The proposal is to install a new gas line via a directional bore, requiring three (3) standard-sized bore pits, creating a minimal disturbance and connecting the residence to the primary gas line in Mountain View Avenue N. A 3 -foot by 5-foot cut will occur in the off-street parking area parallel to Mountain View Ave N, approximately 220 fe et from the ordinary high water mark (OHWM) of Lake Washington and outside of the shoreline jurisdiction. The purpose of this cut is to tie into the primary gas line, establish the primary gas line connection at the street, and initiate the directional bore from the street. A 2-foot by 4-foot cut will occur in the planter strip along the north side of the driveway, approximately 210 feet from the Lake Washington OHWM (outside of shoreline jurisdiction). The bore pit serves two (2) purposes. The primary purpose is to avoid existing utilities, and the secondary purpose of this cut will be to connect the stub from the primary gas line to the new service connection line to the residence. A 2 -foot by 4-foot cut will occur along the north side of the existing driveway for re-orienting the new gas line to the north away from the driveway. The purpose of the change in direction is necessary to avoid existing structures and other existing underground utilities. The cut will occur in the planting area to the north of the driveway, approximately 115 feet from the OHWM, and an approximate 25-foot bore will make the final connection for the line to the meter on the home. Disturbed surfaces would be restored to original condition or better upon completion of construction. The project site is located within the Shoreline Residential designation, within Lake Washington Reach E. "Single-family residence" means a detached dwelling designed for and occupied by one family including those structures and developments withi n a contiguous ownership which are a normal appurtenance. An "appurtenance" is necessarily connected to the use and enjoyment of a single-family residence and is located landward of the ordinary high water mark and the perimeter of a wetland. On a statewide basis, normal appurtenances include a garage; deck; driveway; utilities; fences; installation of a septic tank and drainfield and grading which does not exceed two hundred fifty cubic yards and which does not involve placement of fill in any wetland or waterward of the ordinary high water mark. Local circumstances may dictate additional interpretations of normal appurtenances which shall be set forth and regulated within the applicable master program. Construction authorized under this exemption shall be located landward of the ordinary high water mark Staff Comment: The scope of work is classified as an appurtenance for a single-family residence as it is a necessary utility service installation and would meet the classification for exemption from the Sho reline Management Act, WAC 173-27- 040(2) (g), for single-family residences and all appurtenances to that residence, including natural gas as a necessary utility for heat delivery. FINDINGS: The proposed development is: i. Consistent with the policies of the Shoreline Management Act. ii. Consistent with the City of Renton Shoreline Mater Program. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or before 5:00 PM on July 20, 2022. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Due to the ongoing state of emergency enacted by Governor’s Proclamation 20-28.14 (and as amended), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. Puget Sound Energy (PSE) is proposing to install gas service to a customer at 3101 Mountain View Ave Nort h in Renton Washington, King County Tax Parcel; 3342103895. The current land use is residential single-family, zoned R-8, and the total site area of the parcel is 37,742 square feet. The proposed project will require minimal site disturbance, therefore no fill materials will be imported or exported from t he site. Adjacent Land-Use: North: Single-Family Residential South: Single-Family Residential East: Mountain V iew Ave N. & Vacant (Single-family) West: Lake Washington The proposed will occur partially in the Shoreline Residential designation of Lake Washington in the City of Renton, Washington. All available data from federal, state, and local databases, including the City of Renton GIS, were utilized to assess the presence of critical areas at the project site. According to the available data, no portion of the proposed project occurs within critical areas and/or their buffers. The scope of work is classified as an appurtenance for a single-family residence as it is a necessary utility service installation. The proposed project meets the classification for exemption from providing a SEPA Checklist according to WAC 197-11-800(23) (d); “all-natural gas distribution lines and necessary appurtenant facilities and hookups.” The proposed also meets the classification for exemption from the Shoreline Management Act, WAC 173-27- 040(2) (g), and the City of Renton Municipal Code; RMC 4-9-190 C.1(f), granting exemptions for single-family residences and all appurtenances to that residence, including natural gas as a necessary utility for heat delivery. An “appurtenance” is defined by RMC 4-9-190 C.1. (f)(i) as being “necessarily connected to the use and enjoyment of a single-family residence and is located landward of the OHWM and/or the perimeter of a wetland.” Project Details The proposal is to install a new gas line via a directional bore, requiring three standard-sized bore pits, creating a minimal disturbance and connecting the residence to the primary gas line in Mountain View Avenue North. Detailed information illustrating the bore pits is included in the submitted shoreline exemption exhibit, and the location, purpose, and size of the cuts are described in further detail below. Best Management Practices (BMPs) will be implemented to protect the nearby natural resources from all construction sediment when needed. Please note that PSE does not have the authority to encumber property owners with critical areas assessments outside of PSE’s recorded utility easements. If any critical area assessments are deemed to be required for this gas install, the study area will be limited to the recorded utility easement where PSE has operating right work will either occur within established city rights-of-way under a franchise agreement or within private utility easements. Minor vegetation management may be necessary to provide space for gas meter equipment and attachments in some cases. Where vegetation management occurs within private utility easements, PSE will work with the property owner to negotiate a preferred level of restoration on the property. ESC measures will be applied on an as-needed basis depending on site conditions at the time of construction. Disturbed surfaces will be restored to original condition or better upon completion of construction. All work will occur during reasonable hours and construction limits will be marked.
