HomeMy WebLinkAboutAddendum - 1AMENDMENT NO. 1 TO CAG-22-089 AGREEMENT FOR DOWNTOWN HANGING FLOWER BASKET PROGRAM THIS AMENDMENT, dated for reference purposes only as July 1, 2022, is by and between the City of Renton (the “City”), a Washington municipal corporation, and Uyeta Landscape and Maintenance (“Consultant”), a Washington Corporation. The City and the Consultant are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-22-089, dated March 25, 2022, to provide necessary services for the installation and maintenance of flowers/plants in hanging containers in the Downtown Renton business district (referred to herein as the “Agreement”); Whereas, the Parties wish to amend the Agreement to change the compensation in order to provide continued maintenance of the containers through the end of the term of the Agreement, based on mutual misunderstanding of the level of effort required. NOW THEREFORE, It is mutually agreed upon that CAG-22-089 is amended as follows: 1. Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $10,800 from $50,000 to $60,800 plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit A-1 which is attached and incorporated herein. 2.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. In the event you or your contractor fail to pay us, we may file a lien against your property. A lien may be claimed for all professional services, materials, or equipment furnished after a date that is sixty days before this notice was given to you or mailed to you, unless the improvement to your property is the construction of a new single-family residence, then ten days before this notice was given to you or mailed to you. Important Information for your Protection • This notice is sent to inform you that we have or will provide professional services, materials or equipment for the repair, remodel, or alteration of your property. We expect to be paid by the person who ordered our services, but if we are not paid, we have the right to enforce our claim by filing a construction lien against your property. • LEARN more about the lien laws and the meaning of this notice by discussing them with our contractor, suppliers, Department of Labor and Industries, the firm sending you this notice, your lender, or your attorney. • COMMON METHODS TO AVOID CONSTRUCTION LIENS: There are several methods available to protect your property from construction liens. The following are two of the more commonly used methods. o DUAL PAYCHECKS (Joint Checks): When paying your contractor for services or materials, you may make checks payable jointly to the contractor and the firms furnishing you this notice. o LIEN RELEASES: You may require your contractor to provide lien releases signed by all the suppliers and subcontractors from whom you have received this notice. If they cannot obtain lien releases because you have not paid them, you may use the dual payee check method to protect yourself. • You should take appropriate steps to protect your property from liens. • Your prime contractor and your construction lender are required by law to give you written information about lien claims. If you have not received it, ask them for it.
