HomeMy WebLinkAboutORD 6075CITYOFRENTON,WASHINGTONORDINANCENO.6075ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,EXTENDINGBYSIXMONTHSTHEMORATORIUMONLANDUSE,BUILDINGPERMIT,ANDBUSINESSLICENSEAPPLICATIONSFORWAREHOUSINGANDDISTRIBUTION;SElliNGFORTHFINDINGSOFFACTINSUPPORTOFSAIDSIX-MONTHEXTENSION;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,onFebruary14,2022,theCityCounciladoptedOrdinanceNo.6057declaringamoratoriumonlanduse,buildingpermit,andbusinesslicenseapplicationsforwarehousinganddistributionfacilities;andWHEREAS,theCityCouncilheldapublichearingonApril11,2022,toacceptpublictestimonyregardingthemoratoriumdeclaredbyOrdinanceNo.6057;andWHEREAS,theCity’sCommunityandEconomicDevelopmentDepartment(CED)isundertakingaworkprogramtoproposeamendmentstoTitleIVoftheRentonMunicipalCode(RMC)regardingtheWarehousingandDistributionlanduseandtheimpactfeeamountforthatlanduse;andWHEREAS,theCityseeksadequatetimetocompletesaidworkprogram;andWHEREAS,theCityCouncilhasdeterminedthatthereisaneedtoextendbysixmonthsthemoratoriumonacceptinganylanduseapplication,buildingpermitapplication,orbusinesslicenseapplicationforwarehousinganddistributionfacilities;andWHEREAS,theCityCouncilheldapublichearingonAugust1,2022toconsiderasixmonthextensionofthemoratoriumdeclaredbyOrdinanceNo.6057;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:1 ORDINANCENO.6075SECTIONI.TherecitalsadoptedasfindingsoffactinOrdinanceNo.6057insupportofthemoratoriumonlanduse,buildingpermit,andbusinesslicenseapplicationsforwarehousinganddistributionfacilitiesareherebyincorporatedbythisreference.SECTIONII.TherecitalsincorporatedbyreferenceinSECTIONIofthisordinanceandtheaboverecitalsareadoptedasfindingsoffactinsupportofthesix-monthextensionofthemoratoriumpursuanttoRCW35A.63.220andRCW36.70A.390andarefoundtobetrueandcorrectinallrespects.SECTIONIII.ApublichearingwasheldonAugust1,2022.SECTIONIV.TheCityCouncilherebyextendsbysixmonthsthemoratoriumuponthesubmissionoracceptanceofanylanduseapplication,buildingpermitapplication,orbusinesslicenseapplicationforWarehousingandDistribution.SECTIONV.ThemoratoriumextendedhereinshallbeineffectuntilFebruary1,2023,unlessendedearlierbysubsequentCityCouncilaction.SECTIONVI.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVII.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.ThisordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshallcausetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.2 ORDINANCENO.6075PASSEDBYTHECITYCOUNCILthis1stdayofAugust2022.Jason.Seth,CitlerkAPPROVEDBYTHEMAYORthis1stdayofAugstApprovdastofShaneMoloney,CityAttorneyDateofPublication:8/4/2022(Summary)ORD—CED:2228:6/29/222022.3
