Dear Ms. Nishihira:
Thank you for your April 12, 2000 letter to Ann Nichols approving the La Pianta 2000 Lot
Line Adjustment. In response, I herewith submit (1) the signed mylar drawings, (2) an Assignment
of Funds ("Cash Bond") in the amount of$18,300.00 and (3) a Halinen Law Offices, P.S. check
payable to CD&L in the amount of$22.20 for two-hour courier service from the City to the King
County Department of Assessments.
Please note that I spoke this morning with Elaine Hawkins, an Abstract Technician of the
King County Department of Assessments who handles processing of final plats, short plats and lot
line adjustments for that Department. I explained that we are anxious to have the subject lot line
adjustment recorded by tomorrow and asked for her assistance. She told me that if the mylars are
delivered this afternoon, she will process them and get them recorded by tomorrow(assuming that
everything is in order). She told me that the Renton City Clerk should have them delivered to her
attention (rather than to the attention of Nimpa Gueco, another official in her office who would
normally take them in but who is not in today. Elaine Hawkins address is:

Dear Ms. Nichols:
The City has finished reviewing your proposed lot line adjustment and is now ready to approve
and send the final version for recording,subject to the condition that a cash bond in the amount of
$18,300.00 is provided for the deferral of setting lot corners (1.5 x the cost of setting corners
based on surveyor estimation of$12,200.00). Please submit the original signed mylar, the
required cash bond, and a check for$14.60 made out to CD&L to me at the sixth floor counter of
City Hall.
Please verify that all owners of record'have signed the mylar and that the mylar has been
notarized with an ink stamp (not embossed). The ink stamp must be legible so that King
County will promptly record the lot line adjustment.

The La Pianta Limited Partnership has requested that the declaration of easements for access and
utilities be waived for the recording of the boundary line adjustment LUA 00-020. La Pianta
Limited Partnership has provided us with a letter stating that once the conveyance of land has
occurred, easements for access and utilities will be recorded. The commitment to reserve the
required easements is clear and therefore the boundary line adjustment should proceed without
encumbrances.

Line Adjustment Drawings That You Are Reviewing Today
Dear Bob:
As a follow-up to the phone conference that you and I had a few minutes ago, I am writing
to (a) forward to you a copy of an April 6, 2000 letter from attorney Ellen Dial of Perkins Coie and
(b) confirm our intention to have Triad Associates remove from the draft Lot Line Adjustment
drawings the "Access Easement" depicted thereon. I hereby request that the City approve the
removal.
As Ms. Dial points out in her letter, La Pianta will reserve easements in conjunction with its
phased sate of property to my client Liberty Ridge, LLC(a limited liability company with which the
Merlinos are involved). Hence, the depiction of easements on the lot line adjustment is unnecessary.
Please bear this in mind as you complete your review of the draft Lot Line Adjustment
drawings this afternoon. Please phone me if you wish to discuss this matter. Thank you very much
for your cooperation.

This firm represents La Pianta Limited Partnership, which has applied for
boundary line adjustment LUA 00-020 for portions of Sections 16 and 17, Township
23 North, Range 5 East, W.M. in the City of Renton. You have had a number of
conversations with Mr. David Halinen, who represents the prospective purchaser of
this property, concerning the boundary line adjustment_
La Pianta intends to sell portions of the land affected by the boundary line
adjustment to Mr. Halinen's client in the very near future. At that time, La Pianta will
reserve easements over the land that is conveyed so that La Pianta's remaining land
will have adequate,means of access and locations for utilities. Since La Pianta has
agreed.with Mr. Halinen's client that appropriate and adequate easements will be
reserved, we ask that the City not require any further declaration of easements at this
time.

Dave Halinen has asked that our firm establish an estimated cost for staking the property
corners of the proposed La Pianta LP boundary line adjustment and for preparing a
Record of Survey drawing which depicts the location of these corners for recording with
King County. It is our understanding that this estimate is for bonding purposes and that
a performance bond will be filed for this work prior to approval of the boundary line
adjustment.
The estimated cost to stake the lot corners within the boundary line adjustment is
S11,000:00 and the estimated cost to prepare a final Record of Survey drawing is
$1,200.00.

Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced lot line adjustment submittal and have the
following comments:
Comments for the Applicant:
The Access Easement legal description does not agree with what is shown for said access easement
on the lot line adjustment drawings.
Note the City of Renton land use action number and land record number,LUA-00-020-LLA and
LND-30-0203, respectively,on all drawing sheets, preferably in the upper right-hand corner. The
type size used for the land record number should be smaller than that used for the land use action
number.
Add an approval block for the King County Assessor's Office(Sheet 1 of 5).
Because the subject properties fall within both Zone 1 and Zone 2 of the City of Renton Aquifer
Protection Area, note the Aquifer Protection Notice on the drawing. See the attachment.
Note whether the adjacent properties are platted(give plat name and lot number)or unplatted. If
platted,note the name of the plat and the tract/lot numbers.
Change the year noted("19_") in the Recording Certificate block on all drawing sheets.
The Second Subdivision Guarantee, dated January 14,2000,notes a Development Agreement
recorded under King County Rec.No. 19991213000395. Determine if said agreement should be
noted on the drawing.

Note that//there are restrictive covenants, agreements or easements to others(City of Renton, etc.)
as part of this subdivision,they can be recorded concurrently with the lot line adjustment(note on
the drawing to whom said easements, etc. are granted). The lot line adjustment should have the first
recording number. Reference the recording number(s)for the associated document(s)on the lot line
adjustment.
If new easements are shown for the benefit of future owners of the proposed lots,then include the
following statement,juxtaposed to the subject easement(s): "Area for private easement for(Water,
sewer stub, gas, access, etc.)." Since the new lots created via this lot line adjustment are under
common ownership at the time of recording,there can be no easement(s)until such time as
ownership of one of the lots is conveyed to others,together with and/or subject to specific easement
rights.
Also, add the following Declaration of Covenant language on the face of the subject drawing, if the
previous paragraph applies.
DECLARATION OF COVENANT:
The owner of the land embraced within this lot line adjustment, in return for the
benefit to accrue from this subdivision, by signing hereon covenants and agrees to
convey the beneficial interest in the new easements shown on this lot line
adjustment to any and all future purchasers of the lots, or of any subdivisions
thereof This covenant shall run with the land as shown on this lot line adjustment.
Comments for the Project Manager:
Since the lot corners are not being set,the city is requiring a cash bond(1.5 X cost of setting
corners)to be held until such time as the final lots are staked. We have received a letter from the
surveyor giving the projected cost of$12,200. Therefore,the applicant needs to post a cash bond in
the amount of$18,300 for deferral of this requirement.
Fee Review Comment:
Lots within or affected by the lot line adjustment are subject to the city's special charges, if any.

Project Narrative
for a
Lot Line Adjustment
The 127.33-acre La Pianta site is located in the City of Renton north of Maple Valley
Highway, south of NE 3`d/NE 4th Street, east of both Mt. Olivet cemetery and the La
Colina residential subdivision, and west of the King County shops/storage yard. The
project site has been cleared and graded in association with the previously-approved
Cedar Crest manufactured housing project and previously-conducted gravel mining on
the site.
The proposed lot line adjustment contemplates adjusting the boundaries of (a) the 8
existing, previously-adjusted parcels that comprise the site into (b) 8 altered parcels. (See
the accompanying drawings for the details of the layout.) The purpose of these
adjustments is to create legal parcels that conform to a proposed phased sale of portions
of the subject property for subdivision and development purposes.

On behalf of the applicants, I herewith submit the following materials as La Pianta
Limited Partnership's application for a Lot Line Adjustment:
(1) Land Use Permit Master Application: Original plus four(4) copies;
(2) Site Map: Five (5) copies of the proposed drawings;
(3) Survey Calculations: Three (3) copies;
(4) Access Easement Legal Descriptions: Five(5)copies of the legal descriptions of the
proposed access easements depicted on the drawings (Note: easement instruments
have not yet been prepared);
(5) Neighborhood Detail Map: Five(5) copies;
(6) Fees: Application fee check in the amount of$450.00;
(7) Project Narrative: Five(5) copies;
(8) Parking, Lot Coverage and Landscaping Analysis: Waiver requested—no analysis is
submitted because no development is planned prior to (a)preliminary plat approval
. of the portion of the property contemplated for single-family residential development
(a preliminary plat application is anticipated to be submitted in March, 2000) and(b)
rezone and future project approvals for the small portion of the property(located at
the site's northwest corner)contemplated for convenience commercial development;

(12) Wetlands Study: Waiver requested: no such study is submitted. (See 11, above.)
