SUMMARY OF REQUEST: Applicant seeks approval of a special permit for fill and grade of approximately +25,000 cubic yards on a four-acre site along N.E. 44th Street east of FAI-405 for possible future development of a motel complex. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on April 5, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on April 10, 1979 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional exhibit into the record: Exhibit #2: Site Development Plan Mr. David Clemens, Associate Planner, corrected line three of Section L.4 of Exhibit #1 to read ". . .bottom being one foot below" in lieu of ". . .bottom being one inch below" as denoted in the report. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Paul Kosteniuk Austin Company 800 S.W. 16th Street Renton, WA 98055 Mr. Kosteniuk indicated concurrence in the recommendations contained within the report. The Examiner then requested testimony in support or opposition to the request. There was no response. He then inquired if the proposed landfill operation conforms to requirements contained within the Mining, Excavation and Grading Ordinance. Mr. Munson indicated that conformance is indicated. The Examiner requested further comments. Since there were none, the hearing on File No. SP-321-79 was closed by the Examiner at 10:07 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a special permit for landfill and grading of 25,000 cubic yards on four acres of B-1 zoned property in preparation for a potential motel complex. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. S1--3z1-79 Page Two 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the requirements of Chapter 23 (Mining, Excavation and Grading) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. According to the Environmental Checklist contained in the file of record, the landfill operation will encompass approximately four months. Upon completion of grading of the landfill, the area will be hydroseeded (Exhibit #2) . 9. The storm drainage ane erosion control methods to be used have been reviewed by the Public Works Department and approved (Exhibit #1) . 10. The proposal must conform to Section 4-2312 (Work in Progress) . 11. Per Section 4-2303.2.0 the final plan for development on the landfill must be approved by the Examiner pursuant to a public hearing. CONCLUSIONS: 1. The landfill and grading operation conforms to the Comprehensive Plan and does not appear to ". . .be an unreasonable detriment to the surrounding area." (Section 4-2303.2.B) . 2. The annual license from the Planning and Public Works Departments (Sections 4-2307.2.B. , 4-2307.4. , 4-2310 and 4-2309) that is required is sufficient to guarantee compliance with Chapter 23 and the Examiner's decision. 3. Access to the site should be reviewed by the Public Works Department to insure adequate traffic safety on N.E. 44th Street. , 110th Avenue S.E. and N.E. 43rd Place. Of particular concern is the curved configuration of N.E. 44th Street. Points of access should be approved by these departments. 4. Since methods of dust and mud control were not proposed or specified, these mitigating methods must be approved by the Public Works Department prior to the beginning of the operation. 5. Hydroseeding and other fill stabilization measures must be approved by the Planning Department. Their consideration should include existing vegetation that might assist in this stabilization. DECISION: Approval of Exhibit #2 subject to: 1. Approval of access point(s) by the Public Works Department. 2. Approval of dust and mud control measures by the Public Works Department. 3. Approval of hydroseeding and fill stabilization methods by the Planning Department. 4. Compliance with these conditions prior to beginning the landfill operation. 5. Compliance with all other applicable provisions of Chapter 23 and other regulations and ordinances of the City of Renton. ORDERED THIS 13th day of April, 1979. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton ' s Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended , RCW 43-21C , a declaration of non-significance has been issued for the subject proposal . This negative declaration is further based on proper development procedures per City ordinances and the provision of suitable landscape areas to help reduce the resulting loss in vegetation by site development. The subject site is presently zoned B-1 , Business Use, which will permit future commercial development on the site. The applicant ' s general proposal for a motel would be consistent with the comprehensive planning and zoning for the area . 2 . No specific development plan for the subject property has been submitted at this time . However , the applicant ' s proposed future development will be subject to City of Renton require- ments including the Hearing Examiner ' s site plan approval per Section 4-2303 . 2C of the Mining , Excavation , and Grading Ordinance . 3. The proposed ±25 ,000 cubic yards of fill will be placed on the site to establish an elevation of 36 feet. The existing eleva- tions range from a low point of ±28 feet in the south central portion to a high point of ±50 feet near the southeast corner. 4. The Engineering Division of the Public Works Department notes that the temporary sedimentation pond is required to have a 150 cubic feet per acre capacity with the bottom being 1" below the flow line of the outfall . Straw bales should be placed against the outfall pipes to reduce downstream siltation. 5 . The Fire Department advises that for any future development, the required access and hydrants or any other fire protection facilities will have to be installed prior to and during con- struction . These facilities will be required to meet fire flow and uniform fire code requirements for occupancy type . 6 .
