tothePropertiesthatarewithintheCity’swaterserviceboundaryidentifiedwithintheCity’sWaterSystemPlan,and1.7WHEREAS,DistrictandCityareauthorizedbyChapter39.34RCWtoenterintointer-localagreementsforjointaction.Inconsiderationofthetermsandconditionscontainedherein,thepartiesnowagreeasfollows:2.1TheDistrictagreestotransfertotheCity,waterservicetotheProperties.InconsiderationoftheDistrict’stransferoftheProperties,theCityshallacceptandprovidewaterservicetotheProperties.TheCityshallinstallnewservicelaterals,makeserviceconnectionstoCitywatermains,andprovidenewwatermeters.TheDistrictshallmakeextensionsoftheprivateserviceconnectionstoaccommodateconnectiontothenewwatermeters.2.2TheCityagreestowaivetheWaterSystemDevelopmentChargeforeachProperty.TheDistrictwillreimbursetheCityfortimecostandmaterialsperratesestablishedundertheCityofRentonFeeScheduletocompletetheworkidentifiedwithinthisAgreement.2.3ThepartiesagreetocooperatetoeffectthepurposeofthisAgreementandtoexecuteanyfurtheragreementsordocumentsrequiredforsuchcustomertransfer.TheDistrictwillprovidetheowners/residentsofthePropertieswithamailednoticeregardingtheproposedchangeofwaterpurveyorfromtheDistricttotheCityatleast45daysbeforethedateofsuchtransfer.ThenoticeshallprovideinformationastothemeetingdatebeforetheDistrict’sBoardofCommissionerswhereowners/residentswillhaveanopportunitytocommentonthetransfer.2.4EachpartyshallapprovethisAgreementbyappropriateresolutionorordinanceandprovidetheotherpartywithacertifiedcopyofthesame.ThisAgreementshalltakeeffectuponitsapprovalbytheCity’sCityCouncilandtheDistrict’sBoardofCommissioners.EachpartyrepresentstotheotherthatithasthefullpowerandauthoritytoenterintothisAgreement.ThisAgreementmaynotbeterminatedinwholeorpartbyeitherpartiesortheirsuccessorsininterest.CITYOFRENTONATfESTArmondoPavone,MayorJasonSeth,CityClerkDateApprovedastoLegalFormShaneMoloney,CityAttorneyPage-2
