HomeMy WebLinkAboutContract CAG-17-165 LEITER OF UNDERSTANDING BETWEEN THE CITY OF RENTON AND THE RENTON HERITAGE LLC REGARDING THE CONSTRUCTION OF THE PORTION OF MAIN ALLEY SOUTH BETWEEN SOUTH SECOND STREET AND THE SOUTH PROPERTY LINE OF THE LOFTS PROJECT, 207 MAIN AVENUE SOUTH Renton Heritage LLC and the City of Renton (City)wish to implement the following understanding with regard to construction of Main Alley South between South Second Street and the south property line of The Lofts project located at 207 Main Avenue South. The City has established a capital improvement project to improve Main Alley South from the south property line of The Lofts project to the southern extent of the existing alley, and then extend the alley eastward to an intersection with Main Avenue South. Renton Heritage LLC is currently responsible for constructing and improving the portion of Main Alley South adjacent to the west property frontage of The Lofts project. Due to the high cost of lowering existing franchise utilities including a Puget Sound Energy(PSE)power line,a 2-inch PSE gas line and a communication line, Renton Heritage LLC offered to compensate the City to incorpo�ate the portion of Main Alley 5outh adjacent to The Lofts project into the City's Main Alley South capital improvement project (see Attachment A). These franchise utility lines needed to be lowered to accommodate the City's standard alley cross section consisting of 4 inches of asphalt pavement placed over 6 inches of crushed aggregate base. After legal review it was determined that the City would encounter the same expenses if the City took over the construction of this portion of the alley, The City ultimately declined this offer. During these negotiations, Renton Heritage LLC installed,with the City's concurrence, this portion of the alley using a cross section consisting of 2 inches of asphalt pavement placed over dense compacted sand and gravel (existing fill) soil and 1-1/2-inch minus crushed rock backfill. Geotechnical consultant Earth Solutions NW observed a proof roll test and considered the subbase suitable for support of pavement. Renton Heritage LlC and the City later entered into discussions about the City accepting this portion of the alley as it is,with Renton Heritage LLC compensating the City for the cost differential between building the alley in accordance with the City's standards, and building it as is. This funding will compensate the City for the expected added costs over the years of maintaining the alley built with this substandard cross section. The terms of this letter of understanding are as follow: 1) Renton Heritage LLC shall pay the City the installed cost of a 2-inch lift of asphalt pavement and 6 inches of compacted crushed aggregate base on the alley, in the amount of$ 39,461. Payment to the City shall be made prior to the City's approval of final occupancy for the project, but in no event later than 30 days after the date of Renton Heritage LLC's signature on this letter of understanding. i il , . . ,.._. ,.�. ,..,.....���wwrr Letter of Understanding Page 2 of 2 iuN z6,toi� 2) Prior to the City's acceptance of the alley, Renton Heritage LLC shall correct punch list items identified by the City construction inspector. 3) Renton Heritage LLC shall be responsible for maintenance of this alley for the period of time established by City code and the terms and conditions of their construction permit,and shall provide the City with a maintenance bond as required. 4) In the event Renton Heritage LLC fails to pay the amount specified in Provision 1 bythe time specified therein, Renton Heritage LLC agrees that in lieu of such payment it shall be responsible for improving the portion of the alley adjacent to The Lofts (located at 207 Main Avenue South) in accordance with the City-approved plans for the alley. These improvements to the alley shall be made within 90 days from the date of Renton Heritage LLC's signature on this letter of understanding.
