinafter the "Transfer Area", are identified in the Skyway Coordinated Water
System Plan, as to be transferred to the appropriate purveyors as feasible and /
or required by new development or annexation.
SEATTLE is not a party to this agreement and the agreement should have no
direct effect on SEATTLE. This agreement does not directly discuss the transfer
of the SEATTLE service areas. This agreement only identifies the boundaries of
the local purveyors to whom the service areas would belong to when transferred.

5. Existing SWSD Water Service Connections in RENTON Service Area: SWSD
currently provides water service to properties inside RENTON's water service
area. RENTON consents to SWSD continuing to provide water service to these
properties. The properties are listed in Exhibit E and depicted in Exhibit B.

7. Overlap Areas: It is understood that RENTON and SWSD will continue providing
service within the service area boundaries of the adjacent water utility, as
defined in Sections 5 and 6 of this agreement, and which shall be known as
overlap areas. RENTON and SWSD agree that any retail water service line
extending outside of the service area boundary, as set forth in Section 1, shall be
phased out and service transferred to the adjacent utility by mutual agreement.

9. RENTON's Service Area Boundaries Overlao SWSD's Corporate Boundarv:
There are areas where RENTON's service area boundaries and SWSD's
corporate boundary overlap. RENTON and SWSD acknowledge that, with
regard to providing service, it is the water and sanitary sewer service boundaries
which govern, not the corporate boundaries.
10. Rescission of Prior Agreements: The former Skyway Water and Sewer District
and RENTON entered into an agreement relating to water service area
boundaries between the two jurisdictions dated February 2, 1998. That
boundary has been incorporated into the SWSD boundary adopted by this
document and the agreement is hereby rescinded.
The former Skyway Water and Sewer District and RENTON entered into an
agreement relating to sanitary sewer service area boundaries between the two
jurisdictions dated June 9, 1994. That boundary has been incorporated into the
SWSD boundary adopted by this document and the agreement is hereby
rescinded.
11. Maintenance of Existing Facilities: SWSD and RENTON will each maintain their
own facilities, according to industry standards.
12. SWSD Comprehensive Water and Sewer Planning. SWSD will submit, to
RENTON, all future Comprehensive Water and Sewerage Plans and

amendments thereto involving area and/or improvements within RENTON City
Limits. Said submission of the SWSD Plan(s) is to assure consistency with
adopted city plans, policies, and land use controls, assist in the review of new
development proposals and right-of-way construction permits, and to fulfill the
responsibilities set forth in RCW 57 and King County Title 13. As new facilities
are planned, constructed, maintained, and/or replaced within RENTON, they
shall comply with RENTON design and construction standards then in effect, or
SWSD design and construction standards, whichever are the higher design and
construction standards.
13. Extension of Utilities Across Properties. RENTON and SWSD agree that they
will require property owners who must end facilities to service their property in
a comprehensive fashion up to i incl ing extending said facilities to the far

RENTON and SWSD will im edi tely begin negotiations for a new franchise for

new franchise shall be negotiated within three years.
Upon any subsequent annexations by RENTON within the SWSD service area,
RENTON shall amend the franchise to include the annexed area, in order to
maintain one franchise agreement. The franchise shall maintain the remaining
balance of the term of the franchise. The franchise should include any updated
provisions as approved by RENTON and agreed to by SWSD.
Any franchise agreement issued hereunder shall be consistent with the
respective comprehensive plans of the parties and State law.
15. Governmental Approvals. The parties will give notice of the adoption of this
Agreement to Metropolitan King County, to the Department of Ecology, to the
Department of Health, and to any other agency with jurisdiction, and shall
cooperate and assist in any reasonable manner in procuring any necessary
approvals hereof by those agencies.
16. Miscellaneous. This Agreement constitutes the entire agreement of the parties,
concerning the subject matter herein, and there are no representations or oral
agreements other than those listed herein, which vary the terms of this
Agreement. Future agreements may occur between the parties to identify, agree
upon, or transfer service areas and/or facilities. This Agreement shall have a
term of 25 (twenty-five) years.

17. Obligations Intact. Nothing herein shall be construed to alter the rights,
responsibilities, liabilities, or obligations of either SWSD or RENTON regarding
provisions of water or sewer services to the properties described herein, or other
properties, except as specifically set forth herein.

The Utilities System has prepared an Agenda Bill to request Council approval for an interlocal
agreement between the City of Renton and Skyway Water and Sewer District. The Council
meeting is scheduled for December V.
You have previously reviewed the agreement for legal form (see attached memo dated 8/20/02).
We are not concerned about the second paragraph of section 1. It is our opinion that both districts
have standards that are similar. We have changed the title to Section 16 to "Miscellaneous".

Dear Members of the City Council / Members of the Safety Committee:
Recently I requested information from the city submitting a public disclosure request
regarding data from the police department. That request included numbers of felonies by
class over a ten year period, number of officers by division (traffic, etc) over that same
period, expansion of the jurisdiction by Renton Police Officers, as well as calls for
service, again over the last 10 years.
I spoke with Chief Gary Anderson regarding the policy of back fill to meet military
obligations. It is my understanding that due to budget constraints, priorities, and the
training lag time of officers, additional officers were not immediately hired. We have
now lost another good police officer to military demands. I strongly urge additional
police officers be hired to assure citizen safety. I urge that a policy be in place to respond
to the change in the number of police officers available to respond to service calls due to
military demand, as well as just routine absent of officers (injury, vacations, family
emergencies, etc).
Over the last 10 years the jurisdiction covered by the Renton Police Department has
grown substantially. The expansion of the jurisdiction in regards to both the number of
people within that jurisdiction and the miles of additional territory now covered, further
strains our police officers. It is my understanding that when a murder suicide in our city
required the response of our officers, a shooting downtown required assistance from the
Tukwila Police Department. This appears to indicate that additional officers are needed
to provide the quality of service our citizens deserve.
As our community grows in respect to population, geographic jurisdiction, traffic also
continues to grow thus having the potential to delay response time. I believe that
additional officers are needed to assist in compensation for this situation as well.
With the city reviewing annexing a large area in the highlands east of the existing
boundary, it seems apparent that additional police officers will be needed. With that
expansion additional demand will be placed upon the police officers that respond to those
service calls. I again urge that additional police officers be hired to guarantee citizens a
safe environment.
Also it has been brought to my attention that a couple of officers may be retiring, thus
again requiring that additional officers be hired. As our community grows it is best to be
proactive than reactive in respects to emergency preparation. My concerns are with the
the number of officers available on shift at any given time to meet the needs of the
people. The strong arm robbery at the transit center, the abduction of one of our citizens
at gun point just a short distance from the transit center, and the incident at Dennys'
involving a large number of victims all have a negative impact on the image of our city.
l strongly encourage additional police officers, those available to respond to the daily
demands of our community, be hired.

AND CATALOG SALES TAXES; WHERE THE STATE OF
WASHINGTON ADOPTS A POINT OF DELIVERY SALES TAX
COLLECTION SYSTEM FOR INTERSTATE SALES, BUT ORDERS THE
DEPARTMENT OF REVENUE TO DISTRIBUTE SALES TAX TO
WASHINGTON CITIES BASED ON POINT OF SALE.
WHEREAS, the City of Renton understands and supports the concept of streamlining
definitions and sales tax rates for interstate sales; and
WHEREAS, the City Renton believes it is important to make the State sales tax system
effective and efficient for private businesses both within the state of Washington and for
businesses outside its geographic boundaries; and
WHEREAS, the state of Washington's tax structure is highly dependent upon sales tax
receipts; and
WHEREAS, the City of Renton has made a commitment to economic development with
an emphasis on warehousing and retail sales as its economic base; and
WHEREAS, the City of Renton has made a commitment to its citizens and businesses,
which includes capital programs that are based upon present and future sales tax dollars for the
delivery of services to the citizens of Renton, construction and reconstruction of infrastructure
and facilities, and the possible investment in infrastructure as the City's share of economic
development; and

WHEREAS, the City of Renton and many other cities, pursuant to the expectations of the
Growth Management Act, have worked hard to develop economic, transportation, and land use
policies that meet regional needs for employment in warehousing and retail activities; and
WHEREAS, industrial,. commercial and retail zones place disproportionate traffic, utility
and public safety demands on the City of Renton; and
WHEREAS, the City's industrial, commercial and retail zones have provided a sales tax
base that has allowed the City to develop and improve infrastructure to facilitate commerce; and
WHEREAS, if the State changes the distribution of sales tax receipts from point of sale
to point of distribution, there will be a tax shift between cities which have developed the economic
and land use policies to support regional growth to cities that have chosen not to have this activity
in their geographic boundaries; and that
WHEREAS, if the State changes the distribution of sales tax receipts from point of sale
to point of distribution, a small number of cities will bear the largest share of the burden; and
WHEREAS, the issues of equity are of great importance to the City of Renton; and
WHEREAS, the proposed changes to streamlining sales tax would provide a positive
impact for the state of Washington, but would produce disparate impacts for cities, counties and
lesser taxing districts;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO RESOLVE AS FOLLOWS:
SECTION I. The above findings are true and correct in all respects.
SECTION II. The City of Renton supports the concept of streamlining sales tax

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
ANNEXING CONTIGUOUS UNINCORPORATED TERRITORY KNOWN
AS THE FALK ANNEXATION, BY THE ELECTION METHOD, AND
SETTING THE TAXATION RATE, ESTABLISHING ZONING
CLASSIFICATIONS, AND FIXING THE EFFECTIVE DATE OF THE
ANNEXATION.
WHEREAS, after public hearing, the City Council enacted a resolution calling for an
annexation by election under RCW 35A.14.015 for an area commonly referred to as the Falk
Annexation, which area is the property generally bounded by the existing City boundaries to the
north boundary (the southern edge of South 471` Street) and west, the northern edge of SE 185t`
Place, if extended, to the south, and the eastern edge of 102nd Avenue SE to the east, legally
described in Exhibit A attached hereto and incorporated by reference as if fully set forth; and
WHEREAS, said resolution also called for an election on a proposition that the property
in the Falk Annexation should be subject to existing bonded indebtedness; and
WHEREAS, said resolution also called for an election on the proposition that all property
located within the territory to be annexed, excluding street right-of-ways, shall, simultaneous with
the annexation, have imposed City of Renton zoning regulations, with a Comprehensive Plan
designation of Residential Single Family (RS) and a zoning designation of R-8; and
WHEREAS, said proposed annexation had been submitted to and approved by the King
County Boundary Review Board; and
WHEREAS, an election was held pursuant to State statute; and
WHEREAS, in the September 16, 2003 election for the Falk Annexation, the assumption
of indebtedness, and the zoning regulations were approved by the voters; and
ORDINANCE NO.
WHEREAS, the election results certifying a sufficient majority to permit annexation of
the area have been received by the City;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION I. The City Council finds it to be in the best interest of the citizens of
the City of Renton to annex and does hereby annex the territory submitted to the voters as the
Falk Annexation situated in King County, Washington, as contiguous, proximate and adjacent to
the present corporate limits of the City and as more particularly described by its legal description
as set forth in Exhibit A and graphically shown on Exhibit B, attached hereto and incorporated in
full by this reference.
SECTION II. The territory set forth in this ordinance and for which said election
results were certified for annexation should be and is hereby made a part of the City of Renton.
The area shall be assessed and taxed at the same rate on the same basis as property within the City
of Renton to pay for all or any portion of the outstanding indebtedness of the City of Renton,
which indebtedness has been approved by the voters, contracted for, or incurred prior to or
existing at, the date of annexation.
SECTION III. Zoning for the annexed area is hereby designated as R-8, with a
Comprehensive Plan designation of RS (Residential Single Family).
SECTION IV. This ordinance, being an exercise of a power specifically delegated
to the City legislative body, is not subject to referendum, and shall take effect five days after its
passage, approval, and publication.

2. Commodity Rates: Two (2) consumption blocks will be established for
residential customers (single-family and duplex customers). The size of the first block will be
zero to one thousand (0 to 1,000) cubic feet of water consumed per month. The second block will
be all consumption over one thousand (1,000) cubic feet per month. The rates for these two (2)
blocks are as follows:

All commercial customers (multi -family, commercial and industrial) will pay for
consumption at the first block rate of one dollar eighty one cent ($1.81) per one hundred (100)
cubic feet.
C. Senior Citizens And Disabled Persons: The following is hereby established for
certain senior citizens and disabled persons who are economically disadvantaged as herein set
forth:
1. Low -Income Seniors: A "low-income senior citizen" is defined as a
person sixty-two (62) years of age or older who resides in a single-family dwelling that is
separately metered for water usage, either as owner, purchaser, or renter, and whose total
income, including that of his or her spouse or co -tenant, does not exceed the annual income
threshold for low-income rate eligibility. The annual income threshold for eligibility for low-
income rate shall be adjusted each calendar year, proportionate to the increase in the local
consumer price index (for urban wage earners and clerical workers), to a base of the most recent
census data available for determining the median household income for Renton. Any household
with a disposable income of thirty five percent (35%) or less of the median household income for

the City of Renton will be eligible for a seventy five percent (75%) rate subsidy. Any household
with an annual disposable income between thirty five (35%) and fifty percent (50%) of the
Renton median household income is eligible for a forty percent (401/o) rate subsidy. For the
calendar year 2001 those figures shall be less than fifteen thousand dollars ($15,000.00) per
annum for a seventy five (75%) rate subsidy and between fifteen thousand dollars ($15,000.00)
and twenty one thousand nine hundred dollars ($21,900.00) for a forty percent (40%) rate
subsidy for single occupancy, and for double occupancy less than seventeen thousand nine
hundred fifty dollars ($17,950.00) for a seventy five percent (75%) rate subsidy, and between
seventeen thousand nine hundred fifty dollars ($17,950.00) and twenty five thousand fifty dollars
($25,050.00) for a forty percent (40%) rate subsidy. For households with more than two
individuals qualifying under subsection C of this Section, an additional five thousand dollars
($5,000.00) is added to the income threshold per qualifying individual.
2. Low -Income Disabled Citizen: A "low-income disabled citizen" is defined
as: a) a person qualifying for special parking privileges under RCW 46.16.381(1)(a) through (f);
b) a blind person as defined in RCW 74.18.020; c) a disabled, handicapped, or incapacitated
person as defined under any other existing State or Federal program; or d) a person on home
kidney -dialysis treatment who resides in a single-family dwelling that is separately metered for
water usage, either as owner, purchaser or renter, and whose total income, including that of his or
her spouse or co -tenant, does not exceed the annual income threshold for eligibility for low-
income rate.
3. Qualified Persons:
a. Every such person (if double occupancy, then both household
members) shall meet either of the above requirements to qualify for senior citizen and disabled

rate(s). Every such person (if double occupancy, then both household members), shall file with
the Utilities billing section of the City, his or her affidavit, that he/she or they are qualified to be
charged the special rate for such utility services herein stated.
b. Such statement shall contain such other information as the Utilities
billing section may prescribe, including but not limited to address, ownership or interest in the
dwelling occupied by such applicant(s), amount, source and nature of all income from any and
all sources, together with the applicant's unqualified promise to forthwith notify the City of any
circumstances or change in condition which would make the applicant(s) ineligible to receive
said special rate(s). The Utilities billing section may establish rules and procedures for
implementing this Section.
4. Low -Income Rates:
a. For those senior citizens and disabled persons who qualified as
economically disadvantaged and were on this low-income rate prior to August 1, 1994, the
following rates for water service relating to such single-family dwelling in which such eligible
person or persons permanently reside are as follows:
(1) One dollar twenty nine cents ($1.29) per month for a
seventy five percent (75%) rate subsidy and two dollars thirty two cents ($2.32) for a forty
percent (40%) rate subsidy, limited to nine hundred (900) cubic feet of water per month.

(2) Any excess shall be charged as provided in Sections 8-4-
b. For those senior citizens and disabled persons who qualify as
economically disadvantaged, and were on this low-income rate after August 1, 1994, the

person or persons permanently reside:
(1) Two dollars eighty three cents ($2.83) per month for a
seventy five percent (75%) rate subsidy, limited to nine hundred (900) cubic feet of water per
month, and six dollars eighty cents ($6.80) per month for a forty percent (40%) rate subsidy,
limited to nine hundred (900) cubic feet of water per month.
(2) Any excess shall be charged as provided in subsections 8-
4-3 LA and B, except for those persons who qualify under home kidney dialysis. These
customers are limited to one thousand seven hundred (1,700) cubic feet of water per month
before any excess is charged as provided in subsections 8-4-3 LA and B.
C. For those senior citizens and disabled persons who become eligible
according to the criteria in Sections 8-4-31.C.1 and 8-4-31.C.2 after the effective date hereof, the
following rates for water service relating to such single-family dwelling in which such eligible
person or persons permanently reside:
(1) Two dollars fifty eight cents ($2.58) per month, limited to
nine hundred (900) cubic feet of water per month, and for households with income thirty five
percent (35%) or below the median household income for Renton; and six dollars eighteen cents
($6.18) per month, limited to nine hundred (900) cubic feet of water per month for double
occupancy households with income between thirty six percent (36%) and forty seven percent
(47%) of the median household income for Renton.
(2) Any excess shall be charged as provided in Section 8-4-
3 LA and B.

5. For those senior citizens, sixty two (62) years of age or older and/or
disabled citizens, when such seniors and/or disabled citizens are not otherwise eligible for special
rates as low-income seniors and/or disabled citizens, but who qualify for property tax exemption
pursuant to RCW 84.36.381.5(a) and are not residents of the City shall be exempt from the fifty
percent (50%) utility surcharge applicable to those customers not residents of the City. To
receive this exemption the applicant must provide the information required under Section 8-4-

SECTION II. Section 8-5-15, Sewer Charges, of Chapter 5, Sewers, of Title 8
(Heath and Sanitation) of Ordinance No. 4260 entitled "Code of General Ordinances of the City
of Renton, Washington" is hereby amended to read as follows:
8-5-15 - SEWER CHARGES:
A. Disposal Rates: The monthly rates and charges for sewage disposal service shall
be as follows:
1. Single -Family: Thirteen dollars four cents ($13.04).
2. All Other Users: A base charge of one dollar ninety nine cents ($1.99) plus 3
one dollar forty seven cents ($1.47) per month for each hundred (100) cubic feet of water used,
for a minimum charge of thirteen dollars four cents ($13.04) per month.

3. Charges For Sewer Service Without City Water: In the event that water
obtained from sources other than purchased from the City is either discharged or drained into the
sewer system, users shall be charged by one of the two (2) following methods:
per month.
a. For single-family residences, thirteen dollars four cents ($13.04)
b. For other than single-family dwellings, the
Planning/Building/Public Works Administrator shall install a water meter into such private water
system at cost to property owners, and the method of billing shall be in compliance with Section
8-5-15.A.2 of this Title.
B. Separate Sewer Exempt Meter: Whenever the use of water is such that a portion
of the water used does not flow into the City sewer system but is lost by evaporation or used in
irrigation, manufacturing or any other use, and the person in control provides proof of this fact,
such person may apply for the installation of a separate sewer exempt meter to measure the
amount of water so used or lost and no charge shall be made for sewage because of water so used
or lost. A sewer exempt meter application will be made in the same manner as a regular water
meter installation. All sewer exempt meters shall be located at the property line or adjacent to the
regular meter; provided, however, an evaporation exemption may be granted to coin -operated
and commercial laundries without the installation of a submeter. Such exemption shall be an
eleven percent (I I%) reduction in chargeable water consumption for commercial and industrial
laundries and a three percent (3%) reduction in chargeable water consumption for coin -operated
laundries.
C. Service Outside Of City: The rates to such special uses shall be one and one-half
(I-1/2) times the basic City water rates applicable to resident users for similar services plus any

monthly fees levied by Metro except that such exemptions and discounts as provided in Sections
8-4-32, 8-5-15.D.4 and 8-5-15.D.5 shall likewise apply to these rates.
D. Additional Charges: In addition to the foregoing charges specified in this Section,
the following rates shall be charged:
l . A charge of twenty three dollars forty cents ($23.40) per month payable to
Metro for each single-family dwelling unit.
2. A charge of twenty three dollars forty cents ($23.40) per month payable to
Metro for each seven hundred and fifty (750) cubic feet, or any fraction thereof, of water used
for all users other than single-family.
3. ' Any additional charges hereafter imposed by Metro under the "Industrial
Cost Recovery" or "Industrial Waste Surcharge" programs required under the FWPCA (PL 92-
500), section 204, or as same may be amended hereafter, plus fifteen percent (15%) thereof as an
additional charge for the City's cost of implementing such programs.
4. Senior and/or disabled citizens who qualified under Section 8-4-3 LC for
low-income rates prior to August 1, 1994, are eligible for the following rates:
a. Twenty three dollars forty cents ($23.40) per month for Metro
sewer, -and one dollar eleven cents ($1.11) per month for City sewer charges for a seventy five
percent (75%) rate subsidy and two dollars twelve cents ($2.12) per month for City sewer
charges for a forty percent (40%) rate subsidy.
b. Senior and/or disabled citizens who qualify under Section 8-4-3 LC
for low-income rates after August 1, 1994, are eligible for the following rates:
(1) Twenty three dollars forty cents ($23.40) per month for
Metro sewer and three dollars thirty four cents ($3.34) per month for City sewer charges for a

seventy five percent (75%) rate subsidy, and seven dollars eighty five cents ($7.85) per month
for City sewer charges for a forty percent (40%) rate subsidy.
(2) For double occupancy households, seven dollars thirty two
cents ($7.32) per month for households with incomes between thirty six percent (36%) and forty
seven percent (47%) of the median household income for the City.
5. For those senior citizens, sixty two (62) years of age or older and/or
disabled citizens, when such seniors and/or disabled citizens are not otherwise eligible for
special rates as low-income seniors and/or disabled citizens, but who qualify for property tax
exemption pursuant to RCW 84.36.381.5(a) and are not residents of the City shall be exempt
from the fifty percent (501/o) utility surcharge applicable to those customers not residents of the
City. To receive this exemption the applicant must provide the information required under
Section 8-4-31.C.2.
E. Installation Of Sewage Meter: Whenever the use of the public sewer is such that
infiltration and/or inflow is evident from a private sewage facility, or a building sewer, where the
sewer flow is two (2) times in excess of the daily metered water, the Utilities Engineer shall
install a sewage meter and charge the regular monthly rates and charges for customers in that
class, for all infiltration and inflow and sewage that it discharged into the public sewers. All costs
and expenses incident to the installation and connection of the sewer meter shall be borne by the
owner or applicant of the premises in question.

WHEREAS, under Section 4-2-020 of Chapter 2, Zoning Districts — Uses and Standards,
of Title IV (Development Regulations) of Ordinance No. 4260 known as the "Code of General
Ordinances of the City of Renton," as amended, and the maps and reports adopted in conjunction
therewith, the property hereinbelow described has previously been zoned as Residential 1 du/ac;
and
WHEREAS, the City of Renton initiated a proceeding for change of zone classification
of said property; and
WHEREAS, this matter was duly referred to the Planning Commission for investigation,
study, and public hearing, and a public hearing having been held thereon on or about
