Modification Request for Pierce Ave NE
Dear Angelea,
This letter, along with the supplemental materials included, are provided in support of a
modification to the required improvements to Pierce Ave NE for the Shum Short Plat.
Those requirements are outlined below for Residential Access Street Standards:

Modification Request:
Pierce Ave NE along the project frontage currently does not meet Residential Access Street
Standards. Within this subject area, is a row of significant and mature trees that would need to
be removed with the standard improvements. The addition of paved road section required (13‐
ft from 53‐ft right‐of‐way centerline) would mean removal of ten of the eleven significant trees
within this area.
Based on feedback received during the Pre‐Application meeting, City Staff would support a
modification to keep the existing road pavement section as‐is and provide a larger planter area
to retain as many trees as possible. This would meet the City’s objective and goals for this type
of development.
Justification for the Modification Request (Form M Item #6):
a. Substantially implements the policy direction of the policies and objectives of the
Comprehensive Plan Land Use Element and the Community Design Element and the proposed
modification is the minimum adjustment necessary to implement these policies and
objectives;
Response: The property is located within the Residential‐8 (R‐8) Zone. The proposed
modification does not conflict with any design regulations and or design elements.
The proposed modification will achieve Comprehensive Plan objective (Policy U‐36) by
promoting tree retention to the maximum extent feasible.
b. Will meet the objectives and safety, function, appearance, environmental protection and
maintainability intended by the Code requirements, based upon sound engineering judgment;
Response: The proposed modification would result in improvements that is better suited to
meet the City’s objectives than the standard improvements.
More trees would be retained which would enhance safety (buffer to pedestrians on
sidewalk), function, appearance, environmental protection, and maintainability (less road,
storm, infrastructure, etc.). In our opinion, the proposed improvements meet the objectives
intended by Code requirements based upon sound engineering judgment.
c. Will not be injurious to other property(ies) in the vicinity;
Response: It is unlikely that the proposed improvements will be injurious to other
properties in the vicinity.
d. Conforms to the intent and purpose of the Code;
Response: Please refer to response to item ‘b’ above.
e. Can be shown to be justified and required for the use and situation intended; and
Response: Addressed in previous responses.

Response: It is unlikely that the proposed improvements will create adverse impacts to
other properties in the vicinity.
