� NOTICE OF RENTON MUNICIPAL CODE VIOLATION
The City has elected to establish a non-judicial hearing and determination system to enforce violations of the Renton
Municipal Code. Therefore a code violation fine consistent with RMC 1-3-2 (F) is imposed, not including any costs, fees or
assessments.You may respond in the following manner:

• 506.1 General. Plumbing fixtures shall be properly connected to either a public
sewer system or to an approved private sewage disposal system.
• 506.2 Maintenance. Every plumbing stack, vent,waste and sewer line shall
function properly and be kept free from obstructions, leaks, and defects.
June 1, 2016: The City of Renton was provided documentation from King County
Environmental Health Services that an inspection was performed at 1781198th Ave S
revealing that unpermitted work was performed in the past. The Inspection performed
by King County was in response to complaints received by neighbors who stated that
the septic system had failed and a foul odor was coming from the property. See
attached King County Notice of Violation dated 06-01-16, attached.
August 11, 2016: A Warning of Violation, CODE16-000518, was issued to Monique
Adams, the person in possession of the property, for violating the City of Renton's
International Property Maintenance Code Section 506. The compliance date was
September 10, 2016. Attached.
November 29, 2106:After receiving a number of complaints from neighbors about the
foul odor coming from the property, Rob Shuey was asked by the city attorney's office
to go out to the property, and with Monique Adams permission, walk the back yard to
see if there is any sign of a failed septic system. He contacted Monique and she agreed
to allow him on the property to look at the drain field area. Mr. Shuey emailed the
results of the site inspection to Alex Tuttle, City Attorney. See the email and
photographs, attached.
February 21, 2017: The City received a copy of the Notice of Health Code Violation
issued to the property by King County Environmental Health. The notice described the
violations as an unpermitted and unlawful discharge of sewage upon the ground surface
and failure to comply with the requirements of the King County On-site Sewage
Regulations, attached.

June 20, 2017:A Notice of Violation & Order to Correct was hand delivered by Rob
Shuey to Monique Adams. It was explained to Monique that the Notice and Order along
with the $250.00 fee were being assessed for continuing to be in violation the City of
Renton's International Property Maintenance Code Section 506, attached.
June 22, 2017:The City Clerk received an appeal request from Monique Adams,
attached.
The city's position is that Monique Adams has been aware that the septic system is in
violation of both the City of Renton and King County for over a year. According to King
County, because there is a sewer main in the street in front of the house, the property
will not be issued a permit to replace or repair the septic system, and that it is required
to be connected to the sewer main. A sewer availability certificate has already been
issued for that property verifying that connection to the sewer is allowed. The City
requests that the property connected to the sewer system in the street and that the
septic system be properly abandoned in place pursuant to King County requirements.

Code Text: Storage of Bulky Waste: Private Property 8-1-4 E:
The City of Renton has adopted regulations that governs bulky waste. The code specifically states "it shall be
unlawful for any person in the city to store, maintain, keep, retain,dump or accumulate bulky waste on
private property in the city".
Bulky waste is defined as "large items of solid waste,including but not limited to items such as furniture,
large household appliances, refrigerators, freezers, oven, ranges,stoves, dishwashers,water heaters,
washing machines, or clothes dryers:junk vehicles,vehicle hulks or any other oversized solid wastes which
would typically not fit into or be permitted for collection as garbage in garbage cans".
Corrective Action: Remove and properly dispose of the bulky waste stored outside on the property in the driveway.

Code Text: Unlawful Placement and Removal of Garbage Cans, Recycling Bins and Yard Waste Carts: It shall be unlawful
for a person residing in a single-family residence to place garbage, recyclables, or yard waste at the curbside
for collection by the City's collection contractor more than 24 hours prior to the regular collection date for
his or her single-family residence. It shall also be unlawful for a person residing in a single-family residence
to leave garbage cans, recycling bins or yard waste carts at the curbside more than Z4 hours after collection
by the City's collection contractor. Further, it shall be unlawful for a person residing in a single-family
residence to maintain, place or store any garbage cans, recycling bins or yard waste carts at a location other
than adjacent to the residential structure or within a fully enclosed building or garage.

Code Text: 102.2 Maintenance. Equipment,systems, devices and safeguards required by this code or a previous
regulation or code under which the structure or premises was constructed,a�tered or repaired shall be
maintained in good working order. No owner, operator or occupant shall cause any service,facility,
equipment or utility which is required under this section to be removed from or shut off from or discontinued
for any occupied dwelling,except for such temporary interruption as necessary while repairs or alterations
are in progress.The requirements of this code are not intended to provide the basis for removal or
abrogation of fire protection and safety systems and devices in existing structures. Except as otherwise
specified herein,the owner or the owner's designated agent shall be responsible for the maintenance of
buildings,structures and premises.
Corrective Action: There is no approved septic service to your residence. if the septic system is not repaired pursuant to King
County Public Health Notice of Violation Case No.C00086910 within 30 days (09-10-16) of the date of this
Warning of Violafion,occupants will be ordered to immediately discontinue occupancy of this residence as a
dwelling unit and remain out of the dwelling unit until approved septic service is again restored pursuant to
King County Public Health requirements.
In the event the septic service is not repaired on the date noted (09-10-16),the building will be posted "DO
NOT OCCUPY"and the City of Renton will employ all means necessary to vacate and secure the building from
occupancy.

Hi Alex, per our conversation last week, I went out to the subject address and with the permission of Monique Adams,
the resident, I walked the back yard to see if there were any sign of a failed septic system. These signs may include
water leaching or puddling above the septic tank or drain field and/or foul odors.
As you can see by the attached photos, there is an indentation where a trench was dug (with leaves gathered in it) to
make repairs to the septic system. I walked the length of the trench and didn't see any obvious sign of leaching liquid,
nor was there any water running at the downhill end of the trench,where I would expect to see an issue if there were
one in regards to leaching. I did however observe the foul odor of a septic system as soon as I stepped out of the
basement door into the back yard, which is right next to the lid if the septic tank. If you look at photo 2005, under the
leaves is the lid to the septic tank. I asked if there was a tight fitting lid on the tank and she seemed to think there was. I
explained that the odor can only come from one of two places,a loose lid on the septic tank, or a leaching area. I told
Monique that the complaints we have been receiving regards the odor. I suggested that she place some black plastic
over the lid and then cover that with dirt to see if it resolves the odor issue.
Due to the leaves everywhere, my inspection was very limited, but the ground was fairly dry, and I believe that if there
were a leaching problem in the drain field, I would have found it. I didn't uncover the septic tank lid as I didn't have the
tools or protection to feel safe to do so.
According to Monique,the house is for sale and they are looking for an investor to purchase the house so she can buy it
back from them. She clearly wants to stay in the house, and expects whoever purchases the house to make the repairs
required by King County.

or system components on the Property to be lawfully repaired or upgraded as follows:

the services of state of Washington-licensed OOS designer or professional engineer to
prepare and submit,to the Health Officer,an OSS site design application in accordance
with Health Code Chapters 13.28(Design),13.64(Repairs and Remodeling),and 2.18
(Director Regulated Activities—7'itle 13 (On-Site Sewage))to repair or replace the
failing OSS or system component(s)at the Property;
(b) Repair bvi cert�ed master installer:Obtain the services of a King County-certified OSS
master installer in accordance with Heaith Code Chapter 13.20 (Permits and
Certificates) to obtain an OSS construction permit from the Health Officer and
complete repairs or replacement of the failing OSS according to an approved and
current site design application. An OSS construction permit from the Health Officer
must be obtained before starting any work to repair or upgrade the OSS serving the
Property;
(c) Filine of notice on title before sale or transfer of the Propertx: Tn accordance with
Health Code sections 13.Sb_054 (Notice on Title) and 13.56.005 (Operation and
Mazntenance),cause a notice on title to be recorded with the Kiz�g County Recorder's
Office before sale or transfer of the Property. The notice on title shall include alI of the
owner's responsibilities for OSS operation and maintenance specified under Health
Code section 13.56.005;
(d) Operation and maintenanceperformance monitorin�inspection and report bv a licensed
OSS Maintainer before sale or transfer of the Propertv:Obtain the services of a King
County-licensed OSS Maintainer before selling or transferring title to the Property,in

The house located at 17811 98t��Ave South is not connected to a public
sewer system. On April 6, 2016, King County Environmental Health
Services observed the failed sewage system. According to Matt Wilson,
King County Health and Environmental Investigator 1, at that time,the on-
site sewage septic system (OSS) was exposed and appeared to be in
FINDINGS: failure. On February 21, 2017,the King County Department of Public
Health declared the septic system a failure. The owner has not taken any
steps to fix the septic system, has not applied for any building or
construction permits to make the required repairs, and has not connected
to an approved sewer or a City of Renton sewer utility. The septic system
remains in violation.
CODE VIOLATiON: Renton Municipal Code (RMC)4-5-130(A); International Property
Maintenance Code (IPMC)Section 506
506.1 General. Plumbing fixtures shall be properly connected to either a
public sewer system or to an approved private sewage disposal system.
