a. Approval of Council meeting minutes of December 8, 2003. Council concur.
b. Economic Development, Neighborhoods and Strategic Planning Department recommends
approval of an agreement with Washington State Department of Community, Trade and
Economic Development for a $45,000 grant to complete the Airport Compatible Land Use
Program and to implement the Urban Center -North Comprehensive Plan designation. Council

c. Economic Development, Neighborhoods and Strategic Planning Department recommends
declaring a moratorium on the development of primary use surface parking lots, including

d. Economic Development, Neighborhoods and Strategic Planning Department recommends

f. Transportation Systems Division submits CAG-03-069, 2003 Overlay; and requests approval of
the project, authorization for final pay estimate in the amount of $104,016, commencement of
60-day lien period, and release of retainage bond to Lakeside Industries, contractor, if all

SPECIAL PRESENTATION City Clerk Bonnie Walton recognized the City Hall lobby volunteers who staff
City Clerk: Lobby Information the front desk and provide assistance and information to City Hall visitors and
Desk Volunteers Recognition callers. Noting they answer innumerable questions on a daily basis, she
expressed her appreciation for their generous contributions of time and
dedicated service. The volunteers and the total hours of service given are as
follows: Helenanne Botham, 1,903.5 hours; Mary Breda, 8,137.5 hours; Jean
Delaurenti, 1,570.5 hours; Ethel Eastman, alternate, 369 hours; Melanie Gain,
1,449 hours; Ann Grinolds, 6,139.5 hours; Delores Mead, 742.5 hours; .
Florence Morris, 1,053 hours; Bert Nord, 3,991.5 hours; and Donna Struck, 630
hours.
Additionally, Ms. Walton thanked Deputy City Clerk Michele Neumann for her
work with Council meetings, and the videographers who film the Council
meetings, which are cablecast on-Renton's government access cable television
channel 21.
PUBLIC MEETING This being the date set and proper notices having been posted and published in
Annexation: Anderson, 148th accordance with local and State laws, Mayor Tanner opened the public meeting
Ave SE & SE 120th St to consider the proposed Anderson 10% Notice of Intent to Annex Petition for
approximately 19.75 acres, including the abutting 148th Ave. SE right-of-way,
located east of 148th Ave. SE and south of SE 120th St., abutting the Urban
Growth Area boundary on its north side.
Don Erickson, Senior Planner, stated that the site is within the East Renton
Plateau Potential Annexation Area and contains 14 single-family dwelling
units. The topography is essentially flat, with a wetland located in the
southwest corner of the site. Reviewing the public services, he noted that the
site is served by Water District #90; that roadway and stormwater
improvements are likely; and fire service, currently supplied by Fire District
#10, will convert to the City of Renton upon annexation.
Mr. Erickson explained that existing King County zoning is R-4 (Residential -
four dwelling units per gross acre). Renton's Comprehensive Plan designates
the site as Residential Low Density, for which R-4 (Residential - four dwelling

units per net acre) zoning is proposed. Regarding the fiscal impact of the
proposed annexation, he reported that the City will realize a surplus of $44,018
at full development, assuming an increase to 59 single-family homes and an
assessed home valuation of $300,000. He also noted the one-time estimated
expense of $63,000 for the acquisition and development of parks. Mr. Erickson
concluded by stating that the proposed annexation will further City business
goals, is consistent with City policies for annexation, and meets Boundary
Review Board objectives.

the costs associated with hooking -up to Renton's sewer service, paying for
unwanted City amenities such as libraries and parks, and the increase in
density.
Jon Newman, 8070 Langston Rd. S., Seattle, 98178, stated that his family owns
1.93 acres in the proposed annexation area, and expressed his support for the
annexation.

PUBLIC HEARING This being the date set and proper notices having been posted and published in
Planning: Multi -Family accordance with local and State laws, Mayor Tanner opened the public hearing
Property Tax Exemption to consider the designation of residential targeted areas for Washington State's
multi -family property tax exemption provided for under RCW (Revised Code
of Washington) 84.14.
Mark Santos -Johnson, Economic Development Specialist, explained that
utilizing Washington State's property tax exemption means eligible multi-
family housing projects such as apartments or condominiums would be able to
receive a partial property tax exemption for up to ten years as an added
financial incentive for developers to create multi -family housing projects. The
tax exemption applies to the value of qualified new housing construction after
completion, but does not apply to the value of the land, any existing
improvements, or any non -housing related improvements. Mr. Santos -Johnson
stated that the tax exemption also applies to all levels of the ad valorem
property tax, including city, county, state, and local taxing districts; and for
projects in Renton, this amounts to $11.10 per $1,000 of assessed value for
2003. He added that the value of the property tax exemption will vary greatly
depending on the nature, quality, and costs of each multi -family housing
project.
Mr. Santos -Johnson reviewed the proposed residential targeted areas for the tax
exemption as follows:

• The Center Downtown (CD), Residential Multi -Family Urban Center (RM-
U), and Residential Multi -Family Traditional (RM-T) zones in the Center
Downtown Comprehensive Plan designation;
• The Urban Center -North District 1 (UC-N 1) zone in the Urban Center -
North Comprehensive Plan designation; and
• The Center Suburban (CS), Residential Multi -Family Suburban Center
(RM-C), and Residential - ten dwelling units per acre (R-10) zones in the
Center Village Comprehensive Plan designations.
Continuing, Mr. Santos -Johnson explained that eligible projects must be
located in designated targeted areas; must be new construction rental or owner -
occupied multi -family housing with four or more housing units in each
building; must have a minimum number of housing units (minimum of 10 units
in lower density zones and minimum of 30 units in higher density zones); must
be mixed -used if located in the CD or UC-N 1 zones, or in the CS zone within
the Center Village Comprehensive Plan designation; and must comply with
urban center overlay design standards and guidelines.
Mr. Santos -Johnson described the process applicants must undergo to receive
the property tax exemption, and he reviewed the proposed application fees. In
conclusion, he recommended Council adopt the designated residential targeted
areas for the proposed property tax exemption for eligible multi -family housing
projects, noting that the proposed ordinance includes a provision that projects
will not be accepted after 12/31/2006 unless otherwise extended by the City
Council.
In response to Councilman Clawson's inquiry, Mr. Santos -Johnson confirmed
that if an applicant's project resides in a targeted area and meets the eligibility
requirements, the applicant is entitled to the property tax exemption. He noted
that the Economic Development Administrator is responsible for overseeing the
application process, and Council reviews and has final say for each project.
Councilmembers Clawson, Briere, and Corman expressed their support for the
tax exemption, noting that it will aid in drawing more people to live in the
downtown area, encourage new construction, and benefit the contractors.
Responding to Council comments, Economic Development, Neighborhoods and
Strategic Planning Administrator Alex Pietsch pointed out that several multi-
family housing projects in the downtown area have been proposed, but for
various reasons have not moved forward. He indicated that the property tax
exemption may stimulate those projects.
In response to Council President Keolker-Wheeler's inquiry regarding assessing
tax on mixed -use projects, Mr. Santos -Johnson explained that for the final
application, applicants are required to submit a variety of reports including a
break down of their costs to separate the difference between qualified housing
improvements and non -housing or mixed -use commercial uses. King County
would use that information for determining the value of the exempted property.

ADMINISTRATIVE Derek Todd, Assistant to the Chief Administrative Officer, reviewed a written
REPORT administrative report summarizing the City's recent progress towards goals and
work programs adopted as part of its business plan for 2003 and beyond. Items
noted included:
In 2003, City of Renton employees collected food for and donated over
$13,000 to the Salvation Army Renton Food Bank, gave almost $30,000
through the United Way Giving Campaign, and raised over $10,000 for the
Salvation Army Renton Emergency Assistance Program. Employees also
serve as mentors, participate in service clubs, donate blood, and volunteer
in many of er ca acities. - - --- -
Three special dedication ceremonies will take place over the next week.
The Henry Moses Aquatic Center will be dedicated on December 17, Fire
Station #12 will be dedicated on December 18, and the Pavilion Building
will be dedicated on December 22.

membership is capable of performing the landscaping work, and he asked that
this issue be placed on the Community Services Committee agenda for
discussion.

Separate Consideration Economic Development, Neighborhoods and Strategic Planning Department
Item 8.c. recommended adoption of a resolution that declares a six-month moratorium on
Planning: Primary Use Surface the development of primary use surface parking lots, including commercial lots,
Parking Lots Development park and ride lots, and lots serving transit facilities; and sets a public hearing

At the request of Council President Keolker-Wheeler, Economic Development,
Neighborhoods and Strategic Planning Administrator Alex Pietsch gave a
briefing on the proposed moratorium. He noted that City staff has discussed,
with no result, the leasing of parking spaces at the new City Center Parking
garage for commuters with Sound Transit and King County Metro.
Additionally, he noted that the now -closed K-Mart parking lot on Rainier Ave.
S. is being used as a park and ride until McLendon Hardware commences
construction of its new store on that same site. With this in mind, Mr. Pietsch
explained that King County is now seeking permits for a new surface parking
park and ride facility on property located adjacent to Fred Meyer along Rainier
Ave. S.
Upon review of City Code, it was found that although transit center and surface
parking as a primary use is defined in City Code, a park and ride facility as a
use is not defined. Mr. Pietsch emphasized that the use of surface parking lots
on commercially viable land in the business core is an inefficient land use, and
he noted the importance of the location and design of such lots. Therefore,
staff needs time to review policies and criteria, and to prepare and present
proposed changes to the Comprehensive Plan and zoning.
Reporting that City staff met with King County staff today to discuss the use of
the City Center Parking garage, Mr. Pietsch indicated that they seemed
interested, but made no promises. Meanwhile, King County is in due diligence
to buy the property from Fred Meyer. In conclusion, Mr. Pietsch stated that a
moratorium is needed to give the City time to review policies and criteria, and
time to continue discussions with King County regarding the use the City's
parking garage.
Reporting that she attended the meeting with King County, Transportation
Systems Director Sandra Meyer stated that King County seemed responsive,
and she believed an agreement may be possible. In response to Councilman
Clawson's inquiry regarding the park and ride spaces at Metropolitan Place, Ms.
Meyer stated that King County leases 150 spaces, and reports that 30 to 50
spaces are not being used at this time.
Mayor Tanner noted that when commuters are unable to use the old K-Mart
parking lot, there will be a demand for more parking spaces. Ms. Meyer added
that King County will encounter a shortage of 80 to 85 spaces when the parking
lot is closed.
Councilman Corman stated his support for the moratorium, as it would allow
time for further discussions with King County about the City Center Parking
garage. Councilman Persson also expressed his support for the moratorium,
noting that current zoning allows surface parking lots in prime commercial
locations.

Mr. Pietsch explained that the moratorium only applies to all primary use
surface parking lots throughout the City, and does not apply to accessory
parking lots developed as part of permits for other land use activities.

Rights, Growth Management Act, Law and Justice, Liability Reform, Gambling
Activities, Parks, Affordable Housing, and Social and Human Services.

Annexation: Bales, SE 128th Council President Keolker-Wheeler presented a Committee of the Whole report

regarding the Bales Annexation zoning. The Committee recommended that
Council adopt R-1 (Residential - one dwelling unit per acre) zoning under the
Residential Low Density Comprehensive Plan land use designation. This
recommendation is based upon the City Attorney's letter of September 26,
2003, in which he opines that since the R-5 (Residential - five dwelling units
per acre) zoning regulation was rejected by the electorate at the September 16,
2003, Special Election, it can no longer be considered as part of the same
annexation. If the property owners desire consideration of R-5 zoning after the
subject properties are annexed into the City, they can request such a zoning

ANDERSON ANNEXATION PUBLIC MEETING
COUNCIL CONSIDERATION OF PROPOSED ANNEXATION
WITH R-4 ZONING
December 15, 2003
The City is in receipt of a Notice of Intention to Commence Annexation Petition from a property
owner in the proposed annexation area representing approximately 34% of the area's 19.75
acres. The subject site is within the City's East Renton Plateau Potential Annexation Area and is
designated Residential Low Density (RLD) on the City's Comprehensive Plan Land Use Map.
This site currently has the County's R-4 zoning on it. The area currently has 14 dwelling units.
Proposed zoning would be R-4 (4 units per net acre). This is slightly less density than would be
allowed under the County's R-4 zoning since Renton's zoning, when calculating density, deletes
critical areas and streets from a site's gross acreage and the County does not. With the City's
proposed R-4 zoning, the site could accommodate approximately 59 single-family detached
dwelling units including the 14 units now in the area. County zoning allows both attached and
detached units.
Under the recently adopted new rules amending RCW 35A.14.120, direct petitions to annex are
initiated by property owners representing at least 10% of the annexation area's acreage. The
Notice of Intention to Commence Annexation Proceedings petition is then forwarded to the
Council. Council is required to hold tonight's public meeting in order to decide whether the City
will accept, reject or geographically modify the proposed annexation.
If the Council decides to accept the proposed annexation, it will:
1. Authorize the circulation of the new 50% Petition to Annex;
2. Decide whether to require the simultaneous adoption of zoning consistent with the
Comprehensive Plan Land Use Map; and,
3. Decide whether to require property owners within the annexation area to assume their fair
share of the City's existing indebtedness.

APPLICATION NAME: Designation of residential targeted areas for a potential limited
property tax exemption for eligible multi -family housing
projects.
PROJECT DESCRIPTION: The Economic Development, Neighborhoods and Strategic Planning
Department proposes to utilize Washington state's multi -family
property tax exemption (provided for in Chapter 84.14 RCW) to help
stimulate construction of new multi -family development in targeted
areas. If adopted by the City Council, eligible multi -family housing
projects (e.g., apartments or condominiums) would be able to receive
a partial property tax exemption for up to 10 years as an added
financial incentive for developers to create multi -family housing in
targeted areas in our community.
As required by state law, the City is holding a public hearing for the
purpose of considering the following three areas (highlighted on the
attached map) as designated residential targeted areas for the
proposed property tax exemption for multi -family housing:
• The Center Downtown (CD), Residential Multi -Family Urban
Center (RM-U) and Residential Multi -Family Traditional (RM-T)
zones in the Center Downtown Comprehensive Plan designation;
• The Center Suburban (CS) Residential Multi -Family Suburban
Center (RM-C) and Residential 10 dwelling units per acre (R-10)
zones in the Center Village Comprehensive Plan designation; and
The Urban Center North District 1 (UCN-1) zone in the Urban
Center North Comprehensive Plan designation.
RECOMMENDATION: Council adopt the above areas as designated residential targeted areas
for the proposed property tax exemption for eligible multi -family
housing projects.

In addition to our day to -day activities, the following items are worthy of note for this week:
GENERAL
• City of Renton employees always provide outstanding service and their generosity is impressive as well. In
2003, city employees collected food for and donated over $13,000 to the Salvation Army Renton Food Bank,
gave almost $30,000 through the United Way Giving Campaign, and raised over $10,000 for the Salvation
Army Renton Emergency Assistance Program to help citizens in need pay their utilities or rent. Employees
also serve as mentors, participate in service clubs, donate blood, and volunteer in many other capacities. Not
only do our employees receive the blessings that come from giving, more importantly, they are able to make a
difference in the lives of others in Renton and our local communities. A sincere thank you is extended to all
city employees.
ADMINISTRATIVE, JUDICIAL, AND LEGAL SERVICES DEPARTMENT
• Three special dedication ceremonies will take place over the next week. The Henry Moses Aquatic Center will
be dedicated on Wednesday, December 17d', at 12:00 noon. Fire Station #12 will be dedicated on Thursday,
December 18d', at 4:00 p.m. The Pavilion Building, undergoing renovation, will be dedicated on Monday,

WHEREAS, the City of Renton has initiated an AirportCompatibility Use Program, and
is in the process of drafting development standards for implementation of the Urban Center —
North mixed use development Comprehensive Plan amendment; and
WHEREAS, the Washington State Department of Community, Trade and Economic
Development (hereinafter CTED) has a responsibility, under state law, to provide financial and
technical assistance to the communities of the state to assist in improving the delivery of federal,
state and .local programs; and to provide communities with opportunities for productive and
coordinated development beneficial to the well-being of communities and their residents; and
WHEREAS, CTED has a statutory authority to offer technical and financial assistance to
the City of Renton for its planning under the Growth Management Act; and

completion of the Airport Compatible Land Use Program and the development standards for
implementation of the Urban Center — North mixed use development Comprehensive Plan

of $45,000. The grant is being awarded through the Growth Management Update program to
complete the Airport Compatible Land Use Program, and the Development Standards for

CONTRACT TERMS & CONDITIONS
ECTION 1 - PREAMBLE
This CONTRACT, entered into by the City of Renton, (hereinafter referred to as the GRANTEE) and the
Department of Community, Trade and Economic Development (hereinafter referred to as the DEPARTMENT),
WITNESSES THAT:
WHEREAS, the DEPARTMENT has the responsibility under RCW 43.330.050(5) to provide financial and
technical assistance to the communities of the state, to assist in improving the delivery of federal, state, and
local programs; and to. provide communities with opportunities for productive and coordinated development
beneficial to the well-being of communities and their residents; and
WHEREAS, the DEPARTMENT has the statutory authority under RCW 43.330.120 to offer technical and
financial assistance to cities and counties planning under the Growth Management Act; and
WHEREAS, the DEPARTMENT has selected the GRANTEE to receive funds and the GRANTEE shall use the
funds to undertake a project which furthers the goals and objectives of the DEPARTMENT's Growth
Management Services Unit in accordance with its mission.
THEREFORE, the parties mutually agree to the following terms and conditions:
SECTION 2 - WORK PLAN
mover the course of the CONTRACT period, the GRANTEE shall accomplish the activities described in
Attachment "A": Work Plan that is incorporated into the CONTRACT by reference.
SECTION 3 - FUNDING
The total funds to be reimbursed to the GRANTEE for costs incurred during the CONTRACT period shall be a
sum not to exceed $45,000.
SECTION 4 - BUDGET
An approved budget by category of expenditure is included as Attachment 'B" of this CONTRACT that is
incorporated into the CONTRACT by reference. The total amount of transfers of funds between line item
budget categories shall be as specified in Attachment `B." If the cumulative amount of these transfers exceeds
or is expected to exceed the amount specified in Attachment `B," the total project budget shall be subject to
justification and negotiation of a CONTRACT amendment by the GRANTEE and the DEPARTMENT.
SECTION 5 - CONTRACT PERIOD
A. The effective date of this CONTRACT shall be the date all parties sign and complete execution of the
CONTRACT. This CONTRACT shall terminate on December 31, 2004 except for any remaining
obligations of the GRANTEE as may exist under Section 7.
ji. Costs to be reimbursed by the DEPARTMENT under this CONTRACT are those eligible costs incurred
during the performance of the CONTRACT work program on or after July 1, 2003.

SECTION 6 - REIMBURSEMENT PROVISIONS
A. Funds will be disbursed per the schedule established in Attachment `B."
B. Only eligible project -related costs will be reimbursed. Ineligible costs include, but are not necessarily
limited to: capital expenses, such as land acquisition or construction costs; purchase of machinery; hosting
expenses, such as meals, lodging, or transportation incurred by persons other than staff and volunteers
working directly on the project; lobbying or political influencing; and other costs which are not directly
related to the project.
C. Within twenty (20) days after receiving and approving the voucher, the DEPARTMENT shall remit to the
GRANTEE a warrant covering the DEPARTMENT's share of the costs incurred for work performed.
D. The final invoice voucher covering costs incurred for work performed on or before December 31, 2004,
must be submitted by the GRANTEE prior to January 9, 2005 to allow the DEPARTMENT sufficient time
to process it. Payment of the final voucher shall be contingent upon the DEPARTMENT's receipt and
approval of any products or deliverables designated in Attachment "A."
SECTION 7 - REPORTS
A. The GRANTEE shall submit a brief semiannual progress report on a form approved by the DEPARTMENT
which describes the progress made on the work program outlined in Attachment "A. Progress reports will
be submitted on a semiannual calendar cycle. The semiannual progress report shall also provide detail on
the dedicated matching funds.
B. The GRANTEE shall furnish, along with or prior to submitting.the final invoice voucher, two copies of each.
final product designated in Attachment "A."
SECTION 8 - ACKNOWLEDGMENT OF STATE FUNDING
The GRANTEE shall provide all project -related press releases to the DEPARTMENT. Press releases shall
identify the DEPARTMENT as a project financier.
Publications such as reports and pamphlets which are developed totally or in part with funds provided under this
CONTRACT shall give credit to the funding source by including the following: "Funds made available through
the Washington State Department of Community, Trade and Economic Development."

SECTION 9 - DOCUMENTATION, MONITORING; AND AUDIT
-)uring the CONTRACT period and following its termination, the GRANTEE shall follow accounting
procedures and shall maintain books, records, documents, and other evidence which sufficiently and properly
reflect all project specific costs expended in the performance of this CONTRACT. The Office of the State
Auditor or any persons duly authorized by the DEPARTMENT shall have full access to and the right to inspect,
excerpt, audit, or examine any of these materials at all reasonable times for a period of six years after
termination of the CONTRACT.
The DEPARTMENT may require a copy of the GRANTEE's most recent audit and management letter.
The DEPARTMENT may require the GRANTEE to obtain an audit for specific expenditures under this
CONTRACT. Costs of a required audit are an allowable expense.
SECTION 10 - RECAPTURE PROVISIONS
In the event that the GRANTEE fails to expend funds under this CONTRACT in accordance with state laws
and/or the provisions of this CONTRACT, the DEPARTMENT reserves the right to recapture state funds in an
amount equivalent to the extent of the noncompliance.
Such right of recapture shall exist for a period not to exceed six years following CONTRACT termination.
Repayment by the GRANTEE of funds under this recapture provision shall occur within 30 days of demand. In
the event that the DEPARTMENT is required to institute legal proceedings to enforce the recapture provision,
ie DEPARTMENT shall be entitled to its costs thereof, including reasonable attorney's fees.
SECTION 11 - CONTRACT AMENDMENTS
A. The .DEPARTMENT or the GRANTEE may request changes to the CONTRACT or its provisions. It is
agreed and understood that no material or substantive alteration or variation of the terms of this
CONTRACT shall be valid unless made in writing and signed by both parties. Any oral understanding or
agreements shall not be binding unless made in writing and signed by both parties.
B. CONTRACT amendments shall not be made which result in an extension of the CONTRACT period
beyond June 30, 2005.
SECTION 12 - NONDISCRIMINATION CLAUSE
During the performance of this CONTRACT, the GRANTEE shall comply with all federal and state
nondiscrimination laws, including, but not limited to chapter 49.60 RCW. Washington's Law Against
Discrimination, and 42, U.S.C. 12101 et sea., the Americans with Disabilities Act (ADA).
In the event of the GRANTEE's noncompliance or refusal to comply with any nondiscrimination law,
regulation, or policy, this CONTRACT may be rescinded, canceled, or terminated in whole or in part, and the
GRANTEE may be declared ineligible for further CONTRACTS with the DEPARTMENT. The GRANTEE
shall, however, be given a reasonable time in which to cure this noncompliance. Any dispute may be resolved in
xordance with Section 20.

SECTION 13 - TERMINATION OF CONTRACT
If, through any cause, the GRANTEE shall fail to fulfill its obligations under this CONTRACT in a timely
and proper manner; or if the GRANTEE shall violate any of its covenants, agreements, or stipulations; the
DEPARTMENT shall have the right to terminate this CONTRACT. The DEPARTMENT may withhold the
balance of state funding if such default. or violation is not corrected within twenty (20) days after the
DEPARTMENT submits written notice to the GRANTEE describing such default or violation.
B. Notwithstanding any provisions of this CONTRACT, either party may terminate this CONTRACT by
providing written notice of such termination, specifying the effective date thereof, at least thirty (30) days
prior to such date.
C. Reimbursement for GRANTEE work performed, and not otherwise paid for by the DEPARTMENT prior to
the effective date of such terminations, shall be as the DEPARTMENT reasonably determines.
D. In the event funding from the state, federal, or other sources is withdrawn, reduced, or limited in any way
after the effective date of this CONTRACT and prior to normal completion, the DEPARTMENT may
unilaterally reduce the scope of work and budget or terminate this CONTRACT.
SECTION 14 - GRANTEE NOT EMPLOYEE OF DEPARTMENT
The GRANTEE, its employees, or agents performing under this CONTRACT are not deemed to be employees
neither of the DEPARTMENT nor as agents of the DEPARTMENT in any manner whatsoever. The GRANTEE
,ill not hold itself out as or claim to be an officer or employee of the DEPARTMENT or of the State of
,Washington and will not make any claim, demand, or application to or for any right or privilege applicable to an
officer or employee of the DEPARTMENT or of the State of Washington.
SECTION 15 - USE OF SUBCONTRACTS
The GRANTEE may enter into subcontracts for any of the work contemplated under this CONTRACT without
obtaining prior written approval of the DEPARTMENT. The GRANTEE shall follow local policies regarding
procurement, or in absence of local policies, shall use a competitive procurement process.
Each CONTRACT that the GRANTEE enters into with subcontractors, creditors and others shall contain a
clause providing notice that the state and the DEPARTMENT are not responsible for any legal obligation,
financial or otherwise, incurred by the GRANTEE.
The DEPARTMENT reserves the right to monitor the subcontractor selection process and contractual
documents either during or following the selection process.
The GRANTEE is responsible for the performance of any subcontractors. The GRANTEE shall require all
subcontractors to follow the same rules and regulations as described in this document. All subcontractors must
be monitored by the GRANTEE to ensure fiscal accountability.

SECTION 16 - OWNERSHIP OF PROJECT MATERIALS
.11 finished or unfinished documents, data, studies, surveys, drawings, models, photographs, films, duplicating
plates, computer disks and reports prepared by the GRANTEE under this CONTRACT shall be works for hire
under U.S. copyright law. The DEPARTMENT may duplicate, use, and disclose in any manner and for any
purpose whatsoever, all materials prepared under this. CONTRACT.
The GRANTEE must have prior approval of the DEPARMENT to produce patents, copyrights, patent rights,
inventions, original books, manuals, films, or other patentable or copyrightable materials, in whole or in part
with funds received under this CONTRACT. The DEPARTMENT reserves the right to determine whether
protection of inventions of discovery shall be disposed of and administered in order to protect the public
interest. Before the GRANTEE copyrights any materials produced with funds under this CONTRACT, the
DEPARTMENT reserves the right to negotiate a reasonable royalty fee and agreement.
SECTION 17 - TRAVEL AND SUBSISTENCE REIMBURSEMENT
Travel and subsistence reimbursement shall be made in accordance with the guidelines followed by the
GRANTEE in the course of normal operations. In the absence of local provisions, per diem rates and travel
allowances shall be paid in accordance with rates set for state employees pursuant to RCW 43.03.050 and RCW
43.03.060 as now existing or hereafter amended.
SECTION 18 - SPECIAL PROVISION
,he DEPARTMENT's failure to insist upon the strict performance of any provision of this CONTRACT or to
.;xercise any right based upon a breach thereof or the acceptance of any performance during such breach shall
not constitute a waiver of any right under this CONTRACT.
SECTION 19 - HOLD HARMLESS
The GRANTEE agrees to defend, hold harmless, and indemnify the State of Washington and the
DEPARTMENT, their officers, agents, employees, and assigns against any and all damages of claims from
damages resulting or allegedly resulting from the GRANTEE's performance of activities under the terms of this.
CONTRACT.
SECTION 20 - DISPUTE RESOLUTION
Except as otherwise provided in this CONTRACT, when a bona fide dispute arises between the parties and it
cannot be resolved through discussion and negotiation, either party may request a dispute hearing. The parties
shall select a dispute resolution team to resolve the dispute. The team shall consist of a representative appointed
by the DEPARTMENT, a representative appointed by the GRANTEE, and a third party mutually agreed upon by
both parties. The team shall attempt, by majority vote, to resolve the dispute. The parties agree that this dispute
process shall precede any action in a judicial or quasi-judicial tribunal.

SECTION 21 - GOVERNING LAW AND VENUE
he CONTRACT shall be construed and enforced in accordance with, and the laws of the State of Washington
hereof shall govern the validity and performance. Venue of any suit between the parties arising out of this
CONTRACT shall be the Superior Court of Thurston County, Washington.
SECTION 22 - APPLICABLE LAWS AND REGULATIONS
The GRANTEE shall comply with all existing applicable laws, ordinances, codes, regulations and policies of
local, state, and federal governments, as now or hereafter amended.
SECTION 23 - SEVERABILITY
In the event any term or condition of this CONTRACT or application thereof to any person or circumstances is
held invalid, such invalidity shall not affect other terms, conditions, or applications of this CONTRACT which
can be given effect without the invalid term, condition, or application. To this end, the terms and conditions of
this CONTRACT are declared severable.
SECTION 24 — ENTIRE AGREEMENT
This contract, including referenced exhibits, represents all the terms and conditions agreed upon by the
parties. No other understandings or representations, oral or otherwise, regarding the subject matter of this
contract shall be deemed to exist or to bind any of the parties hereto.

4. Special Budget Provisions

transfers exceeds or is expected to exceed ten percent, the total budget shall be subject to
justification and negotiation of a CONTRACT amendment by the GRANTEE and the
DEPARTMENT.
B. For CONTRACTS under $30,000 the total amount of transfers of funds between line item budget
categories shall not exceed twenty (20) percent of the total budget. If the cumulative amount of these
transfers exceeds or is expected to exceed twenty percent, the total budget shall be subject to
justification and negotiation of a CONTRACT amendment by the GRANTEE and the
DEPARTMENT.
C. A sum of ten (10) percent of funds shall be withheld until all tasks, activities, and final products
defined in ATTACHMENT "A" have been successfully completed by the GRANTEE and accepted

SUMMARY OF ACTION:
The proposed moratorium is needed to give the City time to review policies and criteria needed
to ensure that commercial surface parking lots, transit facilities and park and ride lots are sited
in a way that implements the Land Use Element Urban Center policies, transit policies within
the adopted Transportation Element, and the City Council Business Plan goals. The proposed
moratorium will apply to all primary use surface parking lots throughout the City but will not
apply to accessory parking lots developed as part of permits for other land use activities.
STAFF RECOMMENDATION:
Adoption of a Resolution declaring a moratorium on surface parking lots and transit centers
Set a public hearing January 12, 2004 to take testimony on the moratorium and consider
modifications to it.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF RENTON, WASHINGTON,
DECLARING A MORATORIUM ON THE DEVELOPMENT OF
SURFACE PARKING LOTS AS A PRIMARY USE, ESTABLISHING A
HEARING DATE, AND ESTABLISHING A TERMINATION DATE FOR
THE MORATORIUM.
WHEREAS, the City of Renton has expended substantial time and energy on its
Comprehensive Land Use Plan and associated policies; and
WHEREAS, the City of Renton has expended substantial funds in the construction of a
municipal parking garage in its downtown core area; and
WHEREAS, construction of surface parking lots as a primary use leads to unsightly,
unplanned and misplaced surface parking lots; and
WHEREAS, construction of surface parking lots as a primary use removes developable
land from the stock of land for development or redevelopment, thereby frustrating the City's
economic development efforts; and
WHEREAS, development of surface parking lots in certain areas may result in
potentially significant traffic impacts on regional roads at a time when the electorate has
significantly reduced the amount of available money for transportation improvements; and
WHEREAS, the City of Renton wishes to encourage the use of parking structures rather
than surface parking lots to allow the City of Renton to better function as a urban center; and
WHEREAS, approval and construction of additional surface parking lots, without review
of the Comprehensive Plan policies, may undermine the benefits of coordinated planning, and
may foreclose or irreparably damage long-term Comprehensive Plan goals; and
RESOLUTION NO.
WHEREAS, this moratorium will be implemented to provide adequate time for City
staff to prepare and present proposed changes to the Comprehensive Plan and zoning, and present
such changes to the City Council for review and adoption;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASEENGTON, DO RESOLVE AS FOLLOWS:
SECTION I. The above findings are true and correct in all respects.
SECTION II. There is hereby declared a moratorium on the permitting or
construction of surface parking lots as a primary use, including commercial lots, park and ride
lots and lots serving transit facilities, in order to provide adequate time for staff to draft, review
and present to the City Council, and for the City Council to review and adopt changes to the
Comprehensive Plan policies concerning the permitting, location and use of surface parking lots
as a primary use.
SECTION III.
There is hereby established a public hearing date on the 12th day of
January, 2004, for the City Council to take testimony on this moratorium and to consider the
modification, revision, or termination of this moratorium.
SECTION IV. This moratorium shall be in place for a period not to exceed six
months, unless otherwise modified by the City Council, which period may be extended or
renewed for one or more additional periods, but only if a subsequent public hearing is held and
findings of fact are made prior to each renewal, to support such renewal.

Moratorium on Primary.Use Surface Parking Lots
Whether existing code and policies are adequate to guide development of primary use surface
parking lots including commercial lots, park and ride lots and lots serving transit facilities.
RECOMMENDATION:
Revise Land Use and Transportation Element Policies addressing surface parking lots to
reflect current policy objectives during the 2004 GMA Update
• Implement siting criteria called for in the Transportation Element Policy T-25 and revise
the zoning code as necessary to implement the siting criteria.
• Adopt a moratorium on development of primary use surface parking lots, including
commercial lots, park and ride lots and lots serving transit facilities until sufficient policy
review and implementing code is in place to guide development.
• Set a public hearing January 12, 2004, to take testimony on the moratorium and consider
modifications to it.
BACKGROUND SUMMARY:
The City's policy and regulatory framework now has a number of problem areas with
respect to surface parking lots 1) policies calling for development of siting criteria are
not implemented 2) there is inconsistency between existing policy direction and
adopted code and 3) new policies adopted for the Urban Center are not yet integrated
into the policies for the downtown. The Transportation Element of the

Comprehensive Plan states in Policy T-25: "Criteria should be developed to locate
park and ride lots serving residential areas. " The narrative accompanying the
policies states that lots should be located outside the downtown to conserve land
resources and minimize congestion. These criteria are not yet developed. The Land
Use Element references inconsistent descriptions of the "downtown" and the Urban
Center. Amendments were made creating the Urban Center -Downtown during the
2003 Comprehensive Plan review cycle as part of the package of Boeing
Comprehensive Plan amendments, but policies addressing transit in the Urban Center
and review of downtown policies was delayed until 2004. The Planning Commission
began a work program reviewing these sections of the Land Use and Transportation
Elements but this work was delayed due to the magnitude of the work recently
completed addressing the land use changes needed for the Boeing property.
The existing zoning code provisions allow public and surface parking lots in the
industrial zones (IL, IM 111), and in most commercial zones both within and outside
the downtown (CA, CS, CN, CD and CO zones). As surface parking lots are
significant land consumptive uses the location and design of such lots is important to
the economic development of the City, the patterns of traffic circulation in the
downtown and the success of the downtown transit center.
The proposed moratorium is needed to give the City time to review policies and
criteria needed to ensure that commercial surface parking lots, transit facilities and
park and ride lots are sited in a way that implements the Land Use Element Urban
Center policies, transit policies within the adopted Transportation Element, and the
City Council Business Plan goals.
CONCLUSION:
Without the necessary siting criteria in place the city does not have adequate policy
guidance in place to implement the Comprehensive Plan objectives.

SUMMARY OF ACTION:
The changes made in the zoning map by City Council and Hearing Examiner action over the last
year need to be incorporated into the adopted zoning book and map. The major change this year is
the adoption of zoning for the Urban Center -North. In addition there were additional zoning map
amendments in other parts of the city, and two annexation areAthat required new zoning
designations.
The map book adoption is an annual task. The wall map and zoning book represent the same data
in two different formats.

This is a request for adoption of the annual amendments to the City's zoning map. The action
before the Council is adoption of the map documents. An ordinance adopting the 2003 annual
amendments to the zoning map is attached.
RECOMMENDATION:
• Adopt the Revised Zoning Map Book and Revised Zoning Map dated December 22, 2003.
BACKGROUND SUMMARY:
The 2003 changes to the zoning map are completed and presented for Council adoption. Staff
is requesting that the City Council adopt the zoning map in two forms. The first is a map book
which shows zoning detail by sections of the City, and the second is a handout map that shows
the entire City at a glance. Both maps are derived from the identical data. Two maps are
needed so that "official" maps at both scales can be made available to the public. These re-
zoning actions were all previously approved by the City Council. These changes include the

ADOPTING THE 2003 AMENDMENTS TO THE ZONING
CLASSIFICATIONS OF PROPERTIES LOCATED WITHIN THE CITY
OF RENTON.
WHEREAS, pursuant to Ordinance No. 4260 entitled "Code of General Ordinances of
the City of Renton, Washington," as amended, and the maps and reports adopted in conjunction
therewith, property located within the City of Renton has been zoned as various zoning
classifications; and
WHEREAS, the Planning Commission held numerous public hearings and made its
recommendation to the City Council; and
WHEREAS, the City Hearing Examiner held numerous public hearings and made its
recommendation to the City Council; and
WHEREAS, the City Council and the Planning and Development Committee have held
public meetings to consider the zoning classifications to be assigned to various properties within
the City of Renton; and
WHEREAS, the City Council established an amendment process as part of its greater
Growth Management Act process; and
WHEREAS, numerous individuals availed themselves of the amendment processes; and
WHEREAS, the City Council having duly considered all matters relevant thereto, and all
parties having been heard appearing in support thereof or in opposition thereto;

Renton, and the zoning categories shown on these maps for the various properties located within
the City limits of the City of Renton are hereby designated as the zoning designations for those
properties. Rezone ordinances adopted after this ordinance shall amend the official zoning map.
SECTION III. The Economic Development, Neighborhoods and Strategic
Planning Administrator is hereby authorized and directed to make the necessary changes on the

Additional funding is needed to complete the Wetland Mitigation Bank Site Fence Project.
Surface Water Utility requests approval from Council to transfer funds in our budget and carry
these funds forward into 2004 for the completion of this fence project.
RECOMMENDATION:
The Planning/Building/Public Works Department recommends Council approval to transfer
$30,000 from the completed Morris Ave. S. Storm Improvement Project account (account #
421.600.018.5960.0038.65.065435) to the Wetland Mitigation Bank Site Fence Project (account
# 421.600.018.5960.0038.65.065119) to provide sufficient funding for the project construction.
The Wetland Mitigation Bank Site Fence Project will place chain link fences to protect the two
Wetland Mitigation Bank Sites along Oakesdale Ave. South (see attached Project Vicinity map).
The chain link fences are needed to prevent the reoccurrence of vandalism, dumping of garbage,
and environmental degradation caused by sport -utility vehicles four -wheeling on the sites. The
project will reduce the need for City services for site clean-up as well as reduce police and code
enforcement responses to illegal activities. The sites were donated to the City for the creation of
a wetland bank and are zoned for resource conservation.
The illegal dumping of garbage and the off -road vehicle use has required extra code and law
enforcement services, in addition to the costs associated with Public Works Maintenance
Services cleaning up the garbage dumped on the sites. This project will reduce the need for these
services and the associated costs to the public.
The Surface Water Utility had initially planned to construct the Wetland Mitigation Bank Fence
Project in 2003. The construction contract was advertised last August and bids were opened.

Unfortunately, we had to reject the only two bids received due to irregularities in both bids.
From the apparent intent of the bids we deduced that the real cost of construction will be higher
than we had estimated. In addition, the staff costs to produce the construction plans and
specifications, and advertise the project for bid was more than originally estimated. The
additional funding is also needed for staff costs associated with the re -advertisement of the
construction contract, and project management during the project construction.
The 2003 project budget was $45,000. Year-to-date expenditures on the project are $9,474. The
remaining project budget is $35,526. The revised estimated construction cost for the 2,300 linear
feet of fence and other improvements is approximately $55,000. The requested funding transfer
of $30,000, plus the remaining budget of $35,526, would provide for a total project budget of
$65,526, which would be carried forward into 2004. The total project budget will fund the
construction and project management necessary for completion of the project. The Wetland
Mitigation Bank Site Fence Project will be re -bid in early 2004.
The Morris Ave. S. Storm Improvement Project was part of an interlocal agreement with King
County. The City of Renton worked with King County to make water and storm utility
improvements in Morris Avenue as part of King County's Eastside Interceptor Sanitary Sewer
Capacity Restoration Project. The Surface Water Utility has paid King County in full for their
work, and approximately $34,000 remains in the account.
CONCLUSION:
The Surface Water Utility recommends the transfer of $30,000 from excess funds from the
completed Morris Ave. S. Storm Improvement Project to the Wetland Mitigation Bank Site
Fence Project for its completion in 2004. The completion of the Wetland Mitigation Bank Site
Fence Project will help protect the sites from environmental damage and reduce City service
requirements from our code enforcement officers, our police, and Public Works Maintenance
Services Division.

SUMMARY OF ACTION:
The City of Renton and Soos Creek Water and Sewer District (District) have been discussing
updating a portion of our water and sewer service boundary agreements. As part of the original
1991 agreement, Renton took over a part of Soos Creek's sanitary sewer facilities. For
`payment', Renton agreed to collect and pass through Soos Creek's System Development
Charge for any new development connecting to the system that flows into the line(s) we took
over.
Soos Creek has approached us with a proposal to connect an additional portion of their system to
our system. We have worked out an agreement whereas all conditions and obligations contained in
the original agreement regarding the pass through of Soos Creek connection fees are deemed
satisfied in full. The agreement also requires that, when Soos Creek utilizes our system, they will
pay us one-half (1/2) of their System Development Charge for each unit that connects to the system
that flows into ours. (Half their fee is a little over $1,000 and we project up to 125 units in the
area.)
STAFF RECOMMENDATION:
The Planning/Building/Public Works Department recommends that Council authorize the
Mayor and City Clerk to approve and execute the agreement.

SUBJECT: Addendum to Sanitary Sewer and Water Service Area
Boundary Agreement Between Renton and Soos Creek Water
and Sewer District
ISSUE:
The City of Renton and Soos Creek Water and Sewer District (District) have been discussing
an addendum to our water and sewer service boundary agreements. We have come to an
agreement on the proposed interlocal agreement.
RECOMMENDATION:
• The Planning/Building/Public Works Department recommends that Council approve the
agreement and adopt the resolution authorizing the Mayor and City Clerk to execute the
agreement.
BACKGROUND SUMMARY:
The City of Renton and Soos Creek Water and Sewer District (District) entered into a water
and sanitary sewer boundary agreement in 1991. In 1997, Renton and the District entered
into another agreement to revise the service area boundaries. All other parts of the original
agreement remained intact.
As part of the original 1991 agreement, Renton took over a part of the District's sanitary
sewer facilities. For `payment', Renton agreed to collect and pass through the District's
System Development Charge for any new development connecting to the system that flows
into the line(s) we took over.

All of the sewer facilities Renton acquired from the District flow to a point where S 55'
Street would intersect State Route 167. At the point the sewers cross the freeway, the
facilities become the District's again. The District also had facilities upstream that are still
connected to those that Renton took over and remained theirs.
Soos Creek has approached us with a proposal to connect an additional portion of their
system to our system. Under the original agreement, they would have the right to connect to
the portion of the system that we acquired from them. Where they are asking to connect is
not part of the system we acquired from them
We have worked out an agreement whereas all conditions and obligations contained in the
original agreement regarding the pass through of the District connection fees are deemed
satisfied in full. The agreement also requires that, if the District does utilize our system, they
will pay us one-half (1/2) of their System Development Charge for each unit that connects to
the system that flows into ours.
The area that would be served into Renton's sewer system projects to about 125 new units.
The District's System Development Charge is just over $2000 per unit. The City Wastewater
Utility could get up to approximately $125,000 of revenue by letting the District utilize our
down stream sewers. We have analyzed the capacity in the existing facilities and have
determined that the additional 125 units will not impact our system.
There are not any proposed changes to the service boundaries as part of this addendum.
Nothing in this addendum affects the water portion of the agreements.
CONCLUSION:
We are asking the Council for approval and adoption of a resolution authorizing the Mayor
and City Clerk to execute the agreement.

IHEREAS, the parties now desire to modify the 1991 AGREEMENT as to both terms
ce area; and
WHEREAS, the 1991 AGREEMENT as modified by the 1997 AGREEMENT, and by
this Addendum, will continue to provide for maximum efficient use of existing and future
facilities, and orderly and efficient water and sanitary sewer system planning.
NOW, THEREFORE:
IT IS HEREBY AGREED by and between the parties hereto as follows:
1. Sale of Springbrook Area Sewer System to Renton. The parties have agreed that in
consideration of the mutual agreements contained herein, that all payment obligations
contained in Section 6. and Section 7. of the 1991 AGREEMENT regarding the sale of the
Springbrook Sewer System to Renton shall be deemed to have been satisfied in full, and
Renton shall have no further payment or accounting obligation there for.
2. Amended Terms for Service and Payment by District for Stonehaven Area. The
parties agree that as an alternative the District may connect the Stonehaven and adjacent area,
as shown on Exhibit "A" which is by reference incorporated herein, to the South 47`h Street
sewer line of Renton, generally in the manner shown on said Exhibit. In the event of such
alternate connection, and in consideration thereof, the District shall pay one half of the General
Facilities Charges it collects from such area to Renton, after the property owner has made such
payment to the District. Total payment will be dependent upon the number of units utilizing
such alternate connection, when the charge is paid, the rate at the time of connection, and the
number of units developed.
3. Termination on Build -out. The terms hereof with regard to the Stonehaven and
adjacent area shall terminate and be of no further force or effect upon completion of build -out
within that area.
4. Remaining Obligations Intact. Nothing herein shall be construed to alter the rights,
responsibilities, liabilities, or obligations of either the City or the District pursuant to either the
1991 AGREEMENT or the 1997 AGREEMENT, previously executed by the parties, except
as specifically set forth herein.

Subject: Annexation Vote Rejecting Zoning Regulation but Adopting Annexation
This memorandum is to confirm my conversation with you of September 24, 2003. The prior day.
you called and indicated that there had been an annexation vote and that the question .of
annexation was submitted separately from the question of whether or not to adopt the City's
proposed zoning regulation. The annexation passed but the proposed zoning failed. You ask for
guidance.
RCW 35A.14.080 provides for submission,of.three potential ballot issues.
1. For and against annexation.
2. For or against annexation and adoption of the proposed zoning regulation.
3. For or against assumption of all or a portion of the indebtedness.
From this reading of the law, it was improper to submit the issue of adoption of the proposed
zoning regulation separate and apart from that of the annexation.
Having concluded that the ballot issues were improperly submitted does not answer the question
of what should be done next. The electorate has voted to be annexed. However, the property is
without zoning. That fact is no different, however, than if the only issue submitted had been for or
against annexation. The City would have to schedule public hearings and adopt zoning for the
property.
I would suggest we follow that procedure. We properly notice and hold public hearings about the
zoning to be imposed on the property and then adopt a zoning ordinance at the same time we adopt
the annexation ordinance.
One caveat seems appropriate, however. Since the voters rejected a proposed zoning regulation,
that zoning regulation would appear to be off the table. As I understand it, the comprehensive

plan designation supports three separate zoning designations and. so, the Council would have to
choose one of the two zoning designations that had not been rejected by the electorate.

WHEREAS, the City of Renton has initiated an Airport Compatibility Use Program, and
is in the process of drafting development standards for implementation of the Urban Center —
North mixed use development Comprehensive Plan amendment; and
WHEREAS, the Washington State Department of Community, Trade and Economic
Development (hereinafter CTED) has a responsibility, under state law, to provide financial and
technical assistance to the communities of the state to assist in improving the delivery of federal,
state and local programs; and to provide communities with opportunities for productive and
coordinated development beneficial to the well-being of communities and their residents; and
WHEREAS, CTED has a statutory authority to offer technical and financial assistance to
the City of Renton for its planning under the Growth Management Act; and
WHEREAS, CTED has selected the City of Renton to receive $45,000 to undertake the
completion of the Airport Compatible Land Use Program and the development standards for
implementation of the Urban Center — North mixed use development Comprehensive Plan
amendment; and

A RESOLUTION OF THE CITY OF RENTON, WASHINGTON,
DECLARING A MORATORIUM ON THE DEVELOPMENT OF
SURFACE PARKING LOTS AS A PRIMARY USE, ESTABLISHING A
HEARING DATE, AND ESTABLISHING A TERMINATION DATE FOR
THE MORATORIUM.
WHEREAS, the City of Renton has expended substantial time and energy on its
Comprehensive Land Use Plan and associated policies; and
WHEREAS, the City of Renton has expended substantial funds in the construction of a
municipal parking garage in its downtown core area; and
WHEREAS, construction of surface parking lots as a primary use leads to unsightly,
unplanned and misplaced surface parking lots; and
WHEREAS, construction of surface parking lots as a primary use removes developable
land from the stock of land for development or redevelopment, thereby frustrating the City's
economic development efforts; and
WHEREAS, development of surface parking lots in certain areas may result in
potentially significant traffic impacts on regional roads at a time when the electorate has
significantly reduced the amount of available money for transportation improvements; and
WHEREAS, the City of Renton wishes to encourage the use of parking structures rather
than surface parking lots to allow the City of Renton to better function as a urban center; and
WHEREAS, approval and construction of additional surface parking lots, without review
of the Comprehensive Plan policies, may undermine the benefits of coordinated planning, and
may foreclose or irreparably damage long-term Comprehensive Plan goals; and
RESOLUTION NO.
WHEREAS, this moratorium will be implemented to provide adequate time for City
staff to prepare and present proposed changes to the Comprehensive Plan and zoning, and present
such changes to the City Council for review and adoption;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO RESOLVE AS FOLLOWS:
SECTION I. The above findings are true and correct in all respects.
SECTION II. There is hereby declared a moratorium on the permitting or
construction of surface parking lots as a primary use, including commercial lots, park and ride
lots and lots serving transit facilities, in order to provide adequate time for staff to draft, review
and present to the City Council, and for the City Council to review and adopt changes to the

SECTION III. There is hereby established a public hearing date on the 12th day of
January, 2004, for the City Council to take testimony on this moratorium and to consider the
modification, revision, or termination of this moratorium.
SECTION IV.
This moratorium shall be in place for a period not to exceed six
months, unless otherwise modified by the City Council, which period may be extended or
renewed for one or more additional periods, but only if a subsequent public hearing is held and
findings of fact are made prior to each renewal, to support such renewal.

A RESOLUTION OF THE CITY OF RENTON, WASHINGTON,
AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO AN
INTERLOCAL COOPERATIVE AGREEMENT WITH KING COUNTY
REGARDING THE DISTRIBUTION OF FUNDS UNDER THE
REGIONAL AFFORDABLE HOUSING PROGRAM.
WHEREAS, the state legislature authorized a surcharge on the recording of documents
as a means of funding regional housing; and
WHEREAS, King County is the recipient of a portion of those funds, which has been set
aside in a special fund to be used by the County and its cities to support very low-income housing;
and
WHEREAS, such funds must be allocated among the jurisdictions by an interlocal
cooperative agreement between the counties and cities that is consistent with regional housing
policies and objectives; and
WHEREAS, a set of guidelines has been established through a regional effort, for the
administration of this low-income housing program; and
WHEREAS, it is necessary to document the terms and conditions under which these
funds will be distributed pursuant to those guidelines;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO RESOLVE AS FOLLOWS:
SECTION I. The above findings are true and correct in all respects.

THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN
AS FOLLOWS:
SECTION I. After due notice and public hearing thereon as provided by law, the
annual budget for the City of Renton for the year 2004, previously prepared and filed with the
City Clerk, as modified hereby, be and is hereby ratified, confirmed and adopted, in all respects,
as such annual budget for the year 2004. Such annual budget is detailed in Attachment A, 2004
Budget Summary by Fund, Resources and Expenditures, which is incorporated herein as if fully
set forth. A future ordinance, to be adopted in December 2003, fixes the amount of tax levies
necessary for the year 2004.
SECTION II. Attachment A defines the total sums authorized and allowed for
expenditures and establishes such sums in each of the funds in the annual 2004 budget.
SECTION III. Acts pursuant to this Ordinance, but prior to its passage or
effective date, are hereby ratified and confirmed.
SECTION IV. A copy of the annual 2004 budget, as herein adopted, shall be
transmitted to the Office of the State Auditor, Division of Municipal Corporations, and such
other governmental agencies as provided by law.
SECTION V. This Ordinance shall be effective upon its passage, approval, and
five days after publication.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
CREATING A NEW FUND TITLED "INSURANCE HEALTHCARE
FUND" FOR THE YEAR 2004.
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN
AS FOLLOWS:
SECTION I. A. new Internal Service Fund shall be created — Fund 512 —
Insurance Healthcare Fund. The purpose of the fund is to provide accounting for self-insurance
services to all City departments for health care programs. The Insurance Healthcare Fund will
pay expenses and revenue will be provided by rates charged to departments based on use and
coverage requirements.
SECTION II. All healthcare related revenue and expenses previously contained
in Fund 502 — Insurance Fund shall be transferred to Fund 512 - Insurance Healthcare Fund.
SECTION III. This Ordinance shall be effective upon its passage, approval, and
five days after publication.

conjunction therewith, the property hereinbelow described has previously been zoned as
